RE: AIRPORT PROJECT The mayor said the airport has a project to repair the apron and to construct and mark the segment of the parallel taxiway and pave the air craft parking. It has been all okayed and is ready to go, but because the city and the county own the airport, we have to sign the papers, and the council has to give the mayor permission. A motion was made by Morgan Garner and .seconded by Darlene Blackburn to authorize the Mayor to sign and enter into the agreement. All Aye. RE: ANNEXATION DESCRIPTIONS The mayor said we have been working on the city map and have found some errors in annexation descriptions. We will get the ordinances corrected on the property descriptions and while we are at it we will annex some areas in the city .that we thought were in and are not. City Clerk Rose ey MINUTES OF PUBLIC HEARING 8/24/83 State of Idaho) County of Madison( City of Rexburg) RE: SPECIAL USE PERMIT May o C. Porter Mayor Porter started the meeting by stating that the meeting was for the purpose of a special use permit for the corner of Center Street and Second South. Ardyth Carlson, manager of the Ricks College Credit Union, was at the meeting to request a special use permit for professional business offices to be located on property zoned Residential. Said property being located at the corner of Center Street and Second South. She said in July they had an average of about 50 people in the day. She said they do a lot of the business by mail and do a inquiries each day. They had taken a survey of the people on they felt about building a credit. union building and 68% were ones they received through the mail were about 80% in favor. building would be quite compatable with the neighborhood. Letters had been sent out to everyone within 300 feet of the property and there was one resident that had sent a letter to object. A protest letter was received from Edan Lucille Wood and Seth Wood, residing at 166 South Center. (spy attached) Glen Pond said one of the problems that. he saw with it was that we turned. down some for spot zoning a few weeks and asked them not to encroach in residential areas. The mayor said on the drawing it shows that the drive-in-window is right next to ~~. the Woods property. He asked if they had thought about putting it on the other side. Mrs. Carlson said they could change it. Venla Wright was at the meeting to ask about the parking for her apartment. Last year she was told she did not have enough parking for her apartments and had arranged to use that lot. Will it effect her student parking? The mayor told her we would have to work that out when a decision was made about the Credit Union. Kenneth Papenfuss of the Credit Union said they could not go into a relationship on the parking. Mayor Porter asked if they had tried to buy the property on 4th South. Mr. Papenfuss said it was too small. Kenneth Papenfuss said if they. don't build on it he wonders if anything will be built there. Mr. Carlson said the environment of the Credit Union will be more pleasing than if apartments were built there. Mr. Papenfuss indicated that it is not predominately residential, because of the College across the street and Post Office right there and most of the block is in student housing. He felt that it would be a nice addition to the corner. He said he didn't think there was going to be much of a need for more student. housing because of the shut le bus. Nile Boyle said as long as he had been on the council they had never approved it unless there was 80% of the people within 300 feet for it. Mr. Papenfuss said he thought that lot was an eyesore to the street. Mary Smith read from the Zoning Book about the requirements for the Special Use Permit. Morgan Garner said he thought before we move on it we need to contact Seth Wood and show him the plan. A motion was made by Nile Boyle and seconded by Jim Morris that the Public Hearing be adjourned until the next regular council meeting. All Aye. Mayor Porter said he would contact the Wood's before then and show them the drawing and see what they had to say. RE: ORDINANCE .656, INCREASING SALARIES Mary Smith read Ordinance No. 656, and ordinance increasing the: salary of the mayor and increasing the salary of the councilmen, which would be paid monthly. AN ORDINANCE AMENDING SECTION III OF ORDINANCE N0. 567 INCREASING THE SALARY OF THE MAYOR, TO COMMENCE JANUARY 1, 1984, AND .AMENDING SECTION I OF ORDINANCE N0. 467 INCREASING THE SALARY OF COUNCILMEN, TO COMMENCE JANUARY 1, 1984. A motion was made by Councilman Jim Morris and seconded by Councilman Glen Pond that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be number 567. Those Voting Aye: Nile Boyle Glen Pond Jim Morris Morgan Garner Those Voting Nay: None Ordinance 467 was then placed before the council. The mayor then called for the voting for final passage of the Ordinance, and. the motion was made by Jim Morris and seconded by Morgan Garner that ordinance be passed. Those Voting Aye: Nile Boyle Glen Pond Jim Morris Morgan Garner Those Voting Nay: None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said Ordinance, and that said Ordinance was duly and regularly passed. Mayor Porter declared the motion carried. 0 August 10, 1983 To the Mayor and City Council: The undersigned, Edna Lucille Wood and Seth Wood, who are owners of a residence at 166 South Center, Rexburg, Idaho, object to the granting of a special use and variance permit for professional business offices to be located on property zoned Residential R-2 and located at the corner of Center Street and 2nd South, Rexburg, Idaho, for the following reasons: 1. The area is zoned Residential R-2. 2. There are many commercial areas in the City of Rexburg that should be developed. The distances in Rexburg are not so great that the commercial section of the city cannot be reached within a distance of just a few blocks or a few minutes travel time. 3. The granting of the special permit will downgrade the area and is an encroachment on the value of the property used in the area as Residential R-2. 4. It is unfair to those who are established in this Residential R-2 area to grant this special use permit for commercial offices. 5. It would be against the policy of the city, which has been established to keep the commercial growth in the commercial area. 6. The encroachment of businesses in residential areas downgrades the area and causes the residents to suffer a great financial loss. We respectfully request that you deny this application for a special use perm~.t, and variance. Edna Lucille Wood Seth Wood NOTICE OF PUBLIC HEARING Notice is hereby given that the City Council of the City of Rexburg, Idaho, will hold a public hearing on August 24, 1983, at 7:30 p.m., in the City Council Meeting room of the Rexburg City Hall, to hear a request for a special use permit for professional business offices to be located on property zoned Residential R-2. Said property being located at the corner of Center Street and Second South, Rexburg, Idaho, and described as follows: Situated in the County of Madison, State of Idaho: Commencing at the Southeast Corner of Lot 4, Block 48, original addition to the City of Rexburg, as per the recorded plat thereof, and running thence North 90 feet, thence. West 115 feet, thence South 90 feet, thence East 115 feet to the point of beginning. The City Council will also hear a request for a variance permit pertaining to the above special use to provide parking space and blacktopping on the above-described property. Rexburg City C1 (Seal) RE: NOTICE OF CLAIM Mary Smith read a Notice of Claim on behalf of Val Klingler, Pam Klingler, and Kasey Klingler. This claim. is for $300,000. (copy on file) Kasey injured his hand in an area where cemnet had been dumped by the City. Mayor Porter explained that the area was where you turn to go past the high school. Someone had put a plant across the drain .ditch and the kids had dug caves and were playing in that area. Farrell had told the kids twice they could not play there. Once two mothers were there when he told the kids. The Street Department had been putting fill in the hole including cement and gravel. Morgan Garner said it was not an open area and the kids would have to cross the plank over .the drain .ditch to get there. A motion was made by Nile Boyle and seconded by Jim Morris to deny the claim and give it to the insurance company. All Aye. Porter City Jerk Rose gl~- MINUTES OF A SPECIAL MEETING 9/2/83 Those Present: RE: RICKS COLLEGE CREDIT UNION Mayor: John C. Porter Councilman: Morgan Garner Glen .Pond Jim Morris Also Present: City Clerk, Rose Bagley Seth Wood Ardyth Carlson Mayor Porter showed Seth Wood the drawing of the Credit Union. He explained that the drive in window would be moved to the other side away from the Woods property. The front of the building would be 20 feet back and would be landscaped. Ardyth Carlson explained that she did not think there would be anymore traffic now than there already is, because a lot of people would walk across the street from the campus. She said they probably wouldn't have only about five or six people in during an hours time. Seth Wood said he understood that they had about 1500 members in the three counties. He said he understood it was a business and the zoning would have to be changed. Mayor Porter explained it would not be changed to a regular commercial zone, it would be what they .calla limited commercial. If they would ever change their type of business, they would have to move,. because the limited commercial would be for the Ricks College Credit Union only. Seth Wood said when they allowed the business of Bill Kennedy to come in on the corner of Center and 1st South he understood it was just for that business and now there is two or three businesses. Mayor Porter said the corner is always a mess of weeds and the city always has to cut the weeds, he thought this would make it look nice. Seth said that David Wood had offered the owner of the property the price that he was asking and then he .raised the price up about $8000 because he thought he could sell if for commercial property. He felt that they were already congested with the new building on the Ricks Campus at the end of Center Street and especially with the Post Office traffic. He said he felt there was all kinds of business property in the city that you don't have to walk very far to, that could be used for this. He thought it would be better for the college not to congest it anymore.
