RE: LUBRICATION ENGINEERS
Mayor Porter said there is some Lubrication Engineers that want to put on a
movie and program. to see if they can save us any money. The mayor said he would
tell Farrell to arrange it.
RE: TELEPHONES
The mayor said one day we will have to buy our telephones. We have some people that
want to give us a demonstration, Gregg Merrill. He would have them come to the
next meeting.
RE: WATER DEPOSIT RULE
Mayor Porter discussed the Water Deposit Rule. We have run into some problems
with hardship cases. What we have decided to do now is to get someone to sign
them. That person would become responsible for the bill if the person cannot
pay the bill.
RE: HORSE ON BENFIELD PROPERTY
The mayor said we have another problem with a horse that has been moved into the
city on the Benfield property. Jay Willmore said it had been there since
Thursday at noon. The mayor said he thought we would just have to tell him to
move it. Mary Smith was instructed to check on it and write them a letter. She
was also instructed to write Ken Benfield a letter telling him he had to tear down
the frame building he had built in the fire district and take out the gas tank
he had put in the back of his store.
RE: APPROVAL OF BILLS
A motion was made by Morgan Garner to pay the bills. Seconded by Sander Larson.
All Aye.
RE: PARKING OF A TRAILER
The manager from Arc Electric was at the council meeting to ask permission to park
a trailer in two parking places for three days in front of his store. The council
gave their okay.
RE: SPEED LIMIT CHANGE
Mayor Porter said from time to time people come in and want a speed limit changed
on various streets. This is happening all over the State of Idaho, so the
Transportation Department has set up a set of rules that we should go by. There
is a form, after a study has been made we fill out the form and it is a resolution
we pass.

MINUTES OF THE CITY COUNCIL MEETING
July 6, 1983
A meeting of the City Council for the City of Rexburg, Madison County, held
July 6, 1983, at the City Hall.
Present were the following:
Councilmen: Jim Morris
Morgan Garner

RE: APPROVAL OF MINUTES
Mayor: John C. Porter
Councilwoman: .Darlene Blackburn
Also Present: Mary Smith, City Attorney
Rose Bagley, City Clerk
Richard Horner, Treasurer
A motion was made by Morgan Garner and seconded by Sander Larson to approve the
minutes. All Aye.
RE: APPRECIATION FOR FLOWERS
Mary expressed her appreciation for the flowers the council sent her while she
was in the hospital.
RE: RETAIL BEER LICENSE
The Mayor read an application for a Retail Beer License to sell canned and bottled
beer not to be consumed on the premises for the Maverik Store. A motion to approve
the license was made by Nile Boyle and seconded by Sander Larson to approve it.

RE: STREET REPAIR
Mayor Porter told the council they had the bid opening for the Street Repair. The
total was $105,000 the estimate was $80,000. He said there are some things we
can cut out. He said we had. decided to put fabric down, GO Textile Fabric, if we
took it out it would only save us about $10,000. We did not award the bid, but
we will probably work it down to save $5,000 or $6,000. He suggested that they
won't be able to start until August and then we can work it into this years and
next years budget. He said they were going to meet on Friday to work it out.
Tiger Asphalt was the lowest bid. There was only $800 difference between the
two bids.
RE: PARKING PERMIT
Mr. Gardner from the Career Beauty College was at the meeting to ask if there was
a way to get a permit for himself and people that come in the shop to be able to
park longer than two hours. in the parking lot next to the school. The council
told him they could park over across the street, he said it was not convenient.
He said he would like a permit for himself and seven other permits so he could
check them out to people in his shop. Mayor Porter said he_did not know how we
could work it because there are stores all over town and other beauty shops that
have the same problem and would object.
RE: VARIANCE
Harold Jones and Jim Dressen had met with .the Planning & Zoning requesting a
variance for the property at 107 East lst North to which is zoned R-2 for the
purpose of putting an insurance and financial planning office in a home on that
property. They had made a canvas and only one person objected in that area. The
Planning & Zoning was concerned with off-street parking. Mr. Jones showed a
map of parking, they would take out the fence and put parking where the garden
now is, it would give them eight off street parking places. A motion was made
by Nile Boyle to proceed, with the publishing of a public hearing of a request
for a special use permit for professional business offices to be located on
property zoned Residential R-2 at 107 East 1st North and for a variance permit for
special parking space and blacktopping to be held on June 28, at 7:30 p.m.
Seconded by Morgan Garner. All Aye. Mayor Porter told them they would be required
to pay any publishing and other costs, they agreed.
RE: BENFIELD HORSE
The Council discussed the Benfield horse. Mary Smith said the city would have to
get with the county and the Planning & Zoning to pass an impact Ordinance.
Mayor Porter said he asked John Millar. to check the boundry lines to make sure it
was not in the city limits. Mary Smith said they had to go through certain
procedures, to get the impact area, the council asked her to proceed.
RE: VACANT HOUSES
Mayor Porter asked the council if they had read the Planning & Zoning minutes.
They want us to get a list of all the vacant houses that people are complaing about
and do something about them. Vacant lots were discussed that needed to be cleaned
up of weeds (1) Corner of 5th West and Main, (2) West side of canal on both sides,
(3) there is a car on 5th West, the mayor said he thought it was on old time car of
Jerome Berrick's (4) car across from Porter Park on 2nd South and 3rd West (5) a lot
by Davenports by Cora Nelson's belonging to Higleys which is a mess. The mayor said
he had talked to some cities at the AIC meeting and they are having the firemen.
burn the lots. He had asked our fire department, but they do .not have enough
firemen on duty to take care of something like that and also the fires. If someone
wants to burn some weeds and have all the neighbors get out with garden hoses it
would be okay. Another thing is we have been getting complaints about the lot that
Fergusons own behind Farm Bureau and across from the shopping center. People are
dumping in the hole that is there. The mayor suggested that it should be leveled
and then put up NO DUMPING signs. Jim Morris said he would talk to them. The mayor
said we have had some complaints about the Mitchell property, but they have
started to clean it up. There has also been a lot of complaints about the
Walters property on East 1st North.
RE: CENTENNIAL
The mayor said we have a number of people who are doing a lot on the Centennial.
Bill Christensen went out with some scouts and walked along the road from Rexburg
to the landfill sight and picked up all the trash along the road. The people
that have put on the pageant, Eunice Layton and Mary Lou Leavitt, they have done
a tremendous job. He proposed to give .them a certificate of appreciation. He
said he had bought a plaque for the "Winner of All Who Participated" from the
City in the race on the 4th of July to be hung in the tabernacle.
RE: PHONE SYSTEM.
Gregg Merrill from Engineered Communication Systems Inc. was at the meeting to make
a presentation on a phone system for the city. He presented (1) Six Button Key
System, (2) 701 Electronic Key Set (3) Strata. He showed two different types with
a difference of $300 between them. He suggested that we go over and look at
Rigby & Thatcher offices and look at their new system. It was decided by the
.council to have the Mayor, Richard, and Rose check the proposal through.
Richard was to check the cost proposal.
RE: CROSS WALKS
Mayor Porter told the council that last year we hired two city employees to paint
the cross walks. This year we have a bid from them to do the work for $2706. The
city will furnish the paint and they will do the work. Jim Morris suggested that
we could hire two men to do the work and .pay them a wage which would be cheaper.
Mayor Porter said he would check into it.
RE: ANNEXATION OF REXBURG HEIGHTS
Mayor Porter said he had not heard anything about the annexation of Rexburg Heights.
Nile Boyle said they were probably going to go through the county for an LID.
RE: REZONING AND VARIANCES
Glen Pond told the council that the Planning Board wanted the council`s feeling on
what they wanted the Planning Board to do over all on rezoning and variances.
Mayor Porter said the council needs to consider that we have a lot of commercial
property.
RE: APPROVE BILLS
A motion was made by Morgan Garner to pay the bills and seconded by Darlene
Blackburn. All Aye.
RE: ADJOURNMENT
A motion was made by Jim Morris to adjourn and seconded by Nile Boyle. All Aye.
