RE: TETON PIPE LINE PEOPLE
The Teton Pipe Line people were in the city hall and want to sign the lease. Mary
Smith said the lease is ready.
RE: UTAH FLOOD FUND
Mayor Porter said another thing, he thought the council and the city should start
a fund for the people in Utah that are in the flood. The money can be sent
or brought to the city hall and we can send it down to them. Sander Larson
suggested that we send man power down, the mayor said that would probably be
handled by the church.
RE: BLUE CROSS PREMIUM
Glen Pond discussed the increase in the Blue Cross premium. It has gone up about 20%.
Single Membership from $53.46 to $66.55
Two-Party Membership from 118.55 to 145.25
Family Membership from 136.75 to 166.20
The employees have been paying 20% and 25% and the city has been paying 75% and 80%.
This increase will start July 1. Glen read an additional clause "A new Idaho law
requires that the charge for benefits for elective abortions be defined and made
optional. Your current health care program includes this coverage at a cost of $.05
per contract, per month. If you prefer to remove this benefit from your group
program, you may do so be completing a waiver card.." It was decided by the council. to
go ahead for the balance of the budget year with the same percentage scale as we have,
and then at budget time take it under consideration as to what percentage the city
will pay. It was also decided to leave the elective abortion as part in the policy.
RE: REXBURG IRRIGATION COMPANY
Members of the Rexburg Irrigation Company were at themeeting. The council approved
a contract with them and they are to pay the city $300 a year.

A motion was made by Morgan Garner to pay the bills and seconded by Sander Larson.

RE: FIREWORKS PERMITS
Mayor Porter read Fireworks Permits for:

A motion was made by Morgan Garner and seconded by Nile Boyle to approve these
Fireworks Permits. All Aye. The mayor said they were allowed to sell only safe
and sane fireworks, and the police will check all the places that have permits.
RE: FLOOD RESTORATION FUND
The mayor said we have had a good response to the Flood Restoration Fund. We have
collected $2075. It has come from a number of places, not only from Rexburg,
Glen Pond said they had received several anonymous donations at the bank.
RE: REXBURG HEIGHTS
Richard Horn representing the Public Health Department. He said they wanted to
meet with the City Council and express their concern about Rexburg Heights. It is,
in their opinion, a potential health hazard. He said they have had meetings with
the people to let them know that it is the intent of the Health Department to come
before the City Council to present some documents and complaints sufficient to ask
the city council to take some action. People have corrected their sewage problems
a number of times and they have no where to correct them. Every year at the Health
Department they get phone calls of open sewage complaints. He showed the council
a paper that was signed by property owners who were in agreement to coming into
the city.
Mayor Porter said Clayter Forsgren, the engineer, was at the meeting to give
estimated costs on sewer and curb and gutter. He gave handouts on the estimated
cost of the sewer system and also showed a drawing.

These costs would include the engineering and administration.
Clayter explained you have the sanitary sewer and then .you have the pump station
pressure line. Stubs would be put in across the street, it will not run lines to
the houses, it would make a collection line and a tie into every home. Nile Boyle
asked Clayter Forsgren if he had looked into the feasibility of a grant for this.
He said they are inquiring about it; to get a grant on a collection system is
almost next to impossible. The only place they are giving out grants is where
people can show economic problems or extreme health problems, but even then it is
generally on the trunk line, it would be easier to get a grant on the lift
station and on up the hill than it would to get a grant over to Rexburg Heights.

Mayor Porter said he talked to the state and suggested that if there is a chance to
get the city's share, then what ever we got for the city's share we could apply
to help on the other. The only way we could get it is if the health department
would certify that this was an extreme health hazard. There could be a matching
grant, we could get from 25% to 50% of the cost of those two lines, that would
reduce the rest of it a little. We may be able to get a grant for $25,000 which
would reduce it 20% to 25%.
Nile Boyle asked the group if they would want to pay that much per lot cash and
circumvent the annexation. Clayter Forsgren said there would be no reason that
they could not do that. Annexation would make it so you could have an LID, but
they could possibly get one in the county. Clayter said it would cost about
$4 a foot from the septic tank to the line to dig and connect onto the sewer
plus a hook-up fee, $300 from the city. Clayter said we could figure into
the LID 100' or 150' of connection pipe for every house and then divide that
into the total, and if people are more than that feet, they would have to pay
for additional feet. Clayter told the people after the LID is set up it would
take about 30 days for construction.
Clayter Forsgren passed out a work sheet on the cost of road construction and
curb and gutter.

Clayter showed drawings explaining that our Sub-division ordinance calls for
Curb & Gutter. John Millar had checked it out and said there are some places
that the road will have to be completely re-built to bring them up to city
standards.
Nile Boyle said if he had a lot up there, he would rather get a loan and pay
for the sewer and curb and gutter. He said the. reason he thought there should
be curb and gutter put in is we require it of everyone else and as soon as we
accept those streets we are going to have upkeep on them and. if the upkeep
starts quick, it is not fair to .the rest of the people to have them cone in
contrary to the Sub-division ordinance.
Richard Horne said the best solution is annexation. There are a number of homes
up there that have no choice other than hooking onto the sewer. Clayter Forsgren
said the Rexburg Heights could get together and put in a sewer line.
Richard Smith asked what kind of studies have been done to see if septic tanks will
work. Richard Horne said there is always new research, initial study by the Health
Department was that they thought it would work up there, when the project was
initially put in.
Ken Burt--I feel that we are at the mercy of the City Council, and I think the
only solution of the problem is being hooked up to the city sewer. He said at
one time the city council agreed to turn it over to the Planning & Zoning and
take their recommendations. The minutes of the Planning & Zoning was that. they
recommended that Rexburg Heights be annexed, and wave the provision for having
curb and gutter. He felt that putting curbs and gutters in Rexburg Heights was
prohibited because of the cost. He didn't think it was fair because the
developer did not put the sewer system in when he developed the sub-division, and
didn't put curbs and gutters in. He said they didn't have a bad drainage problem.
He said he would appreciate it as a home owner if the city would wave the curb
and gutter; the roads are good roads. He said he didn't think the curbs and
gutters would be an advantage to them, the lawns and driveways are right up
to the side of the road.
Nile Boyle asked Clayter Forsgren how the road would last without curb and gutter.
Clayter said the main thing curb and gutter does is to keep the water from
getting on the edge and working under the road. He said he didn't believe that
the roads were constructed at city standards. Nile Boyle asked Mary Smith
what would happen if we annexed and had a stipulation in the annexation that
when improvements had to be done it would be done at the expense of the
property owners. Mary said you would have to stipulate that any improvements
would have to be born by the property owners of Rexburg Heights.
Mayor Porter said he thought it would be a good idea for the city council to go
up and look at it.
Dr. Dave Crandall--I moved to that area two years in September. One of the things
that attracted me to that area was the chance to have a little more spacious area
of my own. Where I came from in California, there was no room, and very little
privacy; and I appreciate the rural environment and also being able to live close
to work. He said he saw that area as being different to the downtown area, because
it is rural in orentation, but the controls are there to keep that area nice. He
felt this was keeping the value higher. He suggested considering going ahead
and solving the sewer problem separate to the annexation. He would like to see
keeping the rural environment. He did not feel that curbs and .gutters are necessary.
He would be in favor of keeping the animals up there. He would be in favor of
having the city help solve the sewer problem and letting the residents pay the
additional outside of city rates, without annexation.
Nile Boyle said the only thing the city can do is put in the pump station, which
we are going to do anyway. If they are not in the city, we cannot help with the
financing. He said if they want to just put in the sewer, most of the people could
finance $3000 per lot and not go through an LID.
Richard Horne--He said he would like to see the city council make a stand as to
if they are going to be annexed and what standards they would have to meet, or they
would have to form their own LID and let them hook onto the sewer.
Mayor Porter said we won't take them in with the horses.
Mayor Porter said if they put in their own sewer district and hook on to the
city sewer, the costs would be l~ times that of the city residents for hook-up
fees and regular sewer service.
Richard Smith asked if we could annex them and state in X amount of years they
would put in curbs and gutters & streets, and. from the date of .annexation
start charging from a formula for the LID and set that money aside to do this work.
Mayor Porter said that one of these days the county. will tell Rexburg Heights they
won't maintain .the streets. The mayor said for instance he pays taxes to the
county and they take care of several sub-divisions in the county and they don't
help the city on their city streets. In Salt Lake City the county has put a tax
on the sub-divisions to maintain the roads. Eventually you will have to take
care of your streets, because you won't get a farmer that pays taxes to fix your
streets.
Richard Horne--He said he understood that the city has the power to annex them in
without permission of the people if the Health Department insisted they annex
because of health .problems. Mayor Porter said he knew that, but we don't want
to annex people in the city that don't want to be annexed in.
Sander Larson told the people that there were several alternatives:
1. you can annex with the sewer and the curb and gutter and it is very expensive.
2. you annex with the sewer without the curb and gutter.
3. & 4. the same thing and if you annex with horses or without
5. you establish your own special LID or finance your own sewer system.
Nile Boyle told them that if they can't get their money for the sewer system, there
is no alternative than to be annexed. Ken Burt said there are. some people that
could not get the money. Ken said without curb and gutter he thought he could
get 75% to sign the petition for annexation.
Mayor Porter told them they could have their own sewer district and then enter
into a contract with the city to maintain it. The county could form the LID.
Mary Smith said she thought we should have the property owners come to the next
meeting with a request for annexation and present us with what they would like
and we could either accept it or turn it down. If they don't want curbs and
gutters at this time they need to state that and that they would come in as R
Residential and comply with .the zoning laws of the city. This should be on a
petition signed by the property owners.
A motion was made by Nile Boyle that the city council go on record as stating that
if annexation occurs, they will comply with all the regulations of the Sub-division
Ordinance of the city or they will form their own sewer district and stay out of
the city and we will aid anyway we can with the sub-station. Seconded by
Morgan Garner. All Aye.
RE: LUBRICATION ENGINEERS
Mayor Porter said there is some Lubrication Engineers that want to put on a
movie and program to see if they can save us any money. The mayor said he would
tell Farrell to arrange it.
RE: TELEPHONES
The mayor said one day we w'11 have to buy our telephones. We have some people that
want to give us a demonstration, Gregg Merrill. He would have them come to the
next meeting.
RE: WATER DEPOSIT RULE
Mayor Porter discussed the Water Deposit Rule. We have run into some problems
with hardship cases. What we have decided to do now is to get someone to sign
them. That person would become responsible for the bill if the person cannot
pay the bill.
RE: HORSE ON BENFIELD PROPERTY
The mayor said we have another problem with a horse that has been moved into the
city on the Benfield property. Jay Willmore said it had been. there since
Thursday at noon. The mayor said he thought we would just have to tell him to
move it. Mary Smith was instructed to check on it and write them a letter. She
was also instructed to write Ken Benfield a letter telling him he had to tear down
the frame building he had b ilt in the fire district and take out the gas tank
he had put in the back of h's store.
RE: APPROVAL OF BILLS
A motion was made by Morgan Garner to pay the bills. Seconded by Sander Larson.

RE: PARKING OF A TRAILER
The manager from Arc Electric was at the council meeting to ask permission to park
a trailer in two parking places for three days in front of his store. The council
gave their okay.
RE: SPEED LIMIT CHANGE
Mayor Porter said from time to time people come in and want a speed limit changed
on various streets. This is happening all over the State of Idaho, so the
Transportation Department h~s set up a set of rules that we should go by. There
is a form, after a study ha been made we fill out the form and it is a resolution
we pass.
