Porter MINUTES OF THE CITY GOUNCIL MEETING April 30, 1983 A meeting of the City Council for the City of Rexburg, Madison County,. held May 4, 1983, at City Hall. Present were the following: RE: APPROVE MINUTES Mayor: John C. Porter Councilman: Jim Morris Nile Boyle Morgan Garner Glen Pond Councilwoman: Darlene Blackburn Also Present: City Attorney, Mary Smith City Clerk, Rose Bagley Treasurer, Richard Horner A motion was made by Darlene Blackburn and Seconded by Nile Boyle to approve the minutes. All Aye. RE: REQUEST FOR VARIANCE The mayor said that there had been a request for a variance on North 3rd East. Chuck Frost had called him and the Planning Board had planned on calling everyone on the Planning Board about it, but after he had called one or two, they decided they had better have a public meeting. He said after the f1QOd, anyone that had a 50 foot frontage that had had a one-family dwelling on that property we had allowed them to build back, but this is for a four-plex to be put on it. RE: STREET REPAIRS Mayor Porter discussed street repairs. He said we have two or three streets in the city that are in bad shape. H & K is going to come in and do some work for the college and some parking lots. The mayor asked them to go up and look at 4th South and Mohawk and suggested to them that. on Mohawk and 4th South we needed to have two blocks done. He had asked them to give him a price per yard to repair the road and put a half soul on it and seal coat it with chips. To do 4th South and Mohawk the cost would be approximately between $45,000 and $47,000 and the seal coating would be $1.00 a square yard for any streets that they do. The mayor said we have to bid it, but he wanted to get an idea on how much it would cost. Mayor Porter reported there is also an Asphalt Maintenance Company that has come up with a proposal to fill the cracks in the streets. On 1st North it is starting to crack. What these people do is they rod out the cracks 1/2 inch wide and 3/4 inch deep and put a product in the cracks. He had called up the Highway Department to check on it and they use something like it. The rod out the cracks and put it in the cracks for $2000 a ton. Barton Jensen said they had done .some of it in the parking lot at the East Stake Center if anyone wanted to go look at it. The mayor said he would recommend that we go ahead and let them put a ton on lst North and see what it looks like and then have some others done. These same people have been talking to Dr. Mix in the Professional Plaza and they are going to have their parking lot done with this same thing. He has gone around to everyone up there and has got them to agree to have them pay to have it done on the street. The fellow told Dr. Mix it would cost about $2696 that is a little more than he planned on. The mayor said he thought if they were willing to pay 60% of it, maybe the city could pay the other 40%, which would cost the city $400 or $500. Jim Morris suggested that they go look at the streets around the city and go by priority. l RE: WATER SLIDE Barton Jensen and Perry Beckley presented a proposal for the Big Flush Company to put in a water slide at Porter Park. (Copy Attached) The tube would be completely self-contained. Mary Smith said she would check on the liability insurance. The Big Flush Company would carry liability insurance on the slide. Barton Jensen said when the pool closed on Labor Day and if the weather permits, they would like to operate the slide only. On an 80 day 250 people revenue generated to the city would be somewhere in the neighborhood of $17,000. Barton said if we can add a few more days to the season it would add to the income. He thought that the slide would be paid for in about 3 or 4 years. He said on special events or Holidays, they would probably have a special on tickets, with a discount. The tickets would be sold on a half day basis. Jeff Teeples was to the meeting representing Elmer Park. He wanted to ask some questions and discuss the slide in the park. He asked Barton Jensen and Perry Beckley how many tubes they had built, has it been tested under all weather conditions and stress, and why they were turned down in Idaho Falls. They told him an engineer had designed the tube and it had been tested, they were aurned down in Idaho Falls because the timing was off. Mr. Teeples asked what they figured the life expectancy of the tube was. They told him 20 or 30 years. Mr. Teeples said that a man by the name of Kerry Robinson had designed a tube like the one at Heise and the life expectancy of that tube is 6 to 8 years. A tube like this collapsed in California and there is a multi-million dollar law suit. He wanted to know where the city's liability ends. The mayor told him we will turn it over to our insurance carrier to make sure we have the right insurance. The insurance the Big Flush has will cover liability for the tube. He said whether or not the Big Flush builds the tube in Rexburg, a private industry, whom he is representing, have a private lake south of the city, is putting up a 130 dome, he will put a water slide inside the dome to be run year around, the water slide will probably not be a tube. There will be a pool inside the dome. It will have a beach and private fishing with probably a KOA type campground. He asked the council to think of private enterprise also when he is considering this slide. Barton Jensen said if the slide gets brittle and they tell us it won't work we will take it down. He said Fiber-Glass under different makes, must last longer. He told him thrt this is a private company that will pay for this tube and it will increase revenue for the city. There will be a yearly inspection of the tube to make sure it is safe. The entire expense is to the private business and the city will share the revenue. A motion was made by Morgan Garner and seconded by Darlene Blackburn to axcept proposal. for the slide from the Big Flush Company and work out the details as needed. All Aye. Mary Smith was instructed to get together with Barton Smith and Jim Morris and work out any necessary details and draw up a lease. RE: KIDDIE PLAYGROUND Coke McClure, Pastor of the Community Church was at the meeting to represent the Rotary Club. He presented a Kiddie Playground for Smith Park to be built by the Rotary Club. It would be built adjacent to the existing playgrounds. It was hoped to complete the first phase of this playground by Whoopee Days in July. It would have a Western Town false front at the entryway. The area would be enclosed. He said he had been in touch with Roscoe Orton and Jim Morris on the types of toys to put in it. Reed Wyatt had done the drawing and it had been approved by the Rotary Board, and now they were asking for approval of the council. He said they were using redwood products and it-would need little or no upkeep at all. A motion was made by Jim Morris to okay the project and give them the go ahead to start construction and install the Kiddie Park. Seconded by Darlene Blackburn. All Aye. RE: KEEPING KIDS OFF STREETS Mary Smith told the council she thought someone needs to start a campaign to keep the kids off the City. Streets. They play in the streets and it is a hazard. RE: PROPERTY BETWEEN SHOP AND WALTERS PROPERTY Mayor Porter told the Council when Mayor Shirley was the mayor the city bought the. property between the Shop and Walters Property for a park. The Soil Conservation Office thought they could get the architect, Reed Wyatt, from Ricks College to draw some plans and without putting out too much money it could be made into a park. Trees and grasses, native and not native could be planted. There could be a bike path, bridal path and jogging paths. There could even be enough room for two soccer fields. RE: CITY CODES Mayor Porter gave the city attorney the new Uniform Building Code and Planning Code and also the Uniform Code for Abatement of Hazardous Buildings for 1983. He asked her to check them over so the city could adopt them. RE: AGREEMENTS WITH HIGHWAY DEPARTMENT Mayor Porter read agreements with the Highway Department he had received. He read a maintenance agreement. (.copy on file) A motion was made by Jim Morris and seconded by Morgan to enter into a Traffic Signal Maintenance Agreement stating obligations of the State and City of Rexburg in the maintenance of existing traffic signals on the urban extension of the State Highway System within the corporate limits of the city of Rexburg, All Aye. (copy attached) RE: SAFETY GRANTS AVAILABLE Mayor Porter said he received a list of some Safety Grants available. He had Blair go over them. The one he wanted to apply for was to purchase a $4300 intoximeter to replace mobile blood alcohol tests for determining if a driver is intoxicated. The grant will pay 75% the local share would be $1093. The sheriff office and college will share in the local cost which will leave the city $500 to pay. The mayor had told Blair to go ahead with it. RE: FINANCIAL REPORT Richard Horner presented a 6-month financial report. It looks like the income taken in would be over the budget figure. It will only take care of 1/4 of the deficite. The revenue in total is up about $12,000 more than the budget figure. The Fire Truck and Garbage Compactor are not on the report. The Sanitation department is having the most trouble. (copy on file) Mayor Porter and Richard will meet with the department heads and the councilman over each department and go over the budgets. Mayor Porter said the Senior Citizen's Bus is going to start setting up a route schedule which will help on the gas usage. RE: ASSOCIATION OF IDAHO CITIES Mayor Porter told the Council the annual conference of the Association of Idaho Cities would be held June 16-18, 1983 at Twin Falls, at the Holiday Inn - Canyon Springs Inn. There is also a CCFOA Institute in McCall in the Fall for City Clerks & Finance Officers. Last year we made a rule that employees could only go to one meeting. He said if they wanted to attend two meetings, they could only go to the meeting in Twin Falls for one day on Thursday, which would cost $25,00. The employees could decide which meeting they wanted to go to or they would go one day to Twin Falls and one other meeting. Dear Mayor Porter: The Idaho Transportation Department is updating their Cooperative Traffic Signal Maintenance Agreements to more closely conform to our Department policy to share signal maintenance cost with the mwlcipalities equally. The existing agreement requires the City to assume all operation and maintenance costs and the State furnishes the replacement parts needed to maintain the signal system. We .recognize that energy costs have risen until they are near half of the maintenance costs, also the new equipment we are using is becoming more technical and complicated to maintain, so we have revised the agreement to be more equitable.. Basically, the proposed agreement assigns the re- sponsibility for power to the City and the State will provide for the maintenance costs, including periodic re-lamping.- A copy of the proposed Cooperative Traffic Signal Maintenance Agreement is enclosed for your inspection. If you would like to have modifications or discuss any of the terms or provisions, please call us. Train representatives designated by the City in emergency procedures related to signal shutdown or partial opera- tion due to power. failure, accidents, or equipment malfunction and the replacement of lamps. An outline of emergency and notification procedures, are hereby provided by the State - and attached as Exhibit "A". _ ,_ ~•. 3, Replace all signal lamps on a scheduled basis, 4. Perform a complete annual check of the traffic signal equipment and operation. 5, Furnish replacement signal lamps to the City.. 6, Respond promptly to notification from the City that a traffic signal related emergency exists. Response will normally be by the next working day SECTION II, that the City will: 1. Assume all energy costs necessary to operate the traffic signal installation. 2, Monitor the traffic signal operation daily. 3. Replace signal lamps as necessary (Signal lamps will be furnished by the State). 4. Perform emergency measures as needed in accor- dance with Exhibit "A". $. Promptly notify the State of any equipment malfunction or need for maintenance in accordance with Exhibit "A". 6. Not use the traffic signal poles or mast arms for any purpose other than to support traffic control devices. 7, Hold harmless the State against suits, actions, or claims of any character, brought because of injury or damages sustained or received by any person, persons, or property, result- ing from, or allegedly resulting. from, failure of the City to follow the emergency procedures., or to notify the State of any - equipment malfunction or need £or maintenance. _~,_. Should the traffic signal installation(s) be damaged or destroyed through the wrongful or negligent act of any third party, the City will undertake an investigation to ascertain the identify and whereabouts of the responsible party, and the State will attempt collection of the cost of repair or replace- ment. The State and City will pay a proportionated share of the cost of repair or replacement based upon the number of inter- . section approaches on and off the highway system if: (a) Collection cannot be accomplished after a reasonable attempt, or (h) The damage or destruction was not caused by the wrongfu ox- negligent act of a third party. It is under- stood, however, if the damage or destruction is the result of the wrongful or negligent act of either the State or City, then that party shall bear the full cost of repair or replacement. ~. For the loss of all signal indications: 1. ~ Check for bl.ocra fuse -- replace fuse. 2. Check for possible loss of power. f 3. If the above actions produce no results, switch signal to the flashing mode. 4. If signal will not flash, install stop signs on Cross Street and cover the. signal heads. 5. After applying the above procedures and the situation is not corrected notify the state. II. For the partially operating signal: 1. With a loss of detection - Place on recall (for an actuated signal). Z. With ane or more signal lamps not working - replace signal lamps. 3. That is flashing - reset the failsafe unit - if it trips again - leave on flash. 4. Other malfunctions - switch to flashing mode. 5. After applying the above procedures and the situation is not corrected. notify the state. -7- I T I .
