MINUTES OF THE CITY COUNCIL MEETING
April 20, 1983
A meeting of the City Council for the City of Rexburg, Madison County, held April
20, 1983, at City Hall.
Present were the following:
RE: WATER SLIDE

Barton Jensen presented a proposal for a Water Slide, showed the plans for the slide
and the slide area. He said 90% of these slides are built on a hill, which is much
cheaper and more feasible. because of the expense of the tower and the support system.
The tower will be approximately 40 feet high, the pool is 15' x 32', it is self-contained,
has a filter system and has its own gas heater to keep the water warm. He said we
would have to go with a different ticket situation than they do in most cities because
you will be doing more repeat business than you would have in a larger city. Barton
said they would not be fully dependent on the city pool. The council felt that the
slide would be a good idea. Barton Jensen said this would give the concession stand
more business and might need to be expanded. The construction time for the slide would
be about 30 days. Mr. Jensen also suggested having lockers put in the dressing
rooms and rent them at 25~. Mayor Porter thought we should look at the dressing rooms
and see if they are adequate. Barton Jensen said it would be about a $170,000 investment,
and they would need to get at least that money back. He said they would like to meet
with the Parks & Recreation Committee and present their proposals.
RE: WATER LINE EXTENTIONS
Mayor Porter said there had been a question on water line extentions. When someone
had to extend a line, we have had them extend the line the size that we have needed
it. If there is a 10" line on the street it should be extended with a 10" line and if
they only need a 6" line for the connection, the city would pay the difference between
the 6" and 10". The property owner would have to pay the cost of burying it. That
would be the proposal we would give to Lyle Robison on the extention across the river
for his new building. The mayor said we have enough 10" and 8" pipe on hand so we don't
have to buy anymore. The council agreed to this proposal.
RE: METERS INSIDE HOMES
Mayor Porter said we have another problem. We still have some meters that are inside
homes. Every once in a while one of the lines from the main water line into the house
will get a leak. There is one in town that has been leaking all winter. DeLynn has
told the homeowner that they should fix it, but it is on our side of the meter,
and they haven't done anything about it. The mayor had told DeLynn that we would give
the people 30 days and if they didn't get it fixed within that time we would turn it
off, but we haven't even got a turnoff in the street. The council felt that we need
to move all the inside meters outside.
RE: READING METERS
Mayor Porter said we are in the process now of reading all the meters for the first
time since last fall and we have discovered there are a few places where the line is
broken and because we have not been reading meters, no one has known. We have one rule
that says we will pay for half of the first billing and then after that if they do
not get it fixed they have to pay the whole thing. Mayor Porter said last year
the ones we found that had a broken line we estimated what they would have paid if
they would not had a leak and charged that. It was decided by the council that we
charge what we would estimate they would normally use for the whole winter and charge
them that amount.
RE: CONTRACT WITH IRRIGATION PEOPLE
Mayor Porter said we have got to enter into a contract with the irrigation people,
with Rexburg Irrigation; we already have a contract with Teton Pipe Line. Mary Smith
has been in touch with the Water Resource Board, and they told us we have got to have
a written contract lease all the time. He said it is alright with the council, he and

Mary would go ahead and get it all lined up. Last year what we did is they cancelled
our assessment on our stock in the Canal Company. The mayor said, what we need to do
is find out what the actual acreage they are watering from our irrigation ditch and
base our charge on that. Mary said we are obligated to furnish the water for those
farms. The mayor said we have more shares of water now than it takes to do that, we
are also dumping the wastewater from the city ditch in it. He said now that Idaho
Power has control of all the water in the Snake River, our water is pretty valuable.
A motion was made by Jim Morris and seconded by Darlene Blackburn to authorize the
mayor and city attorney to enter into a perpetual lease with the Rexburg Irrigation
Company. All Aye. Mary Smith said that Ron Carlson from the Water Resource Board
suggested that we make it perpetual to let either party have the right to terminate it
at anytime.
RE: PRIVATE LINES
Mayor Porter said DeLynn was concerned, he thought there should be something in the
ordinance concerning private lines that hook onto the city water main. What we have
always done is at the curb between the meter and the mainline the city has taken
care of and from there into the home is the property owners line. On the homes that
have meters inside their home, the rule has always been from the meter to the mainline
is the property owners line. If anything happens to that connector line, they have
to take care of it. It doesn't spell that out in the ordinance but that is the rule
we have always followed. Jim Morris said he thought we should change the ordinance to
include that. DeLynn thinks what it should be is from the mainline into the house,
if the meter is in the house. If the meter is at the curb, have it from the mainline
to the meter as the cities responsibility. The council suggested that a resolution
be made and that the Mayor and DeLynn Edstrom get together and decide the best way
it should be handled, and get the resolution ready.
RE: RAISED•FEES THAT FARMERS PAID
Mayor Porter said last year we raised all the fees by 50% that the farmers paid for
water that comes out of the ditch. This year we have made arrangements for a backhoe
to go through the ditch and clean it all out. The mayor said what we should do every
year is keep an accurate account of all the costs on the ditch and have a meeting with
the farmers showing the costs and assets accordingly.
RE: 4TH SOUTH NEEDS TO BE REPAIRED
Mayor Porter said 4th South is in bad shape and needs to be repaired. If we don't
do something there won't be much left. He said we need to check and see the streets
that need to be repaired and then check with H & K and see how much it will cost
to repair them.
RE: COSTS TO REPLACE CONCRETE
The mayor said he had previously asked Farrell to talk to concrete firms and see how
much they would charge per foot to replace concrete. Instead he got bids, and we had
not advertised for them. The mayor had opened up the bids and they would charge
$11.50 per foot which is too much. Jim Morris asked if we had our own forms because
if we do, he thought we could hire someone to just do the cement work at a reasonable
price at so much an hour. The mayor told him we have the regular curb and gutter forms,
except for the ones going around corners. He said he was going to go along and talk
to the people and see if we dug out the old curb and gutter if they would pay for the
installation. Jim Morris said he would check into hiring someone by the hour to do
the cement work only.
RE: GOLF COURSE AND PARKS
Jim Morris reported on the Golf Course and Parks. There is only two changes in the
green fees. The daily fee went from $4.00 to $4.50 with the 50~ being earmarked for
the Clubhouse. The other change .we have come up with is a 30 day pass for some people
that come to our area for a short period of time. He said he had met with Farrell
and discussed the people that are taking care of the parks. He said they had decided
to pay them a minimum wage and pay the supervisor a little more. They would knock the
wages down from $3.75 to $3.35 for minimum wage.
RE: PAYING BILLS
A motion was made by Morgan Garner to pay the bills and seconded by Nile Brown. All Aye.
RE: CALLS ABOUT MOBILE HOMES
The mayor said we have been having a few people call in about mobile homes. Some are
senior citizens that forgot to come to a hearing. He suggested that we get the committee
together and meet with them.

1983, at City Hall.
Present were the following:

A motion was made by Darlene Blackburn and Seconded by Nile Boyle to approve the
minutes. All Aye.
RE: REQUEST FOR VARIANCE
The mayor said that there had been a request for a variance on North 3rd East.
Chuck Frost had called him and the Planning Board had planned on calling everyone
on the Planning Board about it, but after he had called one or two, they decided
they had better have a public meeting. He said after the f1QOd, anyone that had a
50 foot frontage that had had a one-family dwelling on that property we had allowed
them to build back, but this is for a four-plex to be put on it.
RE: STREET REPAIRS
Mayor Porter discussed street repairs. He said we have two or three streets in the
city that are in bad shape. H & K is going to come in and do some work for the
college and some parking lots. The mayor asked them to go up and look at 4th South
and Mohawk and suggested to them that on Mohawk and 4th South we needed to have two
blocks done. He had asked them to give him a price per yard to repair the road and
put a half soul on it and seal coat it with chips. To do 4th South and Mohawk the
cost would be approximately between $45,000 and $47,000 and the seal coating would
be $1.00 a square yard for any streets that they do. The mayor said we have to bid
it, but he wanted to get an idea on how much it would cost.
Mayor Porter reported there is also an Asphalt Maintenance Company that has come .up
with a proposal to fill the cracks in the streets. On 1st North it is starting to
crack. What these people do is they rod out the cracks 1/2 inch wide and 3/4 inch
deep and put a product in the cracks. He had called up the Highway Department to
check on it and they use something like it. The rod out the cracks and put it in
the cracks for $2000 a ton. Barton Jensen said they had done some of it in the
parking lot at the East Stake Center if anyone wanted to go look at it. The mayor
said he would recommend that we go ahead and let them put a ton on 1st North. and
see what it looks like and then have some others done. These same people have been
talking to Dr. Mix in the Professional Plaza and they are going. to have their
parking lot done with this same thing. He has gone around to everyone up there and
has got them to agree to have them pay to have it done on the street. The fellow
told Dr. Mix it would cost about $2696 that is a little more than he planned on. The
mayor said he thought if they were willing to pay 60% of it, maybe the city could pay
the other 40%, which would cost the city $400 or $500. Jim Morris suggested that they
go look at the streets around the city and go by priority.
