Those Present: Mayor Councilman: John C. Porter Jim Morris Morgan Garner Sander Larson Glen Pond Nile Boyle Councilwoman: Darlene Blackburn RE: PROPOSED ORDINANCE N0. 651 Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, Treasurer Mary Smith introduced Proposed Ordinance No. 651, it would only be introduced but not passed today, it would be published once and then a period of 30 days elaps before final passage, the ordinance can be upgraded at that time but cannot be diminished. Copy on file at City Hall. The ordinance would be dated January 1, 1983. RE: NEED TIME FOR BONDS Bud Rhees said they need a certain length of time for. their bonds. The bonds are sold for 30 years. They would like the Franchise for the same length of time that the bonds are sold for. Mayor porter said in view of that he thought the city should go for 30 years on the bonds. Nile Boyle said he had had a lot of comment: on the length of time of the Franchise. People wanted the franchise to go a short time. RE: RATES CHARGED ON DIFFERENT AREAS The council discussed with Mr. Rhees the rates charged on the different areas in the city where the consumption stays the same. Mr. Rhees said their rate people will file it with the PUC to see if they can get those rates on a set amount. Mayor Porter said if we could get the. ordinance introduced and then get with .the UPL and go over the rates, where we know the Kil. is a set amount a month and possibly get the rate at a set amount. Mary Smith said we need to determine the % of Franchise which can be flexible with notification of 60 days. Nile Boyle said he didn't want to make it easy to raise the amount of the franchise tax. Mary Smith said other cities recommend to keep it rather flexible but to put ceiling on the franchise. RE: MOTION BY NILE BOYLE A motion was made by Nile Boyle to have a 25 year franchise with a 2% Tax, seconded by Darlene Blackburn. All Aye. RE: PROPOSED ORDINANCE N0. 651 AN ORDINANCE GRANTING TO THE UTAH POWER AND LIGHT COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE TO CONSTRUCT, ERRECT, MAINTAIN, OPERATE, REMOVE AND USE WIRES, POLES AND FACILITIES FOR TRANSMITTING AND DISTRIBUTING ELECTRICITY FOR HEAT, LIGHTS AND POWER TO THE CITY OF REXBURG, IDAHO, AND ITS INHABITANTS, AND TO ERECT, CONSTRUCT, MAINTAIN OPERATE, REMOVE AND USE SUCH FACILITIES FOR TELEPHONE AND TELEGRAPH IN ITS PRIVATE BUSINESS, AND TO CONSTRUCT, INSTALL, MAINTAIN, AND REMOVE CONDUITS ON, OVER, ALONG, UNDER AND ACROSS THE STREETS, ALLEYS AND PUBLIC WAYS WITHIN THE CORPORATE LIMITS OF THE CITY OF REXBURG, IDAHO, AS THEY EXIST OR AS THEY MAY HEREAFTER BE CHANGED, AND GRANTING USE OF STREETS, ALLEYS AND PUBLIC WAYS WITHIN THE CORPORATE 1 LIMITS OF THE CITY OF REXBURG, IDAHO, TO THE UTAH POWER AND LIGHT COMPANY FOR A TWENTY-FIVE (25) YEAR TERM: PROVIDING FOR EVIDENCE OF BUILDING PERMITS OF THE CITY OF REXBURG BEFORE ELECTRICAL HOOKUP CAN BE MADE:. PROVIDING THAT THE UTAH POWER AND LIGHT COMPANY PAY TO THE CITY OF REXBURG, IDAHO, A FRANCHLSE TAX AND PROVIDING FOR THE EFFECTIVE DATE THEREOF: AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. Ri 4. RE: MAYOR PORTER READ BEER LICENSE Mayor Porter read. beer licenses for: David Beesley at Hi County Bar to be sold and consumed on the premisis. Horkley Self Service to be sold not consumed on the premisis. A motion was made by Jim Morris and seconded by Darlene Blackburn to approve these licenses. Those Voting Aye: Nile Boyle Glen Pond Darlene Blackburn Jim Morris Those Obstaining: Sander Larson Morgan Garner RE: NEW HOURS AT CITY HALL Mayor Porter told the council that the City Hall was going to start on Dec. 1 to have new hours from 8:00 A.M. to 4:00 P.M. The staff will work until 5:00 P.M. and will be able to get more done and be able to cut one of the girls hours. People can use the drop box for payments. RE: MOTION BY JIM MORRIS A motion was made by Jim Morris and seconded by Darlene Blackburn to approve the bills for review at next meeting. All Aye. RE: NEXT COUNCIL MEETING Mayor Porter announced the next council meeting would be on December 15. RE: ADJOURN A motion was made by Glen Pond and seconded by Nile Boyle to ajourn. Larson Glen Pond Councilwoman: Darlene Blackburn Also Present: Mary Smith City Attorney In the excused absence of City Clerk, Rose Bagley, Mayor Porter asked Mary Smith to take the minutes. The Mayor called the meeting to order. Re: MINUTES APPROVED On motion of Nile Boyle, seconded by Darlene Blackburn and unanimously carried, Dec 1, 1982 minutes were approved.
