Those Present: Mayor: John C. Porter Councilmen: Nile Boyle Sander Larson Jim Morris .Glen Pond Morgan Garner Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, Treasurer LJ A motion was made by Jim Morris and seconded by Nile Boyle to approve the minutes. All Aye. RE: REQUEST NO GARBAGE SERVICE Deloris Birch was at the meeting, she told the council they owned the building where the old Walker Cafe use to be, the business that was in the building has moved out. Her daughter lives in .the apartment in the basement and there is a Pawn Shop upstairs. They do not have any garbage, what. garbage her .daughter has they haul away. They wanted to be exempt from paying garbage. The council told her the ordinance made it manditory for everyone to have and pay for garbage service. They did tell her that they would charge her for a residential rate only. RE: BUD RHEES FROM UTAH POWER & LIGHT TALKS ABOUT FRANCHISE WITH THE CITY 1 Bud Rhees came to the meeting to discuss the Utah Power & Light Franchise. Mayor Porter told the council that in their packets was a copy of the present franchise which was dated 50 years ago. Bud Reese told the .council that the franchise gives the Utah Power & Light the right away to be on city streets and alleys, existing and future. He said it was time they needed to go to work on the new franchise. Mayor Porter read .the Franchise Ordinance Regulations (copy attahced). Nile Boyle ask about the time limit on it. Mr. Rhees said as soon as the ordinance was .passed .they would. put it into effect, they would not wait until the summer to do it. Nile Boyle was concerned as to what effect the Homestead Act would have on the local government. Mayor Porter s<~i.d it would not have any effect, it effects the tax on residential property and puts it on business property. Mayor Porter siad he and Mr. Rhees had discussed this Franchis and 1% would bring in about $3500 per month, or 2% would bring in $7000 per month. Bud Rhees gave the council a copy of cities in Utah .that are involved in the franchise tax and the amounts they receive. He said we don't have any cities in Idaho that pay franchise tax to. Mr. Rhees said one thing we need to be aware of if you decide you are going to go with a franchise tax is they had been told that Idaho Power is very concerned about what we do in Rexburg and might challenge it in the courts. He said he understood that there are some cities in Northern Idho that are charging a franchise tax under Washington Power.Mayor Porter said he knew that Idaho Power is having a problem with Boise, but actually all the right-a-ways in Boise are owned by the State Highway District, they are trying to get Idaho Power to pay a franchise tax. Mr. Reese said the Legislature in Utah put a lid on it and said the maximum amount that could be charged was 6% Franchise Tax. He said in Utah the ordinance read so they can adjust the tax each year. The mayor said he would like to make a deal on the meter charges; down on the yellow flashing light by the school, every year for the last 10 years it had been 50 kil, and it costs us 39G or 40~ a kil. because of the meter charges. Out on the highway the state has somekind of a flat charge. .The intersection signal lights cost us 15~ a kil, but the amount used is stationary every month, in the parking lots they put an extra meter on, in the parks there is several meters and meter charges that could be combined. Mr. Rhees said there would be costs involved in order to combine them under one meter. Jim Morris suggested that the council make a list of things they want to talk about on the Franchise with the Power Company and then meet with them.. Nile Boyle said he thought the council needed to get somemore information on it and think about it for a month. The mayor felt we needed to get it settled so we could get it going by the first of the year. Mayor .Porter said we would try to be able to pass the ordinance in the next meeting. RE: REPORT ON IDAHO CITIES LEGISLATIVE MEETING Mayor Porter reported on the Idaho .Cities Legislative meeting he attended.. .They are going to try to get the .legislature to pass a Local .Option Tax, also to.support an increase inthe sales tax with the increase going 50% to the city and 50% to the county. The present division of the sales tax is unfare to the cities and counties, the schools get a major portion of it. They are going to appoint a commettee to study the Unemployment Insurance Program. There is also a problem with the Volunteer Fire Fighters under the State Insurance Fund. The State Insurance Fund refund for this year will be more than it was last year. They are going to try to change the bid limit to $10,000 instead of $50:00. They are going to try to get a bill to create a fund to buy LID Bonds in case we can`t sell the bonds, it would be a Bond Pool. At the present time now we have to pay for the police to go to the Post school, what they want to do is have the court place a $3.00 surcharge on the court costs that would go into a fund to pay for the police training. RE: REPORT FROM MOBILE HOME COMMETTEE Morgan Garner reported on the Mobile Home Commettee Report. He ask the council if they had read the minutes from the Mobile Commettee Meeting and their recommendations. He said the council would now have to determine what is to be done and if they wanted to go along with the recommendations. that have been made. .Mayor Porter said there was one trailer that did not meet with the commettee, Mark Siepert, for Blair Siepert's trailer right next to Johnsons Trailer Court, no one lives in it, it is in a Commercial Area, they would like to keep it there. Nile Boyle said he saw no problem with it because it is consistant with the other recommendations. Morgan Garner said. he felt good about the commettee, they had done a good job. A motion was made by Nile Boyle to endorse and except the recommendations of the Trailer Board and sent the letters out. Seconded by Jim Morris. All Aye. RE: TRAFFIC LIGHT AT MAIN AND 1st EAST DISCUSSED Mayor Porter said there was a fellow called him up and suggested that we eliminate the traffic light at Main and 1st East, now there isn't as much traffic, The mayor told him we would make a study but he did not think it was a good idea. RE: PARKING RESTRICTED Mayor Porter reminded the council of the ordinance we have which prohibiter the parking on the streets from 2:00 AM to 7:00 AM from November l to March 1. RE: OKAY TO PARK IN DRIVEWAY AT OLD WATER SHOP The mayor said there was a fellow that had ask to park in the driveway of the old watershop. He told him there would be no problem to go ahead and park there. RE: REPORT ON CENTINIAL COMMETTEE The mayor told the council that there has been a Centinial Commettee organized. There will be-a lot of things happening this summer. One thing that everyone will get a kick out of is Max Brown is organizing a run from Utah to Rexburg. There will be a pagent which has been written and they are working on. There will be various reunions. RE: SCOUTS AT MEETING Two ..Boy Scouts was at the meeting from Troup 48, Sherwin and Craig Davenport. RE: BUILDING PERMITS Mayor Porter reported on the building permits for October, $150,000 which brought in $411. RE: MONEY FROM LIQUOR FUND We received $18,731 from the State Liquor Fund. A motion was made by Nile Boyle and seconded by Darlene Blackburn to pay the bills. All Aye. A motion was made by Morgan Garner and seconded by Glen Pond to adjourn.
