radar, and have the police ticket cars that do not stop for kids in the crosswalk.
Nile suggested that we educate the children on how to cross the street..
Mayor Porter said since the police department has been cut, sometimes they are
in a different place and cannot be at the crossing.
Morgan Garner said he thought we needed to paint the road and put signs up.
Nile Boyle said maybe we could. write a letter to the State Highway people and when
they come to the ribbon cutting for the new. highway they maybe could .come and
look at it.
The council told the PTA .they would have a representative from the council and the
chief of Police at the meeting on September 22.
Lee Boyle of Reed Ave. said in his neighborhood there are not sidewalks and all
the kids walk in the middle of the street which is very dangerous.

The council decided that there would not be a council meeting on Sept. 15, the
next meeting would be held on October 6, unless something comes up.

WORK MEETING

A special work meeting of the City Council of the City of Rexburg, held September
16, 1982 at the City Hall.
Present were the following:

RE: AUDIT BIDS
The council discussed the audit bids. Rudd, DaBell & Hill had first given a bid
of $8100, when the mayor gave that figure to the council they had. told Mayor
Porter to get bids. After we had sent out requests to all the auditors in the
area and received them back, Rudd, DaBe11 & Hill's audit is $1000 more for this
year than the lowest bidder and $400 more for next year. Their bid for this year
is $7500 and Galusha Higgins's bid is $6500 for this year. The council discussed
if Galusha would charge extra for consultations. Rudd, DaBell and Hill in the
past have given the city extra help.
The Mayor felt that if we meet the bid from Rudd,DaBell & Hill the public would
rebel. Morgan Garner said he felt like we should go with a local firm if they
would come down in price. Darlene Blackburn said she was in favor of saving
money.
Mayor Porter said he had talked to Mary Smith, who had advised that since we
had called for. bids we might have a legal problem, if we did not take the
lowest bid.
The council felt that Rudd, DaBell and Hill had done a good job in the past.
Sander Larson said that if by law we are locked into these bids, you would
probably by hung up by public critism. He said he would prefer to keep the
money in town, he suggested they give Rudd, DaBell & Hill until 10:30 a.m.
today to come down the $1000 so their bid would be the same as Galusha Higgens,
even if it is for the one year bid. The .motion was made by Sander Larsen
to give Rudd, DaBell and Hill until 10:30 A.M. to meet the bid of Galusha
Higgens.

Sander Larson said as a result of this we would have to say we would have
to be as careful with other kinds of bids as we have been with this because
the money is not there. He said he had received a lot of criticism about the
crossing guards and if we did pay the extra .$1000 for the audit this would
come up.
RE: DEAN DALLING REPRESENTING MOBILE HOME BOARD
Dean Dalling was at the meeting to clear p some questions for the Mobile Home
Board. He said the Board would like to know what the council wanted the board
to apply as far as the law was concerned. .The original Zoning Ordinance
passed in 1968, indicated that you can .have mobile homes in Industrial,
Commercial Zones and also in R3. In October, 1981, the city council passed
an ammendment of the ordinance which says that ordinance is ammended and
changed to include double wide mobile homes on masonary foundation for
residential purposes as one of the permitted uses in Residential Zones 2,3
and commercial zones and industrial zones.
Mayor Porter said where the confussion comes is we also have a mobile home
ordinance that makes it so they can't put them anywhere in Rexburg, except in
a Mobile Home Court.
Dean Dalling said he thought the problem they would run into is that if they
were in a certain place before the ordinance was passed, we might have a hard
time kicking them out. Dean .said the problem the board had run into is if
they are not allowed to have a trailer anywhere except in a court, there are
clot of trailers out there that look nice and are set up and the people have
lived there for years, and if you are going to start granting variances,
under general-.law you should only grant a variance in extreme hardships, that
people in similar situations don't have. It is going to be really difficult
for anyone to show that kind of a situation. You are also going to have to
show a good reason why you suddenly stopped granting .variances, or you will
be liable for a law suit.. He said there are some people that have some nice
looking mobile homes and it will be hard to make a decision, but if you let
anyone stay that is outside of the zoning ordinance-and someone else comes
in with the same situation in another neighborhood, it is going to be difficult
to say this guy can stay and you can't, unless you .can show a good reason.
Mayor Porter said the big problem is, some people after the flood actually
have a trailer court. Jim Morris said that people owning property aren't
the big problem, it is the .ones that are .rented. Nile Boyle said we need
to be sure not to let any trailers stay in Rl and R2. Sander Larson said
that after the flood the trailers that were located on a temporary basis
should have had ample time to re-locate.
Nile Boyle suggested that .they get all the neighbors within 300 feet that
didn't object. Dean Dalling said that might present a problem too.
Dean dalling said any of ..them that .are out of compliance will not be
inclined to let them have the trailer unless they can show a good .reason,
and if that is the standard the council would like applied, that is what they
would do as aboard, and if the council wants to be more lenient the board
will leave it up to the council and just make a recommendation. Morgan
Garner said those families that own their own property and have a trailer
in the right zone and keep them up, he thought they should give them some
serious consideration, the others we can take care of.
