Present were the following: Mayor: John C. Porter Councilman: Glen Pond • Nile-Boyle Morgan Garner Jim Morris Councilwoman: Darlene Blackburn Also Present: Mary Smith, City :Attorney Rose Bagley, City Clerk • Richard Horner, Treasurer A special budget work meeting was held at 7:.00 P.M. Mayor Porter told the council since the Override did not pass, there was-two ways we could balance the budget, (1) leave the budget like it was .and then the 3% or 4% we intend getting from Utah Power & Light for the Franchise, just add that estimated franchise tax on there. (2) We could cut out the $112,000 and then we could have another budget hearing, if we get the franchise money. That would give us an excuse to raise the water, sewer, and garbage rates. Jim Morris reported that in Parks and Recreation they are going to have to pay their own way. The pool will operate until we run out of money and then we will close it. Mayor Porter said we got the Ordinance from Courer D'Alene that they use for putting a fee on street lights. They had put in the budget $15,000 for street lights, Couer D'Alene has a flat fee. of so much a month for everyone and then they add on if you are in a district that is lighted better. After discussion the council decided to charge 75G straight through for everyone to be added on the water bill. Mary Smith was instructed to draw up an ordinance. Mayor Porter handed out a sheet with proposed rate increases for the council to review. REGULAR COUNCIL MEETING STARTED AT 7:30 P.M. RE: CANVAS OF VOTES FOR THE OVERRIDE ELECTION Precinct People Voting For Against First 117 76 41 Second 155 99 56 Third 90 50 40 Fourth 227 156 71 589 381 208 A motion was made by Jim Morris and seconded by Morgan Garner to approve the results of the Override Election showing that there is 381 for and 208 against, showing that it failed to have a 2/3 majority voting for the override. All Aye. Mayor Porter reported that they had taken out of the budget $112,000. On the Road & Street Fund they .took out $6000, and had transferred $6600 Irrigation. On the Pool they took $5000 out and raised it in case there are donations we can still use them, and if the donations run out we will close the pool. The Mayor had told Farrell Davidson to just patch streets instead of doing any major repairs. There would be only one car purchased for the Police, that car would be purchased by Revenue .Sharing money. We would plow snow only until we run out of money. RE: A RESOLUTION WAS INTRODUCED TO INCREASE THE WATER RATES. RESOLUTION: BE IT RESOLVED: Whereas operations and maintenance expenses has increased. BE IT RESOLVED: That the water rate per 1,000 gallons over the first 6,000 gallons be and the same is hereby increased from twenty-three cents ($.23) to twenty-five cents ($.25). Such increase to become effective October 1, 1982. A motion was made to pass the resolution by Nile Boyle and seconded by Jim Morris. Those Voting Aye: Glen Pond Nile Boyle Morgan Garner Jim Morris Darlene Blackburn Those Voting Nay: None A resolution was introduced in increase the sewer rates. RE: RESOLUTION BE IT RESOLVED: WHEREAS, there have been changes in the operation and main- tenance of the Sanitary Sewer in that the costs of operating and maintaining said sewer have increased and it is therefore necessary to increase the charges to the users of the sewer in order to pay such increased expenses. NOW, THEREFORE, BE IT RESOLVED that the sewer rate be and the same is hereby increased from thirty-four cents ($.34) to thirty-five cents ($.35) per 1,000 gallons for the residents of the City of Rexburg, Idaho, such increase to become effective October 1, 1982. A motion was made by Morgan Garner and seconded by Darlene Blackburn to pass the resolution. Those Voting Aye: Glen Pond Nile Boyle Morgan Garner Jim Morris Darlene Blackburn Those Voting Nay: None Mary Smith said we would leave the garbage rate the same for Business, except the minimum charge would be increased from $9.00 to $11.00, for all businessess, apartments, and or trailer courts. Mary Smith introduced Ordinance 4650 in- creasing residential rates for Single Family Dwelling Units,. trailers, and mobile homes, .duplex units, triplex units, apartment house units, and rooming house units to $5.50 plus $3.00 for each additional unit, and all other residen- tial units $5.50 RE: ORDINANCE N0. 650 AN ORDINANCE AMENDING SECTION I OF ORDINANCE N0. 635 OF THE CITY OF REXBURG, IDAHO, WHICH PROVIDED FOR MONTHLY CHARGES FOR GARBAGE REMOVAL SERVICE FOR EACH OCCUPIED RESIDENCE AND/OR OCCUPIED. RESIDENTIAL PREMISES WITHIN THE CITY OF REXBURG, IDAHO, AND AMENDING SECTION I OF ORDINANCE N0. 640 OF THE CITY OF REXBURG, IDAHO, WHICH PROVIDES FOR MONTHLY CHARGES FOR GARBAGE REMOVAL SERVICE FOR NON-RESIDENTIAL PREMISES WITHIN THE CITY OF REXBURG, IDAHO, BY INCREASING THE MONTHLY CHARGES FOR GARBAGE REMOVAL FOR RESIDENTIAL PREMISES AND NON- RESIDENTIAL PREMISES, AND PROVIDING WHEN THE INCREASED CHARGES .SHALL BECOME EFFECTIVE AND PROVIDING THE EFFECTIVE DATE OF THIS ORDINANCE. A motion was made by Councilman Nile Boyle and seconded by Councilman Morgan Garner that the rules requiring an Ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said Ordinance be numbered No. 650. Those Voting Aye: Glen Pond Nile Pond Morgan Garner Jim Morris Darlene Blackburn 1 Those Voting Nay: None Ordinance 650 was then placed before the council. The Mayor then called for the voting for final passage of the Ordinance, and the motion was made by,Nile Boyle and seconded by Jim Morris that Ordinance 650 be passed. Those Voting Aye: Those. Voting Nay: Glen Pond Nile Boyle Morgan Garner Jim Morris Darlene Blackburn None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said Ordinance,-and that said Ordinance was duly and regularly passed. Mayor Porter declared the motion carried. RE: MARY SMITH INTRODUCED A FUND TRANSFER RESOLUTION BE IT RESOLVED THAT $76,500.00 of the Capital Projects Fund be transferred to the General Fund of the City of Rexburg, and that $81,700.00 of the Utilities Fund be transferred to the General Fund of the City of Rexburg, such transfers to be made and become effective upon the passage of this Resolution. BE IT FURTHER RESOLVED that $107,200 of the Capital Projects Fund and $4,300.00 of the Recreation Fund be transferred to the General .Fund of the City of Rexburg, such transfers to be made and become effective October 1, 1982. A motion. was made by Morgan Garner and seconded by Darlene Blackburn to approve the resolution. Those Voting Aye: Glen Pond Nile Boyle Morgan Garner Jim Morris Darlene Blackburn Those Voting Nay: None RE: INSPECTORS TRAVEL PAY Mayor Porter said we had lowered the travel for the inspectors travel pay $25.00. RE: STREET LIGHTING In the next meeting we would pass an ordinance to charge for street lighting. RE: FEE FOR PARK RESERVATIONS We would change the fee for park reservations for shelters to $15.00 a day anal $10.00 for i day There were no citizens present at the budget & Revenue Sharing hearing that objected. RE: ORDINANCE N0. 649 Mary Smith read Ordinance No. 649, the Annual Appropriation Ordinance. AN ORDINANCE ENTITLED .THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1982 TO SEPTEMBER. 30, 1983, AND APPROPRIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTEMBER 30,.1983. A motion was made by Councilman Nile Boyle and seconded by Councilman Morgan Garner that the rules requiring an ordinance of a general and permanent nature to be read on three occassions be dispensed with and that said ordinance be numbered No. 649. Those Voting Aye: Glen Pond Nile Boyle Morgan Garner Jim Morris Darlene Blackburn Those Voting Nay: None RE: IDAHO ENERGY LAB TOUR Mayor Porter told the .council that there would be a tour of the Idaho Energy Lab on Thursday, September 9, if anyone would like to go to it. RE: HOMER TAYLOR APARTMENTS SEWER LINE PROBLEM Mayor Porter said they had found the trouble on the sewer line for Homer Taylor apartments, another line was plugged and shooting into his line, they have unplugged the .line but it is still too small to handle it. RE: CROSSING GUARDS A group, representing the Kennedy PTA was present at the meeting to discuss crossing guards at the intersection of 5th West and Main, Kary Knowski acting as spokesman. He passed an outline around to the council made by the Kennedy PTA.. He said the PTA felt that they had a high risk area at the crossing at Main and 5th West. A lot of the traffic is currently going 50 mph in a 35 mph zone. He said there would be more traffic now with the new Interstate Highway with the ramp just west of Rexburg, especially until the ramp north of Rexburg is finished. He said they felt that it was a parental problem, a school problem, a city problem and a. county problem. In the survey it showed how many students crossed the highway, there being 113 students living on the north, side of the highway and need to cross the street. There is 36z percent of the entire kindergarten children that live on the north side of the highway. Solutions that they suggested were: a. School traffic light, whether city. or state responsibility b. Survey immediately after thru-way opens on West Main by State c. Change of priorities on budget to give us adult school guard d. PTA will help fund or finance part of school guard e. Regular police patrol of speed limit f. Request 20 MPH at crossing area g. Invite city officials to PTA/School Board Sept. 22, 1982 at 7: P.M. meeting at Kennedy School. h. permanent solution i. Temporary solution, police patrol j. PTA will work with city on schedule of times school guard is needed. k. Answer now and report back. Mayor Porter said he had discussed it with the State Highway Engineer, he had a man by the name of Mr. Crawl come up and look the situation over. They have nothing in their budget and have no plan for lights. He did suggest that we have four bouncing lights, to let people know that there is an intersection, they could not participate in the cost. The cost would be $2000 per light, a total of $800 plus $25 for power each to operate. We have also checked with other cities. St. Anthony has no crossing guards, they do have a bouncing light by the Forest Service Building. Blackfoot has no crossing guards. Idaho Falls has a few, the city pays z and the school pays 2, they also have flashing signs The Mayor said four or five years ago we had a crossing guard at Washington and the city was paying for it entirely, when we met with the PTA, people all over the city wanted crossing guards. We told them we would pay z and the school agreed to do it for one year, and then they went along with it for another year. We had a budget problem last year and we tried to get an override passed which included the crossing guards, and we were not able to get it passed, and was unable to continue with the crossing guards because of lack of funds. The city received a letter from the school saying they could not use any of their money for crossing guards because they. had to use their money for academic purposes, but .they bus kids in from the county and it seems that they could use some of the money for transportation to get the kids in Rexburg safely across the street. The city of Rexburg will do everything in our power to get the state to cut down the speed limit. What they do to set these speed limits, is, they bring a radar in and they check that area periodically at various times and they present their findings to the highway board. They recommend the speed limit and if the board approves that then that is what it is set at. They then send us a letter saying what speed limit the board has approved. We need to convince the board that that is a school zone. .Another thing that might work is a four way stop sign, again we need to get permission from the highway department. The mayor told the committee, he did not think there was a possibility of getting a stop light there, it had taken 4 or 5 years to get the one at Circle K. 1 Nile Boyle said we will have the police patrol the intersection and check it with radar, and have the police ticket cars that do not stop for kids in the crosswalk. Nile suggested that we educate the children on how to cross the street.. RE: RE: Mayor Porter said since the police department has been cut, sometimes they are in a different place and cannot be at the crossing. Morgan Garner said he thought we needed to paint the road and put signs up. Nile Boyle said maybe we could. write a letter to the State Highway people and when they come to the ribbon cutting for the new. highway they maybe could come and look at it. The council told the PTA .they would have a representative from the council and the chief of Police at the meeting on September 22. Lee Boyle of Reed Ave. said in his neighborhood there are not sidewalks and all the kids walk in the middle of the street which is very dangerous. COUNCIL MEETING ON SEPT. 1S. The council decided that there would not be a council meeting on Sept. 15, the next meeting would be held on October 6, unless something comes up. Jo C. rter I Mayor Rose Bagley ty er MINUTES OF A SPECIAL CITY COUNCIL MEETING WORK MEETING Sept. 16, 1982 State of Idaho) County of Madison( City of Rexburg) A special work meeting of the City Council of the City of Rexburg, held September 16, 1982 at the City Hall. Present were the following: Mayor: Councilman: John C. Porter Morgan Garner Jim Morris Glen Pond Nile Boyle Sander Larson Councilwoman: Darlene Blackburn Also Present: Rose Bagley, City Clerk Richard Horner, Treasurer RE: AUDIT BIDS The council discussed the audit bids. Rudd, DaBell & Hill had first given a bid of $8100, when the mayor gave that figure to the council they had told Mayor Porter to get bids. After we had sent out requests to all .the auditors in the area and received them back, Rudd, DaBell & Hill's audit is $1000 more for this year than the lowest bidder and $400 more for next year. Their bid. for this year is $7500 and Galusha Higgins's bid is $6500 for this year. The council discussed if Galusha would charge extra for consultations. Rudd, DaBell and Hill in the past have given the city extra help. The Mayor felt that if we meet the bid from Rudd,DaBell & Hill the public would rebel. Morgan Garner said he felt like we should go with a local firm if they would come down in price. Darlene Blackburn said she was in favor of saving money. Mayor Porter said he had talked to Mary Smith, who had advised that since we had called for. bids we might have a legal problem, if we did not take the lowest bid.
