RE: REDUCING TAX LEVY Mayor Porter said we don't have to pay any insurance this year and won't have that so we will be able to reduce the tax levy by $20,000. ~n1e are asking for $112,000 in the Override Election, however last year we had Tort Liability to pay and ..that is outside the 1% and can. be levied, and that .was $20,148 and we have already paid our insurance for 14 months,. and in selling this to the public we can say .that the property tax that they paid last. year will be $20,148 less. Richard said we could also reduce the LID Guarantee Fund. Mary Smith said with all the LID's we have and especially with hard times coming up, we need to keep the Fund up or we will be in trouble. Those Present: Mayor: Councilman: John C. Porter Jim Morris Glen Pond Sander Larson Morgan Garner Nile Boyle Councilwoman: Darlene Blackburn Also Present: Rose Bagley, City-Clerk Mary Smith, City Attorney Richard Horner, Treasurer RE: SPECIAL WORK MEETING FOR COUNCIL A special work meeting for the council to work on-the budget started at 7:00 P.M. The council duscussed the budget. The city is short on the LID 22 account, apparently was caused when the bonds were wold. Whenever the LID Fund gets down below 5% of bonds we owe then we can levy up to 2 mills to build it up, the Mayor said. RE: RE: RE: RE: RE: RE: RE: JIM MORRIS REPORTED ON TALK WITH UTAH POWER & LIGHT Jim Morris said he had .talked to Bud Reese with the Utah Power & Light and he said as soon as the agreement is signed for the Franchise they can levy and put it into force. The mayor said we are .planning on having a street light utility fund. The franchise. tax will bring in $14,000 a month at 4%. The Utah .Power & Light Franchise is coming up for renewal on July 19, 1983, and they will negotiate with us anytime, and we could start it January 1, that would give us if we go 4% for nine months $125,000.. There is two or three ways we could do, we could open up the budget again and take the cash money we put in now and take it back out again and use the $126,000. Then we could pay off the TEDRO if we wanted to. The council agreed to go. ahead with that principal of .balancing the budget. LEASING THE GOLF COURSE Jim Morris ask about leasing the golf course. Nile Boyle said we could only do that if we had some say about it. REGULAR CITY COUNCIL STARTED AT 7:30 P.M. MINUTES A motion was made by Nile Boyle and seconded by Morgan Garner to approve the minutes. All Aye. REVENUE SHARING BUDGET The council went over the revenue sharing budget for the amount of $106,400. A public hearing will be held on August 10, at 7:30 P.M. COMMITTEE FOR TABERNACLE CHOSEN Mayor Porter said he had chosen a committee for the tabernacle. Glen Pond would serve from the council, Louis Clements from the Historical Society, Bob Smith from the Chamber of Commerce, and the members at large would be Keith Peterson and Dell Klinger. A motion was made by Mortan Garner and seconded by Sander Larson, to approve the committee. All Aye. JILL PETERSEN IVY DELINQUENT LID ~ ~ Mayor Porter said there was a lady by the name of Jill Petersen Ivy, who came in the office today to talk about her delinquent LID. She was upset because when her curb. and gutter was run they didn't leave a curb cut for a driveway. She felt it was the city's responsibility to have that done before she would pay her LID.. There was a basement there when .the .LID was done, she said she didn't care where the cut was put, she just wanted to be able to drive in the lot. The reason she wants .this is because she is going to put it up for sale, and she wants to be able to tell the person that .buys it what we are going to do. Mayor Porter said he thought we should write a letter and tell her that whoever buys the property could contact us and we will tell them what we will do. The council decided she would have to be on her own that the city could not participate in putting in the curb cut. COMPLAINTS FROM RODNEY DRIVE ON GARBAGE PICKUP Some people from Rodney Drive were at the council meeting, Gary Rogers, being the spokesman. They complained that they had trouble getting service on garbage and snow removal both. On the last holiday, July 24, Friday was the holiday, the garbage was not picked up until Wednesday late after they had called many times to complain. They had a problem with snow removal, they could not get their snow removed last winter. Mayor Porter told him that the city had a problem with garbage and had trucks broken down, but we would get it straightened out tomorrow. Mr. Rogers said they had been treated very rudely by the city employees, and had been told they were not in the city limits. The council told Mr. rogers that we had a problem with snow removal all over town in the residential area, because the city did not have the money, and if the override election does not go through there would not be any snow plowed in the residential area. RE: MEETING TO BEHELD WITH STATE, EMPLOYEES & INDUSTRIAL ACCIDENT BOARD Mayor Porter said the State wants to have a meeting with the employees and the Industrial Accident board and they will show a film. We have cut down on accidents some but they are higher than they should be. The mayor said he would set up the meeting and he would like the council to be there. 1 RE: BUDGET DISCUSSED Budget discussed again in the regular meeting. The mayor told the council that we would receive more in .the inspections .for plumbing and electrical because of the new building at the college. The .council discussed changing the Planninga Zoning Ordinance to charge a fee for checking the developer's maps, they ask Mary Smith to get the ordinance from Idaho Falls and see what they charge for it. If we charge for that we can raise the revenue in the budget for Planning and Zoning. There would be a change in the heat and lights for the police lowering it a little. On the fire we took $40,000 out that was put in for a truck. The park budget was left the same. The amount for street lights was taken out of the street budget and put in a separate account. They cut the shop expenses $1000. They reduced the sanitation budget for gas and oil because of the new diesel truck. They will charge the water department for the. use of the backhoe which belongs to the street department. There was a change in the water and sewer on the computor lease program. The sewer budget for the telephone and radio .would be reduced because we .are going to do away with part of the telemeter.. The amount budgeted for pumping could be lowered, we would need to allow for the purchase of 150 new meters which would change the figure for meters and parts.. Adjust the amount for the lift station power. The senior citizens would be turned over to the. senior citizens commettee and we would give them $650 per month for salary and would not have to pay any benifits which would lower the figure. RE: EXTRA MONEY ON FRANCHISE FOR UTAH POWER & LIGHT Mayor Porter said when we get the extra money for the Utah Power & Light franchise we can have another budget hearing and pay back the $130,000. RE: ORDINANCE 647 DIGGING PERMITS City attorney read Ordinance 647 amending the .digging permits. AN ORDINANCE AMENDING SUBSECTION A OF SECTION 1, ORDINANCE N0. 565, OF THE CITY OF REXBURG, IDAHO, PROVIDING THAT THE CITY COUNCIL BY RESOLUTION SET A FEE TO BE CHARGED BY THE CITY CLERK FOR THE ISSUANCE -0F A STREET EXCAVATION PERMIT, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by councilman Jim Morris and seconded by councilman Jim Morris that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 647. Those Voting Aye: Ordinance 647 was then placed before the for final passage of the ordinance, and by Darlene Blackburn that ordinance 647 Those Voting Nay: Darlene Blackburn Jim Morris Nile Boyle Sander Larson Morgan Garner Glen Pond None council. Morgan Garner Glen Pond Those Voting Nay: None The roll showed all councilmen present voting "Aye".carried, the mayor declared that the majority of all the members of the city council had voted for the passage of said ordinance, and that said ordinance was duly and regularly passed. Mayor Porter declared the motion carried. RE: ORDINANCE 648 IMPOUND FEES City attorney read ordinance 648 changing the fee for cars that are impounded.. AN ORDINANCE AMENDING SUBSECTION 12 OF THE PARAGRAPH DESIGNATED AS "STOPPING, STANDING OR PARKING" OF ORDINANCE N0. 482 OF THE IMPOUNDMENT FEES BY THE OWNER OF A VEHICLE WHICH HAS BEEN IMPOUNDED AND PROVIDED WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by councilman .Morgan Garner and seconded by Nile Boyle that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 648. Mayor Porter declared the motion carried. RE: CHARGE FOR DIGGING PERMITS The council discussed the amount of the charge for digging permits. A motion was made by Jim Morris and seconded by Darlene Blackburn to charge $500 for the digging permit and 10% of that for the inspection fee. Everyone will have to pay for an inspection fee even Utah Power & Light, Mountain Bell, Cable TV, and Intermountain Gas. The city will then have it repaired by a professional. All Aye. Earl Kemp suggested that it might cost more than that to repair the street. Mayor Porter said we would check on it and if we needed to we would change it. RE: LETTER FROM THE IDAHO. DEPARTMENT OF PARKS Mayor Porter said the city had received a letter from the Idaho Department of Parks and Recreation, they had commended us on the achievements made in our facilities. RE: BILLS APPROVED A motion was made by Morgan Garner and seconded by Nile Boyle to approve the bills. All Aye. RE: PLAQUE TO HONOR WOMEN WHO SERVED AND CONTRIBUTED TO DEFENSE OF OUR COUNTRY Mayor Porter showed the council a Plaque from the United States Army Reserve presented to all women who served and contributed their courage, honor and energy to the defense of our country. He would have it put up in the council room. RE: REPORT ON SEWER PROJECT Earl Kemp reported on .the sewer project A motion was made by Nile Boyle and seconded by Darlene Blackburn to adjo/ur~n.
