A meeting of the City Council for the City of Rexburg, Madison County, held July 21,
1982, at the City Hall.

RE: MINUTES
A motion was made by Nile Boyle and seconded by Morgan Garner to approve the
minutes. All Aye.

RE: PARKING FOR Mrs. Francis Wrights Student Housing
Donna Abegglen, Mrs. Francis Wright's daughter, was at the meeting to discuss
her mother's apartment house and the parking, as her mother was in the hospital.'
She ask about the rules about parking and wanted to see about enlarging the
parking. They have a large planter in the front of the property which they
could take and put in parking, this would put in one more parking place.
She ask about putting more parking in by taking out the lawn, the council
told them they. were not suppose to take out the landscaping in the front
yard for parking. She .was told that the apartment still could not be in
compliance with the ordinance for parking for students. Mrs. Wright had been
given permission last year to rent to married couples only or students without
cars, and she had not done this. If she could find parking on another lot
within 300 feet, this would be permissible. Mayor Porter read from the
ordinance book which said there had to be one parking place for every two
students up to 24 and then one parking place for every three students after
that. After the college checked out the apartments that .had problems with
parking they usuallly found there was also no supervision with the apartments.
Mrs. Abegglen ask if they rented to married couples and took out the planter
for parking if that would be okay. She was told they would have to meet
with Nile Brown and if it met with .the zoning ordinance then they would have
to bring in a drawing of the parking for the council to check before they would
okay it for married couples.
RE: SPEEDING ON COLLEGE AVE.
Mayor Porter told the council at the last meeting we recieved a petition from
the people on College Ave, that wanted the city to do something about the
speeding on that street. He had the police go over and set up a traffic
survey, which he gave each council member a copy of the survey they had done.
The average speed limit on that street is 20.4 MPH, the fastest was 31 MPH
and they issued a warning ticket. the mayor and council said they did not
think there was much of a problem. Mary Smith suggested that we have a
problem all over town with children playing in the street, she thought it
would be a good idea for the police to start some sort of a program to keep
children out of the streets. If something is not done there will be some
tragedy sometime because children are playing in the street.
RE: MEMBERS OF HISTORICAL SOCIETY AT MEETING
Members of the Historical Society was at the meeting, Louis Clements was the
spokesman for the group. They wanted to make the council aware that a problem
exists. For the past 6 months they have been leasing the tabernacle at $500.
per month. It has now got to the point that they have no money left.. What
they would like to suggest is that the city create a panel or a civic
auditorium board to study the building for two things: One he thought there
could be some savings made especially in the winter time with heat, second;
to create more use .for the building. If the group that was created would go
out and stir up groups to use the building at a fee, the building would pay
for itself. He said they got $5000 a year to run the historical society, the
rent would be $6000 a year.

They had only earned $50 from renting to groups in the last 6 months, most
of the groups are free ones. They would like to just rent the basement .and
not have anything to do with the upstairs. Six hundred people have signed
the register in July. Mr. Clements suggested that the scheduling and
billing of the building should come out of the city office. Mayor Porter
told Mr. Clements that the tax money should go to the building rent, that is
the reason they receive that money; he suggested that they also had other
ways to earn money. He told them the city already had $20,000 from the
tax payers that we have to pay back .for putting the building back to
standards. He told them if they would go anyplace in town they would find
that $500 a month is a bargain especially where the .city furnish the heat,
because it costs more than that to heat the building. The council agreed
it would be a good idea to organize a committee, it was agreed to appoint
one member from the council, one member from the chamber of commerce, one
member from the historical society, and two members at large. Mr. Clements
told the council that they were backing the Centenial next year and part
of their money had to go for that. The Chamber of Commerce does not pay
any rent..
GETTING SOME OF THE HOLES IN THE STREETS PATCHED
Mayor Porter said he had been talking to Farrell about getting some of the
holes in the streets patched, where people have :dug in the street. We
have been charging $300 and they would repair it at their own expense so
it would meet our .inspection, and then we would refund the $300, but these
people have been putting in the old dirt and .then black topping it and the
next year we have to do it all over again. The mayor said he thought we
should change .the ordinance, and charge $500 and have someone like H & K
fix it. They are not suppose to put the old dirt back, the last two feet
has to be clean new gravel. If we spend the time inspecting this to make
sure it is done right we should get some kind of a fee for it, he suggested
$50 or $100 as the fee for inspection. Farrell has made arrangements for
H & K to patch all the holes around town. The council agree to charge
$500 plus an inspection fee and have it repaired by a qualified company
and then if there is anything left refund it. The telephone Company, Utah
Power & Light and Intermountain Gas would have to pay an inspection fee also.
MAINTENANCE ON EQUIPMENT
Mayor Porter said since they had been going through the budget they had found
that the mantenance on the equipment is going up. He said he had checked
with Utah Power & Light on how they manitain their equipment. On the garbage
department this year they spent $23,000 on maintenance and last year we spent
$12,000. The Utah Power & Light have their own whop down to the service
center, everyone is assigned a truck and in the office every thirty days they
give the truck driver notice it is time to have the vehicle serviced; if they
can't do it at the service center they take it to a garage. and have it done.
Then if they find out it isn't being taken care of the driver is held responsible.
All of our vehicles are numbered and should have a card on each, and we should
be able to keep a record on each vehicle. Mayor Porter suggested that Morgan
Garner and Richard go down and check the records.
WEED CUTTING
The council discussed the cutting of weeds.
ANNEXATION OF REXBURG HEIGHTS
Nile Boyle said he had had a lot of people from Rexburg Heights wanting to
know what it would take to get annexed. He told them he could not .speak for
the council but he thought if they could get 90% of the people that want
annexation either to agree on horses or to agree to not have horses, we
won't except any other animal except horses and they will also have to drop
the law suit and then we will consider it.
RE: BILLS

A motion was made by Jim Morris and seconded by Nile Boyle to pay the bills.

RE: CARS PARKED BY THE OLD TRIPLE g1 RENTAL
Darlene Blackburn said there are cars parked by the Old Triple ~ Rental on the corner
of 2nd East and ..1st North on the sidewalk, Mayor Porter said he would have the police
check it.
RE: REDUCING TAX LEVY
Mayor Porter said we don't have to pay any insurance this year and won't have that so
we will be able to reduce the tax levy by $20,000. ~n1e are asking for $112,000 in the
Override Election, however last year we had Tort Liability to pay and ..that is outside
the 1% and can. be levied, and that .was $20,148 and we have already paid our insurance
for 14 months,. and in selling this to the public we can say .that the property tax that
they paid last year will be $20,148 less. Richard said we could also reduce the LID
Guarantee Fund. Mary Smith said with all the LID's we have and especially with hard
times coming up, we need to keep the Fund up or we will be in trouble.
RE: SPECIAL BUDGET MEETING
It was decided to have a special budget meeting Thursday July 29 at 7:00 A.M.

Nile Boyle discussed the telemeter line and how expensive it was. It was decided to
take it out.

RE: SPECIAL WORK MEETING FOR COUNCIL
A special work meeting for the council to work on the budget started at 7:00 P.M.
The council duscussed the budget. The city is short on the LID 22 account,
apparently was caused when the bonds were wold. Whenever the LID Fund gets
down below 5% of bonds we owe then we can levy up to 2 mills to build it up,
the Mayor said.
