I have examined copies of the Minutes, Resolution and Note and find that they comply with the provisions of Chapter 31, Title 63, Idaho Code, which provides for the antici- • pation of revenue by taxing districts. Inasmuch as the tax levy for the current fiscal year has not been completed and the entire proceeds therefrom have not yet been paid to the City of Rexburg, it is necessary to use the 1981 market value and tax levy. This opinion is based upon the figures set forth in the Resolution. The Tax Anticipation Note in the amount of $19,000.00 will not exceed seventy-five (75) per cent of the general tax to be levied by the taxing district in the current fiscal year and not yet collected based upon the said 1981 market value and levy. There are no other outstanding tax anticipation notes to be paid from this general levy. There is a rule that when there is a large water leak the city will cancel 2 month bill but .then from then on if they .don't get it fixed they will have to pay the entire bill. There was a woman with five children, Michelle Dass, and she didn't know there was a leak because we haven't been reading the meters during .the winter. When we had the read in the spring, the first month she owed $102 in addition to what she had been paying. We figured it for just one month and it reduced it $5.06 on the water and $14.96 on the sewer, he said he was inclined to suggest that we should figure what it would .have been ordinarily and charge her that. Nile Boyle said that Verla Parkinson had got a $53.00 bill because it was not read correct last fall, which was not her fault, she had been billed the minimum and lives alone and suddenly she gets this big bill.
