Minutes of the regular meeting of the City Council fo the City of Rexburg held May 5,
1982, at 7:30 P. M., at the City Hall.
Those Present:
Mayor: John C. Porter

Also Presnet: Mary Smith, City Attorney
In the excused absence of Rose Bagley, City Clerk, the Mayor asked Mary Smith, City
Attorney, to take the minutes.
RE: MINUTES APPROVED
The Mayor called the meeting to order and stated .the first order of business was a motion
pertaining to the minutes of the Council Meeting held April 21, 1982. Darlene Blackburn
moved that the minutes of the meeting held April 21, 1982, be approved. Seconded by
Sander Larson .and unanimously carried.
RE: TRAFFIC LIGHT ON South 2nd West By Porter Park & Bridge On 5th West Discussed
Mayor Porter said he had met with the Idaho Transportation Department in Idaho Falls and
felt that Rexburg was fortunate to have obtained the bridge on 5th West and the traffic
light on South 2nd West by Porter Park. He stated the contract for the traffic control
installation had been awarded to Bengal Electric Company of Pocatello, and as soon as the
contractor had all of the controls available they would proceed with the installation.
Mayor Porter stated that as soon as the weather warmed up the bridge on South 5th West
could be completed; that water could go under it now.
RE: MAYOR PORTER ATTENDS A DISASTER MEETING IN IDAHO FALLS
Mayor Porter stated he had been to a disaster meeting in Idaho Falls about a week ago;
that they introduced a disaster control program and had given him material instructing
the Police Department and other City Departments how to deal with disasters and set up
an alert plan.
RE: LOGO ON CITY EQUIPMENT DISCUSSED
The mayor said the City now had the plates with the approved logo. The matter of placing the
approved logo on City equipment was discussed.
RE: MAYOR PRESENTS APPEAL BOARD OF TRAILER HOUSES
The Mayor presented to the council for .its approval the following five persons as
members of an appeal board to hear and determine variances requested by mobile home
owners: Morgan Garner, to represent the City; Dean balling, attorney; Leonard Longhurst,
representing the Zoning and Planning Board; Grace Jones, representing mobile home owners;
and Berniece Ricks, member at large. Moved by Nile Boyle, seconded by Sander Larson and
unanimously carried that the said appointments be approved.
RE: COMPENSATION TIME FOR WATER DEPARTMENT DISCUSSED
The matter of compensation time for the water department was discussed. In the discussion
it was brought out .that there had been some changes fromthe original established policy.
Nile Boyle said he would like to investigate the matter and report back to the Council.

RE: CAMPOUSES ASK FOR DECISION REGARDING VARIANCE FOR MOBILE HOME
Mr. and Mrs. Camphouse, who were present at the meeting, asked if a decision had
been made regarding their requested variance for mobile home location. Mrs. Camphouse
presented a petition signed by neighbors adjacent to their mobile home, located at
471 West 1st North, who stated they had no objections to the mobile home at that location.
The matter was. discussed and the Mayor explained it would be turned over to the newly
appointed appeals board and they (theCamphouses) would be contacted.
RE: BOY SCOUTS ATTEND MEETING
Boy 5cout~ attending the meeting introduced themselves and stated they were from Troops
212 and 48. The Mayor presented each of them with "First Aid Facts".
RE: DELIVERY ON GARBAGE TRUCK - TAX ANTICIPATION NOTE PASSED
The Mayor stated the City had taken delivery of the ordered garbage. truck and suggested
the City pay $10,000 down and finance the balance of $19,000; that the First Security
Bank would take the City's Tax Anticipation Note at 11% interest. Nile Boyle introduced
the following resolution (copy of minutes and resolution).
RE: CLEAN UP WEEK UNTIL MIDDLE OF MAY
Mayor Porter suggested clean up week be continued until the middle of May. Discussed.
RE: ROTARY CLUB WANT TO HELP KEEF THE POOL OPEN
Jim Morris stated a member of the Rexburg Rotary Club had contacted him and wanted to
know how they could help in having the swimming pool opened. The matter was discussed.
The Mayor stated .the City had enough to keep it open for about two months and would
make every effort to keep it open as long as they could.
RE: CETA WORKERS FOR RECREATION PROGRAM
The Mayor reproted the City had about three CETA workers for the Recreation Program; that
this was the last year for CETA program.
RE: CITY TO USE COMMUNITY WORK EXPERIENCE PROGRAM
The Mayor stated there was another program the City had signed up for. That the
Department of Health & Welfare had a program for women who were receiving Aid for
Dependent Children and had children over six years of age; that the women would have
to do work of some kind for 20 hours a week. The program wouldn't cost the city
anything but the city would have to furnish liability insurance. That the city would
have to treat them as an employee; that there could not be any discrimination. They
are to be trained so they can get working and get off welfare. If they work for the
City, they are to do anything they are capable of doing. That employees are not to
be replaced by the people in this program. They will work hours and be treated as
an employee. The matter was discussed.
RE: PAVING OF ROAD FROM SECOND EAST PAST THE VALLEY VIEW ESTATES DISCUSSED
Sander Larson said he was informed that people from Rexburg Heights had contacted the
County and AMR regarding the paving of apiece of road from Second East past the
Valley View Estates and asked him what the City's position would be. Mr. Larson
said he told them that when the others were ready the city would pay its portion of
the project as it had agreed last year.. The matter was discussed.
RE: FLAG AT .THE INTERSECTION OF MAIN STREET AND 2ND EAST DISCUSSED
Councilman Boyle said the flag at the intersection of Main Street and 2nd East shouldn't
be up at night unless it had a light to enhance it; that the light had been turned
off. The matter was discussed Councilman Morris said he would investigate it.
RE: REPAIRING STREETS DISCUSSED
The matter of repairing streets was discussed. Mayor Porter stated the Legislature
had raised the gas tax one cent to be used for road repairs and that the City would
recieve about $17,000 or $18,000, which would be helpful.

I have examined the proceedings consisting of the
minutes of a regular meeting of the City Council of
Rexburg, Idaho, held May 5, 1982, showing a Reso-
lution adopted by the Council at that time authorizing
the City to borrow $19,000.00 and issue as evidence of
such debt, Tax Anticipation Note dated May 5, 1982,
bearing interest at the rate of eleven (11) per cent per
annum, maturing February 1, 1983.
I have examined copies of the Minutes, Resolution and Note
and find that they comply with the provisions of Chapter
31, Title 63, Idaho Code, which provides for the antici-
• pation of revenue by taxing districts.
Inasmuch as the tax levy for the current fiscal year
has not been completed and the entire proceeds therefrom
have not yet been paid to the City of Rexburg, it is
necessary to use the 1981 market value and tax levy.
This opinion is based upon the figures set forth in
the Resolution. The Tax Anticipation Note in the
amount of $19,000.00 will not exceed seventy-five (75)
per cent of the general tax to be levied by the taxing
district in the current fiscal year and not yet collected
based upon the said 1981 market value and levy. There
are no other outstanding tax anticipation notes to be
paid from this general levy.

A regular meeting of the Cite Council of the City of
Rexburg, Madison County, State of Idaho, was called to order by
the Mayor, John C. Porter, at 7:30 o'clock P.r•1. on riay 5, 1982,
at the City Hall at Rexburg, Idaho, there being present the
following: Mayor John C. Porter, Councilmen Nyle Boyle, Jim
rSorris, Glen Pond, Morgan Garner, Sander Larson and Darlene
Blackburn; also City Clerk, Rose Bagle;~.
Nile Boyle was recognized by the Mayor and presented
to the Council the following Resolution:
RESOLUTION
BE IT RESOLVED by the City Council of the City of
Rexburg, Madison County, State of Idaho, a municipal corpor-
ation organized and existing under and by virtue of the laws of
the State of Idaho, and a taxing district within the meaning of
Section 63-3101, Idaho Code, in regular meeting assembled:
1. That the City of Rexburg borrow money in the sum
of $19,000.00 and issue as evidence of such debt, a tax antici-
pation note, bearing interest at the rate of eleven (11) per
cent per annum from the date thereof until paid, which said
note shall mature February 1, 1983; that said sum be borrowed
from, and said note be issued to the First Security Bank of
Idaho, a National Banking Corporation, Rexburg, Idaho, with its
office and place of business in Rexburg, Idaho; such money to
be used for general expenses of the City in anticipation of the
taxes levied for the current fiscal year for general purposes
and not yet collected by the City.
2. That. the tax levy for the current fiscal year has
not been completed; that the amount. of taxes levied f_or. general
purposes exclusive of taxes levied for. outstanding bonded
indebtedness a.nd specia]_ purposes in the previous fiscal year
(1981) is .002723 mills on the dollar of market value, which
market value for the year 1981 w~~~~ $1.50,116,706.00, making the

total amount o1= taxes levied for said previous fiscal year,
exclusive of those levied for outstanding bonded indebtedness
and special purposes, the sum of $327,946.82, of which sum none
has been collected; that this proposed tax anticipation note
does not exceed 75 per cent of the taxer not yet collected by
said taxing district for the current fiscal year, and the
proceeds therefrom have not yet been paid to the City of
Rexburg by Pladison County.
3. That such tax anticipation note shall be a
negotiable instrument, and shall pledge the full faith, credit
and resources of the City for the. payment of the same, and
shall be substantially in the following form;

For value received, the City of Rexburg, Madison
County, State of Idaho, promises to pay to the First Security
Bank of Idaho, N.A., a National Banking Corporation, with its
office and place of business at Rexburg, Idaho, or. its order,
on the 1st day of February, 1983, the sum of Nineteen Thousand
($19,000.00) Dollars, lawful money of the United States of
America, with interest from the date of this note at the rate
of eleven (11) per centum per annum until paid.
This note is issued in pursuance of a Resolution duly
adopted by the City of Rexburg, Madison County, State of Idaho,
on the 5th day of P~Iay, 1982.
It is hereby certified and recited that each and
every act, condition and thing required to be done, to have
happened, and to be performed precedent to and in the issuance
hereof has been performed in full. and strict compliance with
the Constitution of the State of Idaho and the provisions of
Chapter 31, Title 63, Idaho Code, and amendments thereof; that
the arlount of this note is not in excess of 75 per cent of the
taxes levied by said taxing district for the current fiscal
year and not yet collected, and that. the tax levy for said
current fiscal year has not been completed and the entire
proceeds therefrom have not yet been paid to the City of
Rexburg by Madison County; that the market value and the tax
levy is based on the 1981 market value and 1981 tax levy; that
the full faith, credit and resources of the. said City are
hereby pledged for the payment of this note, according to its
terms; that there remains to be collected all of the taxes
levied for the current fiscal year and there are no other tax

anticipation notes outstanding to be paid from the uncollected
portion of the taxes levied for the current fiscal year.
ZN F7ZTNESS WHEREOF, the said City of Rexburg has
caused this note to be signed by its Playor and attested and the
seal of such City affixed by the Clerk this 5th day of May,
1982.

4. That such tax anticipation note be sold at
private sale to the First Security Bank of Idaho, N.A.,
Rexburg, Idaho, aforesaid, by the Mayor. of the City forthwith,
and that he be hereby authorized. t.c~ make such sale and to
receive the proceeds therefrom and deposit them to the credit
of said City.
5. To provide for the payment of said tax anticipa-
tion note at maturity, a special fund is hereby created to be
known as TAX ANTICIPATION BOND OR I1OTE REDEMPTION FUND, and it
is hereby provided that. all taxes hereafter collected or
received from the general tax lev~,r f-or the current fiscal year
shall be placed immediately in such fund until such time as the
funds accumulated therein shall be sufficient to pay the
hereinabove mentioned tax a.ntic,ipat~ion note, together with
interest thereon at maturity, and the funds so accumulated in
the said fund are hereby appropriated and set apart for such
purpose only and shall be used for no other purpose; providing,
however, that this shall not limit the payment of said note to
the said taxes collected, but such note shall be the direct and
general obligation of the City of Rexburg.
It was moved by Jim Morris, and seconded by Darlene
Blackburn that such Resolution be adopted, and the proper
officers directed to proceed accordingly, and that the
Resolution be spread on the minutes. Upon call for question,
the vote was taker: as: Far 6, Against 0. tdhereupon the Mayor
declared the Resolution duly adopted and directed that the
proper papers be executed and that the Mayor proceed to
negotiate the loan, as authorized in the Resolution and
directed the Clerk to spread the Re.>~lution upon the minutes of
the Council.
There being no further business to come before the
Council, the meeting was declared adjourned until the' next
regular meeting of the Council, subject to call by the Mayor.

A meeting of the City Council for the City of Rexburg, Madison County, held May 19,
at 1982, at the City Hall.
Those present:
Mayor: John C. Porter
Councilman: Jim Morris

Also Present: City Attorney, Mary Smith

A motion was made by Darlene Blackburn and seconded by Morgan Garner to approve the
minutes. All Aye.
RE:~REQUEST TO PAIP~T HOUSE NUMBERS ON CURBS
Mayor Porter said that a young man by the name of Wes Galaway came in the city hall,
he wants to paint the house numbers on the curb and charge $1.00. The mayor told him
it would be okay.
RE: EMBLEM FOR LOGO
Mayor Porter showed .the council a round emblem he had had an artist at Art Craft draw
from the Logo. This emblem we would be able to put on our cars.
RE: MAYOR DISCUSSED A WATER ACCOUNT
Mayor porter discussed a water account. There is a rule that when there is a large
water leak the city will cancel 2 month bill but .then from then on if they .don't get
it fixed they will have to pay the entire bill. There was a woman with five children,
Michelle Dass, and she didn't know there was a leak because we haven't been reading
the meters during .the winter. When we had the read in the spring, the first month
she owed $102 in addition to what she had been paying. We figured it for just one month
and it reduced it $5.06 on the water and $14.96 on the sewer, he said he was inclined to
suggest that we should figure what it would .have been ordinarily and charge her that.
Nile Boyle said that Verla Parkinson had got a $53.00 bill because it was not read
correct last fall, which was not her fault, she had been billed the minimum and lives
alone and suddenly she gets this big bill.
