State of Idaho) County of Madison( City of Rexburg) A Meeting of the City Council for the City of Rexburg, Madison County, held February 17, 1982, at the City Hall. Present were the following: Mayor: John C. Porter Councilman: Glen Pond Jim Morris Sander Larson Nile Boyle Morgan Garner Councilwoman: Darlene Blackburn Also Present: Rose Bagley, City Clerk Mary Smith, City Attorney Richard Horner, Treasurer A motion was made by Nile Boyle and seconded by Glen Pond to approve the minutes. All Aye. RE: SCOUTS ATTEND THE MEETING TO REPORT SCOUT ACTIVITY FOR 1981 Mayor Porter introduced the Targhee District Scouts, who were attending the meeting as part of Scout week.. Dean Grover told the council the Targhee District Scouts wanted to report the scout activity for 1981. Ryan Dabell gave a report from the Cub Scouts. Brad Edwards gave a report from the Boy Scouts. Johnny Watson gave a report from the Varsity Scouts. Dean Grover gave a report from the Explorers. Mayor Porter said that the previous Sunday night he had participated in a Court of Honor at the 5th Ward, where they presented three Eagle Awards. RE: SEWER CHARGES Mayor Porter discussed with the council the sewer charges. He and Richard had met with Ricks College and gone over the charges with them. A sheet was handed out to the council which gave the various rates. He said that they had revised the schedule a little from the rates that Community Consultants had made up for us. If we adopt anything on this schedule it will mean every body that uses sewer will pay their share of the usage. He said after looking at the various schedules, we agreed the best one was the one that shows the base rate of $2.50 base rate and the volumn charge of 1000 gallon for 34C. A widow who lives alone will pay a lot less than a big family or a big user. The total amount they had come up with to charge the college was $23,656, they resisted us making them pay the full amount the year around. In the four months of the summer their use is only a third of what it is in the winter. In the winter time we have no problem, because all the water going through the meter would go into the sewer system. In the summer time when they are irrigating and things of that nature it would be hard to tell how much water goes into the sewer. Forsgren Perkins has some flow meters and for one week we can put these meters in the sewer line and get an accurate reading of the summer use, and then we will base the fee on that. This year that amount they budgeted for they will pay which amounted to $5000 more. Changing the volume charge from 31C to 34~ will make up the difference in the amount we charge the college, than is on the study. Mayor Porter told the council the budget which would be set this fall would be set from the previous winter usage, and the rates would be reset each year. A motion was made by Nile Boyle to pass a resolution to adopt and set the sewer rates as recommended by the Community consultants making the rate $2.50 as a base rate and 34~ per thousand gallons. All Aye RE: ORDINANCE N0. 645 AN ORDINANCE DECLARING ITS PURPOSE TO BE TO PROTECT AND IMPROVE THE PUBLIC HEALTH OF ITS CITIZENS, TO REQUIRE MANDATOP.Y CONNECTION TO SANITARY SEWER, ESTABLISHING DOMESTIC RATES AND COMMERCIAL RATES INSIDE THE CITY, ESTABLISH CONNECTION FEES, ESTABLISH RULES FOR CONNECTION, ESTABLISHING DOMESTIC RATES AND COMMERCIAL RATES OUTSIDE THE CITY: ESTABLISHING BILLING DUE RATES AND PROCEDURES FOR THE COLLECTION OF DELIQUENT ACCOUNTS OR DISCONTINUANCE OF WATER SERVICE IN THE EVENT OF DELINQUENCY: PROVIDING FOR PENALTIES FOR VIOLATION OF THIS ORDINANCE: SETTING FORTH THE MANNER IN WHICH ITS PROVISION SHALL BE ENFORCED: REPEALING ORDINANCE N0. 638 AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH: PROVIDING FOR THE PUBLICATION HEREOF: AND THE ESTABLISHMENT OF AN EFFECTIVE DATE. A motion was made by Jim Morris and seconded by Glen Pond that the .rules requiring an ordinance of a general and permanent nature be read on three occasions be dispensed with and that said ordinance be numbered 645. The mayor then called for the voting for final passage of the ordinance, and .the motion was made by Nile Boyle and seconded by Jim Morris that ordinance 645 be passed. Those Voting Aye: Those Voting Nay: Darlene Blackburn Glen Pond Jim Morris Sander Larson Nile Boyle Morgan Garner None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said Ordinance, and that said Ordinance was duly and regularly passed. Mayor Porter declared the motion carried. ORDINANCE 646 City Attorney read ordinance 646 for LID 24 for sale of bonds, balance due $51,943.93. This ordinance will made it .possible for us to sell the bonds, tae can't find a buyer so we are buying them ourselves. This is set over 10 years at 9i'. A motion was made by Glen Pond and seconded by Sander Larson that the rules requiring an ordinance of a general and .permanent nature be read on three occasions be dispensed with and that said ordinance be numbered 646. The mayor then called for the voting for final passage of the ordinance, and the motion was made by Nile Boyle to adopt the ordinance and seconded by Jim Morris. Mayor Porter declared the motion carried. ORDINANCE 644 City Attorney read ordinance 644, for LID 25 to establish parking lots. This ordinance will also make it possible for us to sell the bonds and buy them ourselves. The amount paid on them was $34,381.22 which leaves a balance of $115,618.78. These are at 10 years at 10%. April 14, 1982 As you are aware, Mr. Palmer asked our firm to assist him in deter- mining his water consumption, water meter accuracy, water leakage potential, and sewage discharges. In October we furnished a sewage measuring flume to Mr. Palmer. Throughout the winter flow measurements have been taken. We tested the 8" compound meter on September 9, 1980 and found it. to be accurate. A copy of the report is attached. Since that time the registers on the meter failed. and new registers were installed. The 2nd meter serving the area was inspected and we attempted to make a test but found that the meter installed was not an acceptable meter for this installation and this meter has since been changed. Mr. Palmer asked our firm to test both meters this spring. Both the 8" Badger compound and the 6" Rockwell compound meters were tested on April 1st, 1982 and found to be accurate. Water Consumption We have taken water meter readings on the 6" meter at various times of day and night. Minimum flows 12 midnight to 5:00 am - 3 GPM (The meter stops running for short periods of time) Average flows 5:00 am to 8:00 pm - 5 GPM Maximum flows 7:00 am to 9:00 am, 4:00 pm to 8:00 pm - 20 GPM ,. _. • rt L Meter Reading on the b" meter Meter Reading on the 6" meter Total Gallons in 13 days Average Gallons per day Projected Gallons in 30 (October through May) 4/8/82: 009388600 4/lb/82: 0096234?5 = 234,825 = 18,063 days =.541,904 The last few months .the estimated usage was as I recall 793,000 gallons per month. We found no leakage potential. Sewage Flows Our measurement of sewage flows totals average 14,674 gallons per day or 440,220 gallons for 30 days. Thd difference between the average water consumption of 18,603 gallons per day and sewage flows of 14,674 gallons is normal.. The difference being 3,929 gallons divided by 328 people who occupy the park is 11,97 gallons per person difference. This would be in any u sed inside or outside that would-not go into the sewer system. Average daily water use 56.7 gallons per person (18,603: 328) Average daily sewage discharge 44.73 gallons per person (14,674 328) We recommend that the 8" meter not be used. RE: MATTER OF LEGISTURE - LITTLE DAVIS BACON ACT One other matter of legisture the mayor was interested in was .the repeal of the Little Davis Bacon Act. All Council members was in favor of it. RE: USE OF NEW SEWER TRUCK The mayor told the council that from time to time we have requests to use the Sump Truck. He felt that we should charge $l00 per hour plus a man out of the city, and $30 per hour for anyone on the sewer in the city. A motion was made by Glen Pond and seconded by Jim Morris to adjourn. All Aye. A group of boy scouts were present at the meeting. RE: REPORT ON WORKMANS COMPENSATION Mayor Porter reviewed a report from State Insurance Fund on the City's Workmans Compensation, and the accidents that .had occurred in the last six. months, and the pay off for these. They had paid to employees of the city $55,067.87. He ask the council to encourage the department head that they were in charge of to try to get the men to be a little more careful, because the more the company pays on claims the higher our premium is. RE: CITY TO START PROCEEDINGS TO EXCEPT STREET IN MILLIiOLLOTv~ MEADOWS The mayor said Gene Palmer had been in to talk to him, he has a problem in the trailer court. Cars speed through the trailer court and there are cars parked in .the street and he can't get them to move. When he checked with the police, they say it is a private property and they can't do anything about it, the mayor had told him he would check with city attorney. She said she was sure that was true, but she would check on it. The mayor ask the council if they had been to the trailer court to look at the streets that he had requested to be excepted by the city. The council thought they should go ahead and start proceedings to except the through street on the west o_f_ the trailer court that goes through to the west of the trailer court through to the residential area. Mary Smith said he would have to deed it to the city. The mayor said he would contact him and tell him.
