Attorney Rose Bagley, City Clerk RE: RESOLUTION WITH IDAHO TRANSPORTATION DEPARTMENT WO WIDEN CANAL BRIDGE ON S 5 W Mayor Porter read a resolution agreeing to participate in Project M7716(003) with the Idaho Transportation Department to widen the canal bridge on South 5th West. A motion was made by Darlene Blackburn and seconded by Nile Boyle to pass the resolution. All Aye. RE: DICK GRIGGS CLAIM DENIED A motion was made by Nile Boyle and seconded by Darlene Blackburn that the Dick Griggs claim in the amount of $1301.86 be denied inasmuch as there is no easement on the property and the orginal agreement expired several years ago. All Aye. RE: PROBLEMS WITH THE $25.00 METER DEPOSIT Mayor Porter told the council that a lot of problems have come up with the $25.00 meter deposit .that is required for new water connections. A motion was made by Nile Boyle that only people renting homes or property be required to pay the deposit: home owners or people. owning the property would not be required to pay the deposit, and the deposits be refunded to the home owners who have already paid deposits, seconded by Glen Pond. All Aye. A motion was made by Morgan Garner to approve an agreement with the Union Pacific Railroad to widen the crossing at 4th West Street - 48 feet, 2nd South Street - 24 and 1st South Street - 32 feet. The cost to the city would be $8387 and the work would be done by the Union Pacific Railroad, seconded by Glen Pond. All Aye. A motion was made by Darlene Blackburn to adjourn the meeting at the City Hall and go on a tour of the new sewer plant, seconded by Morgan Garner. All Aye. Porter Councilman: Jim Morris Glen Pond Sander Larson Morgan Garner Nile Boyle Councilwoman:Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bab~ley, City Clerk feet, ,~- A motion was made by Glen Pond and seconded by Sander Larson that the rules requiring an ordinance of a general and permanent nature be read on three occasions be dispensed with and that said ordinance be numbered 644. Those Voting Aye: Darlene Blackburn Glen Pond Jim Morris Sander Larson Nile Boyle Morgan Garner Ordinance 644 was then placed before the for final passage of the ordinance, and the ordinance and seconded by Glen Pond. Those Voting Nay: None council. The mayor then called the voting the motion was made by Nile Boyle to adopt Those Voting Aye: Those Voting Nay: Darlene Blackburn Glen Pond Jim Morris Sander Larson Nile Boyle Morgan Garner None The roll showed all councilman present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said Ordinance, and that said Ordinnance was duly and regularly passed. Mayor Porter declared the motion carried. RE: DISCUSSION ON ADOPTING STREETS IN MILLHOLLOW MEADOWS Mayor Porter said there had been a lot of controversy over the .city removing the snow for a fee at Mill I~oilow Meadows. Wher_ we adopted the plat for Millhollow Meadows, it was suggested that the road on the west end. of the trailer court, Syringa, be made a public road. This was opened up so the people in the sub-division use this road as a public road. We cleaned the snow on Syringa and on the road on the east end of the. trailer court, Lilac, and in between there and he is paying for it. He would like to give us that road. It is a 60 foot right-of-way and is 44 feet from .:curb to curb, so it fits the specification for a street in P~exburg. He would also like us to take Lilac as a city street. Earl Kemp saki they were built with good specifications. Nile Boyle suggested that ~,ae take it uia.d.er advisement for two weeks, that would give the counciJ_ a chance to go up and look at it. RE: PRECOT~TSTRUCTIOPv' MEETING IN RIGBY ON BP~IDGE ON 5th T,-BEST Mayor Porter said there is going to be a preconstruction meeting, in Rigby on February 26 at I:.30 P. M. to meet with the contractor that is going to build the bridge on 5th West. He ask Jim ;orris to attend the meeting. RE: RE-NEGOTIATION ON IRRIGATION DISCUSSED, ALSO POSSIBLE BULB TURBINE Mayor Porter said that last year we made a contract with Teton Pipe Line and Rexburg Irrigation in the Resolution we said we wanted to re-negotiate every year. T1e also got a letter from the State Department of Water Resourses saying when we re-negotiate it we should write a _letter to them telling them how much. water each of those companies should get and how much we are retaining for the farmers that we serve on the Fast side. He said he thought we should immediately set up a meeting so that by the end of March *ae will have it all taken care of. bast summer Rexburg Irrigation became convinced that they were going to get quite a lot of water through the waste ditch. They get 7CFS now and if they can get by with 6 CFS, we can sell one more and get more money. We will also be dumping the waste water from the Lagoons into the canal too. He said Tae have 27 CFS in the Teton River at the .present time the old Teton Dam is sitting up there, and if nothing is going to be done with it we could enter into a contract with the Utah Power & Light by using our half of the .water to put in a Bulb Turbine, they migrit finance it and we would sell them the power. There may be another place along the river that we could use part of the water rite and develope a power project. He said that is wry we should hold onto our water rites, we should also put in a flow meter in the wastewater to find out just how much flow is going out there. We will have a flow meter in the flow going into the canal. ~~ With the various sources we have we might find a place for power resource. It may help to keep our power rate down. He said he would. write a letter to both of these people and tell them we want to set up a meeting and go over the whole thing with them and see what we can do. RE: SOROPTIMIST CLUB GIVES $196.70 FOR DRINKING FOUNTAINS AT SMITH PARK The mayor told the council that the Soroptimist Club is going to put a couple of water fountains in at Smith Park. They have given us a check for $196.70 for two drinking fountains, and the water department will install them. RE: DISSUSSION ON SOUTH REXBURG ARTERIAL ROAD Earl Kemp and .Clint Kingsford was at the council to discuss the South Rexburg Arterial Road. They handed out sheets on the costs. (attached) Earl Kemp said. they would let us go ahead with a 34 foot road. the whole way. They will let us .put in two lanes on a preliminary phase, they will fund .right-of-way aquistion at 19% local costs. Now due. to the fact that the .city has adopted the new map showing 2nd East and Znd West as main arterials, they will fund the improvement on 2nd East and 2nd West as part of the project. Clint Kingsford said they .got a letter approving the 4th Alternative but they stipulated that to get that approved they would have to approve the short section from the intersection at 9th South. Deloy Ward was at the meeting to discuss how this road would effect his property.. Mayor Porter said it. was evident that the one everyone thinks will be used the most is the one from highway 191 over to at least 1st West over to the college, the one to 2nd West would be the best way to go on the first phase. The city council was concerned as to where the money was coming from for the road.. Earl Kemp told the council they could make the application for the road and then either drop it or postpone it if the money was not available. The application is sent in and they process it and if they approve it then you have to send, in a basic fee for them to .review the plans, then you can start surveying and come uu with the preliminary plans, once you have them done then you have to go through another hearing, that is called a design hearing where everyone would. have their input. Total engineering on the whole project. would be 10 to 15%. To make the application would not cost anything and then if it was approve you could decide if you was going ahead with it, which could take a while, and then they ask for some and it is credited to the local share. Mayor Porter said he thought we should at least get started with the plans, and then people would at least know where the right-a-way is going to be. A motion was made by Nile Boyle to go ahead and submit the application only, seconded by Sander Larson. All Aye. RE: MEETING WITH RCD AT THE ASC OFFICE Mayor Porter told the council that last Tuesday he attended a RCD Meeting at the ASC office, we are a member of this organization. They have a program where they can get money for conservation projects. They want to go ahead if it is alright with us and get the farmer to go .along with it and they will bring a terracing machine in to do terracing on the farms and on the college property. The Soil Conservation think they can pay for terracing up to 60% to 70%. They will have meetings with the college and farmers and get it all put together. We will get it worked out and eliminate a lot of the silt that is coming from the farm ground now. The other project is one the county have with them and is on the Erickson Road and also on the Millhollow Raod is in the borrow pits, to have a retention wall put in. This will make it so instead of the water coming along in the borrow pits and washing away the road it will help prevent it. RE: BILL INTRODUCED TO INCREASE GAS TAX 1~ There has been a bill introduced by House Transportation Department Commettee the number is 662 to increase the gas tax from 112 to 122, this incease of 1G will go directly to cities and counties. If that bill passes it will give Rexburg an additional $26,9.88, this will be our share out of the find. There is a trend through out the country to go with users fees. He said he would like to have the council's permission to write to our senators and representatives and tell them the council would appreciate them voting for this bill. The council all agreed with the mayor. RE: REQUEST TO PUT VENDING MACHINE IN CITY HALL Mayor Porter told the council that a man had been in the office that wanted to put a vending machine in the City Hall. The council decided that we did not need it. RE: BILLS PAID A motion was made by Nile Boyle to pay the bills and seconded by Sander Larson. All Aye. RE: DISTRICT SIX CLERKS AND FINANCE OFFICERS MEETING Mayor Porter told the council that there would be a District Six Clerks and Finance Officers meeting at the city hall tomorrow. ~~^ A motion was made by Darlene Blackburn and sconded by Sander Larson to approve the minutes. All Aye. RE: PROBLEMS ON SNOW REMOVAL Mayor Porter said there had been one or two problems that had .come up this week about snow removal. Previously the council had decided not to haul the snow away. What has happened. at the intersections where we are piling it up is creating a traffic hazard. Down by the courthouse, the cars going east on Main Street when it is piled up there they cannot see if they are going to make that turn or go straight, so the peoples that are going north on that intersection sit there and sit there to make sure they arn't going to go out there and get hit. The other intersection is up on 3rd East and Main, cars going South .can`t see a car that is going up to the hospital, there has been three or four near misses up there. He said he rad told Farrell Davidson to haul some of that snow away. RE: POSSIBILITY THAT NATIONAL GUARD OR ARMY RESERVE COULD HELP WITH SNOW REMOVAL Jim Morris suggested that we contact the National Guard or the Army Reserve and see if we could get them to help haul snow. Mayor Porter said the National Guard would be the ones to get to do it, and he would ask Farrell to contact them. RE: NEW LIGHTS ARE PUT IN RESIDENTIAL AP.EAS, & WILL BE PUT IN BUSINESS DISTRICT SOON The mayor told the council the Utah Power & Light Company have all the new lights in the residential area, but they haven't changed the ones on Main Street. Jim Morris said he would get the master plan and check it to see the lights are all in. The Utah Power & Light had given the mayor a bill for $2922 to put the lights in, Jim Morris said that was the amount that we had agreed on. RE: INSURANCE BIDS DISCUSSED The council discussed the insurance bids. Jim Morris said we would familarize the council with the bids but we have not had time to evaluate them yet. According to the bids Archibalds was lower than the rest of the bidders.. Jim Morris told the council that a meeting had been set up for Thursday afternoon to go through the three apparent low bids. Farm Bureau 19,513 Homer I~oster 21,110 Moreton & Company 19,236 without the blanket $14,900 Dietrich 18,889 Archibald 18,123 without the blanket 14,522 RE: LETTER WRITTEN TO GRIGGS REALTY INFORMING HIM HIS CLAIM WAS DENIED Mayor Porter told the council he had written a letter to Mr. Griggs at Griggs Realty informing him that the city had determined that they had no city funds that could legally be given to Him to help with the cost of re-establish the sewer line. Nile Boyle said ir. two weeks if r~r. Griggs has not started doing something abut the cars and bilges and junk on his property on West Main, the city should write him a letter about that. RE: BUSIiVESSES NOT CLEANING SNOW FROPi IN FRONT OF THEIR BT.JSINESS Mayor Porter said their is another problem at a number of business houses around town that are not cleaning the snow off the sidewalks in front of their businesses. We have an ordinance that says that they have to. He suggested that if they are vacant, we clean the sidewalks and bill the owners. Teh ones that are iii business, have the police tell them that they have to clean them. RE: BUSINESS LICENSE APPROVED WITH STIPULATIONS FOR ROBER RO~~iBERRY _ The mayor read an application for a business license for Rober Rowberry to operate a mobile food business. He would have a truck with the food in it to sell. Sander Larson said there is no solicitors allowed on campus. It was decided that the license could be issued but he could not solicite and go door to door, he could only deliver food when he had orders by phone firs. ~~ RE: BILL RECEIVED FROM SCHOOL .DISTRICT FOR USE OF THE GYM Mayor Porter told the council that we had received a bill from the school district for the use of the gym for city basketball. Since the school is paying the crossing guards they think we .should pay for the use of the gym. He said there are a lot of kids in that program that are not in the city, even though we are paying the coachs and everything. The school superintendent wants to meet with us, and make up an agreement. He ask Jim Morris to call them and set up a meeting. RE: INSURANCE CLAIMS PAID Mayor Porter told the council to-look at the sheet in their folder which shows all the claims the insurance company has paid.. It was noted that the sewer line problem that they had recently had cost the insurance company quite a lot. The mayor said they had discussed that day doing something to train our operators to run the new sewer machine more efficient. The flooding was when the pressure went into the line,. it caused the flooding. He and De Lynn Edstrom had discussed it, and they are going to start using the rotor, it doesn't take so much pressure. He is also fixing a calender where he will clean out these lines regularly where we have been having problems. (sheet attached) RE: DISCUSSION ON ROAD TO BE BUILD WITH URBAN D MONEY - SOUTH ARTERIAL Earl Kemp told the council we had received work from the State Transportation Department telling us that we have a credit on our Urban ]~ money, this had been mentioned in the last council meeting. Federal-aid Urban Highway Funds are made available to cities over 5,000 population in the proportion that the city population bears to the total population of such cities in Idaho. One option on the road that had been discussed was a two lane road from Mill Hollow Road to 2nd East Street, the other portion of the project was a four lane road that would go eventually to the old highway, along 9th South. He showed a map showing the road and handed out a sheet of cost for the road from Millhollow to 2nd East. (attached) To explain the funding mechanism of Federal Highway projects, Option A - the funding mechanism allows the city to fund the project at 81% Federal Funds and 19% Local. Option B allows the highway department to fund 91% and 9% local. To be eligible for option B, however, the difference of the 10% has to be spent on a project concurrent at the sametime, so we looked at two options doing the piece from Millhollow Road to 2nd East and in concurrent with that improve the section of road from 7th South to 9th South with curb and gutter. One thing that is elgible for funding is land acquisitio Because this project would improve the ajacent land, one of the things that is very fesible is that we look at paying for .the land and assessing the land value back in an LID, .and you would raise the local share just in the cost of the land. This would effectively allow the Highway Department to fund their part. Mayor Porter told the council that we cannot sell our LID Bonds. We have already decided we would have to buy the LID 24 Bonds. He said he was going. to .suggest that because we paid for the city's share and the LID share from our street TEDRO money which was legal and we have been audited. Then as it is paid back we establish a street improvement trust fund, which is about $50,000 and with the interest would amount to about $100,000 in ten years. As that money is paid back we can put into the street improvement trust fund, and we can use some of the money for various projects. If we see fit we could use part of it to help with the balance of the match. If we started tomorrow to try to get that program going it is going to be two years anyway before we get it all put together. Richard had figured that we would be getting $9000 to $10,000 a year on LID 24 payback, that would be interest payment on the principal,. Earl Kemp said we need to get started because next year engineering cost will not be eligible, and will have to be picked up by the city. The year after that they are talking about doing away with federal highway trust money and giving it back to the states. The projects that are already committed will not be effected, so there is some need to get a committment on it. It would be almost tow million dollars to go from Millhollow to the old highway and make the connections. Mayor Porter said his own thinking would be that we would at least get started on I the first phase, Millhollow to 2nd East and then widen that down to the college where the curb and gutter quits, and by using the payback on the LID money, we would have our share. He suggested that we go ahead and make it in two projects, Gerald Taylor had called him and -said if we start on the lower end he would go on an LID and pay the city's share. T11~ council discussed doing the lower part of the road instead of the upper part and the cost being more, and the biggest traffic problem being in the lower part. Earl Kemp told the council to extend from 2nd West to the Highway would be about $600,000 which 9 % of it would be $54,000. With the aquistion of riglita-way then you are talking about having to raise $77,000 to do the project under clause B and during the same period of time we would have to spend $88,000 on city roads. The entire project would take five or six years. Mayor Porter said if we do the lower part there are a lot of things, we will have to condemn three houses. Nile Boyle said there isn't any doubt that you would have 20 or 30 times more traffic on the lower route than you would have on the upper part. Earl Kemp told the council that we could apply for the federal money now and tell them we are going stage construction. The council ask Earl if he would get all the figures together on the cost on the lower half of the road and bring it to the council meeting on Feburary 17, at that time a decision could be made. Nile Boyle said it sounds like what ever part we do last will be 10 years away and he said he wondered if we didn't need the lower part a lot more than the upper part. Jim Morris said we need to know how much. it will cost and where the money will come from. RE: RESOLUTION ON URBAN AREA MAP Mayor Porter said there is one other thing we need to do. Last Wednesday night, Clint Kingsford held a hearing for the Urban Area Map, no one attended the meeting, so the meeting was recessed until tonight. Mayor Porter read the resolution. This being a time set for a public hearing to review and comment on the Urban Area Map as proposed by the State Transportation Department and no one appeared before the council to comment. A motion was made by Morgan Garner and .seconded by Sander Larson to approve the Urban Area Map as submitted. Those Voting Aye: Morgan Garner Jim Morris Sander Larson Nile Boyle Glen Pond Darlene Blackburn Those Voting Nay: None Mayor Porter announced that the motion was carried by a voice vote. ~ RE: STOP SIGN AT CORNER BY CIRCLE K Mayor Porter told the council that we are still trying to make an effort to get a signal at the Circle K corner. He, had Blair Siepert compile all the accidents that had occured on the .intersection since,1979, 1980, 1981. Total accidents was 56 and damage loss $49,200, vehicles involved 144 and injuries 14. He took this down to the State Highway Department, and Ben Frank of the State Highway Department called the mayor and told him they are taking the road off the state highway system and he was doing his best to get the light in there before they do it. He said he had talked to several people including a member of the Highway Board and they think they maybe, in view of this report, can put a light in, because it is a lot more accidents than they have recorded in their study. He told Blair to get the accidents on the other intersections on both sides of it. A motion was made by Jim Morris and seconded by Nile Boyle to approve the bills. All Aye.
