MINUTES OF THE CITY COUNCIL MEETING
January 6, 1982
A meeting of the city council for the City of Rexburg, Madison County, held January 5,
1982, at the City Hall.
Present were the following:
Mayor: John C. Porter
Councilman: Jim Morris
Nile Boyle
Morgan Garner
Sander Larson
Glen Pond
Councilwoman: Darlene Blackburn
Also Present: Mary Smith, City Attorney
Rose Bagley, City Clerk
Richard Horner, Treasurer
A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the minutes.
All Aye.
MAYOR TELL COUNCIL THEY .HAVE DONE A GOOD JOB
Mayor Porter said since this is the last meeting before the newly elected officials are
sworn in, he would like to say that everyone had done a good job.
RE:COUPLE DAMAGES CARS IN SNOW DRIFT, WANTS CITY TO HELP WITH COST OF REPAIRS
Sander Larson said there was a matter that he would like to discuss, a couple had talked
to him about one day when the city was removing snow, the couple followed the snow plow
and the road that had been cleared abruptly ended in a big drift, because of the storm and
oor visability they drove right into it, there was no warning. It buried their car
d did some damage. Sander ask if there was anyway we could turn this over to the
surance company to look at. Mayor Porter said they had come into the City Hall and
lked to him. Sander said he was a little sympathetic, since they are a young married
couple trying to go to school. Nile Boyle made a motion to turn it over to the
insurance company, seconded by Jim Morris. All Aye.
RE: FARRELL DAVIDSON PRESENTS PROPOSAL OF SNOW REMOVAL
Farrell Davidson presented a proposal of snow removal which he had drawn out on a map.
This showed the priority that the plowing would be done in case we just go over 5 in.
of snow and unless we have a major storm, then we would plow the whole city. It is a
tentative plan of what we will plow and what we will sand, the different areas we will
plow to the center of the street, and the areas we will plow and wing to the side of the
street. It indicates the streets that will be plowed first. Mayor Porter explained that
the map would show the streets that would-be plowed immediately and then the rest would
follow. Jim Morris said one recommendation he would make was the farm to market
road, he wondered if they should make the loop up and tye into it. Farrell said he had
outlined the major arteries through town, the schools, churchs, and hospital as
priority. He also presented a sheet with snow removal costs on it. (attached)
Mayor Porter said he thought we should go along with the .map as outlined. He felt that
Farrell had done a good job. Farrell said he would post the map in the City Hall for
anyone to look at. He explained the red ink would indicate the priority plowing,
urple ink would show the area that we would plow to the center and haul off. He
id that past the city hall and in front of the fire station we would have to haul
e snow off to keep the fire station clear.
Morgan Garner said he had .some people mention to him what is the real purpose of
hauling the snow off and why the city doesn't use the money to clear more streets.
Farrell said he wo~~d consider this possiblity and pile the snow up. Nile said
we would have to be careful if we wing the snow to the side if we covered up
the sidewalks where there had to be traffic on the sidewalks, we might need to leave
the snow in the middle. Farrell said we would have to make sure the drains are
clear so when we do have a run off, and the crews will work on that as soon as the
get the streets cleared. There are some green "x"'s on the map which show the
major problems in the intersections that need to be priority on sanding. Nile Boyle
said he thought they are doing a good job.

RE: CITY ATTORNEY READS THE OATH OF OFFICE
Mary Smith read the oath of office to all newly elected officials to swear them in,
John C. Porter as Mayor, Jim Morris, Morgan Garner, and Nile Boyle as councilman for
a four year term, and Glen Pond for councilman for a two year term.
RE: PLAT FOR FAIRWAYS OF TETON LAKES PRESENTED BY ROSS REESE
Ross Reese presented a copy of a proposed plat and protective covenents of the Fairways of
Teton Lakes. It is a parcel of the ground that sets in the center of Teton Lakes Golf
Course. It is the remainder of the land that .was withheld when the land for the golf
course was given to the city by Howard and Robison. It was retained for the purpose of
a Sub-division. The lots are large, the ones that are around the outside of the plat
border the golf course. To meet safety standards plus an attractive entrance there
is a medium, in between the roads; there is a four lane divided street going into the
sub-division. It surveys the purpose of having two streets in the event there is an
accident in the sub-division, it is also a common area to the sub-division. It will be
maintained and signed making an attractive entrance to it, by the home owners association
by assessments of the people living in the sub-division. It also serves as an island
for people that finish up their golf on the 18th hole crossing over to the parking lot and
club house. Dotted lines on the plat are lots that are still owned by Howard and Robison
that were traded with the city and county for some property down below, those three lots
are not a part of the sub-division. Block 4 along with 2 and 3 are proposed condominum
locations. That area allows multiple housing, condominiums, town houses, cooperatives.
The lots are large and the protective covenents are extremely restrictive, very well
controlled sub-division. There will be no nuisances allowed. He said they were
proposing that they be allowed to have rolled edge curbe, there will be oiled roads and
curbs, sidewalks have to be put in within one year. They are proposeing city sewer and
city water. The sewer is under the highway and the water would need to be put under the
highway. Mr. Reese said he had changed the plat, in as much as he had not moved the canal.
They have had a lot of interest in purchasing lots.
Ross told the council that the Planning & Zoning had recommended annexation; as a developer
on it he would .leave the judgement to the P & Z and city council. If it is annexed
in the city it will generate considerable revenue through taxes. If it is in .the city,
the city would have the maintainance of the streets, the water and sewer. Ross said
his request was to not make him change in the middle of the stream, he wants to sell the
first buyer property on the same terms as the last one. If the city doesn't want to
annex their request was that the rates on the city sewer and water be the same as if
it were annexed, as in agreement of the gift of the land by Howard and Robison. They
would ask for that variance and also the rolled edge curb.
Mayor Porter referred to the minutes of February 14, 1979, "Barton Jensen suggested that
we give Howard and Robison credit for sewer and water for $9000, on hook-ups when he
deeds the land over to the city. The city will need a letter of intent. Barton Jensen moved
that we the city give a letter of intent. Morgan Garner seconded. All Aye." The mayor
also said that the land had not been deeded to the city, it was deeded to the county. His
feeling was that the city would allow the Sub-division to hook onto the sewer, but the
people that are building out there would have to pay the same hook-up fee as the people who
live in the city. Nile Boyle said he thought the council should study it for a couple
of weeks.
Earl Kemp said the reason they were bringing it before the council now is they need to
go ahead with the final plat with the sewer and water and the second reason was to give
the council time to decide if .they want to annex it into the city.
Ross Reese told the council what he would .like to have done tonight is to get preliminary
approval of the plat plus the approval of hooking onto sewer and water. Then the
engineering of the sewer and water can be completed so we can get the engineers drawings
to the health department, the county, the city. He said that as .soon as weather permits
he wanted to get out and cross the highway with the water line before they put the
surface on. His request for consideration was that if the city annex it we have no
problem with the exception of the rolled edge curb, and if they do not annex it then
he was asking for a break in .the rates, being the normal city water and sewer rate that
is charged in the city limits.
RE: MOTION TO APPROVE THE PRELIMINARY PLAT
A motion was made by Nile Boyle that we approve the preliminary plat and also give
preliminary approval on the water and sewer to the sub-division, seconded by Morgan
Garner. All Aye. Nile explained that, that was as far as the council could go on it
tonight, and then they would talk about the annexation and sewer and water rates at a
later date.

RE: MAYOR SUGGESTS THAT THE COUNCIL GO THROUGH THE SEWER PLANT
Mayor Porter suggested that the council go out to the new sewer plant and go through
it and look it over. It was decided that they do it on January 20 at 4:00 P. M.
RE: LIABILITY INSURANCE
Mike Jeppesen representing the Association of Idaho Cities, who was planning on bidding
on the liability insurance was present at the meeting. He said he would guarentee that
he could save the city some money, and give more coverage at a lower price. He said they
have about 70 cities in the state under the program. They also have what they call a
eturn premimum program, the way it works is if the insurance company makes a profit on
11 the members of the AIC program, they can return up to 25% of their premimum. Jim Morris
aid that we would compare his bid with some of the local agencies.
Gary Archibald of Archibald Insurance Agency was also at the meeting he said their company
was anxious to cut down his bid price as well as add some coverage to the city. He
had noticed on the bid some things were listed to be covered by insurance that he did
not think was necessary, and some he thought should be added.
Mayor Porter said that when the city received the bids they would study them over.
RE: NEW WATER SUPERINTENDENT
Farrell Davidson introduced the new water superintendent, De Lynn Edstrom.
RE: ALL DEPARTMENTS ARE WORKING WELL TOGETHER
Mayor Porter told the council that Farrell had all the departments caorking together.
When one department needed more help with snow removal or a water problem, men from
other departments switch over and help that department. The water department had
been taking down the Christmas decorations because th.e_ street department had been busy.
Gordon Nelsan and Louis Sommer from the sanitation and street department was at the
meeting as well as De Lynn Edstrom from the water. department. Mayor said they were doing
a good job.

A motion was made by Jim Morris and seconded by Nile Boyle to approve the commettees.
All Aye.
A motion was made by Darlene Blackburn and seconded by Morgan Garner to appoint
Nile Boyle as president of the City Council. All Aye.
A motion was made by Jim Morris and seconded by Nile Boyle to adjourn. All Aye.
