MINUTES OF THE CITY COUNCIL MEETING
December 16, 1981
A meeting of the city council for the City of Rexburg, Madison County, held December
16, 1981, at the City Hall.
Present were the following:

RE: BEER LICENSES READ AND APPROVED
Mayor Porter read beer licenses for:
Safeway, for sale of beer not for consumption on the premisis.
Rex Tac Inc. owned by Dean Hollist for sale of beer not for consumption on the
premisis.
Circle K for saile fo beer not for consumption on the premisis.
VI Oil for sale of beer not for consumption on the premisis.
A motion was made by Morgan Garner and seconded by Jim Morris to approve those
beer licenses. All Aye.
Hebden's Little Giant for sale of beer to be consumed on the premisis. A motion
was made by Nile Boyle and seconded by Darlene Blackburn. All Aye.
RE: AGREEMENT ON SEWER TRUCK
Mayor Porter told the council we have to approve an agreement with Rexburg and Sugar
City for the Sewer Truck. Richard and Rondo Barrus from Sugar City got together and
drew up an agreement. (copy attached) Everytime the truck is used we make a
charge of $30 per hour when we take it to Sugar City, Sugar City has approved the
agreement; if we take it to any other city we will make a charge of $100 per hour.
Jim ask about theuse of the truck locally for private use. The mayor said if it
was just here in town the city has just been going and cleaning them without a
charge, however Richard Horner told the council, the truck had been used at Idaho
First National Bank and they had charged them $100 per hour and they had paid it.
It was moved by Nile Boyle and seconded by Morgan Garner to approve the agreement.
All Aye. Richard also mentioned that the extra $70.00 per hour would be put
in a holding fund for future repairs.
RE: DICK GRIGGS REQUESTS THE CITY TO HELP OUT ON BILL FOR FINDING SEWER LINE
Dick Griggs presented a problem tothe council. This concerns a building on 22-26
Carlson Ave, the city purchased the property to the west of the building for a
parking lot. His building was where Bowen Shoe Shop, Hoggie Heaven and a T
Shirt shop are now. The building has a basement in it with a couple of toilets and
sinks down there. The basement wasn't rented for quite a while and last March
we rented it and the sewer plugged up. He had got the Toto Rotor and Gallup
Plumbing and they put their line in and it went out about 100 feet and hit something
hard and could never get through; that was when they discovered that the line had
gone under the old basement, which had been filled up. When his wife first called
about it, Mayor Porter thought the city could take care of it. The sewer line
had been crushed under all the debris that was used to fill the hole. In August
or September we decided we needed to get the sewer line fixed, and thought they
could dig down and find the line and get it repaired. The city did not have the
equipment to do it at that time, and H & K Contractors was doing work for the city,
so Mr. Griggs got them to dig down and .try to find the line and found it and followed
it out to the street about half way and lost it. So we abanded the project and
decided we would have to go inside and go out the back of the building and put in
a pump, the sewer in back of the building is quite a bit higher. Our bill was
$1058 from H & K Contractors for search project and the plumbing and roto rotor was
about $250 and the total bill was $1301.86 and we still don't have the sewer; we
wondered if the city would help out on the bill.
Mayor Porter said after Mrs. Griggs called him the first time he had gotten in touch
with the fellow who orginally put the sewer line in, Dwayne Wilding. He still has
the contract for the easement that he had with Tanner who owned that property, but
it was about 30 years ago and was only for about 5 years. When the city purchased the
property from Tanner we had a title search and it did not show any easement on the
property, so it came as a surprise to me when Mr. Griggs told me the sewer line
went under the old basement, and talked to Dwayne Wilding and he said they had just had
a floor drain and hooked on to the floor drain by the furnace, and that is why Tanner
would only give them a five year lease. Then we let a contract with H & K to pave
the property and finish it, and the reason I told Mr. Griggs I thought H & K should
do the digging was because no matter who did it, they would have to guarantee that
when it was filled again it would not sink, so I thought it would be better for
you to hire H & K in the first place to do the digging because it would be easier
for them to repair it than if you got somebody else. When I told you to get H & K
I thought you understood that you would have to pay for everything. I did not at
anytime authorize the digging with the idea in mind that the city was going to pay
anything. When we first started to fill the hole up it belonged to Tanner. We
started to put big rocks in it because they came and ask us to because it was a
big hazard. Morgan Garner suggested that the council table it until the next meeting
to make a decision.
RE: CHIEF OF POLICE DISCUSS CARS AND JUMK STORED ON MR. GRIGG'S PROPERTY
Blair Siepert, Chief of Police, told the council he would like to mention while
Mr. Griggs was there, that as they are patrolling they have noticed his property
and all the bikes, old cars, and car parts, and it is starting to appear to them to
be an old salvage yard. He had been going to talk to Mary about this; if it was
out of the city, the county or state would require that a fence be put up. Mr.
Griggs said his son had been working on the cars to get them ready to sell, and
he will be home from college soon and will clear the cars off, he would also try
to get the bikes cleared off. Chief Siepert said there was one other thing
that should brought to the attention of the council Hollist has several abandoned
vehicles behind their business, cars they have used in those derby crashes.
RE: BLAIR PRESENTED PROPOSED BUDGET REDUCTIONS FOR POLICE
Blair Siepert handed out a copy of his proposed budget reductions. (copy attat:zed)
He explained the elimination of the one dispatch position would be filled by the assistant
secretary, Janet Statham. She will be moved into this position at the same wage the
senior dispatch is getting, she would be considered the senior dispatch at that time,
hopefully we can get our reports typed up at the same time while she is dispatching,
she will work straight day shift.
We will eliminate Tom Leman's position, and he has been given notice, there is some
consideration apparently by the college at this time to give him a position in their
department, but it isn't final.
There are other cuts, and some might be hard to live with. He ask the council for
their assistance with the crossing guards to get it out of his salary budget. They
would eliminate all training, and travel to meetings, which are important to their
department as well as the city. Freeze all step increases and rank, and cut half of
their overtime which would be hard to do.
In April he would go back through the budget and see where they stand, and possibly
more reductions at that time. He said he had four people who are seeking employment
elsewhere. It is very unfortunate, because we are talking about senior men who have
been with the department for four and five years, and of course we have a lot of
dollars invested in them. He is looking at eliminating the reserve program, and
going to the Cadet type program azd'there,wouldn't be any money put out by the
city. This would be working with the older married students from the college and
they would receive some sort of credit in their police sciences. We would use
them on a regular basis downtown to cover some of the slack we will have. He
said he hated to loose Tom Leman, he was very experienced and had been doing the
crime prevention, but he has only been with the department for eight months. The
next man to leave would be the K9 officer, Darrell Pettersson, and the next would
be Dan Pettersson, who will be given notice in April.
The county has raised the prisoner fees and we will see an extra four or five
thousand expenses, we had not anticipated. The meals use to run $2.00 a day
and now they have moved it up to $7.50.
The mayor told him he thought they could get by with the way he has it this year,
the only problem is next year he would have the same thing again. There doesn't
seem to be any change from the state. Sometime during the year when someone
resigns the thing tow do is not replace them.
Blair said they would certainly run into service problems, they would not be
able to cover some of the things, the public will just have to expect that, the
calls will have to be delayed.
RE: MAYOR PORTER QUESTIONS BLAIR ABOUT THE DOG PROBLEM THEY HAD ON SATURDAY
Mayor Porter ask about a dog problem that they had had on Saturday, and had had
trouble getting the dog out of the dog pound, and then had paid overtime to the
dog catcher to get the dog out, when the officer on duty should have been able
to do it plus it took three or four hours to do it.
RE: CROSSING GUARD TO BE ELIMINATED
Jim Morris said in order to make this budget work we would have to get rid of the
crossing guard. A motion was made by Jim Morris to notify the school board that as
of January 1, 1981, the crossing guards would be eliminated as far as the city
is concerned, seconded by Nile Boyle. All Aye.
RE: CHANGE IN SEWER AGREEMENT WITH SUGAR CITY
Mayor Porter said when we started in on the sewer project, we entered into an
agreement with Sugar City on the pipeline. After we checked over the agreement
there was one part of it we noticed was pretty hard to live with, "Any connections
made to this new trunk line outside the corporate limits of Sugar City or any
annexed area shall be assessed $9.50 per equivalent residential unit for the purpose
of reimbursing Sugar City it's share of the costs." So they had the idea that that
half went to them too. There were two or three other things in there we discovered
that should be changed, so now we have a new agreement. We changed that part so
they get everything north of the Moody Road and we get everything south of the Moody
Road. The council gave their approval for the Mayor to sign the agreement.
RE: COST OF A SPEED DIP ON MILLHOLLOW
Jim Morris ask Earl Kemp what it would cost for a speed dip on Millhollow. Earl
said it would cost about $18 a foot total of about $500.
