HomeMy WebLinkAbout1981.11.04 CITY COUNCIL MINUTESJim Meyers told the council they are controlled by the college on the rates they can charge for rent on the apartments, so he cannot increase the rates to pass on the increase in utility rates. He said they are running about 74% full. Kent Jolley - Speaking for all the apartment owners, he said they realize the responsibility the council has, and that the council is their representatives, they have elected the council and mayor to exercise their best discretion and judgement in these matters, and the only reason they were at the meeting was to offer information to help the council make a decision. We want to be fair and support our local government. We feel the council and mayor are doing an excellent job. We hope you will consider all the factors we have talked about. Kent Jolley ask if there was different rates for businesses and industrial, for example would the rate for the Racquet Ball Club be different than possibly Flamm Funeral Home. Earl Kemp said there was a different rate schedule for not only flow but for strength of flow. Mayor Porter said he thought we should check the rates in different cities. Richard said he had checked with several cities about 8 months ago and most of them range from $5.00 to $8.00. He said if we do something that is inequatable the EPA will throw it out. Earl Kemp said the only thing that EPA controls is treatment costs, the city man power or anything else has nothing to do with EPA. Meeting Adjourned. May John C. Porter City Clerk ose e MINUTES OF THE CITY COUNCIL MEETING November 4, 1981 A meeting of the City Council for the City of Rexburg, Madison County, held November 4, 1981, at the city Hall. Present were the following: Mayor: John C. Porter Councilman: Sander Larson Morgan Garner Glen Pond Jim Morris Councilwoman: Darlene Blackburn Also Present: J. D. Hancock, Attorney Rose Bagley, City Clerk Richard Horner, City Treas. RE: MINUTES A motion was made by Morgan Garner and seconded by Darlene Blackburn to approve the minutes. All Aye. RE: CANVASS OF VOTES Mayor Porter preceded with canvassing the votes. He told the councilman there was a sheet in their packets, giving the precinct and the amount of votes on each person and the votes on the override election, he told them there are soem write-in which are listed on the Tally Books. Mayor Porter read through the Tally Books and checked the addition. There was two corrections on the addition to Precinct #1. Yes votes for the override was corrected from 79 to 69 and votes received for Glen Pond was corrected from 167 to 157. Porter, Jim Morris, Nile Boyle, Morgan Garner, and Glen Pond winners. All. Aye. The Council gave the City Clerk a vote of thanks for handling the election in the manner she did. RE: PRISONER MEALS Jim Morris reported the prisoner meals have gone form $2.00 a day to $7.50 per day. He said they were going to try to get the judges to consider this in their fines. RE: REPORT ON STOP SIGNS (1) To stripe the center line on the truck route on lst North by the elevators. Mayor Porter said he would check with the State and see if they would do this. (2) There is a problem on the corner of Park Street and 5th West- the bushes make it hard to see the traffic. Jim would check this further. (3) A stop sign at the top of Millhollow, coming down going North, A motion was made by Nile Boyle and seconded by Darlene Blackburn. All Aye. (4) Stripe the center line by the hospital on 4th East on both sides of the streets. (5) Parking problem in front of Kennedy School, making it no parking in front of the school on the one side of the street by the school. A motion was made by Nile Boyle and seconded by Morgan Garner. All Aye. (6) four-way stop 2nd South and 3rd West changed to through traffic going East and West, a motion was made by Sander Larson and seconded by Morgan Garner. All Aye. (7) place a stop sign at the exit of the old hospital parking lot, a motion was made by Morgan Garner and seconded by Darlene Blackburn. All Aye. (8) stop sign on lst North and Millhollow Dr. put stop sign to stop them on lst North. A motion was made by Glen Pond and seconded by Darlene Blackburn. All Aye. A Zoning Hearing was held at 8:00 P.M. to change the zoning on the corner of Ash and East Main on the South side of Main Street. The Planning and Zoning Committee have already approved it in their meeting. No one was present to protest. Glen Pond ask if they had got a signature from Mrs. Hill. Carl Smith said Mr. Hill had signed it but Mrs. Hill had not signed. He also had not been able to get Erma Harris' signature because she had been ill. The mayor said under the ordinance it was required they have 80% of the property owners signatures and they have more than that on the petition, the council will still have to approve the plat. Dr. Dave Crandall and Dr. Allen Workman, the two doctors who plan to build on the property were at the meeting. RE: ORDINANCE NO. 643 Mayor Porter read Ordinance No. 643. AN ORDINANCE AIENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, TO PROVIDE THE CERTAIN PROPERTY HEREINAFTER DESCRIBED LOCA'ED WITHIN THE CITY OF REXEURG, MADISON COUNTY, IDAHO, BE ZONED LIMITED COMMERCIAL FOR PROFESSIONAL OFFICES ONLY. A motion was made by Councilman Morgan Garner and seconded by Nile Boyle that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 643. Darlene Blackburn Sander Larson Morgan Garner Nile Boyle Jim Morris Glen Pond None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council have voted for the passage of said Ordinance, and that said Ordinance was duly and regularly passed. Mayor Porter declared the motion carried. RE: BEER LICENSE Mayor Porter read a renewal for a Beer Lecense for Skaggs, for the sale of beer not to be consumed on the premises. A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the license. All Aye. RE: DISCUSSION ON SEWER RATES Kenneth Hacking and h1_s wife, who own a trailer court, were at the meeting to observe the discussion on sewer rates. Mayor Porter ask the council to look at copies of sewer charges from various cities. The Mayor said after studying all of these he had become confused. He and Richard had taken several formulas to try to come up with something that would be equable. They first thought they would take the water meter reading and take a 3000 unit and we would come up with something for apartments that are only 75% full, and we could go with that formula, but after_ Richard figured out that the students are showering so much their bill_ would be quite high. Student housing that have six students in each apartment use a lot more water than a residence. He told the council rather than spending a lot of time at council meeting, he had come up with doubling the sewer rates for the time being, and then make further study, this would make the residences $5.00 and the apartments and trailers $2.50. We would use this rate with the understanding that in 30 or 60 days after we have time to make a study we would change it. The council discussed going with the amount of water used. Nile Boyle said if the city could go by the use of water no one could claim discrimination. Ken Hacking ask the council if they figured the sewer by the water usage, how it would work when people were irrigating their yards. The Mayor told him it would be figured on the usage in the winter months only, January, February, and March and average that. :Nile Boyle ask about a place like the Raquet Ball Club, they would use a lot of water, the High Schools would use a lot of water for the gym classes shower- ing. Mayor Porter said when we passed the ordinance, Earl Kemp had told the council it was 350 gallons per person and he came in last week and told us it was only 50 gallons per person he had made an error, so we changed it from 350 and it makes it 3000 a unit, but there is no reason we can't change that. We have got to come up with a formula of somekind. The Laundry Mats, Flower Shops will have a big bill if we go by water usage, so we will have to have a formula. RE: RE: RE: RE: RE: Sander Larson suggested the City get Community Consultants from Provo to come and make a study and come up with a formula. The Mayor told the council he had the idea the 1980 census was 5.2 per household, but we went into ECIPDA office and had them check with the 1980 census. There study was as follows: Persons in rental units - 5865 Persons in owner occupied units- 4851 Rental units- 1,658 Owner occupied units- 1,322 2,980 Persons per rental unit. 5865 = 3.54 1658 Person per owner occupied units = 4851 = 3.67 1322 A motion was made by Jim Morris and seconded by Morgan Garner to go ahead with doubling the rates, making them $5.00 for residents and $2.50 for each rental unit, and in the mean time a study be made so we can find out just what to do on the rates. All Aye. PARKING PROBLEM AT SUMMER SET APARTMENTS Mayor Porter ask Jim Morris if he would go up to Summer Set Apartments owned by Kent Jolley. They have a parking problem when the students families come to visit, they have no place to park. They would like to have one or two parking spots for restricted parking. ALLEY BY MANWARINGS Jim Morris reported he had gone over and talked to Var Manwaring about the alley, and he didn't know anything about it, so he told them to work it out and then contact the city. BILLS A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the bills. All Aye. BIDS FOR NEW POLICE CAR Mayor Porter read the bids for the new police car, there was bids on two cars, but now we will only be able to buy one. Stones Town & Country - $10,421.35 per unit, for a Dodge Taylor Chevrolet - Impala 4 door sedan - $11,336.50 Malabu 4 door sedan - $10,975.50 The mayor said he would turn them over to the Police committee. The bids were over the budget figure, and would probably not be able to except the bids. The mayor said it may be we might have to give up the police package, it is the thing that costs a lot. DISCUSSED PROBLEMS SINCE OVERRIDE DID NOT PASS Mayor Porter suggested because the override did not pass, we will have problems with the budget. He would like to meet separately with the department heads and go over the whole budget, we may be able to find things in there we can get along without, and see how much we can save. Maybe we can still keep doing all the things we are doing. The Mayor. thanked the councilman for all their help in the election. Community consultants - Provo, Ut. quote 25 gal. per resident per day sewage discharge flows as a high end figure. 2.7 x 25 = 67.5 gallons per sewer hook up. E.P.A. statistics quote the average home nationally to be 100 gallons of effluent daily. Therefore, MillHollow Meadows flow is 67.5% of average U.S. household. Measurement of sewage flow determined for 24 hour period October 26 and 27 indicated flow to be 6225 gallons or 27.4 gal. per day. L - A-i-T-qcc- 14 M E ur "A COMMUNITY CONSULTANTS INC. 91 EAST 780 SOUTH PROVO UTAH 84601 801 377 3737 Mr. Gene Palmer Route 4 Box 17 Rexburg, ID 83440 Dear Gene: IMPROVING WATER & WASTEWATER TECHNICAL SERVICES October 26, 1981 The information that you requested on your Trailer Park projected water and sewage.use would be as follows: Based on 100 lots with 6600 square feet per lot, with 1500 square feet per lot covered space, with approximately 5000 square feet of turf area; the following information would be estimated water irrigation and sewage needs: Water Useaqe Domestic Water - The estimated useage per person in the Trailer Park would be 30 gallons per person per day or 90 gallons per connection with 100 connections. Your average daily flows should be 9000 gallons approximately. Irrigation - Your irrigation demands for the grass areas would be 3 cubic feet per square foot of grass area and an irrigation season of approximately 6 months. (Mid April - Mid October) This calculates to approximately 184 gallons per person per day for the irrigation season. Therefore, your metered useage per person per day would be 214 gallons or approximately 650 gallons per connection per day for the irrigation season, or 65,000 gallons per day metered domestic water. Sewage - Your anticipated average annual day would be based on 25 gallons per person per day sewage discharge flows. In order to establish what your actual domestic sewage discharge is, it would be our recommendation to use the monthly average flow for the month of January and calculate your sewage flows based on that month. We would recommend that your domestic water meters be tested, and that flow measurements be made on your sewage discharge lines to determine the actual flows.
