October 21, 1981, at the City Hall.

A motion was made by Nile Boyle and seconded by Glen Pond to approve the minutes.

RE: AGREEMENT WITH SUGAR CITY
Mayor Porter told the council he and Earl Kemp had met with the City Clerk and
Mayor of Sugar City and went over the agreement with Sugar City. They had made
some changes. We'approved this agreement in April of 1979, the line had not
been built, it is constructed now and ready to go into use. We will give the
changes on the agreement to Mary and let her draw the whole thing up and then
the two councils will approve them.
Maintaince of the line. The City of Rexburg maintains the line -south of the
Moody Road and Sugar City maintains it north of the Moody Road. People who
hook onto the line pay $950 for hookup fee. The south, we are responsible for,
and get the money for and if it is on the north side Sugar City gets it.
Both cities have to approve the hookup. There is a line in the original agree-
ment where it looks like our money has to be paid to Sugar City, we changed it,
we struck out for reimbursing Sugar City for its share of the costs, and put in
the $950 per unit to pay for maintainance. We have changed the formula for
sharing the costs, it will be on a population bases of the two cities, according
to the 1980 census. If Sugar City or Rexburg annex people into the city or
let people outside of the city limits hook onto the sewer system, we have
got to be sure this does not overload the line, that is why one city can have
the right to veto annexations or people outside of the city hoaaking onto the Yewer.

There is a meter that will meter the sewer flow at the Moody road and Sugar
City will pay the City of Rexburg 20G per 1000 gallons of wastewater, or an
equivalent of 150 gallons percapita, if the perca;ita use goes over 1.50 gallons
the fee will jump to 40G per 1000 gallons.
RE: PETITION FROM CAF.IER BEAUTY COLLEGE
A petition was read by the mayor which had been presented by the Career Beauty
College. They want us to allow them to park in the Parking Lot next to them
without a time limit, without raving to pay. Jim Morris ask them what they
thought if the city would let them park across the street next to his building.
The mayor told them the problem we have with the parking lot is it cost the
city $150,000. Everyone on that block has been assessed for that, and if
the Beauty College fill it up so those businesses can't use it they are going
to come in and tell_ ti -).e city they won't pay that money. Marvin Gardner,
owner manager told the council, most of their students walk to school, but
we need a parking place for our customers. They can't get through in 3 hours,
if it was changed to 4 hours it would help. .Jim Morris ask the council what
their feeling would be to open up the parking lot behind his store, anything
that was not adjacent to the building for all day parking for eith employees
or customers. ?ie suggested we try it until t`,'ie business area near the parking
lot builds up. The Mayor explained they are considering selling spots behind
Nile Boyle's store and also in the Old Spee Dee Cleaners lot. A motion was
made by Nile Boyle to have unlimited parking behind Jim Morris', the parking
lot South West of Center Street, seconded by Morgan Garner. All Aye.
Earl. Kemp said that parking lot and also the one across the street will be
open for parking on Monday.
RE: PAVING OF ALLEY Ir? BACK OF SAFEWAY
Mayor Porter ask Earl Kemp if he had paved the alley, Earl told him it had
been paved. Nile Boyle said he had talked to Clint Carpenter from Safeway
and he thought Safeway would pay for the material. The mayor showed the
council the Planning and Zoning minutes, which states in them that Tom
Carter would share in the cost of laving that alley, he did not know if we
could do anything about.it. Jim Morris said he would. talk to Mr. Carter.
Earl Kemp said the total cost to pave the alley will be about $3500. The
council told him he would have to separate the oil and gravel and come up
With a figure for that part of it.
RE: SEWER RATES
Mayor Porter said they had met with the College on Monday to discuss the
sewer rates. After the ordinance was passed on the sewer rates, the rate
actually have to be set by resolution. The college has already set their
budget, and they have problems, and all the student housing people have
contracts and their rate will jump from $1.25 to $6.50 or whatever we decide.
We actually don't know how many units there will be, we have been going on
the assumption that there is 3500 units in Rexburg, there may be 4090. Richard
thinks he will_ have that figure for us next week, and at that time if there
is 4500 units it will make the charge about $5.00 per unit. Fart Kemp said he
was figuring; by the flow of the college. The college budgeted $19,000 for
sewer, which was more than they paid this year, with the figure being $6.50
per unit the cost to them would be $34,000. They do want to pay their share.
He suggested when we get all these figures, we have a public hearing and
have all the people with student housing, and the college and people with
trailer courts come to the hearing so we can get their input. He said he
could see if a student housing unit have contracts with the students to pay
so much, and they can't rise the rate until that contract is up, it would
put a financial stra4,-1 on them. Trailer courts have a problem, because
under the state law they can't raise the rent without giving; 90 days notice.
It was decided that an information hearing for both sewer and garbage rates
would be held on Wednesday, October 28, 1981, at 8:00 P.M. Mayor Porter said
he would get in touch with Bob Smith so he can be there and have him notify
all the student housing people.
RE: PAVING ON SOUTH 2nd EAST GOING U2 THE ERICKSON ROAD
Some people have talked to Sander Larson about that paving on South 2nd East
going up the Erickson road. The agreement was that we would pay the county
$5000 and the county would take their crew up there and put the oil on the
road, and that is where it stands. The mayor said the last time he talked
to Snuffy Ss-nith he told him the County had so much work they probably would
not be able to get it done this fall.
RE: WIDENING THE CANAL BRIDGE ON 5th WEST
We have been talking about widening the canal bridge on 5th West. It is a state ,
project, we paid about $6000 for engineering and everything else. It
has been ready to go for a year, but the state had to wait until they
had their money. He had called the state to ask about it, and they
had called him back and told him they had gotten their first quarter
allotment, but since it was late in the year and they could not do any-
thing this winter, they are going to wait and call for bids in March. They
said everyting is ready to go, the bridge will be finished before the
water is turned in, this will be the 15th of May.
RE: STOP SIGNS ON 2nd SOUTH AND 3rd WEST
Jim Morris said he would have a report on the stop signs on 2nd South
and 3rd West for the next council meeting, because they now have a split
decision.
RE: ONE WAY TRAVEL IN ALLEY BEHIND THE SMALL MALL
The mayor told the council the Small Mall and Manwarings want the city
to designate one-way travel in the alley behind the Small Mall, the one
that goes north and south. Rudy Van Orden of the Small Mall wants to
see if they can trade some spaces with Manwarings so they can have parking
right behind their store. The mayor had talked to Var Manwaring about it,
without much success. The alley belongs to the hotel except three feet
by the Manwaring building, but it has been used for so long it is probably
a public alley. They want us to tell them which way would be the one-way.
The alley in question is the one coming off Carlson Ave. and goes over
to the main alley. Jim Morris said he would have the police check it
and make a report at the next council meeting.
RE: COMPLAINTS ABOUT NOISY CHAIN SAWS IN REXBURG
Mayor Porter told the council he had had some complaints about noisy chain
saws in Rexburg. He wondered if we could set'some kind of an ordinance.
Some of the businesses sell chain saws and have been demonstrating them in
the back of their stores and some of the businesses near the store that
is having a demonstration can't conduct business because of the noise.
Mary Smith said it sounded like a local situation. Jim Morris said he
would go over and talk to Mr. Benfield at Coast to Coast and tell him he
will have to have regular hours for sawing demonstrations and tell him he
will have to just use one saw at a time.
RE: RAILROD CROSSINGS NEED TO BE WIDENED
Earl Kemp told the council we need to get the Railrod Crossing widened
where we put new roads in last summer; there are three that need to be
widened. Where we paved the streets up to the crossings, the streets
are wider than the crossings. Earl said we had sent in the application,
the railroad won't let the city do it, they have to do it. The Mayor
said the next trip he makes to Boise, he will see the special agent
over there and get it taken care of. This needs to be taken care of,
because we have had two accidents already that the insurance company
have taken care of, and it is a liability problem.
RE: OLD BUILDINGS - SKUNKS
The mayor told the council there are one or two areas in the city where
there is old buildings and the porches are inhabited by skunks. We need
to find someway to get rid of them.
RE: OVERRIDE ELECTION
The mayor told the council they needed to try to promote the Override
Election. Mary Smith told the council Mayor Porter had given an
outstanding talk at the Soroptimist Club about the Override Election.
Maybe some of the other service clubs could have John talk to them.
RE: ORDINANCE NO. 641
Mary Smith read Ordinance No. 641, amending the zoning ordinance.
AN ORDINANCE AMENDING AND CHANGING ZONING ORDINANCE NO. 478 OF THE
CITY OF REXBURG, IDAHO, TO PROVIDE THAT DOUBLE -WIDE MOBILE HOMES ON
MASONRY FOUNDATIONS BE INCLUDED AS ONE OF THE PERMITTED USES IN RESIDENTIAL
ZONE R2, R3, AND COMMERCIAL ZONES AND INDUSTRIAL ZONES, AND PROVIDING
THE EFFECTIVE DATE HEREOF.

A motion was made by Councilman Nile Boyle and seconded by Councilman Jim Morris
that the rules requiring an ordinance of a general and permanent nature to be
read on three occasions be dispensed with and that said ordinance be numbered
No. 641.

Ordinance No 641 was then placed before the council. The mayor then called for
the voting for final passage of the Ordinance, and the motion was made by Morgan
Garner and seconded by Darlene Blackburn that ordinance No. 641 be passed.

The roll showed all councilmen present voting "AYE" carried, the Mayor declared
that the majority of all the members of the City Council had voted for the
passage of said Ordinance, and that said Ordinance was duly and regularly passed.
Mayor Porter declared the motion carried.
RE: ORDINANCE NO 642
Mary Smith read Ordinance 642 amending the mobile home ordinance.
AN ORDINANCE AMENDING SUBSECTION A OF SECTION 4 OF ORDINANCE NO. 642 OF THE
CITY OF REXBURG, IDAHO, TO PROVIDE THAT DOUBLE -WIDE MOBILE HOMES ON MASONRY
FOUNDATIONS SHALL BE PERMITTED FOR RESIDENTIAL PURPOSES IN RESIDENTIAL ZONES
R2, R3, AND COMMERCIAL ZONES AND INDUSTRIAL ZONES; AND PROVIDING THE EFFECTIVE
DATE HEREOF.
A motion was made by Councilman Nile Boyle and seconded by Jim Morris that the

RE: QUESTION ON WORDING OF ORDINANCE NO. 639
Bob Ratallick owner of the Village Apartments questioned the wording of
Ordinance 639, which prohibits opened containers of beer or alcoholic beverages
on parking lots and sidewalks, and streets of the City of Rexburg. He ask if
it referred to just City owned parking lots and sidewalks or all parking
lots and sidewalks in the city. Mary Smith told him that we do not have any
control over private property, the city cannot go on private property, but they
could file a conplaint and then the city can take action.

INPUT HEARING FOR
SEWER RATES
A Special Public Input Hearing for Sewer Rates held by the City Council for the
City of Rexburg, Madison County, held October 28, 1981, at the City Hall.

Mayor Porter told the group the purpose of the meeting was to get input from the
citizens on the sewer fee. The fee had not been set yet, it has to be done by
resolution. We have estimated about $6.50 a unit, but nothing has been done until
we get the input from the users.
Gene Palmer, told the group he had done some homework, and gave the council a hand-
out explaining the study he had done on the sewage flow from his trailer court.(attached)
He had spent last weekend in Provo talking to Community Consultants. He wanted to talk
to some people who would have some statistics as far as mobile homes.
At the present time they have 82 lots occupied with 225 residents. He then reviewed
the handout. To back up his study he had one of Community Consultants flumes and have
had it in his sewer system for a 24 hour period to check the flow. He had come up with
a figure of daily flow of 6225 gallons per day, or 27.4 gallons per day per resident.
He had called Community Consultants and the way he had taken the read was about 1/3 of
an inch off. He said the average mobile home has less occupants than the average home,
and uses less sewage, he feels that should be considered in the rate structure. He
had had people tell him it should not matter to him, he could pass on the raises, but
he has people living in the mobile home park that work at Louisana Pacific, within the
last ten days Louisana Pacific has shut down and these people working there would be
without work for about six months, how do you pass on the increase to people like that.
Earl Kemp said he had gone over the figures with Gene Palmer, and they are correct, he
had also checked the flow and by that he is equivalant to 62 equivalent users instead
of the 82 trailers occupied.
Earl Kemp said the Sewer Ordinance does allow for monitoring the flow and setting
rates, based on monitored flow.
Kenneth Hacking and his wife were present. Mrs. Howard Pearson, owner of a trailer
court, told the council most of the trailers in her court have only two people in each
one and some have only one person.
Gerald Mackay from E1 Centro Trailer Court said he has twelve trailers in his trailer
court and eitht of them are single people. The mayor told him, we can't get down
to splitting them too much unless he wanted to put a meter in. Earl Kemp told him
if we tried to set the rates for each home saying they all had a different amount of
people in them, it would cost too much for clerical work.
