BUDGET MEETING CONTINUED
A motion was made by Darlene Blackburn and seconded by Nile Boyle to except
the budget as presented with the cuts suggested by the Mayor and Treasurer.'

Mayor suggested giving a bonus of $100 to Richard for the excellent work he
did on the budget. Council agreed.
A date for the Budget Hearing was set for September 9, 1981.

A meeting of the City Council for the City of Rexburg, Madison County, held
September 2, 1981, at the City Hall.

A motion was made by Morgan Garner and seconded by Nile Boyle to approve
the minutes. All Aye.
RE: DAVENPORT RENTAL PROPERTY ON COLLEGE AVE.
Mae Davenport and Betty Davenport were at the meeting.
Nile Boyle reported on the rental property on College Ave. owned by Price
and Betty Davenport. He and Nile Brown had gone through the old hospital
at 118 College Ave. Things were quite minor. The fire escape had been
ruined by a very well meaning neighbor, Risa Johnson, who tore some steps
off the fire e§cape so children would not get hurt playing on them. The
fire escape has now been repaired. There had been an exposed cable but
it has been repaired.
In order to reach the fire escape in the upstairs, students would have to
go through one room to another to escape. He said he did not think it was
out of code.
Some of the houses would meet code for houses but not for apartments, but
corrections was being made. There was wires that had been put in and not
covered, the problem is now being fixed.
The outside appearance of the houses had drawn the attention of people.
We have trouble when zone 1 is next to another zone. If these houses had
not been next to zone 1, people would not have noticed the appearance so
much. In comparison to other apartments around town, they are equally as
good. The things on the list that was given to the council have either
been corrected or will be corrected.

Mayor Porter ask Nile Boyle about the parking problem. He said they were
either going to rent parking from Taylors or will make parking behind the
apartments.
Nile said he felt it sounded worse than he found it to be. He had been in all
the apartments previously when he visited girls in his ward and they are nice
apartments for boys.
Mayor Porter mentioned the supervision problem was between Davenports and the
College. Outside of the parking problem they are now in conformance. The
landscaping was a problem, but has now been corrected. Price Davenport did
a good job in correcting the problems. Mayor Porter told the Davenports they
need to be careful parking cars on the street; they are towed away and then the
students come in and complain because they do not have the money to pay the
impound fee.
Nile Boyle explained to the Davenports, in the past College Ave has been a
street people in Rexburg have been proud of, people walk back and forth to
the College and notice the yards and outside appearance of the houses. If
these rental houses was in an area by other apartments there would be no
problem.
RE: STUDY AND RECOMMENDATIONS ON 3rd WEST- ALSO POWER AGREEMENT
Jim Morris told the council he would have a study and recommendations on
3rd West and present them to the council at the next meeting. He also has
gone over the power agreement and had taken the information to Clyde Johnson
and has not heard from him since.
RE: DISCOUNT FOR PEOPLE WITH LEAKS IN THEIR WATER SYSTEM
Mayor Porter told the council from time to time people have leaks in their
water system, sometimes they are large and they think we should give them a
discount. The council need to make a decision for how much of a compromise
the city should make. Jim Morris said if the leak is on the home owners
side of the meter, they should pay for it. Richard Horner told the council
the pumping of the water is 46% of the bill. The mayor said in ordinary
circumstances you know you have a leak, but there is sometimes you can't
do anything about it because you are away or there is another reason. A
motion was made by Nile Boyle and seconded by Darlene Blackburn that the
homeowner should pay z the cost of the water caused by the leak for the first
bill and after that it would be their problem to pay the entire bill. All Aye.
RE: APPEAL BOARD FOR TRAILER HOUSES
Mayor Porter explained since they need to appoint an appeal board for trailer
houses, he thought we would have to ammend the Zoning Ordinance, but after
checking the Zoning Ordinance it calls for a Board of Adjustment. This
board could be organized to comply to the Planning & Zoning recommendations.
Mary Smith suggested it might not be a good idea to have a council member
on the board. If it would be ok with the council he would try to have the
board ready to present to the council by the next council meeting. We would
have to amend the trailer ordinance and also the zoning ordinance to allow
trailers in the designated zones which was recommended by the Planning &
Zoning Board.
RE: COMPUTOR PROPOSAL PRESENTED BY RICHARD HORNER
Richard Horner presented a computor proposal. ECIPDA have curtailed operations.
They have computor software, hardware, and a phone line hooked to Dean Ferney's
computer. They have made us a proposal to either buy or lease their equipment.
(copy on file) He had talked to Dean Ferney and Ed Richardson at the college,
he does the programming, and he said we could get good backup. The lease
payment for this year would be $6500 but they would cut it to $4500 which
could be applied to the purchase. Glen Pond suggested the way equipment is
changing we wouldn't want to buy..
Jim Morris ask what advantage this computer would be. Richard told him it
would save time and also our computer is getting old, we could get the
utility program from Pocatello for $150, and we could also save time with
the payroll. Richard pointed out that we would not have to increase the
budget this year for the computer, we already have $3000 in the budget for
maintainance on the old machine and $1300 in the budget for a card reader.
The cost of the computer next year would be $7080. Jim Morris said he did
not understand how we could think about laying off employees and then consider
buying a computer. He ask why we did not stagger our utility bills like
the power company does. Mayor Porter pointed out there is work that is not
getting done because we don't have time, the computer would save enough time
the city would't have to hire extra help to keep up the paper work. Richard
said he would like to get the utility program on the new computer by October
1, and the payroll on it by Januaryl. The mayor pointed out that we would
never be able to get into a computer as easy and cheap as this one, he suggested

the council think about it and decide at the next meeting. Glen Pond
pointed out the computor would give us better equipment. Jim Morris
suggested we have a computor company come to a meeting and give us the
advantages and disadvantages. Jim Morris ask if we get this computor
to save time what percent of payroll will we have to cut.. Richard
pointed out we are going downhill. With the system we have now. Jim
Morris thought cutting people was going downhill, he was not happy about
the budget at all.
THE NEED FOR PEOPLE AT BUDGET MEETING NEXT WEDNESDAY
Mayor Porter told the council next Wednesday at the budget meeting we need to
get a lot of people here. He would write to Service Clubs and Legislators
to get them here, and we could present a program to let them know our
problem. The legislatures have froze our taxes and we only have
a 5% raise to work with. Richard Horner handed out diagrams on revenues
and expenditures and explained them. (copy attached)
Jim Morris ask, if the law stated we could not charge anymore for
water than it costs, he was in favor of raising garbage, sewer, and
water rates. The mayor said he didn't think that was the way to do it.
We can raise rated, but we need to raise the base rates, it isn't
fair for widows, when places like Utah Power & Light will not have to
pay more. Jim Morris said the ones that complain use the services and
should pay.
Mayor Porter said a man who owns a store in Rexburg that is the same size
as the same type of store in Burley which is open 18 hours a day and
7 days a week, and the one in Rexburg is not open that much, has a
power bill twice as much as the one in Burley. We can't change the power but
we can try to equalize as much as we can with our other utilities.
Jim Morris stressed the question is the city suppose to decline and go
down hill, all businesses have to adjust to their costs. Nile Boyle said
there is a better way to do it.
The Mayor pointed out we have to have rates in line with other communities.
Nile Boyle explained the problem is not with the local government but
with the legislature, they have frozen the property tax for five years.
Jim Morris compared Rexburg with Blackfoot, the mayor told him Blackfoot's
property tax is double Rexburg.
Mayor Porter had called Boise and talked to the tax man. Rexburg only
gets .2766% of property assessed valuation. We held our tax low and
then they froze it. We need to get the Legislature to let us go up to
1%.
Mayor Porter read from a survey the AIC made.

We have 10 employees less than we had one year ago. The Police want
another man and we have a problem in the street department because they
do not have enough men and are behind on their work. We need to convince
the people we need the override. We have had money from TEDRO to help
now it is gone. We have got to decide on how big of an override we need.
We need to get the facts of how much it would cost for an average house
of $50,000. If we have to let four men go we will have to hire part time
employees. We have 100 volunteers coming from the college this weekend
to help. We are just getting the streets painted. There are a lot of
ways we couldsave for example we could leave the petunia plants out on
Main Street, Mayor explained.

A motion was made by Jim Morris to pay the bills and seconded by Nile
Boyle. All Aye.
CLAIM AGAINST CITY FROM ROBIN SYLVESTER
A claim against the city was read by Mary Smith, City Attorney, from
Robin Sylvester for an accident on 350 South Street. A motion was made
by Morgan Garner and seconded by Darlene Blackburn to turn down the
claim. All Aye.

MINUTES OF A SPECIAL BUDGET HEARING
September 9, 1981

A Budget Hearing of the City Council for the City of Rexburg, Madison County, held
September 9, 1981, at the City Hall.
Present were the following:

Councilwoman: Darlene Blackburn
Also Present: Rose Bagley, City Clerk
Richard Horner, City Treasurer
Mary Smith City Attorney
Mayor Porter told the council there were two or three items that needed to be
discussed before the hearing.
A resolution was read by Mayor Porter proclaiming a General City Election to be
held on November 3, 1981, designating the polling places, designating the
registrar and deputy registrars, and ordering the city clerk to give notice of
such election. The boundaries of the precincts will remain the same. The
following are designated as the polling places for such election:
FOR THE FIRST PRECINCT: Adams School
FOR THE SECOND PRECINCT: Washington School
FOR THE THIRD PRECINCT: Erickson Pontiac
FOR THE FOURTH PRECINCT: Lincoln School
That Rose Bagley, City Clerk, is hereby designated as Registrar and the following
as Deputy Registrars: Nancy Otteson, Deputy City Clerk, Marie Hathaway, Deputy
City Clerk; Barbara Sorenson, First Precinct; Laurie Dance, Second Precinct;
Joan Brunson, Third Precinct; Joyce Larsen, Fourth Precinct. A motion was
made by Morgan Garner and seconded by Nile Boyle to pass the resolution.

The mayor told the council he had not been able to find an appeals board for
mobile homes yet.
The mayor told the council Steve Meikle has moved, leaving a vacancy on the
Golf Board, he suggested appointing Keith Larson to this board.
About 20 persons attended the public hearing including State Legislator, Mark
Ricks and Representative Mel Hammond, also some city employees were present.
The proposed budget was presented, by the Mayor. (copy attached) He explained
the Police, Fire and Street Department should be financed through the property
tax. The Utilities should pay their own way, because of the freeze on. -our property
taxes they can't be raised.
