Porter Councilman: Glen Pond Nile Boyle Sander Larson Councilwoman: Darlene Blackburn RE: MINUTES A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the minutes. All Aye. RE: GARBAGE RATES Mayor Porter told the council that he, Richard Horner, Darlene Blackburn, and Farrell Davidson had had a meeting and went over the garbage rates, and figured out the cost of a pickup. The new rates would be: BUSINESS Can, boxes or Bags Numberp" er pick-up Price per pick-up 1 to 3 $1.10 4 to 6 2.75 7 to 9 4.40 Cubic Yard Size Price Per Pick-up 1 $2.30 12 2.60 2 3.00 3 3.60 (Price per month= Price per pick-up times Number of pick-ups times 4 (weeks per month) The Committee has gone over the list of every commercial user and found that there is a lot of discrepancy. We want to be prepared to confront people with solid facts. We now have sheets made up to put in each garbage truck, they will make a detailed report on the amount of garbage picked up and how often. This will be done for one month, at the end of August we will know what garbage we are picking up and then we will go over it all and revise the rates through the study. RE: PAVING OF THE ROAD GOING PAST THE NEW WATER TOWER Mayor Porter told the council that he had met with the County Commissioners. They had discussed the paving of the road going past the new water tower which extends up to Rexburg Heights. The county will do the project, AMR has agreed to pay $5000 toward the project and the mayor told them that the city would pay $5000 if the council agreed. A motion was made by Darlene Blackburn and seconded by Nile Boyle for the city to pay $5000 toward the project. All Aye. RE: BIG JOHN STRONG CIRCUS Nile Boyle said that he had received a letter from the Big John Strong Circus requesting to have a circus at Porter Park on September 1. Last year the City made $200 from the circus. They will guarantee us $150. We will receive 50% from the presale of tickets and 15% of tickets sold at the gate. The kids will get in free and the adults will be charged $4.00. He suggested that we have Roscoe Orton get one of the recreation groups such as the Swim Team to sell the tickets to earn Extra money for the recreation department. RE: PUBLIC HEARING FOR LID 25 A Public Hearing for LID 25 started at 8:00 P.M. Official legal minutes of this meeting recorded by City Attorney, Mary Smith. A brief summary of the meeting as follows: Warren Porter met with the council. He questioned the correctness of the assessment, he did not feel that the measurements of the building was correct. Mayor Porter told him that they would check to make sure they are correct, and bill for the actual measurement of the building. Jim Wood met with the council. He said that they were going to eliminate the apartments upstairs and ask if that had been taken into consideration, he also questioned the footage. Earl said that it had been figured with each building having 2880 square footage. Jim Wood said it was smaller than that. Mayor Porter said that we would let the records show that we will measure the building and double check on it. Mr. Wood ask if there would be any increase, the council told him that there would not be, we already have the bids. Written Protests: Ruby Raybould doesn't feel she would benefit from the Parking Lots. A motion was made by Nile Boyle and seconded by Glen Pond to disalow the protest. All Aye. Betty Phillips said that whe will not benefit from the Parking Lots. A motion was made by Darlene Blackburn and seconded by Nile Boyle to disapprove the protest. All Aye. Tom Carter was at the meeting to protest. He said that he did not get a notice in the mail, he had a vacant lot and there is a chance that he might build a residential home on the property rather than a business. Mayor Porter told him that the LID district has been set up & possibly a year from now he might change his mind and decide to build a business. Glen Pond reminded him that he had met with the planning board and showed them plans for a business to be built on the property. Nile Boyle told him that he could go for the 20% but if he built he would have to meet code for parking. There will have to be enough parking on the property for the building. He told him that he was in Zone 1 because his property is adjacent to the parking lots. Mr. Carter ask if he did build a residential home there if the city would refund his money, the council told him no, these parking lots would increase the value of the property. He was told that if he put a home on the property, it would have very little resale value. Mr. Carter withdrew his protest. Mayor Porter read a written protest from Rudd & DaBell & Hill, Mr. Rudd protested the formula that was used in figuring the LID. Mayor Porter said that the formula that was used was by City Ordinance, it doesn't make any difference the kind of business you are in, you still have to have enough parking to go along with the ordinance. Earl Kemp said that he had checked it out and the LID was assessed ok according to the ordinance. A motion was made by Nile Boyle and seconded by Darlene Blackburn to disallow the protest. All Aye. A written protest from the Racquet Ball Club, the owners of the Racquet Ball Club was also at the meeting. He said that they have a maximum of 60 people at one time at the Racquet Ball Club. Nile Boyle said that there is no formula for a Racquet Ball Club, but we need to be fair. Earl Kemp and Nile Boyle will go and measure the building again and re- figure the amount due. Earl Kemp said that if the measurement was 12,000 sq. ft. the assessment would be $3056. A motion was made by Darlene Blackburn and seconded by Nile Boyle to refigure the assess- ment if the measurement was correct to change the assessment to $3056. All Aye. Rudy Van Orden was present to protest. Mayor Porter suggested that we trade parking with Manwarings for parking directly behind Van Orden building with the parking in the parking lot. Earl Kemp also will go and remeasure the building to see if the assessment is correct, and make an adjustment. A written protest from Margaret Keeler for the Econo Mart. A motion was made by Nile Boyle and seconded by Sander Larson to disapprove. All Aye. A written protest from David Wood. The property was assessed 20%. A motion was made by Sander Larson and seconded by Glen Pond to disallow. All Aye. A written protest from Dr. M.F. Rigby. He has closed his apartments and isn't going to use them anymore. They are assessed for 22 apartments. He has no parking. With that change it would lower his assessment by $425.03. A motion was made by Nile Boyle and seconded by Darlene Blackburn to change his assessment, assessing it without the apartments. All Aye. A written protest from E1 Genes. They felt that they have 3 or 4 parking places. Earl Kemp said that he measured it and they have 1 parking place. They said they have 16 employees instead of 24. The mayor said that there is 3 spaces on the property behind their building if the property is paved. A motion was made by Glen Pond and seconded by Nile Boyle to reduce the assessment $419 or if the property is paved behind the building reduced it $761. All Aye. Earl Kemp said after all the changes, the LID would b $158,000. It would be reduced $6650 possible $7000. RE: LETTER FROM BOR Mayor Porter told the council that we have a letter from the BOR giving us 60 days to protest the Loan we have and then 60 more days until we have a hearing. RE: BILLS A motion was made by Sander Larson and seconded by Glen Pond to approve the bills. All Aye. RE: ADJOURN A motion was made by Glen Pond and seconded by Darlene Blackburn to adjourn. All Aye. RE: MR. LODGE FROM SUN CITY, ARIZONA AT THE MEETING Mr. Lodge from Sun City, Arizona was at the meeting and thanked the council and City for the Lawn Bowling that was available in the city and for the hospitality that the city have shown them. He said that they had really enjoyed the lawn bowling. RE: THANK YOU CARD Mayor Porter read a thank you card from Sander Larson's wife for flowers that was sent to her while she was in the hospital. RE: KEN BIRD REQUESTED A VARIANCE FOR A 6 FOOT FENCE Ken Bird was at the council meeting. He explained that he owned the Chapparel Apartments, the old KRXK Building, Mansard Village is on the south. He requested a variance to put up a 6 foot fence 1x6 between the two apartments going clear
