Porter Glen Pond Jim Morris Nile Boyle Sander Larson Darlene Blackburn Mary Smith, City Attorner Rose Bagley, City Clerk Richard Horner, City Treasurer Glen Pond presented a certificate to Gerald Smith which he earned from Pacific Northwest Pollution Control Association, which will certify him as a Lagoon Treatment Plant Operator. RE: MINUTES A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the minutes. All Aye RE: PETITION FROM REXBURG HEIGHTS FOR ANNEXATION Mayor Porter stated that at the last meeting the council reviewed a petition from Rexburg Heights for annexation, but did not take any action on it. He suggested that it be turned over to the Planning & Zoning Commission for recommendations and zoning. The people in Rexburg Heights want it zoned so they can have horses. Ellis Miller from Rexburg Heights was at the meeting and ask what could be done to the septics until the sewer system is put in, it is a health hazard. He was told that he should contact the Health Department, and that as soon as it is annexed the City will take steps to set it up on an," LID to put in a sewer system. Mr. Miller also complained about snowmobiles racing on the road in the winter and 12 and 13 year old kids riding motor cycles on the road. Jim Morris told him that if it was annexed into the city we would post signs and police it. A motion was made by Jim Morris and seconded by Nile Boyle to turn the petition over to the Planning & Zoning for their recommenda- tions. All Aye. RE: MR. & MRS. DONALD WYLIE AT MEETING TO DISCUSS TRAILERS Mr. and Mrs. Donald Wylie was at the meeting to discuss the trailers that are parked on their property at 222 West 2nd North. Mayor Porter told them that they were in violation, they were given permission to put three trailers on their property for one year for their children and now the trailers are being rented. Mrs. Wylie gave a letter to Mayor Porter explaining their situation, which he read to the council. (copy attached) The Mayor told them that there was two problems (1) the use of the mobile homes has been changed from the original intent, (2) all rented trailers have to conform to the trailer ordinance with paved streets, laundry facility, and playgrounds. All the other courts have to conform and it isn't fair not to make everyone conform. Mrs. Wylie said that it takes a while to get a trailer court but they would try to conform if the council would let them have it. Sander Larson said that he thought we should wait to see what the Planning & Zoning decide on trailers. The mayor said that after the hearing that was held on June 24, he thought the Planning & Zoning were leaning toward the 1974 Trailer Ordinance, and we will have to go by their decision. Nile Boyle advised them not to put any more real improvements on the property until a decision is made. Mayor Porter told them that if we ever have a law suit because of trailers not being in trailer courts, we will have to inforce the 1974 Ordinance if the Overlay Zone is not passed. If you have rental trailers on your property, you will have so much time to have them moved. The Wylies were told that they were not licensed for a Trailer Court and the council have had complaints about the trailers that were on their property. The Mayor told them that the Planning and Zoning Committee will have one more meeting before they make a decision about trailers, and they should come to the meeting. He said that most people are opposed to the Trailer Overlay Zone. Glen Pond, who is on the Planning & Zoning Committee said that they would probably go with the 1974 Ordinance with the exception of Commercial Property and trailers would be allowed in the commercial zone. They would not allow rental trailers except in a Trailer Court. RE: COUNCIL DISCUSSED PROBLEM WITH GOATS AT 144 NORTH 3rd WEST The Council discussed the report from the Planning & Zoning Committee and the problem with Dale McIntire of 144 North 3rd West having goats on his property. City Attorney, Mary Smith, was instructed to write them a letter. RE: DISCUSSED VARIANCE FOR MRS. VENA WRIGHT The council discussed giving Mrs. Vena Wright at 23 East 2nd South a variance to have student housing. After discussing the problem the council decided that she would have to comply with the Ordinance.. If she does not have enough parking she will not be able to rent to students. Anyone wanting to rent to students will have to comply with the ordinance. RE: EARL KEMP ASKED WHEN ALL PROJECTS WOULD BE FINALIZED The council ask Earl Kemp when they were going to get all the projects finalized. The council told him that the grass still has not been planted at the medium on Main Street and also at Smith Park, this needs to be done right away. Nile Boyle told him that if they did not get the grass planted by the first of the week we would have to get someone else to do it. Earl reported that the LID was finished, the paving was all done. He said that they are making a list on the Storm Sewers for inspection. Mayor Porter told him that they needed to get the water system working at the medium, the city crew have to go up there every day and water the petunias with the flusher. The council ask Earl if we could charge a penalty on the late construction. He said they could charge $100 a day. He was instructed to write a letter to H. & K. telling them that as of July 15, they would be in violation of their contract and would be charged $100 per day until the construction was finished. Earl said that he would put the pressure on them to get it completed. The Mayor told Earl that there is a problem by Terrell Arnold's, water is setting there all the time. Earl told him they have made a list of 35 or 40 places that need to be fixed, they will have an inspection having someone on the council go around with them on the inspection. It was suggested that Morgan Garner and Farrell Davidson help with the inspection. RE: DISCUSSED THE TREES & FLOWERS IN THE PARKING LOTS The Mayor said that the trees in the parking lot don't look like they are getting any water. Gerald Smith said that probably part of the sprinkling system is broken, because the water just runs all over, so they have turned it off. Gerald also told Earl Kemp that the Parking Lot behind Porters Book Store has broken pipes in the flower beds. RE: USING THE FILL OFF THE NEW PARKING LOTS Mayor Porter told Earl that when they start on the two new parking lots and take the fill off the top to surface them, he wanted them to use that fill to put in the old drain ditch by Autumn Arbor on 2nd East and also the ditch at Smith Park. RE: BARNEY DAIRY ROAD Earl Kemp told the council that the Barney Dairy Road is now complete and as soon as the county except it, it will become a city road out to the Dairy. The city needs to get signs posted on the road so it can be policed. RE: RE RE : 1.40 I!";" RE: RE: no RE: TURF AT THE OLD GOLF COURSE Mayor Porter said that they have been cutting the old driving range at the Golf Course and taking the turf off. He talked to Kent Marler, who was under the impression that we would not maintain the old Golf Course after the new Golf Course was completed. He had told Kent that we have to maintain it, and Kent said they wouldn't take anymore turf and would replant it. OPEN HOUSE AT THE MUSEUM AT THE TABERNACLE ON JULY 23 Mayor Porter told the council that on July 23 the Historical Society are going to have an open house at the museum at the Tabernacle. There will be nothing in the top of the tabernacle, music will be playing throughout the building and there will be a ribbon cutting ceremony. He ask the council to attend. The open house will last two days the 23rd and 24th. Clyde Orme is going to let them put some of his animal heads in the museum that he had gotten all over the world. RECREATION REPORT EXPLAINED Mayor Porter explained the Recreation Report that was passed out to all the councilmen. He reported that the swimming pool had been going good except that the paint was starting to flake off, and they could'nt see anyone on the bottom of the pool so they closed the pool. They had a man from the college look at it, he told them that they was using the wrong kind of ash. We have budgeted $5000. from Revenue Sharing for repairs to the pool. We can use $1000 for paint, and he had authorized Chapple Paint to order the paint. The pool should be running again by Saturday. MAYOR REPORTED ON A WATER PROBLEM Mayor Porter reported there was a water problem last night. Someone had shut off the valve between the pump and the resovoir, and some people were without water. The reservoir went dry and the upper tank got low. DISCUSSED STRIPPING OF STREET ON SOUTH CENTER Sander Larson said last year when they did the storm drain on South Center by the College football field, the college finished the street but the stripping did not get done, it would be nice to finish the stripping in the nice weather while students are not here. REPLACING OLD CURB AROUND THE CITY The Mayor said that Farrell Davidson had talked to him about replacing the old curb around the city, especially that on West Main. He told him the only way we could do it would be to get the homeowners to agree to go on an LID. CITY CLEAN UP OF WEEDS The city clean up of weeds is getting to be a headache. There are too many lots to mow the weeds on. The employees can't keep up. We need to get people to clean up their own lots. Jim Morris suggested that we advertize and get someone to contract cleaning up the lots and charge accordingly. BILLS A motion was made by Nile Boyle and seconded by Jim Morris to pay the bills.
