A meeting of the City Council for the City of Rexburg, Madison County, held April
15, 1981, at the City Hall.
Present were the following:

A motion was made by Sander Larson and seconded by Darlene Blackburn to
approve the minutes. All Aye.
RE: ZONING REQUEST FROM DIET CENTER
Mayor Porter said that there was a zoning request from the Diet Center at
354 West Main. They want to put up a sign in a Residential Area. The Mayor
had had a petition taken around to all the neighbors. The majority of the
neighbors were against the sign unless it was put up right against the
building.
RE: REQUEST FOR PARKING PLACES FOR HANDICAPPED
Mayor Porter read a letter from Kenneth G. Nickell, 2nd Vice President of
Valley Bank, requesting parking places for handicapped persons to be put
around the business district in the city. (copy attached) Sander Larson
questioned if it would be feasible, would these parking places be used
enough to warrant putting them in. The council felt that possibly one
should be put in on 1st East by Valley Bank and also one by Utah Power &
Light. These parking places would not be exempt from the two hour parking.
The council questioned if Mr. Nickell specifically was requesting one by
Valley Bank and if he was requesting one for employees or for customers.
The city could not provide parking for employees. Nile Boyle said that he
would check with him and clarify these questions.
RE: STUDY ON SEWER SYSTEM FINISHED
Earl Kemp told the council that they had finished the study on the Sewer
System. He gave each of the council members and the mayor copies of the
study. (copy on file at City Hall) Mayor Porter said that the study was
made because we still have $195,000 TEDRO money left for Sewer Lines and
improvements, and while we are doing the Sewage Treatment Plant this money
could be used for matching funds with EPA funds to do some of the work
needed to be done on sewer lines. Earl Kemp referred to the study and ex-
plained a priority list of improvements:

These costs include engineering, street repair, rock excavation, connection
to existing system, as well as costs for relocating utilities which interfere with
these lines.
Earl said that they need to put the costs together on what we decide to do. We
need to put in interseptor lines for carrying sewage not service lines. He had
talked to the Board of Health and gone over the study and over the priorities
and recommendations. The Federal will pay 75% and the State will pay 15% leaving
the city to pay the balance. He said that if we do 1,2,3,4,6 and get 90% funding
it would cost the city approximately $126,000. Jim Morris stated that he did not
know if he was in favor of spending money on Rexburg Heights, why not spend on the
people in the City. Earl told the conucil that any money that the city had re-
ceived from TEDRO FOR SEWER, THAT WAS NOT SPENT for that would have to be given
back to the government. Areas that would qualify under EPA would be areas
established in 1973 or before. The council discussed extending the sewer line
out by Bell Builders and Taylor Chevrolet and also extending the line out 5th
West to 9th South, because the city would eventually annex out 5th West. Mayor
Porter suggested that we get everything we can for matching funds in 1981. Nile
Boyle stressed that we should do the areas that we need badley enough now and
not in 20 years. Earl Kemp said all we should need to do to get the money
would be to amend step 3 of our EPA grant. A motion was made by Nile Boyle
and seconded by Morgan Garner that the council approve 1, 2, 3, 4 and extend
the line on 5th West and do what is needed on Harvard Ave and forget 5 and 6
if we can get 90% funding. If Rexburg Heights annex into the city we can decide
at that time what to do. All Aye.
RE: SORENSON PROPERTY FOR A PARKING LOT
Earl Kemp reported that now that the city has obtained the property from
Sorensons for a Parking Lot, Carlson Ave can be continued through to South 2nd
East. The engineers need permission to go ahead and design three parking lots,
(1) on Center and Carlson, the one on Sorenson property, and the one behind
Jim Morris's on Center street. The cost for all three lots depending if we
buy Brunson's property by Sorenson's would cost about $150,000. They would
figure an accurate estimate and submit it to the council. The city has about
$206,000 left in thePARKING TEDRO money after the check is made out for the
Sorenson property there will be $181,000 left. If the city purchase the Brunson
property that will be $10,000 more.
RE: BUILDING AT CORNER OF CARLSON AVE. AND CENTER
The Council discussed the building at the corner of Carlson Ave and Center
where the new parking lot is to be built. Something needs to be done to improve
the looks of the building, either the owner of the building or the city needs
to paint it.
RE: SPECS AND PRICES ON PARKING LOTS
A motion was made by Jim Morris for Earl Kemp to go ahead and draw up the specs
and prices on the parking lots and let the council look at it before we go to
bid seconded by Nile Boyle. All Aye.
RE: NEED TO RAISE RATES ON GARBAGE BIN DUMPING
Mayor Porter told the council that Gordon Nelson, Darlene Blackburn and Richard
Horner had met and feel that we need to raise the rates on garbage bin dumping.
In checking, we find that to many are using private bins. We need to pro -rate the
charge for the bin use so all users get charged. The committee decided that we
charge $3.00 for a 1 yard bin and $3.75 for a 2 yard bin, but they need to study
it further, and find out who is putting garbage in each bin. We will try to get
the cost adjusted. Mayor Porter suggested that one more bin be put behind
Johnson's so that bin didn't get filled so full and could be picked up less
often. Richard Horner told the council that a lot of places either need an
extra bin or pay for extra pickups. Jim Morris suggested that it helps to
seal the boxes with tape that are put in the bins.
RE: PROBLEM WITH BLOWING DEBRIS
Mayor Porter said that the city has a problem with debris blowing around and
getting caught in fences. He noticed by Adams School, Soil Conservation Office
and by Circle K, especially there was a lot of debris blown on the lots and
caught in the fences.
RE: CLEAN UP IN THE CITY.
Mayor Porter discussed Clean Up in the City. For the last two or three years
for a month, a truck has gone around and picked up extra garbage that was too
big for the regular garbage truck, without an extra charge. After 30 days
they will again charge for this service. The limbs should be cut in lengths
and all garbage put together so it can be picked up as quickly as possible.
People can burn in a barrell from April to the 15th of May if they get per-
mission from the Fire Department first.
RE: PENALTY CHARGE FOR PEOPLE NOT GETTING PERMITS
The mayor told the council that people make it a habit of building, doing
electrical work, and plumbing work without a permit if they don't think they
will get caught. We have not been charging a penalty, but from now on for
those offenders we will charge double.
RE: SEWER CHARGE REFUND FOR BELL BUILDERS AND TAYLOR CHEVROLET
Mayor Porter told the council that some sub -divisions and Bell Builders and
Taylor Chevrolet have automatically been charged sewer when they hooked onto
the water even though they were not hooked on the sewer line. Bell Builders
and Taylor Chevrolet want a refund. All Aye.
RE: STUDENT PARKING COMPLAINTS AT HOME OWNED BY RAYMOND HILL
Norris Reese reported that he had been having complaints about student parking
at the house owned by Raymond Hill. Mayor Porter said that he had had numer-
ous complaints on this problem and he was working with the college on the
problem.
RE: BILLS
A motion was made by Morgan Garner and seconded by Sander Larson to pay the
bills. All Aye.
RE: ADJOURNMENT
A motion was made by Jim Morris and seconded by Nile Boyle to adjourn. All Aye.
