A motion was made by Darlene Blackburn and seconded by Jim Morris to approve the
minutes. All Aye.
RE: LETTER FROM STATE TRANSPORTATION DEPARTMENT FOR BRIDGE INSPECTIONS
Morgan Garner told the council that Mayor Porter had received a letter from the
State Transportation Department with a proposed State/Local Agreement for Bridge
Inspection to conduct inspections, collect the federal share from FHWA and provide
local matching shares from the Local Bridge Inspection Account. Mayor Porter
recommended that the City handle it like the county. Morgan Garner had checked
with County Commissioner, John Smith, who told him that the county was going to
go with the State. Morgan Garner stated that the City can either let the State bid
with the Engineer Firms or they can pick an engineer on their own. His opinion
was that we should go with the state. Norris Reese said that he thought we would be
apt to get a better bid by going with the State. A motion was made by Morgan
Garner and seconded by Jim Morris to instruct Mayor Porter to sign the agreement
with the State and return it to them. All Aye.
RE: ADDITIONAL STREET LIGHTS
Nile Boyle showed the council a map locating the street lights in the City. The
council discussed additional lights that needed to be installed. A motion was
made by Morgan Garner and seconded by Darlene Blackburn to pass a resolution app-
roving the installation of new street lights in four areas. The areas being
(1) at the end of Apache on 2nd South,(2) on Skyview Drive, (3) in the Starlite
Addition, and (4) in back of the Police Station. Jim Morris was ask to meet with
the Utah Power & Light and decide the exact location that the light should be
put. All Aye.
RE: BEER LICENSE
Nile Boyle read an application for a renewal of a beer license for V-1 Oil. A
motion was made by Norris Reese and seconded by Jim Morris to approve the renewal
of the beer license. All Aye.
RE: ORDINANCE 630
City Attorney, Mary Smith, read Ordinance 630 abandoning a portion of 3rd North
Street, located by Louisana-Pacific sawmill property. In exchange for the property
they are giving us an easement of a sanitary sewer line, a deed to a small piece
of property that the city had been using.
ORDINANCE NO. 630
AN ORDINANCE VACATING AND CLOSING ALL THE PORTION OF THIRD NORTH STREET BETWEEN
LOT 1 OF BLOCK 6, AND LOT 1 OF BLOCK 13, IN THE CITY OF REXBURG, IDAHO, AND ALL
THAT PORTION OF FIRST WEST STREET BETWEEN LOT 1, BLOCK 6, AND LOT 2, BLOCK 5, OF
THE CITY OF REXBURG, IDAHO, SUBJECT TO EXISTING RIGHT-OF-WAY EASEMENTS AND FRANCHISE
RIGHTS OF ANY LOT OWNER, PUBLIC UTILITY OR CITY OF REXBURG; PROVIDING THAT ALL OF
SAID STREETS REVERT TO THE OWNERS OF THE ADJACENT REAL ESTATE IN LOT 1, BLOCK 6 OF
THE CITY OF REXBURG; PROVIDING WHEN SAID ORDINANCE SHALL TAKE EFFECT.
A motion was made by Councilman Jim Morris and seconded by Councilman Norris
Reese that the rules requiring an ordinance of a general and permanent nature to
be read on three occasions be dispensed with and that said ordinance be;numbered
630.

Ordinance 630 was than placed before the council. Acting Mayor Nile Boyle then
called for the voting for final passage of the Ordinance, and the motion
was made by Norris Reese and seconded by Morgan Garner that ordinance
#630 be passed.

The roll showed all councilman present voting "Aye" carried, the acting
Mayor declared that the majority of all the members of the City Council had
voted for the passage of said ordinance. and that siad Ordinance was duly
and regularly passed. Mayor Porter declared the motion carried.
RE: STUDENTS PARKING ON LAWNS AND SIDEWALKS IN THE R1 ZONE
Nile Boyle gave copies of a page out of the Planning and Zoning Ordinance
which gave the requirements for parking in R1 Zone. The city has been
getting a lot of complaints about students parking on lawns and sidewalks
in the R1 Zone, where students are living in the homes. It has become
a real problem. Nile Boyle said that we should enforce the ordinance.
He suggested that if we are going to enforce the ordinance we need to
notify the college so they can help us enforce it. Jim Morris said that
the police have issued citations for parking on lawns and sidewalks in
the past, but he would talk to them and have them crack down on enforcing
it.
RE: DISCUSSION OF THE 9th SOUTH ALTERNATIVE
The council discussed the 9th South Alternative. Most of the council had
driven to the area= where the alternatives would go, so they could make
a decision. Earl Kemp told the council that the only disadvantage of the
9th South Alternative would be the displacement of one home. The engineers
could see no problem in moving the power poles to build the road. The
Ninth South Alternative would be cheaper than the Eleventh South Alterna-
tive. The people living in the area and the students would use the road
the most. The road would provide access from east to west for the south
end of the city. A motion was made by Morgan Garner and seconded by Jim
Morris to except the Ninth South Street Alternative as the corridor for an
arterial joining the east and west sides of the city on the South. All Aye.
RE: EARL KEMP REPORTED THEY ARE STILL WAITING FOR EPA ON STEP III FOR THE SUGAR
REXBURG SEWER SYSTEM
Earl Kemp told the council that they were still waiting for EPA to except
the bids for Step III for the Sugar Rexburg Sewer System. He told the
council that two change orders have been made to save money, (1) Clegg
Construction are willing to pay for sand out of the pit behind the shop.
(2) Whittaker Construction are willing to change the discharge point on the
canal.
RE: NEW WATER SUPERINTENDENT
Norris Reese told the council that when the Mayor gets back from Boise he
will appoint a new Water Superentendent, and then he will call the council-
men for approval.

Included herein are procedures to facilitate the Local
Bridge Inspection Program, beginning with the calendar year
1981. The following protcedures are intended to provide you
with more timely information on the condition of bridges under
your jurisdiction, reduce the administrative burden of the
program and provide funding for the local matching share,
The local matching funds are to be provided from the Local
Bridge TLispection Account. This account was established by
the last legislature at the request of the Idaho Transportation
Department. The legislation can be found in Section 63-2342(1)
(d), 40-405(A), (E) and (C) Idaho Code. An annual nppropriation
of $50,000 was set up under the jurisdiction of the Transporta-
tion Board to match federal funds for local bridge inspections,
The federal funds will come from bridge replacement funds
at an 80--20 matching ratio.
Enclosed Is a proposed State/Local. Agroement, for Bridge
inspection. it is a continuing ngret:,aac.nt wlt.lch . uthorizes the
State to conduct inspections, collect the federal share from
FBWA and provide local matching shares from the Local Bridge
Inspection Account. If acceptable, please sign and return the
agreement as soon as possible.
It is our intent to negotiate agreements with local engineer-
ing firms to conduct the inspections. In general, it will be
the firm that has conducted inspections in your jurisdictions in
the past. Should you have some other preference, please advise
me Ltrimediately. Results of the inspections and recommendations
for posting, repairs, etc., will be transmitted to you by the
Division of Highway s .

A meeting of the City Council for the City of Rexburg, Madison County, held February
4, 1981, at the City Hall.

RE: BOY SCOUTS ATTENDED MEETING

A group of Boy Scouts and their leader, Bill Christensen, were at the
meeting. Mr. Christensen told the council that the scouts all over the nation
were reporting to City Council meetings and that this group of scouts would
like to report to the Rexburg City Council.
Cory Foster representing the Cub Scouts gave his report on the things they
had done during the year and presented the Mayor with a Scout Coin.
Jeff Whatcott representing the Scouts gave a report and presented the Mayor
with a tie tack.
Val Ricks representing the Varsity Scouts gave his report to the Council.
Brian Stanton representing the Explorer Scouts told of their projects during
the year. Mayor Porter thanked the scouts and told them that the City
appreciated the projects that the scouts had done for the city. In the past
the scouts had done projects in the City Parks, erected signs at the Smith
Park, built dugouts that were destroyed in the flood, planted flowers in the
flower beds along main street, painted the Steam Engine and many other things.
RE: TRAILER PARKING IN THE CITY
Mayor Porter discussed the trailer parking in the city. The City has a
Trailer Ordinance which requires no trailers to be parked except in trailer
parks. Two years ago Arlo Nelson did a study of Rexburg, his study showed
that there are some areas in Rexburg where lots could have trailer houses
on them. This would be called an over -lay zone. In some areas there are
trailers because after the flood and since then permission has been given
to put a trailer on a lot for one year, and we have not followed up to
make sure they were moved at the end of the year. There are areas in R2
and R3 that trailers could be put if the person owns the lot. Nile Boyle
suggested that this be turned over to the Planning and Zoning Committee
for further study.
