HomeMy WebLinkAbout1980.10.22 CITY COUNCIL MINUTESRE: STUDENTS FROM THE RETURNED MISSIONERY FRATERNITY TO HELP CLEAN STREETS AND ALLEYS Sander Larson told the council that there are 70 students from the returned missionery fraternity that would like to give lh hours of their time from 5:30 P.M. to 7:00 P.M. on Wednesday, 0 c tober 15 and go up and down main street and the alleys, and clean up the streets, parking lots and flower beds. He ask if the city could provide the trucks and shovels. He thought possibly some of the stores would furnish donuts and punch for them. Jim Morris said that he would arrange for the trucks and shovels. RE: DRAINAGE PROBLEM BEHIND JOHNSON DRUG John Millar discussed with the council the drainage problem behind Johnson Drug. The council decided that since the crews are working so close to the problem that they should tput in a catch basin. : JOHN MILLAR & EARL KEMP RECOMMENDED AN INCREASE IN WATER CAPACITY TO RICKS PALMER ADDITION John Millar told the council that he and Earl Kemp wanted to recommended that since the Ricks Palmer Addition is now fed by one 8" water line it is quite marginal, and since we have money left after the other projects are finished, we should increase the capacity by putting in a larger line. A motion was made by Morgan Garner and seconded by Nile Boyle that we increase the capacity to that addition pending that we have enough money. All Aye. RE: DRAINAGE PROBLEM AT CHARLES SMITH PROPERTY John Millar told the council that the drainage problem at the Charles Smith property had been taken care of. RE: PUMPS AT PORTER PARK AND SMITH PARK The engineers told the council that the pumps at Porter Park and Smith Park should not need to be turned on with the new system. Porter Park pump should be drained and turned off. There is no reason to run that pump we should have adequate pressure. Norris Reese said that they would have a valve put on the pumps so they can be drained and turned off. RE- COMPLETION OF STORM DRAINS John Millar said that we are very near completion of the storm drains and need to be sure to check out any problems or anything that is not finished. RE: DISCUSSED GARBAGE RATES FOR SENIOR CITIZENS Mayor Porter told the council that we have had some people in the City Hall since we raised the garbage rate to $4.00. Widows and couples who are senior citizens and only put out one can of garbage don't think they should have to pay $4.00 for garbage. The mayor said that he thought we should work out a rate for Senior Citizens similar to tie tax reduction that the county gives. We could have a special form for them to sign. The mayor and city clerk will get it worked out. RE: BILLS A motion was made by Nile Boyle and seconded by Morgan Garner to pay the bills. All Aye. Porter MINUTES OF THE CITY COUNCIL MEETING October 22, 1980 State of Idaho ) County of Madison (SS City of Rexburg A meeting of the City Council for the City of Rexburg, Madison County, held October 22, 1980, at the City Hall. Present were the following: Mayor: John C. Porter Councilman: Norris Reese Jim Morris Nile Boyle Morgan Garner Sander Larson Councilwoman: Darlene Blackburn Also Present: Brent Moss, Assistant City Attorney Rose Bagley, City Clerk Richard Horner, City Treasurer RE: MINUTES A motion was made by Norris Reese and seconded by Sander Larson to approve the minutes from September 17, 1980 and October 10, 1980. All Aye. RE: BUSINESS LICENSE FOR ELMER B. WINDSOR JR. Elmer B. Windsor Jr. was present to apply for a business license to have a T.V. and Radio repair service in his home at 325 West Main. This would be in a Residen- tial Zone. Mr. Windsor presented a petition signed by all the residents within 300 feet of his property giving their permission for him to operate a part time radio and T.V. repair shop in his home. Mr. Windsor said that he was working with the National Rergerve in Rexburg as a Communication Sargent. Mr. Windsor said that he could not afford to rent a building for,his business, that is why he wanted to work out of his home. A motion was made by Nile Boyle to give Mr. Windsor a variance to operate this business out of his home renewable at the end of one year, the motion was seconded by Darlene Blackburn. All Aye. RE: CHIEF BLAIR SIEPERT EXPLAINED THEIR PLANS FOR HALLOWEEN Chief Blair Siepert was at the council meeting. He had been ask by Councilman, Jim Morris to explain the enforcement program that the Police Department was planning for Halloween. Last year the egg throwers and pranksters were given one oral warning and then if stopped again were sited and taken to court. This year the police are going one step further, they will not issue a warning, the kids will be sited the first time. The court officials have agreed to work with the police in tihe matter. Chief Siepert requested that the press give good coverage so that the public will be aware of what the police plan to do on Halloween to help cut down to a minimum the egg throwers and pranksters. Norris Reese told Chief Siepert that a group of businessmen are preparing a petition for a 10:00 P.M. curfew for anyone under age 18. Chief Siepert said that a curfew presents problems and he would rather not have a curfew at the present time. Earl Kemp expressed his concern about the water tanks being painted, and the danger of having kids climbing up the tanks and getting hurt. The new painting of the tanks has cost the city $17,000 for one and $22,000 for the other. Chief Siepert said that he was sure that would be a prime target, and they would try to watch it. Chief Siepert said if we could get the cooperation from the parents it would help. In the past all the work done by the volunteers and extra officers has been done without pay, however, some of the officers don't want to work unless paid. Jim Morris said that three years ago was rough, and last year it was about 50% of what it was then. Nile Boyle said that he would like to make a comment, one year ago a $180 pistol was stolen from his store. The police detectives have been investigating it. Last Friday the pistol was returned to the store, with $100 and a note of how sorry the person was. RE: TRESPASSING IN PARKING LOTS Chief Siepert told the council that he was aware that the council was concerned about the trespassing in parking lots down town. It had now been controlled and most of the traffic has been moved up to the courthouse parking lot. Eight have been arrested three have pled guilty and the rest are pending. It now appears that some of the businesges don't want to support the police in cracking down on the kids trespassing %y 7 in parking lots.. Norris Reese ask if the police was patrolling Main Street and keeping traffic moving Chief Siepert said that they were trying to keep it moving and had issued citations, but they can't spend all of their time on Main Street, they have to check residential areas and businesses off main street. Mayor Porter told Chief Siepert that we need to plan to patrol the new parking lots. Nile Boyle said he thought after we got the signs up in the lots then they should be checked a couple of days a week, to keep the traffic moving. Mayor Porter said that the employees from downtown are parking in the parking lots and if we give tickets it would eliminate that. He also said that maybe from now until Christmas we could get a college student to help part time. RE: CHUCK FROST AND BLAINE NIEDERER PRESENT TO DISCUSS CUL-DE-SAC ON BARE STREET Chuck Frost of the Planning Board and Blaine Niederer was present to discuss the Cul-de-sac that Mr. Niederer had requested to put in on Bare Street. Mr. Frost told the council that the Planning Board had met twice and have not had a quorum to make a decision. He told the council that it is a 31' street and it has not been dedicated to the city. Mr. Niederer not knowing of the problem bought the property. He will need a variance to put in a 65 foot turn around cul-de-sac at the end of Bare Street. Thestreet is too narrow for the garbage and fire truck to turn around. Mr. Niederer said there had been a weed patch on that property since he moved there and to put a cul-de-sac and two houses there would improve the area. Mr. Niederer was ask if he could put some of his property into parking, he said that he could not because he could not afford to. Mayor Porter said that that street had been an error to begin with and maybe a cul-de-sac would improve the situation. Chuck was ask if he would check with each one of the Planning Board members and get a recommendation. Mr. Niederer complained that he had been trying to get a decision for a month. Jim Morris told him that sometimes these things take time and that he should have started earlier. Mayor Porter said that we have to make sure we get the street dedicated. A motion was made by Nile Boyle that we grant a variance for 65 feet Cul-de-sac with parking on only one side of the street, and that the street be dedicated first, seconded by Norris Reese. Those voting Aye, Norris Reese, Nile Boyle, Morgan Garner, DaIrlene Blackburn. Those voting Nay, Jim Morris and Sander Larson. Mayor Porter said we will have to have a petition signed by all the neighbors within 300 feet of the - property and then have a variance hearing and the Planning & Zoning Committee will have to give a ratification. RE:- INFORMATION SHEET FOR PLOT PLAN AND CONSTRUCTION Mayor Porter presented an Information Sheet for Plot Plan and Construction that the Planning Board wants to have filled out to accompany each building permit application for residential homes. It has a place to sketch out the proposed plot Plan allowing for the location of & dimensions of the house, driveway, water line, sewer line, steps walks, patio, garage or carport, lot dimensions, other buildings, building height above ground surface. It would help the building inspector, he could use it as a guide. A motion was made by Nile Boyle to use the Information Sheet for Plot Plan and Con- struction for all residential building permits. Seconded by Darlene Blackburn. All Aye. RE: VARIANCE FOR GARBAGE RATES FOR SENIOR CITIZENS AND DISABLED CITIZENS Mayor Porter said that at the last meeting there had been a discussion of a variance for garbage rates for Senior Citizens and disabled citizens. Mayor presented a form that he thought we could have anyone with an intone under $8000 fill out and then reduce their garbage rate to $3.00 a month instead of $4.00 for only one can a week to be picked up. Norris Reese said that he thought it should apply to water and sewer too, no decision was made on that. A motion was made by Nile Boyle and seconded by Morgan Garner to grant a variance to senior citizens and disabled citizens with incomes $8000 or less for one can a week to be picked up. All Aye. (copy attached) RE: MILLION GALLON TANK FINISHED Earl Kemp told the council that the million gallon tank was finished and had been filled and we were using it. We are now ready to salvage the old tank. We need to take down the sides and roof, the floor is still good. Mayor Porter had suggested using the floor for an ice skating rink. We have the contract on the demolition of the tank already, it was scheduled in the million gallon tank. Jim Morris ask if we could negotiate with them. Earl Kemp said that there could be just a slight change in the contract with no increase in the cost. Earl Kemp said that it will be a week and a half until the other tank will be in service. Earl said that he and the mayor had been contacted by the people at Rexburg Heights about hooking on to the new system. We could not allow them to hook up unless they install a pressure reduction valve. The cost would. be about $3500 for the entire subdivision. If the property owners do not feel that they want to do this we would not be able to allow them to hook on. Mayor Porter said that in their agreement they are supposed to maintain their system. The council agree. �y RE: CULVERT 1N CONNECTION WITH CANAL ON NEW LID Mayor Porter said that he and Earl Kemp had met with the property owners that the cnaal along the new LID serve. They did not want a culvert put in.. so Earl Kemp and the Mayor decided to move'the canal back to the north far enough so it does not. interfere with the street, and curb and gutter could be put on both sides. The new canal will be about ten feet from the curb and will be on our right-of-way. RFA WATER PROJECT AND STORM SEWER TO BE FINISHED Earl Kemp said that the water project should be finished in two weeks and the storm sewer in one week. RE: BID DATE ON NEW SEWER PLANT Earl Kemp said that the plans are final on Step 3 on the new Sewer Plant and we should decide on a Bid date. We could set the bid for 45 to 60 days. Earl suggest that we start advertising for bids early enough before there is to much snow on the ground so the contractors can inspect the sight before bidding. Mayor Porter said that he thought we should get started so we can bid it the last of January or the first of February. RE: COUNCIL ASK IF SUGAR CITY HAD GOT FHA APPROVAL YET The council ask if Sugar City had got FHA approval yet. Earl Kemp said that they still have to have their bond election. Jim Morris ask what if it fails. Earl said that they would have to raise their sewer rates. RE: TRAINING PERIOD FOR OPERATOR OF THE PLANT Nile Boyle ask how long of a training period would the operator of the plant have to have. Earl Kemp said that EPA will pick up the salary and train someone. He said that we would need to have a man training when construction started. Earl said it would take one man 2 of the time to take care of the plant. Morgan Garner suggested that we should have two men trained. Earl said that EPA would pay for one person to go to school for two weeks and then train him during construction and on the job. RE: PARKING LOTS NEARLY FINISHED. Earl Kemp said that the parking lots were nearly finished, they still need to put the signs up and the lights. The shrubs would be put in next spring. RE: NEW WATER ORDINANCE DELAYED UNTIL NEXT MEETING Mayor Porter said that since Mary Smith was out of town we would not be able to pass the new water ordinance until the next meeting. We are having the computor programmed to print on each bill the due date for the water bills and the delinquent and shut off date which will be printed on the next bills. RE: BILLS A motion was made by Morgan Garner and seconded by Darlene Blackburn to pay the bills. All Aye. RE: SETTING UP A SAVINGS ACCOUNT Richard Horner told the council that he had talked to Mary Smith about setting up a saving account to use when it is feasible to invest. He also stated that he and the Mayor had decided that they should start a fund for recreation, so it could be readily available on how much the income and expense for that department would be. RE: FEES FOR PLANNING AND ZONING DEPARTMENT Richard also reminded the council that we needed to set up fees so the Planning and Zoning department would pay'for itself. Mary Smith Was checking on an Ordinance setting fees for that department. He also said that they are going to make an in- ventory on the street lights.
