1980, at the City Hall.

Lyle Larson, of First Security Bank was present to go through with the Council a
document that had been made with necessary pertinent information to be sent to inter-
ested buyers of the $233,000 General Obligation Sewer Bonds. The Council gave their
approval with a few minor changes.
RE: MINUTES
Mayor Porter told the council that the minutes of the last council meeting were not
ready, but would be ready by the next meeting.
RE: MINUTES OF SPECIAL MEETING
A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the
minutes of a special meeting held on September 10, 1980, for Public Hearing of LID 24

RE: REPORT ON BID OPENING FOR LID 24

The engineers estimate was a total of $206,000 for the total of both. The low bid for
#1 was Tiger Paving $168,444 - for part #2 Ards Exaavating $21,049, making a total of
$189,493. John Millar said that these were excellent bids and would recommend that we
award the bids to Tiger Paving and Ards Excavating. A motion was made by Morgan Garner
and seconded by Nile Boyle to award the bids to the low bidders, Tiger Paving and Ards
Excavation. All Aye.

RE: Blaine & Dave Niederer MET WITH THE COUNCIL TO CHECK ON DECISION FOR BARE STREET '
Blaine and Dave Niederer was at the council to ask if the Planning Board had made a
decision on Bare Street. Mr. Niederer wants to develop his property on that street
and needs a variance for a cul-de-sac at the end of Bare Street to provide a turn-
around. Mayor Porter said that to put in a Cul-de-sac would improve that street, it
is difficult for the snow p.Xows and the garbage trucks to rurn around. There are three..,
houses on Bare Street. Mayor Porter told him that the council would have to get the
report from the Planning Board before they could make a decision, this would give the
council a chance to go down and look at it.
RE: BEER LICENSE
Mayor Porter read an application for a Beer License for approval for Horkley Self
Service, for bottled and canned beer to be sold but not consumed on the property. A
check for $25. accompanied the application, the permit would only be $12.50 because
a permit bought after the year is half over will cost only half the amount of the
usual license. A motion was made by Nile Boyle and seconded by Darlene Blackburn. All Aye.
RE; FUEL AND OIL BIDS
Richard Horner presented the Fuel and Oil bids. (copy attached) He recommended splitting
it two ways. The recommended low bid would be Sieperts for the Turbine Oil and Motor
Oil, and Madison Coop for the regular and unleaded gas and diesel. A motion was made
by Norris Reese and seconded by Darlene Blackburn to except the low bids of Sieperts
and Madison Coop as recommended by the City Treasurer. All Aye.
RE: AUDIT PROPOSALS.
Sander Larson presented the audit proposals. Rudd, DaBell & Hill $5000, and Galusha,
Higgins, Galusha $5000. Mr. Larson recommended that since both proposals are the same
and that Rudd, DaBell & Hill are local and have done the audit before and are acquainted
with the city's system that the bid be awarded to Rudd, DaBell & Hill. A motion was
made by Jim Morris and seconded by Nile Boyle that the bid be awarded as recommended
by Sander Larson. All Aye.
AE: ONE WAY TRAFFIC FOR ALLEYS ON THE NORTH AND SOUTH OF MAIN STREET
V Jim Morris gave a copy of a survey done by the Police Department and the recommendations
made on the traffic going one way in the alleys on the north and south side of Main
Street. (copy attached) A motion was made by Morgan Garner that the alley's be
made one way, and traffic in the alley on the south side of main street go east and the
traffic in the alley on the north side of main street go west, seconded by Sander Larson.
All Aye.
RE: PRECAUTIONS FOR HALLOWEEN
Jim Morris also told the council that Chief Siepert will be at the next City Council
meeting to explain the precautions that the police plan to take on Halloween.
RE: LETTER FROM THE IDAHO SURVEYING AND RATING BUREAU
Mayor Porter read a letter that the city received from the Idaho Surveying and Rating
Bureau, based on a recent grading of the fire protection facilities of Rexburg, the
City's Classification of fire insurance has been reduced, from Class 6 to Class 5.
As a result there will be an approximate reduction of 9.2% in rates of masonry buildings
while the contents rate will be reduced approximately 6.4$. The rates for frame
buildings and their contents will be reduced about 3.5%. The new rates will be
applied to most buildings of commercial nature. (copy attached)
RE: GRANT FROM THE HERITAGE FOUNDATION
We have received a grant from the Heritage Foundation for $50,000 for repairs and re-
modeling the tabernacle. We have matching funds in the bank, from donations. Plans
will be ready to go to bid before the end of the month. The basement will be used by
the Historical Society.
RE: LETTER FROM U.S. ENVIRONMENTAL PROTECTION AGENCY
Mayor Porter told the council that we received a letter from U. S. Environmental
Protection Agency, telling us that we will get the grant for the new sewage treatment
plant and expansion and construction of an interceptor sewer. (copy attached)
Earl Kemp wants to go to Bid on it right away, but the engineer agreement has to be
reviewed by EPA first.
RE: A NEED TO MEET WITH EARL KEMP ABOUT SUCTION MACHINE TO BE PUT ON EPA GRANT
Jim Morris reminded Morgan Garner that they need to meet with Earl Kemp about the
suction machine that could be put on the EPA Grant. Mayor Porter said that there were
speci'l guide lines for preparing the EPA Grant. We have to make sure that the suction
machine is part, of the project. Mayor Porter ask the council if as soon as we get the
grant from the State of Idaho if it was okay for him to go ahead and sign the EPA
Agreement. A motion was made by Nile Boyle and Seconded by Jim Morris for the Mayor
to sign the agreement from EPA. All Aye.
RE:, CITY REQUIRED TO PASS A FLOOD DAMAGE PREVENTION ORDINANCE

Mayor Porter said that we was required to pass a Flood Damage Prevention Ordinance, or
we would risk suspension from the National Flood Insurance Program. If suspension
occurred, federally -related financial assistance for the construction, purchase, or
refinancing of structures (ie: buildings) in flood hazard areas would not be available
because flood insurance could not be purchased to cover the loans. He also said that
the flood zone in the City has been reduced because of the Barney Dairy Road. The
Ricks Palmer addition will be taken out of the flood zone.

WHICH ORDINANCE APPLIES, BASSIS FOR ESTABLISHING AREAS OF SPECIAL FLOOD HAZARD, COMPLIANCE,
ABROGATION AND GREATER RESTRICTIONS, INTERPRETATION, WARNING AND DISCLAIMER OF LIABILITY;
PROVIDING FOR THE ADMINISTRATION THEREOF: VARIANCE PROCEDURES AND APPEAL BOARD: SETTING
FORTH PROVISIONS FOR FLOOD HAZARD PROTECTION AND SPECIFIC STANDARDS FOR CERTAIN TYPES
OF CONSTRUCTION: SETTING FORTH SPECIFIC PROVISIONS Pertaining to floodways; declaring

A motion was made by Jim Morris and seconded by Nile Boyle that the rules requiring
an ordinance of a general and permanent nature to be read on three occasions be
dispensed with and that said ordinance be numbered 627.

Ordinance 627 was then placed before the council. The Mayor then called for the voting
for final passage of the ordinance, and the motion was made by Morgan Garner and seconded by
Sander Larson that ordinance 627 be passed.

The roll showed all councilmen present voting "Aye" carried, the Mayor declared that
the majority of all the members of the City Council had voted for the passage of said
Ordinance, and that said Ordinance was duly and regularly passed. Mayor Porter
declared the motion carried.
DISCUSSION OF NEW ORDINANCE REGULATING TURNING OFF WATER BECAUSE OF NON PAYMENT
Discussion on a new ordinance regulating the turning off of water because of non payment
of the water bill. Norris Reese suggested that the due date be printed right on the
bills. Mary Smith read from the proposed ordinance drafted by the AIC. It stated that
bills were due on the 15th day after they were mailed and delinquent on the 16th day.
Mary also suggested that the city raise the amount of the deposit to cover one or two
months service, the suggested amount would be $25.00. If people request a hearing
after they are told their water will be shut off because of lack of payment we will have
to have one. Mayor Porter said that we have pledged the money from water service to pay
off revenue bonds, therefore, we cannot let collections stop, we have to make sure that
the bills are paid. It was suggested that there be a $25.00 charge for reconnections
after water has been turned off because of non payment. City attorney will prepare the
ordinance so it can be passed at the next council meeting.
RE: GLEN ERICKSON MT WITH THE COUNCIL ABOUT OILING THE ROAD PAST THE RESERVOIR
Glen Erickson was present at the city council to ask about oiling the road past the
reservoir that goes up to Rexburg Heights. Mr. Erickson had checked with AMF-, who
said that they would not do it right now. He had checked with Dell Klinger and Leo
Smith from the"County Commissioners, who said the county could not pave it because it
was too expensive, but they would consider paving it if the City would go 50-50 on the
cost. Mayor Porter told him that the property has been annexed by AMR, and when the
developer annexes property they have to put in curb and gutter and oil it when they start
building, however they have not started building so legally do not have to oil it until
they do. Mayor Porter told him that he sympathized with the people up at Rexburg Heights,
but the city could not afford to pave the road. He reminded Mr. Erickson that Rexburg
Heights is not in the City limits. He told him that we have roads within the city that
we need to repair and pave.

A regular meeting of the City Council of the City of Rexburg, Madison
County, Idaho, was held on Tuesday, the 8th day of October, 1980, at the hour
of 7:30 o'clock P.M. at the Council Chambers in the City Hall, being the
regular meeting place of said Council, at which meeting there were present
and answering roll call, the following, who constituted a quorum:

Thereupon the following proceedings, among others, were duly had and
taken:
RE: BIDS FOR LID # 24
The City Clerk stated that the inviation for bids for the construc-
tion of improvements in Local Improvement District No. 24 for the purpose of
causing certain streets and alleys and parts thereof within the corporate
limits of said City to be graded, re -graded, graveled, paved, re -paved and
otherwise improve certain streets within the District and to construct and
reconstruct curbs, gutters, drainage facilities, and other work incidental
to all of the foregoing improvements along said streets within said District,
had been duly published and presented the publisher's affidavit of publishing
such notice.
The Mayor reported that pursuant to said Notice -the bids for the
construction of improvements for Local Improvement District No. 24 were
publicly opened at the time and place therein specified and read aloud;
that the bids received were in two parts and were as follows:
Part One (All Except Utility):

Part Two (Utility Work):

The Mayor stated the bids after opening, were referred to the City Engineers
to examine and make recommendations to the Council at its meeting at 7:30 P.M.
October 8, 1980.
John Millar of Forsgren and Perkins stated he had examined the bids
and that Tiger Paving with its bid of $168,444.00 for Part One was the low
bid and Ard Excavating of $21,049.00 was the low bid for Part Two; that these
were both excellent bids; that both bids were below the Engineer's estimate;
that both companies are responsible bidders and fulfilled requirements; that
because of rising material and labor costs, it was likely better bids could
not be obtained at a later date, and that he would recommend that the bids
be awarded to Tiger Paving and Ard Excavating. The matter was discussed.
Councilman Morgan Garner presented the following Resolution and
moved its adoption:
RESOLUTION NO. 2
WHEREAS, the bids received from Tiger Paving for Part One, and from
Ard Excavating for Part Two for construction of improvements for Local
Improvement District No. 24 were the lowest and best bids received and were
below Engineer's estimates, and
WHEREAS, said bidders were and are responsible and lowest bidders,
fulfilling the requirements, and it is doubtful that lower bids could be
obtained at a later date because of rising material and labor costs.
NOW, THEREFORE, BE IT RESOLVED that the City of Rexburg, Idaho,
accept the bid of Tiger Paving and enter into a contract with Tiger
Paving for construction of Part One improvements for Local Improvement
District No. 24, and accept the bid of Ard Excavating and enter into a
contract with Ard Excavating for construction of Part Two Improvements for
Local Improvement District No. 24, said contracts to be upon such terms of
payment as shall be fixed by the Council; that the Mayor and City Clerk be
and they are hereby authorized and directed to execute said contracts with
Paving and Ard Excavating; that copies of said contracts, after execution,
are to be on file in the office of the City Clerk and will be available for
public inspection.
The adoption of the Resolution was seconded by Councilman Nile Boyle.
The Mayor called for a vote of the Council members which was as follows:

The Mayor thereupon declared the Resolution carried.
There was no further business before the Council pertaining to

purposes has changed from Class 6 to Class 5. As a result of this grading
there will be an approximate reduction of 9.2% in the rates for masonry
buildings while the contents rate will be reduced approximately 6.4%.
The rates for frame buildings and their contents will be reduced about
3.5%. The new rates will be applied to most buildings of a commercial
nature and if their rates do not benefit by the amounts shown above, it
will be due to the conditions affecting the buildings themselves. There
will be the normal change in the dwelling rates as shown in the Dwelling
Policy Program for Class 6 and Class 5 dwellings.

Dear Mayor Porter:
It is my pleasure to advise you that your application for a grant to
assist in construction of treatment plant upgrading and expansion and
construction of an interceptor sewer to serve the Sugar City area has
been certified for priority by the Idaho Department of Health and Wel-
fare and approved by the Environmental Protection Agency. The grant
amount is $2,253,526, which consists of $2,225,925 from the general
• fund plus $27,601 from the innovative/alternative reserve fund for an
additional 10 percent federal participation in the estimated cost of
alternative project components.
This grant is subject to the applicable terms, conditions, and procedures
of the EPA's grant regulations (40 CFR.Chapter 1, Subchapter S). The
regulations entitled "Construction Grants Program" were published in the
Federal Register on September 27, 1978 and are enclosed for your review.
Since these regulations incorporate recent revisions and additions which
are highlighted in the introduction to the regulations, it is recommended
that you discuss with your consultant the need to comply with these new
requirements. Your special attention is directed to Section 35.935
entitled "Grant Conditions", and to the specific conditions included in
the grant amendment.
Partial grant payments will be made approximately in accordance with
the schedule for payments indicated in your grant amendment. Requests
for payments should be submitted on the enclosed SF 271. In addition,
we have included materials to assist you in the preparation of this form;
determining the eligibility of direct and indirect costs; and establish-
ing an acceptable accounting system. All costs for which reimbursement
is requested are subject to verification by the final project audit.

Please review the enclosed grant amendment thoroughly, particularly
the conditions set forth in Part III. If you find it satisfactory,
sign, date and return by certified mail an original and one copy to
this office (Attn: Grants Administration Office) within three weeks
of receipt. The amendment must be signed by the authorized repre-

profits. The city of Rexburg is now a member of the

Councilman Jim Morris:
A survey was made on a proposal that the area
on the North side
of rain street between Center street and lst East be
posted to restrict
one way traffic only going West. In checking with
the following bus-
inesses, I found that there was no opposition whatsoever
and that all

Mr. Nyle Boyle, owner of Johnson Drug, felt that there was really
no need for the area to be changed, however, indicated that he would sup-
port the one way alley. Manager of Hudson Shoe Business felt that the
alley should be left as is due to the fact that trucks unloading by Porter.
Bookstore often times block the alley making it necessary for himself and
his employees to come in to their business from the opposite direction.
Manager of Parts Service also felt that the unloading trucks would creat
a problem if the alley was restricted to one way. All the other owners
felt that it would be a good idea and would support a one way alley.
In surveying the alley between 1st East and 2nd East on the North
side of the City, it was determined that,those businesses effected dir-
ectly was in favor of the one way alley going East:
Rexburg Standard and Journal
United Plumbing and Heating
There was some concern about unloading steel at United Plumbing
and they felt that arrangements would have to be made to allow the truck
to unload from the opposite direction. I see no problem with this and
I believe in cooperating with the businessmen, the enforcement of the
alley's could be accomplished.
The alley on the South side of the City between Center street and
1st West should not interfere with any particular business and I feel
could be placed one way going East with no probl m.

RE: STUDENTS FROM THE RETURNED MISSIONERY FRATERNITY TO HELP CLEAN STREETS AND ALLEYS
Sander Larson told the council that there are 70 students from the returned missionery
fraternity that would like to give lh hours of their time from 5:30 P.M. to 7:00 P.M.
on Wednesday, 0 c tober 15 and go up and down main street and the alleys, and clean up
the streets, parking lots and flower beds. He ask if the city could provide the trucks
and shovels. He thought possibly some of the stores would furnish donuts and punch
for them. Jim Morris said that he would arrange for the trucks and shovels.
RE: DRAINAGE PROBLEM BEHIND JOHNSON DRUG
John Millar discussed with the council the drainage problem behind Johnson Drug. The
council decided that since the crews are working so close to the problem that they should
put inra catch basin.

JOHN MILLAR & EARL KEMP RECOMMENDED AN INCREASE IN WATER CAPACITY TO RICKS PALMER ADDITION
John Millar told the council that he and Earl Kemp wanted to recommended that since the
Ricks Palmer Addition is now fed by one 8" water line it is quite marginal, and since we
have money left after the other projects are finished, we should increase the capacity
by putting in a larger line. A motion was made by Morgan Garner and seconded by Nile
Boyle that we increase the capacity to that addition pending that we have enough money.

RE: DRAINAGE PROBLEM AT CHARLES SMITH PROPERTY
John Millar told the council that the drainage problem at the Charles Smith property
had been taken care of.
RE: PUMPS AT PORTER PARK AND SMITH PARK
The engineers told the council that the pumps at Porter Park and Smith Park should not
need to be turned on with the new system. Porter Park pump should be drained and
turned off. There is no reason to run that pump we should have adequate pressure.
Norris Reese said that they would have a valve put on the pumps so they can be drained
and turned off.
RE COMPLETION OF STORM DRAINS
John Millar said that we are very near completion of the storm drains and need to be
sure to check out any problems or anything that is not finished.
RE: DISCUSSED GARBAGE RATES FOR SENIOR CITIZENS
Mayor Porter told the council that we have had some people in the City Hall since we
raised the garbage rate to $4.00. Widows and couples who are senior citizens and only
put out one can of garbage don't think they should have to pay $4.00 for garbage. The
mayor said that he thought we should work out a rate for Senior Citizens similar to tie
tax reduction that the county gives. We could have a special form for them to sign.
The mayor and city clerk will get it worked out.
