HomeMy WebLinkAbout1980.09.03 CITY COUNCIL MINUTES53 RE: SEWER DAMAGES THAT HAVE BEEN DONE TO HOMES - DUE TO H & K CONTRACTORS Mayor Porter told Earl Kemp that we need to check with H & K Contractors about sewer damages that have been done to homes. Two or three people in town have had their basements flooded from the sewer, because they have broken sewer lines. The people cannot wait for the insurance payments. Earl Kemp said that the City should go ahead and pay the damages and then withhold that amount from their pay check. People should not have to suffer for their mistakes. Two of the people that had damages that should be paid was Don Ard and Paul Neeley. RE: SUGGESTED ADOPTION OF ORDINANCE SETTING COSTS FOR PLANNING AND ZONING Sander Larson suggested that we should adopt an ordinance setting costs for Plan- ning and Zoning. Mary Smith will check on it. RE: BILLS A motion,was made by Morgan Garner and seconded by Sander Larson to pay the Bills. All Aye. Present were the following: Mayor: John C. Porter Councilman: Morgan Garner Nile Boyle Norris Reese Sander Larson Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk Richard Horner, City Treas. RE: MINUTES APPROVED A motion was made by Darlene Blackburn and seconded by Nile Boyle to approve the minutes. All Aye. RE: BUDGET HEARING REPORT A Budget Hearing was held with no citizens present to protest. Mayor Porter told the council that a few budget figures had been changed as they were published, because of estimated revenue from Federal and State Grants and Addition errors. The revenue from Federal and State Grants had been changed reducing it $43,400 making it $48,600 instead of $92,000. An error in addition of $5600 was corrected in the water department expenditures and adjusted with the difference in the State and Federal Grant Revenue. The Total Budget Figure will remain the same as pub lished, $1,683,090. A motion was made by Nile Boyle and seconded by Morgan Garner to approve the budget with the corrections. All Aye. RE: ORDINANCE NO. 623 City Attorney read Ordinance No. 623, The Annual Appropriation Ordinance. AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF REXBURG, IDAHO, FOR THE FISCAL YEAR OCTOBER 1, 1980, TO SEPTEMBER 30, 1981, AND APPROP- RIATING TO THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID FISCAL YEAR, AND ALL OTHER SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES AND LIABILITIES OF SAID CITY FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1981. A motion was made by Councilman Morgan Garner and seconded by Darlene Blackburn that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 623. Those Voting Aye: Those Voting Nay: Darlene Blackburn Sander Larson Norris Reese Nile Boyle Morgan Garner None Ordinance 623 was then placed before the council. The Mayor then called for the voting for the final passage of the Ordinance, and the motion was made by Nile Boyle and seconded by Norris Reese that Ordinance 623 be passed. Those Voting Aye: Those Voting Nay: Darlene Blackburn Sander Larson Norris Reese Nile Boyle Morgan Garner None The Roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said ordinance, and that said Ordinance was duly and regularly passed. Mayor Porter declared the motion carried. RE: BUDGET DISCUSSION a:»fJr #,Pict' said that he wanted to impress to the council and employees that this was a very austere budget. The budget had gone up 10% from last year. This is just because the costs to operate the city had gone up 10%. We will have to postpone buying a police car and a puckup for the street department and maybe some other items, until we have the money. RE: BEER LICENSE TRANSFERED, V-1 GAS & GROCERY TO R.D. WATERS Mayor Porter read a request to transfer a beer license at V-1 Gas & Grocery at 172 West Main, to R. D. Waters the fee being $5.00. A motion was made by Nile Boyle to approve the beer license transfer and seconded by Morgan Garner. All Aye. RE: NEW WATER TANK Earl Kemp reported on the progress on the water tank. The new elevated water tank will be completed Wednesday, and tested on Next Friday Sept. 12, when the pumps are installed and painted on September 15. The tank will be in service by October 1. The lower million -gallon tank will be painted next week. RE: MEETING WITH MR. LONGHURST TO DISCUSS POWER BILLS FOR WATER PUMPING Richard Horner told the council that he had gone over the power bills for water pumping with Leonard Longjurst a representative from Utah Power & Light. He had made suggestions as to when the pumps should be turned off and on to save demand charges. 5-5 RE: STORM SEWER PROJECT SOON COMPLETED - AND WATER PROJECT The Storm Sewer Project should be completed and cleaned up by September 15. The road work should be completed in two weeks. The storm drain project that Zollinger Construction is doing should be completed in 30 days. The Water Project work will be finished in 30 days. Only one line remains to be installed. RE: STREET REPAIRS Nile Boyle questioned Earl Kemp about the street repair. He questioned him as to if the seal coating of the street was doing any good. There were some spots that he had seen that it had no helped. Sander Larson questioned Earl Kemp, saying that they were one month behind on the street repairs. He ask about the work on First West, and why it had not been finished. He stated that the streets were an eyesore to the community. He stated that they were 30 days behind on the repairs. RE: PHONE CALL TO H & K CONTRACTORS Earl Kemp said that he was aware of the delay and had called the President and Vice President of H & K. He told them that the city was spending a lot of money this summer with them and feel that we should have priority in completing the streets. This project was delayed thwn a portion of the project was removed from the orginal contract to get a better price on replacing concrete. By Law we need to give them so much time to complete the project. Most patching is done. Earl Kemp said that lst West will be finished next week. Threr is going to be a lot of little things that we need to make sure are completed. He said that he wanted the executive committee over the street department to go around with him and check everything out to make sure it is all finished the way it should be. RE: BID OPENING FOR PARKING LOTS Earl Kemp said that the Bid Opening for the Parking Lots would be held next week. RE: LID PROTEST HEARING SEPT. 10 Mary Smith reminded the council that the LID protest hearing will be held Wednesday September 10, 1980 at 8:00 P.M. . RE: CHARLES SMITH'S DRIVEWAY Earl Kemp ask what the council was going to do about Charles Smith's driveway. Mayor Porter said that he had forgot to talk to him. Morgan Garner said that he had been doen to look at it and thought Mr. Smith could have done something about the prob- lem when he put in the driveway. RE: DITCH BY AUTUMN ARBOR Norris Reese ask when the ditch by Autumn Arbor would be filled in. Mayor Porter said that we were not going to use the ditch anymore and it would be closed. He said that he had talked to the engineers about it, who had told him it was scheduled to be filled in, but they were behind on their schedule. Mayor Porter said that when he got the easement for the parking lots he had told them that we would hook up their sumps. RE: PLANS AND SPECIFICATIONS FOR LAGOONS Earl Kemp said that the plans and specifications for the lagoons are being checked by the Corps of Engineers. It would then be submitted to EDA. After the approval of Step 3 in October. they would advertise for bids which would be awarded in Nov- ember so that the work could be started in the spring. Mayor Porter said that we needed to get rid of the weeds at the lagoons. If the weeds are gone it will help get rid of the mosquitos. RE: ORDINANCE y City Attorney read ordinance 624 - changing the sewer rates, increasing them 50G per month. AN ORDINANCE AMENDING SECTION ON E SUBSECTION SEWER SERVICE RATE SCHEDULE OF OR- DINANCE NO. 431 OF THE CITY OF REXBURG, IDAHO, BY PROVIDING INCREASED MONTHLY RATES FOR SEWER SERVICE FOR SINGLE FAMILY DWELLING UNITS AND MULTIPLE DWELLING UNITS, IN_ CLUDING APARTMENTS AND DUPLEXES; PROVIDING AN EFFECTIVE DATE A motion was made by Councilman Nile Boyle and seconded by Darlene Blackburn that 5' the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 624. AN ORDINANCE AMENDING THAT PORTION OF SECTION ONE OF ORDINANCE NO. 599 OF THE CITY OF REXBURG, IDAHO, WHICH PROVIDES FOR MONTHLY CHARGES FOR GARBAGE REMOVAL SERVICES FOR EACH OCCUPIED RESIDENCE AND/OR OCCUPIED RESIDENTIAL PREMISES WITHIN.THE CITY OF REXBURG, IDAHO, BY INCREASING THE MONTHLY CHARGES, AND PROVIDING WHEN THE INCREASED CHARGES SHALL BECOME EFFECTIVE. A motion was made by Councilman Nile Boyle and seconded by Councilman Norris Reese that the rules requiring an Ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 625. Those Voting Aye: Darlene Blackburn Nile Boyle Morgan Garner Sander Larson Norris Reese Those Voting Nay: None RE: DRAWINGS OF THE NEW PARKING LOTS Earl Kemp showed drawings of new parking lots pointing out the lighting and sprink- lingsystem. Var Manwaring was present with a proposal on the parking lot on Carlson Ave. and Center. He would like to tie in the property and alley in back of his buildings on that street. He proposed to eliminate some of the parking places on the drawing and add some parking places from his property. He plans to put a bus- iness in at the rear of his building and it would be advantageous to him to have the property connected to the parking lot. He needed to have that access so he can get to the back of his building. Earl Kemp said that the one concern would be vandalism unless it was properly lighted. Mr. Manwaring said that it was lighted. Mayor Porter said that Earl Kemp said there would be no problem in making the change. Earl Kemp, John Millar, and Manwarings would get together and work it out. The bid opening would be next Wednesday. There was a question as to whether to put in a 'f curb, stops or an elevated sidewalk to keep cars from running into the building. Earl Kemp said that they would put in stops now and see if it would work. The disadvantage to that is snow removal. Nile Boyle advised Earl Kemp to ge together with Manwarings and adjust the plans and have it ready for the bid. The council ask Earl about a time- table, he said it should be done in 60 days. The council said they wanted it done by Thanksgiving. RE: SPRINKLING SYSTEM ON EAST MAIN Mayor Porter said that there was a problem with the sprinkling system on East Main. John Millar had recommended tearing up the grass and putting new in after the sprink- ling system is put in. RE: LID ON STREETS Mayor Porter said that with regard to the New LID on the streets, Gerald Jeppesen had come in the City Hall to see him. He lives on 4th South and 4th West and is concerned about if we drain into 4th South that the flooding problem will be worse. The Mayor had told him to come to the protest hearing next week. Mayor Porter said that while we are doing the LID we should level off the bank of the canal so we can mow the weeds on it. RE: BOB SMITH RECOGNIZED WORK WITH SUN CITY PEOPLE Sander Larson said that he would like to recommend that we recognize the efforts of Bob Smith, for his work with the Sun City People. We should extend appreciation to him and Ricks College for work they did for these people. A motion was made by Norris Reese and seconded by Nile Boyle to express appreciation to Bob Smith and Ricks College. All Aye. Mayor Porter said that he had a Key to the City he would like to present to Bob Smith at the next council meeting and also get a picture for the paper. RE: COMMUNITY CONSULTANTS Mayor Porter said that he had met with Community Consultants of Provo, Utah, they will do the water study for the city for $5000. The council gave him the okay to tell them to do the study. He said that they would start on September 10. RE: TELEMETER SYSTEM Earl Kemp said that he needed to issue a change order on the telemeter. One system would run all the systems in the Sewer and Water. RE: BILLS A motion was made by Nile Boyle and seconded by Sander Larson to pay the bills. All Aye.
