Porter City Clerk - Ro agley MINUTES OF THE CITY COUNCIL MEETING July 2, 1980 State of Idaho) County of Madison(SS City of Rexburg) A meeting of the City Council for the City of Rexburg, Madison County, held July 2, 1980, at the City Hall. Present were the following: Mayor: John C Porter Councilman: Morgan Garner Nile Boyle Norris Reese Jim Morris Sander Larson �% Councilwoman: Darlene Blackburn Also Present: Rose Bagley, City Clerk Mary Smith, City Attorney Richard Horner, City Treasurer RE: MINUTES APPROVED A motion was made by Norris Reese and seconded by Jim Morris to approve the minutes as corrected. All Aye. RE: FIREWORKS PERMIT Mayor Porter read a fireworks permit for Kristy Fullmer and Gina Ann Garner to sell fireworks at the Junior High Parking Lot. A motion was made by Nile Boyle and seconded by Norris Reese to approve the permit. All Aye. RE: PAYING DELIQUENT LIDS Mayor Porter told the council that three people have came in the City Hall, after they had recieved the letter from Mary Smith about their LID, and wanted to make arrangements to pay their LID over a period of a few months because they were having a difficult time paying it all at once. The council agreed to this arrange- ment. A motion was also made by Nile Boyle and seconded by Jim Morris to proceed with legal action against the people who have not contacted the City Office or paid the deliquent LID'S. All Aye. RE: CHARLES SMITH REQUESTS TO PASTURE A HORSE Charles Smith was present to make a request to pasture a horse at the old Ross Covington's property at 169 North 5th West. This property is by the old barn and the Fair Grounds. He would like to pasture the horse for 12 months. A motion was made by Jim Morris and seconded by Nile Boyle to grant permission for the horse to be pastured on that property with the provision that if there are any complaints he would have to move the horse. All Aye. RE: BARN ON NORTH 5th WEST Discussion on the Barn on North 5th West. The council said they would have to check on it apparently there are horses and rabbits in the barn. RE: DELIQUENT LID #23 Richard Horner ask if he could give the list of deliquent LID #23 to Mary Smith to proceed with collection letters. The council gave their permission. RE: FINANCE COMMITTEE REPORT Sander Larsen gave a report on the Finance Committee. The committee had met and went over the bill from Early Bird Sprinkler. Before a decision can be made, the committee needs to look at the Liability Insurance Policy that was in force at the time they had a contract with the City. The City Clerk had written a letter to them requesting that they supply a copy of the insurance policy for review. RE: WORK STARTED ON NEW BUDGET Sander Larsen said that it is time to start working on the new budget. The depart- ments need to get everything ready to start and decide what their needs will be. The finance committee is concerned about one department borrowing from another and one fund borrowing from another. The city has come to the point that they need to be careful of how and where we spend money. RE: RATES AND INCREASES FOR WATER AND SEWER Earl Kemp had prepared a report on rates and increases for water and sewer. (copy attached) The increased rate would provide for a $34,000 profit with no depreci- ation fund. Mayor Porter objected to the increase, he said it would double every- on's water bill. The proposed increase would make the resident rate $5.00 for a minimum of 4,000 gallons and anything over 4000 would be 20G per thousand: the business rate would be $6.50 for a minimum of 4000 and 2ft per 1000 for anything over 4000 gallons per month. All college, schools, and churches would be 710, per thousand. Mayor Porter said that if we had that much profit, the thing that would happen to the budget would be that we would spend the extra. He said that in order to raise the rates that much we should hold a public hearing. The Council discussed how to pay the general account what the water department owes it. The Mayor told them that the water department didn't loose money last year. Revenue Sharing was used for the purchase of a pickup. Norris Reese suggested that the water depart- ment should have a depreciation account for capital expenditures. The mayor point- ed out that the people in Rexburg have to pay more for power than some other cities and we need to take that into consideration. We need to have our rates competitive with other cities. He explained that usually each year the city has to issue a Tax Anticipation note, being we haven't done it this year and we are about $50,000 short because of it. The State of Idaho calls for us to use money from taxes of the last year for this year. Some cities have built up a surplus so they don't have to borrow. The Mayor said that a city cannot generate capital and hold it. We have to spend it that year or cut back tax levy for that amount. The city needs to raise the rates to whatever it costs to operate the water department. The council discussed the rates at length and decided to turn it over to the finance committee to study. They did however discuss a suggested rate of $5.00 and $6.50 and then raising the rate after the minimum to 20G per thousand. The mayor felt that the college rate would be okay and that churches and schools should pay as much as businesses, we need to be realistic. Under the new preliminary figures the sewer fee would be raised to $4.50 per month instead of $2.00. The increase would cover operation and maintenance of the system and accumlate enough money to pay back bonds which would be sold to pay the city's share of upgrading the sewer treatment system. However, if the bond election fails the sewer fee will have to be raised to $7.50 and be on a pay as you go basis. The bond election will be held on July 29. Sander Larson questioned what was being done on advertising for the bond election. The mayor told him that we were issuing literature in the city office to people, and that pamplets were being printed to be passed out in the next week. We were going to get publicity in the papers, and over the radio. We could buy spots onthe radio for the councilman to give their comments about the bond election. The councilman could also speak at civic and community meetings. SEWER Existing Rates $2.00 per unit WATER $3.00 for a minimum of 4,000 gal. $.20/1000 gallons over 6,000 gal. $.12/1000 gallons over 10,000 gal. Business rate -$3.50/4,000 gallons $.20/1000 gallons over 4,000 gal. $.17/1000 gallons over 10,000 gal. $1.50 for every extra unit All churches and schools are $.15/1,000 (flat rate) College - $.10/1,000 (straight) GARBAGE $3.00 per resident $5.00 per business $2.00 for each extra unit Bin - Charged per pick-up $2.00 for most bin pick-ups The more cans a business has, the more they are charged. At the present time the city is coming out even in that department. He ask about the new equipment for that department. Mayor Porter told him that all the equipment had been bought with revenue sharing money. RE: TIME CD'S Nile Boyle said that the finance committee had a question about the $100,000 Time CD that the City has. $65,000 of that money has been promised to the new Golf Course Club House and it was also promised to the LID Fund. RE: BUDGET FOR 1980 Richard Horner told the council that when figuring the budget this year we need to consider that we were not sure if the revenue for the next year would match up with the last years figures. We would probably have less property tax. Mayor Porter said that there would be more property tax because we levied more and the valuation is higher. The Mayor also explained the Homested Act. Tax money will be the same next year regardless. When the city has a law suit such as the Mickelsen suit, we can levey for court costs on the property tax outside of the 1%. We can also do this on additional firemens retirement. RE: RESOLUTION AUTHORIZING THE INVESTMENT OF MONEY Sander Larson said that the finance committee had discussed investing money when it was available. He introduced a resolution authorizing the City Treasurer to invest money under the direction of the Mayor or Chairman of the Finance Committee. (copy attached). RE: EPA FUNDS FOR THE NEW SEWER SYSTEM Norris Reese said that he had been questioned by concerned citizens since the news paper article had come out about President Carter freezing EPA funds for the new sewer system. Mayor Porter said he thinks we can squeeze the money out after the lst of October. The mayor said if we can pass the bond election that will put us on the list for the money. Earl Kemp said that if we can get the bond election through, we can wait to sell the bonds until we can get the money. RE: PLANS AND SPECS READY FOR SEWER SYSTEM Earl Kemp said that the plans and specs are ready on the Sewer System. He will show them next week at the regular committee meeting at 41:30 P.M. wednesday at Forsgren Perkins. RE: MORE PEOPLE TO BE PUT ON LID Mayor Porter said that there were somemore people that want to be on the LID. Ruth Smith wants 350 South Street finished. They own both sides of the street. Also someone was in and wanted 4th West from Main Street to jLst South finished. A Mr. Niederer came in and he wants to extend Bare Street and put in a Culdesac turn around in. He will pay for it but he just wants to be included when the LID is done. He will have to pay separate. Earl suggested that the LID be bid in two portions. Morgan Garner made a motion for the LID to be bid in two portions. Seconded by Norris Reese. All Aye. RE: INSPECTION OF CITY BUILDINGS Mayor Porter read a letter from the State Department of Labor and Industrial Services. An inspector had been to Rexburg and inspected all of the City Buildings. They had listed all the violations that the city needed to correct. (copy attached) RE: CENSUS REPORT Mayor Porter said that he had had a number of people calling to see if the City was going to protest ouy^census report. The water department is going to spot check if the vacancies are less than they have counted we will protest. RE: DISTRIBUTION OF STATE LIQUOR FUNDS Richard Horner said that he had gotten a letter from the State Liquor Department about the distribution of funds. We need to send them a correct census to raise the allication. RE: WATER TANKS Earl Kemp gave color charts to the council to pick for the water tanks. RE: MINUTES APPROVED A motion was made by Nile Boyle and seconded by Darlene Blackburn to approve the minutes as corrected. All Aye. RE: REQUEST BY RICHARD SMITH TO HOOK UP TO THE CITY WATER Mayor Porter said that he hada request by Richard Smith to hook up to the City Water when the new water line is put in up by his property on the hill. He plans to build a house there. The property is 100 feet from the line, but no in the City Limits. Ruth Smith also called to say she would like some of her property that is just outside the city limits to be hooked on to the city water. A motion was made by Nile Boyle to allow Richard Smith to hook up to the City Water and then later the property could be annexed to the City, seconded by Norris Reese. All Aye,
