A meeting of the City Council for the City of Rexburg, Madison County, held June
18, 1980, at the City Hall.
Present were the following: Mayor: John C. Porter

RE: CABLE T.V. DISCUSSION
Richard Strodell representing Cable T.V. was at the meeting to discuss and make the
council more familiar with Cable T.V. Since Don Ellis had sold his interests in the
Cable T.V., it had fallen on Mr. Strodell's shoulders to take over the reins. He
brought the council up to date on what is going on in the Cable news and what is
happening in Cable. They are going to try to bring in at least two more channels.
RE: UTAH POWER & LIGHT REQUESTED TO PARK A TRAILER
Mayor Porter read request to park trailer from Utah Power & Light on the Service
Center property on a foundation. They did not circulate a petition, but the trailer
would be parked inside the compound. A motion was made by Darlene Blackburn and
seconded by Jim Morris to let them park the trailer at the Service Center. All Aye.
RE: REQUEST FOR KAY PERRENOUD TO PARK A TRAILER
A request for Kay Perrenoud to park a trailer at 265 South 5th West. All the
neighbors have given their okay. They want a temporary permit for one year. A
motion was made by Nile Boyle and seconded by Morgan Garner to give them a permit for
one year to put the trailer at 265 South 5th West. All Aye.
RE: EARL KEMP REPORTS
Earl Kemp reported that everything was going great with the projects. He said that
President Carters's freeze will have little effect on the Sewer Grant. The money
has already been appropriated out of 1979 money, so it should have no effect on it
and the President should release it by this fall. It can also be declared a health
hazard and money will have to be appropriated for it.
RE: USE PRECATUIONS WHEN CITY FILLS IN BASEMENT HOLES
Jim Morris ask Mary Smith what precautions needed to be taken if the City fills in
basement holes on people's property. She advised that the city needed to get a written
statement from the property owner giving them permission to fill in the hole.
RE: STREE'T'S BEING TORN UP TO PUT IN NEW STORM SEWERS
Earl Kemp also reported that the streets were being torn up all over town for the
storm sewers. Work will begin in the next few weeks to erect the elevated water
tank and the 1st of July to install new water lines. Bids for the LID Project for
curbs and gutters will be let as soon as the necessary paperwork is completed.
RE: NEW TURN AROUND AT PROFESSIONAL PLAZA
Jim Morris ask Earl Kemp if he had an estimate on the cost to put a change turn
around at Professional Plaza. Earl told the council that the contractor will just
put the curbing in and the city will put in the top soil, so that will keep the
cost down.
RE: APPROVAL BY EPA FOR PLANS AND SPECKS ON STORM SEWER
Earl Kemp said that the preliminary plans and specks and been approved by EPA for
the sewer system and that now they aere getting the final plans and specs ready to
send in to EPA.

RE: DRAINING THE PARKING LOTS
Nile Boyle ask Earl Kemp if there would be any problem draining the parking lots into
the storm drain. He said there would be no problem. Nile said that as soon as the
Title Company was finished with their work, the committee needed to get together and
et the adjustments. A discussion on how to allocate the parking for the businesses
at Madison Square.
RE: SUMP PUMP WITH SWEEPER
Jim Morris said that he had talked to another company about a Sump Pump that a street
sweeper could be added later to. Earl Kemp said they would have to write the per-
formance specs on the machine and call for bids.
RE: NEED TO GET A BILL IN TO GET THE SEWER MONEY
The Mayor said that he had gotten a call from Mc Clure's office telling him that
he is trying to get a bill in so that we can get the sewer money released.
RE: GRANT FOR NEW GOLF COURSE CLUB HOUSE
Nile Boyle ask Earl Kemp about the grant for the new Golf Course Club House. He
said that it did not look good. We are on the top of the lower third of the list,
which is not high enough to get any money at the present time. He said that the
county was getting their budget ready for the city to go over. The budget that
they have set is $91,000 for next year and they anticipate about $43,000 in reven-
ues. The balance left to be split by the County and City would be $38,000. The
golf play in this area is increasing, so possibly in the future the revenues will
increase. Nile Boyle ask that the FAA was going to do about the golf ball hitting
the airplane. The Mayor said that if FAA comes in to talk to us then we could get
it straightened up. If the planes stay in the regular pattern they are too high
to get hit by golf balls.
RE: NEW PARK ALMOST READY FOR AUDITORS
Jim Morris said that the new park was nearly ready for the auditors. He said that
next year the school will have to police the ballgames to keep the litter down. The
city had to clean up a lot of litter this spring that was left from ball games.
RE: RETENTION POND ON HAROLD NIELSON'S PROPERTY
Mayor Porter said that he and John Millar and Earl Kemp had been down to Harold
Nielson's on South 4th West. They would like to put a retention pond on his prop-
erty. Mr. Nielson said that he would give the city an easement for the retention
pond if the city in return would oil his street and he would pay for the curb and
gutter. To oil the street it would cost about $ 2400. He will still be able to
use his property for pasture. Morgan Garner ask what the advantage would be to oil
that street because it was a deadend street. Earl Kemp said that eventually it
would go through to 7th South. Mr. Nielson wants to eventually sell the property
for lots, and then he will go under a LID and finish the street. Earl Kemp said
that it would cost us as much to purchase land for a retaining basin as it would
to pave the street for the easement, and still have the finished street.
RE: FIREWORKS PERMITS
Mayor Porter read fireworks permits for approval for the following:
Ken Brown at Albertson's parking lot
Darrell Henderson & Samuel Gardner at Henderson Warehouse 160 North 2nd East
Skaggs Drug at 125 East 350 North
M.H. Kings at 44-48 East Main
Mighty Mite at 167 West Main
Chateau Drug at 121 East Main
A motion was made by Morgan Garner and seconded by Jim Morris to issue permits to
the above named places to sell fireworks between June 26 and July 26, 1980. All Aye.
RE: DARWIN MICKELSEN'S BEER LICENSE
Mayor Porter read an application for a beer license for Darwin Mickelsen's Bar for
the sale of beer to be consumed on the premises. Attached to the application was
the check for $ 100. The Supreme Court had ordered the City to issue the license.
Nile Boyle questioned if he was required to put up a fence. He had received phone
calls stateing that Mr. Mickelsen had promised in the court that was held origin-
ally held in Rexburg to put up a fence. The city attorney said that since the
license was turned down at that time and went to the Supreme Court, he would not
have to build the fence. Nile Boyle ask if there was an ordinance requiring a
business to put up a fence. Mary Smith said there wasn't.: A motion was made by
Darlene Blackburn and seconded by Jim Morris to approve the beer license.

RE: PRELIMINARY REPORT ON THE CENSUS

Mayor Porter gave a printout on the preliminary report on the census. He explained
it to the council (copy attached). The preliminary report shows a population of
10,451. The last official census in 1970 was 8270, which shows an increase of
26.3%. This count does not include the people that have been missed in the census
or any annexations since 1978. The mayor showed a map with the specific areas
drawn out and the corresponding count of the houses on the report. The mayor
suggested that a count be made by the city of the houses in each area to see if
the report was correct. He said that the water department would go around and
check the count. Students that live here for 7 months or more can be counted in
the Rexburg census rather than their own home town. Many of the students were
missed in the census. The census people felt that the census would go up to
about 10,900 after they finished it.
RE: BOND ELECTION
Discussion on the bond election. Pamplets will be ready next week to hand out.
RE: INCREASE IN STATE TRAVEL ALLOWANCE
Mayor Porter said that he had included in each councilmans folder a printout on the
increase in State travel allowance. It has been increased from 17q, to l8q, a mile
and meals from $12.00 a day to $15.00 a day. Nile Boyle made a motion to increase
travel allowance to the same as the State, seconded by Morgan Garner. All Aye
RE: STATE CALLS HEARING
On July 23 the State is calling a hearing on the South Rexburg Arterial. Mayor
Porter gave a book to the council to look over.
RE: SUGGESTIONS ON AN INDUSTRIAL PARK
Mayor Porter said that since his brother Art Porter had started building his bus-
iness outside of town, other prople have been talking about building out there
especially now there was going to be a sewer line run out there. Mayor Porter
suggested that an Industrial Park be organized for these businesses. ECIPDA will
organize it and secure property or lease property for people that want to come to
the area to establish a business. They would also organize a council to preside
over the Industrial Park. Some of the businesses that are already there that it
would include would be:
Roger Brothers, Ralph Anderson Buildings, George Zollinger property, Art Porter,
Walters Concrete, and Lousinana Pacific.
We would need to get these businesses together and organize it. Earl Kemp said
there is money available for a grant for an Industrial Park. Mayor Porter said
a group was organized after the sawmill burned, which helped get money to get the
sawmill back running again. All that was left of that group is Glen Erickson and
Donald Hinckley. A motion was made by Nile Boyle and seconded by Morgan Garner
to form a committee to study the Industrial Park. All Aye. Mayor Porter said
that they had an Industrial Board and Park in Logan, Utah which had brought in a
lot of plants and industry into that area.
RE: BILL FROM EARLY BIRD SPRINKLER
A discussion on the bill from Early Bird Sprinkler. The finance committee and
Earl Kemp will go over the bill with the contract documents to see what liabil-
ities there are and chech it out and report back to the council.
RE: LOTS NEED TO BE CLEANED
A discussion on lots that need to be cleaned up and ones that have been done.
RE: AIC MEETING IN POCATELLO
Mayor Porter reported that he and Richard Horner and Rose Bagley were going to go
to the AIC meeting in Pocatello on June 19, 20, and 21.
RE: BILLS
A motion was made by Norris Reese to approve the bills and seconded by Morgan Garner.

NOTICE OF PUBIC HEARING
Concerning
Project M-7866(001)
South Rexburg Arterial
Madison County
NOTICE is -hereby given that pursuant to U.S. Code, Title 23, Section 128,
and Federal -Aid Highway Program Manual, Volume '7, Chapter 7, Section 5, a
location hearing will be held pertaining to the above matter at Rexburg City
Hall, Rexb�irg, Idaho, on Wednesday, July 23, 1930, at 7:30 p.m. An informa-
tl�on meeting will be held just prior to the public hearing at 7:00 p.m.
Then and there local public officials and interested groups and indivi-
duals maybe heard regarding the following proposal.
This project will be an urban secondary arterial serving south Rexburg.
It will begin at US -20 on the west and terminate at Mill Hollow Road on the
east. Three alternatives are being considered.
The first alternative is a "do nothing" alternative. No new construction
will be undertaken, existing streets will merely continue to function as they
presently are with no improvement.
Another alternative is to use a Ninth South alignment beginning at US -20
just south of Taylor Chevrolet and going directly eastward to Mill Hollow
Road. The:entire highway will be new construction.
The last alternative would be an Eleventh -Ninth South alignment starting
south of G & R Auto at US -20, curving northeasterly to First West and Ninth
South and then following a Ninth South alignment eastward to Mill Hollow Road.
Again, the entire highway will be new construction.
There will be four lanes, two lanes on each side of a painted median to
Second East and two lanes from Second East to Mill Hollow. A bike path,
pedestrain way, and utility corridor will also be installed. Right-of-way
will be 100 feet wide. Runoff and diversion control structures will be pro-
vided in areas required. Only City streets will be allowed to intersect the
proposed highway.
Plans showing the proposed alternatives, an approved environmental
assessment and other pertinent information to the location of this project
are available for public inspection and copying at Rexburg City Hall (Clerk's
Office), Rexburg, Idaho, and at the office of Forsgren, Perkins and Associates,
350 North 2nd East, Rexburg, Idaho.
Individual copies of the environmental assessment can be obtained by
interested citizens by writing to the Idaho Division of Highways, P.O. Box
f 97, Rigby, Idaho 83442.
Persons who feel that the project would have significant impact on the
human environment or that the environmental assessment does not adequately
assess social, economic, or environmental impacts are invited to comment to
the Idaho Division of Highways or the Federal Highway Administration, summa-
rizing the basis for their position.
Following the hearing, additional written testimony, statements, or ex-
hibits pertinent to the project may be submitted to "Hearing Officer, Idaho
,Iransportation Department, P.O. Box 7129, Boise, Idaho 83707", on or before
Monday, August 4, 1980.

RE: MINUTES APPROVED
A motion was made by Norris Reese and seconded by Jim Morris to approve the minutes
as corrected. All Aye.
RE: FIREWORKS PERMIT
Mayor Porter read a fireworks permit for Kristy Fullmer and Gina Ann Garner to sell
fireworks at the Junior High Parking Lot. A motion was made by Nile Boyle and
seconded by Norris Reese to approve the permit. All Aye.
RE: PAYING DELIQUENT LIDS
Mayor Porter told the council that three people have came in the City Hall, after
they had recieved the letter from Mary Smith about their LID, and wanted to make
arrangements to pay their LID over a period of a few months because they were
having a difficult time paying it all at once. The council agreed to this arrange-
ment. A motion was also made by Nile Boyle and seconded by Jim Morris to proceed
with legal action against the people who have not contacted the City Office or
paid the deliquent LID'S. All Aye.
