Porter Norris Reese Nile Boyle Morgan Garner Jim Morris Sander Larson Councilwoman: Darlene Blackburn Also Present: Rose Bagley, City Clerk Richard Horner, City Treasurer Mary Smith, City Attorney A motion was made by Nile Boyle and seconded by Jim Morris to approve the minutes. RE: EARLY BIRD SPRINKLER RE: A representative from Early Bird Sprinkler was at the council meeting to present a claim. They were low bidder for a sprinkling system at the new community re- creation park two years ago. The project was delayed one year. He had previously told the Mayor that because it was delayed he would have extra costs. He at that time was told to present an itemized bill to the council, but did not do it. He claimed that he had purchased the material and had to store it, he had to hold his liability insurance over to the next year, he had to pay higher wages the next year than he would have the year before, and he had to pay interest on the money he had borrowed to buy materials, he had to pay for damaged power lines which he stated were damaged because of the delay, all of these costs he wanted reimbursed for. The council questioned having to pay more wages a year later and also storage costs. Earl Kemp told the council that he had advised Mr. Bird that they had to be justifiable costs and that they had to be itemized. Mayor Porter stated that he had a bill for this and would find it. Earl Kemp said that the original con- tract had been $41,000 but had been decreased $10,000 because of work the City did itself and the City had already paid him $1,700 for the loss of that amount on the contract. The council recommended that the Mayor find the bill and the finance committee review the bill with the Mayor and pay the justifiable costs. If there was any further questions they would contact Mr. Bird. LIST OF DELIQUENT LID'S Richard Horner, City Treasurer, gave the council a list of deliquent LID'S. He recommended that the City take any action necessary to collect the LID'S. City Attorney, Mary Smith said that she would write letters to the property owners and then take further action ifthe LID'S were not paid. RE: PROBLEM AREAS FOR STORM DRAINS Mayor Porter said that he and Earl Kemp had checked some of the problem areas for storm drains. On 2nd North and 1st East they thought that a sump would work best. Earl Kemp recommended that storm drains be put in at: Ricks Wade Addition costing about $28,500 ,5th West South of Fourth South costing about $24,000 Retention ponds costing about $75,000 Canal crossing at $13,000 Earl Kemp said that the amount available would be $200,000 and $70,000 will not be available from the College until next year. He recommended that the city go ahead with all the projects except the Canal Crossing which could be finished next year along with the work on the Barney Dairy Road. RE: OBSERVING COUNCIL MEETING Two Scout Troups attended the meeting to observe. 4 RE: TERRY SPRAGUE FROM STARLINE EQUIPMENT Terry Sprague from Starline Equipment was at the meeting to show pictures of a street cleaner with a Sump Pump Suction Cleaner. Earl Kemp told the salesman that we needed a machine that would have a vacuum pump on it, it needed to such at a depth of 15 feet, it would need to such silt and mud out of sumps, slug at the bottom of the lift station would need to be sucked out. He also showed brochures on equipment available. Earl Kemp said that if the city bought a machine it would have to be bid out with performance specs. Jim Morris told Mr. Sprague to get additional information which the council would study and take under advisement with the engineer. RE: STREETS TO BE REPAIRED Earl Kemp gave the council a printout on Streets to be repaired for the Council's approval. (attached) Mr. Kemp said that with the remaining money after these projects were done he thought the city could seal coat the remaining streets, possible put in the bridge on 3rd East and extend 350 South Street to Millhollow. Mayor Porter said that the bridge on 3rd East and 350 South Street are new and we could get along without doing them right now. He felt we should fix all the other streets first and see if we had any money to do those projects. The Council had had some complaints on Orchard Street, but the city does not own it and it will have to be put on the LID. Nile Boyle ask if we go ahead and get it ready for the bids if it would interfer with the water project or the storm sewer. Earl Kemp said it wouldn't. Earl said that it would cost about $70,000 for seal coat. Nile Boyle moved to except the list of streets for repair with additional $70,000 for seal coat. Seconded by Jim Morris. All Aye. RE: PHASE III Earl Kemp gave the council a printout on Phase III of the Rexburg Sugar City Sewer Project. He said that they had progressed with Phase III funding. It will be ready to bid this summer if the money is available. Mayor Porter said that we need to get the intercept line in as soon as possible. Earl Kemp recommended that we do the Sewer System in four phases: the interceptor, the earth work at the lagoons, the building, and the aeration system. A motion was made by Morgan Garner to approve the four chases and bid it in four phases, seconded by Norris Reese. All Aye. RE: LETTER FROM PASTOR TOM LOUCKS Mayor Porter read a letter from Tom Loucks, pastor of Mary Immuaculate Parish requesting to be exempt from paying garbage service. He stated that they do not have any garbage to put out. (letter attached) A motion was made by Nile Boyle and seconded by Morgan Garner to exempt them from garbage service charges. All Aye. RE: BLUE CROSS FEES RAISE Mayor Porter read a letter from Blue Cross saying that they are going to raise their fees for the first time in two years. The Mayor recommended that the in- crease cost be split between the city and the employee. A motion was made by Jim Morris and seconded by Norris Reese to split the increase cost between the city and the employees to be reviewed again at budget time. All Aye. RE: BOND ELECTION INFORMATION Mary Smith read proceedings initiating GOB Bond Election. (copy attached) A motion was made by Morgan Garner to interduce the Ordinance. Ordinance 622 setting election for GOB Bonds payable in 10 years. The date for the election would be July 29. (copy of Ordinance attached) A motion was made by Nile Boyle to suspend the rules and seconded by Darlene Blackburn. All Aye. A motion was made by Sander Ldrson to adopt the ordinance, seconded by Morgan Garner. All Aye. A motion was made to publish the ordinance by Darlene Blackburn and seconded by Norris Reese. All Aye. RE: MAILBOX ORDINANCE Mary Smith said that she had been working on the mailbox ordinance. She had talked to the post office and they wanted to make a survey of all the mailboxes that were not located far enough out on the curb before the ordinance was made. The Mayor said that all the mailboxes at the Dunn Trailer Court were three or four feet back from the curb, because then the city did the LID on that street the mailboxes were already in and the curb was put in three or four feet away from the mailboxes. Box 245 Rexburg, Idaho 83440 Dear Sirs: Several months ago one of the parishioners from St. Patrick's Catholic Church talked with the mayor about garbage service for the church. The Rexburg church does not use the garbage service. The mayor said that the billing could be removed by the approval of the City Council. The church in Rexburg is used for Sunday services every week. The winter congregation is rather small. Perhaps every month and a half we have a pot luck dinner, our only g%rbage producing activity at the church. The last dinner we had produced about one gal3on of garbage which I brought back to St. Anthony. Our latt pot luck was held around April 20th. Since that time there has been nothing to throw away at the church. So little garbage is produced that we haven't a large garbage can. Since I have been pastor of the Catholic churches in the area north of Idaho Falls, we have never used the Rexburg garbage service. Yet we have paid the bill each month. My council has asked me to go to the City Council with our request that the billing be discontinued. Tonight you have a meeting. Tonight I have to be at a meeting in Salmon planning for a summer camp for kids from my parishes. What further action is necessary to bring this matter before you? Sincerely, Fr. Porter, Mayor City of Rexburg Rexburg, Idaho 83440 Dear John: Your concern for traffic safety is appreciated. Please be assured that the Transportation Department is aware of the problems associated with the old Thornton Overpass and steps are being taken to eliminate this high accident location. With the construction of the next section of freeway from Thornton to Rexburg, a new railroad crossing with gates and flashing lights will be constructed as a connector to Thorn- ton. The old overpass will then be completely removed. Most of the traffic will, of course, be on the new four lane divided highway where traveling conditions will be much safer. Construction of the freeway from Thornton to Rexburg was scheduled to commence last fall. However, due to difficulty in securing the right-of-way and the current freeze on federal funding, the project has been delayed. With the release of highway funds this fall, the projects will be contracted and construction will begin. In the meantime, I have asked the Transportation Department to improve the signing to try and reduce accidents at this location. Si ely OHN V . Health care services are no exception. During this same two-year period, however, we have not raised the monthly Blue Cross and Blue Shield rates for the category of coverage you and your employees have. At this point, inflation has simply caught up with us, and we have no alternative but to make an adjustment in your monthly dues effective July 1, 1980. We've held the increase to a percentage amount that is well below the inflation rate of 1978, 1979 or year-to-date 1980, and the calculation is with- in President Carter's wage and price guidelines. CITY OF REXBURG ) A regular meeting of the City Council of the City of Rexburg, in the County of Madison and State of Idaho, was held on Wednesday, the 4th day of June, 1980, at the hour of 7:30 p.m., at the City Hall in the City, being the regular meeting place of the City Council, at which meeting there were present and answering the roll call the following, constituting a quorum: Present: Mayor: John C. The ordi- nance was then read in full and at length as follows: -2- ORDINANCE NO. 622 AN ORDINANCE OF THE CITY OF REXBURG, IDAHO, PROVIDING FOR AND CALLING A SPECIAL ELECTION AT WHICH THERE SHALL BE SUBMITTED TO THE QUALIFIED ELECTORS OF THE CITY THE QUESTION OF ISSUING GENERAL OBLIGATION SEWER BONDS OF THE CITY FOR THE PURPOSE OF DEFRAYING WHOLLY OR IN PART THE COST OF CONSTRUCTING, ENLARG- ING,,EXTENDING, REPAIRING, ALTERING AND IM- PROVING THE CITY'S SANITARY SEWERAGE SYSTEM; PRESCRIBING DETAILS IN CONNECTION THEREWITH; RATIFYING ACTION PREVIOUSLY TAKEN CONCERNING THE SYSTEM, THE ELECTION AND THE BONDS; AND PROVIDING THE EFFECTIVE DATE HEREOF. WHEREAS, the City of Rexburg, in the County of Madi - son and State of Idaho (the "City", the "County" and the "State", respectively), is a municipal corporation duly organized and existing as a City under the general laws of the State; and WHEREAS, the City presently operates its sewerage system and its water system as a joint water and sewer system, as.a single utility; and WHEREAS, the City Council (herein "Council") has de- termined and does hereby determine that the interest of the community and the public interest and necessity require the construction, enlargement, extension, repair, alteration and improvement of the City's municipal sewerage system (the "Pro- ject"); and WHEREAS, for the purpose of defraying in part the cost of the Project, the Council further deems it necessary to issue its negotiable, coupon, general obligation sewer bonds in the aggregate principal amount of $235,000, or so much thereof as may be necessary, payable from general ad valorem taxes, pursuant to Section 50-1026, Idaho Code, as amended, and laws thereunto enabling; and WHEREAS, the negotiable, coupon, general obligation sewer bonds of the City cannot be issued without the assent of two thirds (2/3) of the qualified electors voting at an election held for the purpose of authorizing or refusing to authorize the issuances of said general obligation bonds; and &WHEREAS, neither the question herein set forth nor any question for a similar purpose has been defeated at an elec- tion which has been held in the City within six (6) months of the date of the adoption of this ordinance. -3- NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF REXBURG, IDAHO: Section 1. All action heretofore taken (not inconsis tent,with the provisions of this Ordinance).by the Council and the ,officers of the City, directed toward: - A. The Project, B. The issuance of the City's negotiable, coupon, general obligation sewer bonds (the "Bonds") therefor, and C. The calling and holding of an election for the authorization of such Bonds, be, and the same hereby is, ratified, approved and confirmed, in- cluding, without limitation, the giving of notice of such elec- tion: Section 2. Subject to the assent of the necessary per- centage of the electors voting on the question, it is hereby or- dered that the Project be undertaken and that the Bonds in the aggregateprincipalamount of $235,000, or so much thereof as may be necessary, be issued to provide therefor. Section 3. The Bonds shall bear interest payable semi- annually (provided that the first and last interest coupons may be fora.period of longer or shorter than six months, but not to ex- ceed one year, at the discretion of the Council) at a rate or rates not exceeding 10% per annum, and Bonds shall mature and be payable upon an amortization plan, with the first annual principal pay- ment maturing and payable within two years from and after the date of the Bonds and the last annual principal payment maturing and payable during the ten year from the date of the Bonds. The various annual Bond maturities shall be payable in accordance with the provisions of SS 57-201 to 57-230, Idaho Code (the "Muni- cipal Bond Law"), all as provided in Section 50-1026 Idaho Code, and the Municipal Bond Law. The Bonds shall be in denominations of $100, or any even multiple thereof not exceeding $5,000 (to be fixed by ordinance prior to the issuance thereof), numbered consecutively, beginning with the number one, the bonds being payable in numerical order, the lowest number first. The Bonds may be made subject to prior redemption at such time or times, with or without a premium, and upon such terms and conditions as may be determined by the Council (in its discretion) in the or dinance authorizing the Bonds. Section 4. For the purpose of providing funds to pay the interest on the Bonds promptly when the same falls due and -4- also a sinking fund for the payment of said Bonds at maturity, there shall be levied annually upon all of the taxable property in said City, in addition to all other taxes, a sum sufficient to pay the interest on the Bonds and to provide for the payment of the principal thereof as they mature, and all such taxes must be levied, assessed and collected as other taxes until the Bonds so issued are fully paid. The faith and credit and all taxable property within the said City are and will continue to be pledged " for the punctual payment of the principal of and the interest on the Bonds. Nothing herein contained shall be so construed as to prevent the City from applying any other funds that may be legally available for that purpose to the payment of said interest and ,principal, and the levy or levies herein provided for may there- upon to that extent be diminished. Section 5. The Project briefly and generally described, and the object of the indebtedness to be created by the issuance of the Bonds, shall consist of the construction, enlargement, ex- tension, repair, alteration and improvement of the City's munici- pal sewerage system by the construction of an aeration system at the lagoon sewerage treatment site, expanding and deepening the lagoon, and construction and other acquisition of a blower house, an administration control and maintenance building, chlorination contactchambers, a chlorination and pump building, and a 14 -inch discharge Line from the lagoon to the Rexburg Irrigation Canal, and all necessary equipment and appurtenances therefor and all costs incidental to the foregoing and to the issuance of Bonds. Section 6. A special municipal bond election be, and the same hereby is, called to be held on Tuesday, the 29th day ot.duly, 1980, for the purpose of enabling the registered quali- fied electors of said City to vote upon the question of issuing the Bonds, as set forth in the notice of election, the form of which is prescribed by this ordinance. Section 7. There shall be three voting precincts for the Bond election whose boundaries and precinct numbers shall be identical.to the three regular municipal precincts within the City. Ballots shall be furnished by the City Clerk to the judges of the election to be by them furnished to the voters. At said election only those persons who are qualified to vote at elections in the City of Rexburg shall be permitted ` to vote on said'Bond question. A qualified elector shall be 18 years of age or older on the date of the election, a citizen of the United States, and shall have established a bona fide residence in the County of Madison and y City of Rexburg, as of date of the election. Before receiving a ballot each elector desiring to vote at the election shall sign his name in the combination election record and poll book following his name therein. No person shall knowingly sign his name in the combination election record and poll book if his residence address is not within the City at the time of signing. Rose Bagley, City Clerk, is ex officio Registrar of said City. The plAce of registration is the office of the City Clerk at the Rexburg City Hall, in Rexburg, Idaho. Except as provided by Section 50-414, Idaho Code, it shall be necessary to register in order to vote at such special municipal bond election. when once so registered for a general city election, thereafter an elector shall not be required to again register for the special bond election so long as he shall have continued to reside at the same address, or within the same precinct in which he is regis- tered except as hereinafter provided. If an elector shall have failed or neglected to vote at any general biennial city election, the Clerk shall strike the name of such elector from the electors' register, and such elector, in order to vote at the special bond election, must again register. Persons who are not currently registered may register on each day at any time during the office hours of said Clerk until and including the Friday next preceding the election; and on Friday next preceding the election, persons may register from the time the office is opened in the morning continuously until 8:00 P.M. The voting at said election shall be by ballot. The ballots to be supplied the voters for their use at said election shall be in the form set out in said Ordinance No. 622 Absentee voting shall be permitted for the above-des- cribed election in the manner prescribed by law. A written application for an absent voter's ballot shall contain the name of the elector, the elector's home or residence address, and the address to which such ballot shall be forwarded. Proceedings to contest the results of the special muni- cipal bond election on the above question may be instituted as provided in Section 34-2001A, Idaho Code, but shall be instituted within forty days after the votes cast at such election have been canvassed and the results thereof declared and not thereafter. This ordinance shall be published in at least one issue of the Rexburg Journal, the official newspaper of the City; and this ordinance shall be in full force and effect from and after its passage, approval and publication, the Council dispensing with the rule providing that ordinances must be read on three different days, all as provided by law. Bart Jensen was on this commission and someone else needed to fill that position. They meet once a month at the Courthouse. RE: B(ND ELECTION The,Mhyor said that the council should start taking up the Bond Election. We need to get all the information we can and get it to the people and try to get them to vote yes. RE: ARTICLE ON WEISER, IDAHO SEWER Mayor Porter read an article on Weiser, Idaho, sewer users fee for $10.00 . 'RE: CENSUS COUNT Mayor Porter said that a lot of people had been missed on the Census. He had put an article in the paper and had gotten a lot of calls in the City Hall. The census people are coming to Rexburg next week to check with everyone that had been missed. We need to get everyone counted because it means money to the city. RE: FINANCIAL REPORT Richard Horner, City Treasurer, gave a financial report to the council, and ex- plained it. RE: HOMESTEAD ACT Nile Boyle ask the Mayor about the Homestead Act and how it would effect the City's taxes. RE: THORNTON OVERPASS Mayor Porter read a letter that he had received from Governor Evans about the Thornton overpass. The mayor had previously written to him about it. The letter from Governor Evans said that the Highway Department was going to put flashing lights up to caution people of the danger of the overpass. The Highway Department will get the contract this fall on the project and construction will begin. RE: BILLS A motion was made by Morgan Garner and seconded by Sander Larsen to approve the bills.
