1980.05.21 CITY COUNCIL MINUTES
A motion was made by Councilman Morgan Garner and seconded by Councilman Norris Reese that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be' -cumbered 620. Those Voting Aye: Norris Reese Darlene Blackburn Jim Morris Morgan Garner Those Voting Nay: None Ordinance 620 was then placed before the council. The Mayor then called for the voting for final passage of the Ordinance, and the motion was made by Jim Morris and seconded by Darlene Blackburn that ordinance 620 be passed. Those Voting Aye: Norris Reese Darlene Blackburn Jim Morris Morgan Garner Those Voting Nay: None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the pas- sage of said Ordinance, and that said Ordinance was duly and regularly passed. The Acting Mayor declared the motion carried. RE: ORDINANCE 619 WAS READ City Attorney, Mary Smith read Ordinance 619 repealing ordinance 449 and provid- ing for the separation of the position of the City Clerk and Treasurer. AN ORDINANCE REPEALING ORDINANCE NO. 449 AND PROVIDING THAT THE OFFICE OF CITY CLERK SHALL BE HELD BY ONE PERSON AND THE OFFICE OF CITY TREASURER SHALL BE HELD BY ONE PERSON AND PERFORM ALL DUTIES OF THEIR RESPECTIVE OFFICES AS PROVIDED BY LAW AND THE ORDINANCES OF THE CITY OF REXBURG, IDAHO; PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by Councilman Darlene Blackburn and seconded by Morgan Garner that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 619. RE: AT NEXT MEETING REVIEW APPLICATIONS FOR TREASURER AND STREET SUPERENTENDENT Nile Boyle told the council that he thought at the next meeting the council should review the applications for Treasurer and Street Superentendent and fill those positions. Jim Morris said that he is not sure that the council should bove yet to hire a new street superentendent. He said that things are going smooth in that department, things are getting done, attitudes and morales have improved. He said that if they held off for a while on choosing a new supervisor that the city could save some money. He felt that the department had enough employees to handle the work in the city. The council agreed to let Jim Morris and Morgan Garner handle the department for a while and see how things go. W gcd Nile Boyle pointed out that Jim Morris had been putting in extra time down to the shop and using his own car to travel back and forth a couple of times a day. He felt that Jim should be paid $50.00 a month extra for gas for his outfit temporarily for one or two months while he is doing this. It was moved by Norris Reese and seconded by Morgan Garner that Jim Morris be given $50.00 travel pay a month extra for gas as long as he is involved. RE: COMPLAINTS ABOUT THE TRAILER COURT ON SOUTH 5th WEST Nile Boyle told the council that they had had complaints about the Trailer Court on South 5th West owned by Elwood Nielsen. The trailer court needed to be cleaned up and the trailers had bails of straw around them. It is an eyesore. Jim Morris said that he would have the fire department check on it. It needed to be brought up to the minimum standards for fire hazard. RE: BIDS RECEIVED TO REMOVE THE HOUSE AT 40 SOUTH 1st EAST Three bids were reveived to remove the house at 40 South 1st East. Low bid was from C & T Construction for $1149 other bids were for $1880 and one for $2970. A motion was made by Morgan Garner and seconded by Jim Morris to except the low bid from C % T Construction with the stipulation that it be finished in 30 days. RE: HOLE WHERE SPEE DEE CLEANERS USE TO BE The council said that they would approach H & K to see if they would fill in the hole where Spee Dee Cleaners use to be, to get ready for the parking lot. RE: KEEPING PEDESTRIANS IN THE CROSSWALKS Norris Reese ask the City Attorney if we had an ordinance to keep pedestrians in the crosswalks and keep them from walking in the streets and also to keep children from playing in the streets. He said that it was especially bad in the subdivisions where the children played in the streets constantly. He said that he felt that the city had an obligation to help prevent someone from meeting with a serious accident. Mary Smith said she would check on it and see what could be done. RE Present were the following: Mayor: John C. MINUTES APPROVED A motion was made by Darlene Blackburn and seconded by Nile Boyle that the minutes be approved. All Aye. RE:. GUARANTEE FOR SEWER FOR THE NEW ART PORTER BUILDING Mr. Roundy from Art Porter Printing was at the meeting. On their new building that they are building just north of town they are required to file forms with FHA with a guarantee for utilities. They are lacking a letter of guarantee for sewer. They would like to hook up to the Rexburg Sugar City sewer system. Earl Kemp has been checking the chemicals in their sewage to see if the city could allow them to hook up to the sewer. They do have chemical boran in their sewage. Mayor Porter said that Rexburg controls 2 the sewer line and Sugar City controls 2 of the line. We control the half that they would hook up to. Jim Morris ask what would happen if we guarantee that they can hook up to the sewer and then the bond election doesn't go through. Mary Smith suggested that a clause be put in the letter of guarantee incase the bond doesn't pass or in case the chemicals dumped into the sewer are excessive the city could retrieve the guarantee. A motion was made by Nile Boyle and seconded by Jim Morris that we give them approval to hook onto the new sewer subject to chemical restrictions, the new bond being passed and engineer approval with the right to charge at least twice as much as for a regular city resident. All Aye. RE: PARKING RESTRICTED ON RICKS AVE Mayor Porter told the council that the police '..ad circulated a petition on Ricks Ave for parking to be restricted to one side of the street only. There is a lot of parking on that street which is only a 35 foot wide street. Most of the excess parking is because of Porter Printing. When the police circulated a petition there was some oppisition. Mayor Porter said that he drove down that street and with the cars parking on both sides of the street it was a fire hazard. A motion was made by Morgan Garner and seconded by Norris Reese to restrict the parking on that street to only one side of the street, the south side from end to end subject to change if when Porter Printing moves the parking problem is solved. All Aye. RE: RICHARD HORNER APPOINTED AS NEW CITY TREASURER Mayor Porter told the council that he had appointed Richard Horner as the new City Treasurer. He ask for the council's approval. A motion was made by Nile Boyle and seconded by Jim Morris to concur to the appointement of Richard Horner as the new City Treasurer. All Aye. RE: PEDESTRIAN ORDINANCE Mayor Porter said that Mary Smith had been researching a Pedestrain Ordinance, and she needed to go over it with Blair before finalizing it. This ordinance would prohibit pedestrians from crossing anywhere except at crosswalks and from walking in the streets. There would be a problem in the winter time because of the snow being piled on the sidewalks. Mary Smith told the council that there was a problem of children playing in the streets. Jim Morris felt that there would be a problem of enforcing the ordinance and ask if a safety program would work better. Mary Smith said that maybe we needed both, and she and Blair would go over the whole thing before she made a final ordinance RE: SIDEWALK REPAIR Mayor Porter discussed sidewalk repair. He told the council taht the city checked sidewalks for people to see if they needed to be replaced and then after the side- walk was put back in, the city employees would measure it and the city payed 20(,' a square foot. Sometimes if the city needed fill and had time they would go and remove the concrete for the people and then the contractor would do the rest. Rolland Lovegren at 148 South 2nd East replaced his sidewalk and the city had time to remove the concrete. Then the neighbors, Loren Weber and Jerome Barrick replaced their sidewalks and the city was too busy to remove their concrete so they had the contractor remove the concrete and they are upset because the city won't pay the contractor for removing the cement. The Mayor said he thought that the city should pay for the sidewalk removal at these two places. A motion was made by Jim Morris and seconded by Morgan Garner to pay these two bills for side- walk removal. All Aye. RE: COST ON SEWER SYSTEM Earl Kemp said that he and John Millar had pulled together the cost on the Sewer System based on the aeration system. It will cost the city about $2.96 million, Sugar City's share will be approzimately $771,000. There will be additional costs for bonding and legal fees which will cost about $10,000, there will be additional election and printing costs of about $15,000 making a total of $25,000. Earl Kemp recommended that we bond for $210,000. Mayor Porter said that we should rush the bond election through. A motion was made by Nile Boyle and seconded by Darlene Blackburn to move as rapidly as possible with a GOB Bond Election. All Aye. RE: EARL KEMP ASK ABOUT SPECIAL MEETING Earl Kemp ask if he could set up a special meeting to go over the aeration system and roads so construction can get started by July. Mayor Porter ask Mary Smith if they could join the downtown project and the other curb and gutter project on Just one LID. She said that she would check on it. The Mayor said that we needed to have a special meeting to discuss the downtown project and LID with the eningeers. Nile Boyle said that the vacant lots were not on the list of businesses to be set on the LID and he thought we should decide what to do about assessing them, pos- sibly prorating the size of the lot and how much parking willbe needed if a build- ing is built. RE: CONSTRUCTION OF STORM SEWER John Millar told the council that the storm sewer is under consturction and that a line was being put in the West part of town by the Starlite Addition. The city needs to decide on the priorities on the problem areas. RE: MAYOR PORTER REPORTS ON RC&D PROJECT Mayor Porter reported on the RC&D project. He had received a call from the Soil Conservation. They were going to put in some basins but now they can't do it, but they still want to go ahead with the terraces on the farms. They had already met with some farmers who were in agreement of putting them in. They had met with Ricks College also, but had not received an answer. The Mayor said that the Soil Conservation wanted to set up a meeting with all the parties involved, includ- ing the city. RE: WORK MEETING A work meeting for the council was scheduled for May 28 at 7:30 A.M. . RE: WALTERS PROPERTY Jim Morris told Earl Kemp that we need a flagged line at the Walters property so the city can get a cat in there and scrape it. RE: GRANT FOR GOLF COURSE Nile Boyle ask Earl Kemp about the grant for the new Golf Course Club house. RE: CONCERN FOR THE NEED OF MORE WATER DEPT. EMPLOYEES Norris Reese told the council that as they progress with the new sewer and water project that he did not think the five employees in the water department could handle it with the extra work load. He suggested looking at all the personnel and see if some shifting could be done. As all the disconnecting and connecting has to be done, the water department would be understaffed. Earl Kemp said there would only be about thirty connections. John Millar said that we would need an additional trained person to take care of the new sewage treatment plant. He told the council that there would be money in EPA to train two men and pickup their salary during that time. This summer Jerry Brian would need to be working with the construction to be come aquainted with the new systems. RE: NEW FORMS TO BE FILLED OUT PRIOR TO A BUILDING PERMIT Norris Reese also discussed with the council the forms that the Planning & Zon- ing Committee had approved to be filled out prior to issuing a building permit. They also require a set of plans be submitted before the building permit could be issued, to be sure the building complied with any restrictive covenants. RE: SURVEY OF HAZARD AREAS I� TO REXBURG CITY COUNCIL We, the undersigned, do hereby protest the construction of a flagpole in the middle parking on East Main Street and the flying and lighting of a flag on a 24-hour basis for the following reason: L'. Because the`flagpole'will be locatedapproximately 80,feet from the Arnold residence bedroom and -approximately -90 feet from the Thompson bedroom.. A previousexperience with a -flagpole in this same location was a most annoying thing. The ropes continually bung on the flagpole and the flying flag makes an undesirable noise when the wind blows which is most of the time. II. Two alternative sites are suggested: A. A flagpole now exists approximately 100 yards to the west at the courthouse which could be remodeled to fit the needs of the new project. There would not be any residence there and there is also plenty of parking which could be used for ceremonies and public gatherings. B. Another possible site would be the front of the old i hospital. The persons requesting the restriction indicated that the street is a traffic hazard because of its narrow width when allowing parking on both sides. CON'T. The Mayor told the council that the police had gone around the city and surveyed any hazard areas that needed to be corrected. The City would need to check each one out to find out who the property owners were and write them a letter. ( list attached ) RE: DEBRIS ON VACANT LOTS Mayor Porter told the council that he and Jim Morris had briven aroung town and noticed that there is a lot of old cars and machinery on residential lots in the city. This distracts to the appearance of the city. He said that he would have the police make a survey and list of these. Then the city could write a letter to the owners or have them impounded if the owners could not be located. Then if the owners did not haul them away the city would and charge the people. RE: MAIL BOX REGULATIONS The Mayor discussed mail box regulations. He said that he had talked to the post office, and they had a rule that in some areas they would not deliver mail if the mail box was not on the curb. In some areas people have put the mailboxes back on the sidewalk making it necessary for the mailman to drive on the sidewalk to deliver the mail. The post office suggested that the city pass an ordinance speci- fying how the mail box should be put in front of the house. Mary Smith was in- structed to draw up the ordinance. RE: NEW FLAG POLE FOR KIWANIS CLUB Nile Boyle said that he had a protest from Mr. & Mrs. Terrel Arnold and Mr. & Mrs. Frank Thompson asking the city to not let the Kiwanis Club put a flad up on the East end of Main Street by their houses. (copy attached). They protested that the ropes on the flag and the flag itself would make an undesirable noise. Nile explained that the Kiwanis Club was going to put a permanent flag up which would be lighted. A power line would be ran directly to the flag. The council said that they thought the Kiwanis Club should go ahead with the flag at the location using all precautions to keep the noise down.
