RE: JIM KELLER TO MEET WITH NORRIS REESE & THE MAYOR
Jim Keller had requested to meet with Norris Reese and the Mayor prior
to the regular Planning Board Meeting. A Meeting was scheduled for
Monday at 5:00 P.M..

RE: MINUTES
A motion was made by Norris Reese and seconded by Sander Larson to approve
the minutes. All Aye.
RE: ARICHIBALD INSURANCE DISCUSSED QUESTIONS ON COVERAGE FOR SEWER DAMAGE
Lynn and Gary Archibald from Archiblad Insurance Agency was present to
discuss and answer questions on insurance coverage for sewer damage.
Mayor Porter told them that when the adjustor comes to check a claim that
he doesn't check with the city's employees, to find out what has happened.
Archibald said that to prove liability it must be shown that the
city is negligent and contributed to the cause of the problem before the
insurance company will pay a claim. Mayor Porter told them that two years
ago the sewer system was monitored with TV. All the problem areas was
recorded. The water and sewer department try to rod out or flush out
those problem areas every so often. Nile Boyle presented a bill for
sewer damage on Elm Street. Mayor Porter suggested that a schedule be
made up and evary 45 or 60 days the problem areas be augered out or
flushed out. If we fail to do it then we would know it was our problem
when a sewer backup occured in those areas. Mr. Archibald said that he
would check into a different insurance policy that would cover all sewer
problems. He told the criuncil that it would probably be expensive.
RE: DAN MOULTON PRESENTED INFORMATION ON STORM DRAIN CLEANING EQUIPMENT
Dan Moulton was present to present brochures and information on Storm
Drain Cleaning equipment to clean out the sumps. Mayor Porter suggeste d
that Dan find out where the different equipment was being used and set up
a time that the councilman and Dan could go and check out the machines.
RE: GLEN STELZER REQUESTING SEWERLINE BE REPAIRED & REPLACED
Mayor Porter told the council that Glen Stelzer had been to see him
about the sewerline that they had to repair going from his ex-wifes home
to the street. It was plugged up and they had to dig it up and replace
and repair it, He claims that all the heavy trucks running over it
caused it to have problems. He wants the city to share the cost. Dan
Moulton said that they had already put some temporary fill in the hole.
Norris Reese made a motion that the request be denied, seconded by Morgan
Garner. All Aye.
RE: GORDON MERIDETH WAS PRESENT
Gordon Merideth was present. He presently runs a Daycare Center at
48 South 2nd West. He has just bought Dunns Trailer Court at 205 North
3rd West. He would like to move his double wide trailer that he uses for
his Daycare Center to that address. He would move the front three trailers
off and move the Daycare Center on that front spot. Mayor Porter told
him that if he buys the trailer court he should put it in compliance with
the Trailer Ordinance. Mr. Merideth said that he planned to put up a
fence around the daycare center and put lawn in and beautify the yard.
As he can afford it he will improve the entire trailer court. The council
said they would have someone from the city take a petition around to
everyone within.. 300 feet of the property to have them sign it. If there
was no objections they would notify him to go ahead.
RE: ROGER HARRIS FROM GOLDEN VALLEY DEVELOPERS WAS PRESENT
Roger Harris from Golden Valley Developers was present to request a Public
Hearing to put in a trailer court on some property located across the
railroad tracks west of Porter Park on First South Street. Mr. Harris
has already met with the Planning Board. He is asking for a variance on
the size of the trailor court. The property is just short of the two
acres requirement for a mobile home park. He also asked for a variance
of the requirement for a laundry facility. He said that the park would
only have 11 parking spaces, and a laundry facility would create an
eyesore. He said that they had one problem, the planning board had ask
them to straighten out the road and remove the fire hydrant just west of
where it is now. He said that Mr. Brian was reluctant to move the fire
hydrant. Nile Boyle moved that a Public Hearing be set for the 1st
Wednesday in April for the trailer court and the two variances. Seconded
by Darlene Blackburn. All Aye.
RE: REXBURG IRRIGATION CANAL COMPANY & TETON PIPELINE ASSOCIATION
Members of the Rexburg Irrigation Canal Company and the Teton Pipeline
Association met with the council. Earl Hoopes, past president, of the
Teton Pipeline Association acted as spkesman of the group, of seven
farmers from the Clementsville area.
Hoopes briefly told of how this group got into the position that they are
in today. When the Teton Dam was being built, the farmers had invested
in a multi-million dollar project on the basis that irrigation water
would be available from the Teton Dam. After the dam broke, the asso-
ciation drilled three recharge wells in the Moody and Clementsville area.
Then they leased water from the City of Rexburg. They feel that the
water leased is essential to their system.
When the association leased the water it was told that the water was not
being used in the Rexburg area and the association applied to the State
Water Board for use of the water.
Lorin Kauer of the Rexburg Irrigation Canal Company said that the
Council committed itself in 1966 to return the water to the canal
company after the lease with the pipeline association expired. Kauer
said that the council again committed itself in 1975 and ask the council
if they intended to stand by its commitments.
Mr. Hoopes read a letter that was written to the Mayor and members of the
City Council on May 11, 1979, requesting to lease water in the future.

Mayor Porter said that when the city first leased the water to the Pipeline
Association, he had checked with Andy Anderson, who had told him the amount
of water available. By leasing the water it helped maintain the ditch.
Hoopes maintained there is surplus water in the city canal and that the
water used by the association would not cause a shortage for the farmers
along the Rexburg Canal.
Mayor Porter said that it wasto maintain the ditch. The city
had just spent about 40 hours cleaning the ditch by the high school because
of flooding.
Ron Carlson of the Idaho Department of Water Resourses came to the meeting
in the middle of the discussion, and answered questions from the two
groups and from the council. Carlson said the citys water rights were
decreed for municipal and power purposes. Under current state laws no
change in the use of the water is allowed. City Attorney Mary Smith
explained that the water has been used by the city for irrigation and
that the city has never given up any of its water rights, because it
has always used the water. She said that the city has no intention of
giving up any of its rights.
The council instructed the clerk to look up the minutes that were
pertinent for the council review. A meeting of representatives from the
Rexburg Irrigation Canal Co., Pipeline Association, and council members
would be held to discuss the matter and work out a compromise.
RE: PRELIMINARY PLAT OF AMR CORP
The preliminary plat of AMR Corp on the whole section and a final plat on
section 1 and 2 with a frontage road was presented to the council for
approval. The engineer for AMR Corp had told the Planning Board that he
wanted to put in rolling curb. A motion was made by Norris Reese to
approve the plats with regular curb rather than rolling curb, seconded
by Morgan Garner. All Aye.
RE: LETTER FROM CHIEF BLAIR SIEPERT - STOP SIGN ON 4thSOUTH AND 3rd EAST
ALSO ON STREET PARKING ON NORTH 2nd EAST
JIm Morris presented a letter from Blair Siepert, Chief of Police re-
porting on recommendation of stop sign on 4th South and 3rd East. He
had made arrangements to have the stop lights on main street be placed
on caution at 1:00 A.M. through 6:00 A.M. A door to door survey to the
business's was done in reference to passing an ordinance that no on
street parking be allowed on North 2nd East. (copy of letter attached
No one was present to protest the proposal to limit parking along the
street. Nile Boyle moved that Mary Smith draw up an ordinance limitin
parking along North 2nd East, seconded by Jim Morris All Aye.
RE: MAYOR PORTER REPORTS ON MEETING WITH RC&D
Mayor Porter said that he had met with the RC&D Committee. One of there
projects was that the county wants to plant grass in the borrow pits. On
the hill they propose to contour and put grass every so many feet and put
in a retaining dam. They would like to do contouring on the farms on
the hill. They want the city to help on the Erickson road and Millhollow
road. Another project they want to do is to develop a bridal path on the
old city dump property on the north west of the city.

the Association is presently putting to beneficial use.

Dear Councilman Morris:
In reply to whether a stop sign should be placed at the intersection of
4th South and 3rd East, please be advised of the following:
Although there was not sufficient time to do an accurate traffic survey,
it would be my opinion that there is a minimum amount of traffic flow in that
area. If a stop sign is to be placed at that intersection, I would suggest that
it be put on 3rd E,pst on both sides of 4th South allowing a free flow of traffic
on 4th South coming from the Stake Center that is located directly above. Stop
signs on 3rd East would also coincide with other stop signs that are placed at 2nd
South, 3rd East, and 1st South, 3rd East.
If you desire a complete traffic survey at this intersection, please advise.
Contact was made with the City electric contractor, Don Blunck, in reference
to changing all the stop lights to be placed on caution at 1:00 A.M. through 6:00
A.M. I was advised by Mr. Blunck on 3-3-80 that it would be necessary to order
some parts for the lights so that this could be accomplished. Mr. Blunck indicated
he would have the parts in the near future and all the lights would be changed.
A door to door survey to the business's was done by myself in reference to
passing an ordinance that no on street parking be allowed on North 2nd East. A
copy of the survey has been given to the Mayor and also a copy has been placed in
your file for consideration on the matter. As the survey indicates, most of the
business's were in favor of a No Parking to allow the center turn lane. However,
there was some that was questionable and they indicated they would attend City
Council meeting to discuss it further.
I did not contact the Business's beyond 2nd North due to the fact that the
owners in that area have already requested the Police Department and City to
yellow their curbs so as not to allow any On Street Parking.
Should further information be required, please advise.

The Rexburg Police Department is currently doing a survey to
'determine if it would be feasible to elliminate all on street parking
on North 2nd East from the Madison County Courthouse to the Rogers
Brothers turn off. If all parking was elliminated on the street, it
would allow the State Highway Department to design a center turn lane
from the,courthouse to the Roger Brothers corner.
The Mayor and the Rexburg City Council has asked that each Bus-
iness along North 2nd East be contacted for their opinion and also
to invite them to the City Council meeting on 3 X80 where further
discussion will take place.,

Matching funds for the projects would be provided by the RC&D. Work on
the projects would be about two years away. Nile Boyle made the motion
that they should go ahead with planning, with an option to reject the
project if the cost is too much, seconded by Jim Morris. All Aye. Storm
drain money could be used for the contouring of the farms
RE: TREE GIVEN TO CITY
Dar Mickelsen has given the city a tree by his lumber yard. Dan Moulton
will move the tree to the park.
RE: BUDGET FOR THE NEW GOLF COURSE
Nile Boyle reported that the budget for the new golf course would be
$17,000 for the year of 1980. There would be a meeting on Monday with
the county commissioners. A decision would have to be made as to what to
do with the old golf course. The Golf Board wants to know if they will
have complete control of the golf course or just be advisory. Mayor Porter
said that he thought they should be in complete control. Mayor Porter
said that the city and county would share in the maintenance cost.
RE: ORDINANCE NO. 613
The City Attorney read Ordinance 613 amending ordinance 607 as far as the
property description is concerned.

RE: MEETING WITH JIM KELLER OF THE PLANNING BOARD
Norris Reese told the council that he and the mayor had had a meeting
with Jim Keller, of the Planning Board. They would like to adopt a
policy of anyone wanting to present a subdivision plat or multiple
housing unit to the planning board would have to fill out an applicatio
which one of the girls in the office will have and help them fill out.
This will have to be done 10 days prior to the Planning Board meeting.
The office girl will then put them on the agenda for the meeting. They
will also have to give her the specs and plans. A simpliar application
will be made for residential homes. Mr. Keller will meet with the office
girl to instruct her of exactly what needs to be done.

held March 19, 1980, at City Hall

RE: MINUTES APPROVED
A motion was made by Darlene Blackburn and seconded by Sander Sarson to
approve the minutes.
IRE: EASEMENT THROUGH KENNETH BLUNCK PROPERTY DISCUSSED
Kenneth Blunck was present to discuss the easement through his property
for the Storm Sewer. Earl Kemp explained that they would like to obtain
an easement from him. They would also need to have one from the Manwar-
ings and one from Seth Wood. If they did not obtain these easements they
would have to take the alternate route and go down main street. If they
went down main street they would have to tear up the parking lane of the
street. Mr. Kemp told him that the pipe for the storm sewer would be 36"
and would require a 10' easement. If the sewer line went through Mr.
Blunck's property Nile Boyle told him that a time limit would be set as
to when it would be started and finished. Mr. Kemp told him that if they
did acquire the easement from him and put the line through his property
it would limit what he could build on the portion of the property. Mr.
Blunck said that he would not give them an easement through his property
he would only sell it to them. Nile Boyle ask him if he would go home
and think about it and they would contact him later.
RE EARL KEMP ASK FOR APPROVAL TO ADVERTISE BIDS ON MAJOR PORTION OF SEWER
Earl kemp ask the council to give their aporoval for him to advertise for
bids to have a bid opening on April 11 for the major portion of the storm
sewer, some work will still have to be done. A motion was made by Jim
Morris and seconded by Darlene Blackburn to hold a bid opening on April 11
for the major portion of the sotrm sewers. All Aye.
RE: EARL KEMP REPORTED ON THE ELEVETATED WATER TANK
Earl Kemp reported on the elevated water tank. When they first was plann-
ing the tank they found rock down seven feet, when they ran further tests
they found a sediment layer under that layer of rock. When Charles
Zollinger dug down he found that to hit solid rock they would have to go
down 11 feet. Earl Kemp recommended that the city issue a change order
allowing them to increase the height of the pedestal 4 feet to keep the
tank at its original height. The change would cost an additional $1000.
A motion was made by Morgan Garner and seconded by Jim Morris to issue
a change order. All Aye.
