Present were the following: Mayor: John C. Porter Councilman: Morgan Garner Nile Boyle Norris Reese Jim Morris Sander Larson Councilwoman: Darlene Blackburn Also Present: Mary Smith, City Attorney Rose Bagley, City Clerk RE: MINUTES A motion was made by Jim -Morris and seconded by Morgan Garner that the minutes of February 6, 1980 be approved as corrected. All Aye. RE: BOY SCOUTS Some Boy Scouts were present to observe the meeting. RE: REQUEST FOR STOP SIGN AT 3rd EAST AND 4th SOUTH Mayor Porter told the council that he had had a request for a stop sign at 3rd East and 4th South. The council decided to turn it over to the police to study. RE: DISCUSSION OF LID OF CONNALD AND ARDATH CARLSON Mayor Porter reminded the council that about a month ago they had discussed the LID of Connald and Ardath Carlson. The Council had decided to let the Carlsons divide the LID. Since that time Mrs. Carlson had been in and paid the 1980 payment, but the payment was made late. The Mayor suggested that the city cancel the delinquent interest and cert fee for the 1980 payment. A motion was made by Norris Reese, and seconded by Darlene Blackburn. All Aye. RE: LETTER FROM BOB SMITH, CHAIRMAN OF THE SAFETY COUNCIL. Mayor Porter told the council that he had a letter from Bob Smith, chairman of the Safety Council, resigning his position. He recommended that the council be revised. This committee was set up under Ordinance 497. He felt that the committee did not need a judge and a lawyer on it, that they could be called in to advise when needed. He suggested that there be seven people on the committee. Nile Boyle recommended just five people. The information was turned over to Mary Smith to revise the Ordinance. RE: LETTER FROM CHIEF SIEPERT IN REGARDS TO A RECENT TRAFFIC SURVEY Mayor Porter read a letter from Chief Blair K. Siepert. A recent traffic survey has been made in conjunction with State Highway Department on North 2nd East near the new shopping mall. The Highway Department want to make a left hand turning lane in the center of the road similar to that that is now on the south side of Rexburg. However to do this it would be necessary for the City to adopt an ordinance to outlaw any street parking from the courthouse corner north to the Rogers Brothers turn off. (copy attached) They also recommend taking out the island by the Courthouse. The council felt that it should be left in. Earl Kemp suggested that there should be a stop sign where the Barney Dairy Road will come onto the highway north of Forsgren Perkins. Nile Boyle said that the city should give the people along the road a chance to come in and give their input. Mayor Porter said that they would contact the people and have them come to the next meeting it they wanted to protest. An ordinance would then have to be made to out law any street parking along that street. RE: BLAIR HEINZ PRESENT - PROTESTING CLOSING OF ROAD ON TOP OF HILL Blair Heinz was present to protest the closing of the road on top of the hill. He had read in the paper that AMR was going to close the road. He has a shop up there and does not want the road closed. He was advised that that was a county road, and they would be the ones to contact. Mayor Porter told him that the city had not taken any action to close the road. RE: STORM SEWERS DISCUSSED Mayor Porter said that he had talked to Dan Moulton that afternoon. They had discussed the storm sewers. There was still need for sumps in some areas of the city. In order to keep the sumps opened the city needs to invest in a sump pump. After the flood, Idaho Falls came to Rexburg and pumped the sumps out and got them working with their sump pump. This type of pump can pump leaves out of the gutter in the fall. The Mayor said that he told Dan to get in touch with the firms that handled that type of pump and report back to the council at the next council meeting. TEDRO money could be used to purchase the pump. RE: DISCUSSION OF STOP LIGHTS ON MAIN STREET Jim Morris recommen<'ed that the stop lights on Main Street be changed to a blinking caution light from the hour of 1:00 AM to 6:00 AM. Right now the light is worl,_ing all night. A motion was made by Jim Morris and seconded by Norris r_eese to contact the Highway Department to get the light changed. All eye. RE: PEOPLE BLOCKING SIDEWALKS WITH SIGNS Mayor Porter said that he thought they should instruct the Police to check on the people and businesses that were blocking the sidewalks with signs and tell them to move them. RE: DISCUSSION ABOUT MAILBOXES BLOCKING SIDEWALKS There was a discussion about mailboxes that was blocking the sidewalks. The council felt that they should be put directly in the sidewalks and uniform in size. Mary Smith was instructed to draw up an ordinance to that effect. RE: BIDS FOR THE NEW ONE MILLION GALLON WATER TANK Earl Kemp presented two bids for the council for consideration for the new one million gallon water tank. One bid for a concrete tank from Christensen and Griffith of Toole, Utah, for $218,800. Another bid from Pittsburgh Des Moines Steel Company for a steel tank was $239,550 which included side pipe in the amount of $36,800. Earl Kemp said that a steel tank has an expected life of well over 100 years, as compared to about 50 for the concrete tank. He also stated that steel tanks usually present less trouble than a concrete tank. Annual maintenance of a steel tank is higher because it must be painted periodically both inside and out, but it does have some salvage value. The concrete tank would be 16' high and the steel tank would be 20' high. Earl Kemp said that lie would recommend the steel tank. Mayor Porter ask about vandalism. Could vandals shoot through the tank. Earl Kemp said it would be hard, and if they did shoot through the tank it could be fixed easily. A motion was made by Morgan Garner to except the bid from Pittsburg Des Moines Steel Company deleting the portion of the bid for the side pipe in the amount of $36,800, making the bid $202,700, seconded by Jim Morris. All Aye. RE: EARL KEMP SHOWED DRAWING OF NEW GOLF COURSE. Earl Kemp showed the council a drawing of the new golf course. The county had agreed to apply for a Heritage Grant for the Club House to put with the money that has been put aside by the City. He also showed pro- posed drawings of layouts for the Club House. RE: DISCUSSED PROPOSED STREETS TO BE IMPROVED UNDER THE TEDRO MONEY The council discussed the proposed streets that should be improved under the TEDRO money. They discussed the street by the fair grounds and the street by Chapples on 2nd South that needs to be oiled. The property owners would have to be contacted to see if they would pay for the curb and gutter along the streets being paved. Earl Kemp suggested the council consider replacing the bridge over the Rexburg Canal on Third South this summer. Nile Boyle suggested that the council go around the city and 6� check any streets that are not paved that are in the original townsite, and then start paving the streets that will not be torn up with the storm sewer. RE: REXBURG IRRIGATION CANAL COMPANY MEMBERS PRESENT Members of the Rexburg Irrigation Canal Company was present. Spokesman for the group Lorin Kauer presented a history of what has happened over a 20 year period of time. The city had leased excess water to dry farmers, when Rexburg Irrigation Company found out about this, they met with the council, and the council agreed to lease it to them when the leases to the dry farmers ended. Mr. Kauer also stated that they did not feel that they should pay as much as the dry farmers because they had been irrigating some of the land that used to be watered with the City Ditch. Mayor Porter said the Canal Company had been using some of the city's shares of water. He also told them that the cash output last year for the irrigation was $2383.00, plus equipment used and manpower making a total of $3873.03. It was his feeling that the Irrigation Company should take over the whole thing including expenses and then lease to the farmers. The city would wash their hands of it. That way it would not cost the taxpayers. Kauer said that that cost should be strung out over a five year period since the canal is not cleaned out every year and expenses do not total that high each year. Mr. Kauer said that the Canal Company felt that $500 should be a fair charge. The council felt that they could turn the operation and maintenance of the city canal over to the canal company for a $500 per year lease plus the canal company would pay the city's annual $232 assessment for 14 shares of water. The fee would be negotiable upon renewal of the lease. The agreement would go into effect at the end of 1980, when the city's water leases to farmers expire. Mary Smith was instructed to draw up an agreement and bring it to the next council meeting. At that time the years for the lease would be decided as well as other specific details that needed to be filled in. It was moved by Sander Larson and seconded by Nile Boyle to extend Parkinson's water lease for another year. All Aye. Keith Erickson said that the Canal Company was going to change the deversion by the Fantastic Inn near Theodore Ricks's property. The city has a foot bridge there and it is crumbling and needed to be torn out. The Mayor told him that it did not belong to the city, and there would be no problem for them to tear it our. The Mayor also told him that the city is going to widen the bridge on 5th West this summer. RE: NEW POLICE CARS ARRIVED Jim Morris reported that two new police cars had arrived, but additional equipment is needed for the cars that was not ordered with the cars. He said that the additional equipment needed would cost an additional $739. Mayor Porter said that he would check the Police budget. If the budget for the cars did not include the additional equipment, the police department may have to cut its budget in other areas to buy the needed equipment. RE: SANDER LARSON REPORTED ON A SEWER PROBLEM - PAYMENT TO ROTO ROOTER FIRM Sander Larson asked the council to give a $35 credit to a city resident for a bill paid for a roto rooter firm after the problem was found to be a problem in the city lines. Mr. Larson said that the resident had to put a ball bat wrapped in a towel ina basement drain to keep the water from coming up in the basement. He had called the water department and ask them about the problem. They had informed him that it was not a city problem. After the man had a Roto Rooter Firm check the line and then called the city, advising them of the problem then the city found that the problem was in the city line. Nile Boyle said that we needed to be consistant in paying for sewer backups. If it is the cit problem the insurance will pay for it. Mayor Porter said that we need to have confidence in our city employees and hear their side of the story as well as the residents. Councilman Norris Reese, said he woul be having a meeting with the city employees this week and agreed to discuss the matter, and find out both sides to the story. The council- man decided that they should check our insurance policy and see exactly what they will do, and see if a different policy could be purchased to cover these problems better. RE: CITY EMPLOYEE JAILED OVERNIGHT FOR SHOP LIFTING Nile Boyle said that one of the city employees had been put in jail for over night for shop lifting. He thought that he should be put on pro- bation and terminated if it happened again. A notice should be put in his file to that effect. C.i RE: ORDINANCE NO. 611 Mary Smith read Ordinance No. 611 an intent of the City of Rexburg to exchange property with Walters, a public hearing would be held in 60 days for the exchange of the property. ORDINANCE No. 611 AN ORDINANCE EXPRESSING THE INTENTION OF THE CITY OF REXBURG TO EXCHANGE CERTAIN REAL PROPERTY HEREINAFTER FULLY DESCRIBED AS TRACT NO. 3, BELONGING TO THE CITY OF REXBURG AND WHICH HAS CEASED TO BE USED FOR PUBLIC PURPOSES, FOR CERTAIN TEMPORARY AND PERMANENT RIGHTS OF WAY AND EASEMENTS AS HEREINAFTER SET FORTH; PROVIDING THAT NOTICE OF SUCH INTENTION TO EXCHANGE BE GIVEN AND THAT NO EZCHANGE OCCUR UNTIL SIXTY DAYS HAVE EXPIRED FROM THE DATE AND PASSAGE OF THIS OR- DINANCE, AS HEREINAFTER FULLY SET FORTH; PROVIDING THE EFFECIVE DATE OF THIS ORDINANCE. A motion was made by Councilman Nile Boyle and seconded by councilman Morgan Garner that the rules requiring an ordinance of a general and permanent nature to be read on three occasions be dispensed with and that said ordinance be numbered 611. The mayor then called for the voting for final passage of the Ordinance, and the motion was made by Morgan Garner and seconded by Jim Morris that ordinance 611 be passed. Those Voting Aye: Those Voting Nay: Sander Larson Norris Reese Darlene Blackburn Nile Boyle Morgan Garner Jim Morris None The roll showed all councilmen present voting "Aye" carried, the Mayor declared that the majority of all the members of the City Council had voted for the passage of said Ordinance, -and that said Ordinance was duly and regularly passed. Mayor Porter declared the motion carried. RE: ORDINANCE NO 612 City Attorney read Ordinance 612 of intent to sell property by the pump house to Eph Willmore, subject to appraisel and public hearing. ORDINANCE 612 AN ORDINANCE EXPRESSING THE INTENTION OF THE CITY OF REXBURG TO SELL, ON MAY 7, 1980, at 8 O'CLOCK P.M. THE HEREINAFTER DESCRIBED REAL PROPERTY BELONGING TO THE CITY OF WHICH PROPERTY HAS CEASED TO BE USED FOR PUBLIC PURPOSES: SETTING FORTH THAT THE PROPERTY HAS BEEN APPRAISED AND WILL BE SOLD TO THE HIGHEST BIDDER ABOVE THE APPRAISED VALUE AT PUBLIC AUCTION, FOR CASH OR CONTRACT, THE CITY RESERVING THE RIGHT TO REJECT ANY AND ALL BIDS, AND GIVING NOTICE THAT NO SALE SHALL OCCUR UNTIL MAY 7, 1980, AT 8 O'CLOCK P.M. RE: JIM KELLER TO MEET WITH NORRIS REESE & THE MAYOR Jim Keller had requested to meet with Norris Reese and the Mayor prior to the regular Planning Board Meeting. Porter City Hall Rexburg, Idaho Dear Mayor Porter: A recent traffic survey was made in conjunction with the State Highway Department in reference to reducing the speed limits on North 2nd East near our new shopping mall. After our survey was completed, it was decided by the Highway Department that they would in fact reduce the speed from the Teton bridge north to Rogers Brothers to 45 MPH instead of the current 55 MPH limit. However, the 35 MPH speed would remain as currently posted. I feel that this does not eliminate the potential traffic hazard that we have near the mall area because of the numerous left hand turns that are made in getting into the parking lots. In discussing this with the highway department personnel, I found that they would be interested in making a left hand turning lane in the center of the road similar to that that is now on the south side of Rexburg. However, to do this it would be necessary for the City to adopt an ordinance to out law any street parking from the courthouse corner north to the', Rogers brothers turn off. If this ordinance was adopted by the City, I feel that it would greatly increase the safety of traffic not only near the mall but also at the intersection of Ist North and 2nd East by allowing enough space for a left turn area at that intersection. As you are aware of, there is a considerable amount of traffic that backs up at the inter- section due to people attempting to make a left turn. The State Highway Department has indicated that if the City adopts a No Parking ordinance that their department could probably do the paint striping and marking early in the Spring of 1980.
