Mayor Porter told the council that he and the engineers had talked to some of the
farmers about the annexation of the AMR property. The farmers suggested putting
in a frontage road along the property, so that the property owners would not be
backing out on the main road. Mayor Porter felt that they should put in the frontage
road before anyone starts building. The frontage road could have two or three roads
exiting on to the main road.

A motion was made by Councilman Warren Porter and seconded by Councilman Morgan
Garner that the rules requiring an ordinance of a general and permanent nature to be
read on three occasions be dispensed with and that said ordinance be numbered 607.

City Attorney Mary Smith read ordinance 608 annexation of the Golf Course, Airport,
City Shop and Dump Yard property.

RE: ELECTRICAL WIRING AT POLICE STATION
Jim Morris reported that the electrical wiring at the Police Station has been
corrected and is now on two seperate electric meters. This will make i` possible
for the city to pay a lower rate for some of the electricity.

RE: DEVELOPMENT OF 2nd WEST SOUTH TO 7th SOUTH
Mayor Porter read a letter from Ricks College and property owners supporting the
development of 2nd West South to 7th South. They agreed that now that it had been
extended they would pay their share of the cost. (copy attached) He told the council
that statements would be sent to the property owners according to an agreement with
the property owners. He also had a breakdown from the engineers for the work done
on the Jack Randall property. The amount due is $7972. He also owes the city money
for breaking a water line, (copy attached) amount due for this will be $139.06. The
above billings was all part of LID 23.
RE: BILLS
Warren Porter moved that the bills be approved, seconded by Barton Jensen. All Aye.
RE: PLAQUES PRESENTED TO OUTGOING COUNCILMEN
Mayor Porter presented plaques to the outgoing councilmen Barton Jensen and Warren
Porter., Mayor Porter told Barton Jensen that he was one of the finest councilmen
he had served with. He was presented a plaque for 12 years service. Warren Porter
was presented with a plaque for 8 years service. The Mayor thanked Warren Porter
for his outstanding service he had provided the City and presented him a plaque for
8 years service.
Barton Jensen said that he was leaving the council with mixed emotions. He had
served under three mayors. He told Mayor Porter that he had enjoyed working with
him and commended him for his efferts as mayor and especially during the flood.
Warren Porter said that he had served under two mayors. He said he had enjoyed
working with the city personel and department heads and the councilmen.
RE: SWEARING IN OF THE NEW COUNCILMEN AND COUNCILWOMAN
City Attorney Mary Smith swore in Norris Reese, Sander Larson, and Darlene Blackburn.
Mayor Porter appointed Sander Larson, chairman of Finance & Irrigation. Norris
Reese was appointed to be chairman of Water & Sewer. Norris Reese would also serve
on the Finance & Irrigation committee and on the Fire & Police committee. Sander
Larson would serve on the Health & Sanitation committee and also on the Water &
Sewer committee. All other committees would remain the same. Jim Morris moved that
the council approve the appointments, seconded by Darlene Blackburn. All Aye
Morgan Garner nominated Nile Boyle as President of the City Council, seconded by
Darlene Blackburn. All Aye.
RE: BEER LICENSES
Beer Licenses were presented for approval for the following:
College Market
Mighty Mite.
Jim Morris moved that they be approved, seconded by Darlene Blackburn. All Aye.
RE: COUNCILMENS RESPONSIBILITIES DISCUSSED
Mayor Porter told the councilmen that he felt it would be a good idea for them to
hold regular meetings with the department that they are over. He also told them
that the City had a lot of projects going, all of the TEDRO projects and also the
new Rexburg Sugar City Sewer System.
RE: UPKEEP OF PORTER PARK
Nile Boyle told the council that they should keep a better eye on the parks in the
next year. He had had reports that the Porter Park had not been kept up the last
few years. He also said that there were some old trees on the north end of Porter
Park that should be taken out.
RE: THE OLD CITY GOLF COURSE
Nile Boyle suggested that the council should begin to consider what should be
done with the old city golf course when the new Madison County course opens in 1981.
Mayor Porter said it -ould operate with a board similar to the Airport Board. Steve
Meikle and Roger Ferguson had already been appointed for the board.
RE: KENT JOLTEY TO ATRPnRT BOARD
TI -e ceunril approved appointment of Kent Jolley to the airport board. He was
originally appointed to the board to fill an unexpired term of Jim Meikle. Gary
Ball would be quiting the board and at the next meeting the name of the new board
member that was going to take his place would be presented to the council.
RE: EARL KEMP - NEW PROJECTS
Jim Morris suggested that the new council members have a meeting with Earl Kemp so
he could explain the new projects.

RE:
STUDY OF THE WATER USER RATES
The mayor suggested that the city council authorize a study of the water user rates
and consider raising the fees because of the increased pumping costs. The revenue
from the water department should pay the cost of operating the water system.
Earl Kemp told them that he needed n committee to meet to obtain the right -a -ways
needed for the Sugar Rexburg Sewer Line.

Proposal to Rexburg City Council
December 6, 1978
We hereby propose to the Rexburg City Council that 2nd West be built
to a 34' width between 5th South and 7th South under an extension of "the
current 7th South contract of H&K Construction and that funds that were
to be used to extend 7th South between 1st and 2nd West be used to extend
2nd West. By doing this now the following benefits would be realized:
1. The congestion on 4th South and 2nd West would be relieved.
2. The Armory would have improved access.
3. The cost and time to extend 2nd West to the South Arterial
street being discussed would be reduced.

As property owners we would be willing to do the following in order
to expedite the completion of the road:
1. Donate the right-of-way for a 60' 2nd West road to eventually
be built from 5th South to 7th South.
2. Pay for the cost of the curb and gutter for the 60' road when
it is installed.
3. Pay the additional costs of $15,568.00 to build 2nd West
between 5th South and 7th South to a 34' width less any
savings in construction costs.
According to Mr. Earl Kemp of Forsgren and Perkins the $15,568.00
figure is determined as shown on Attachment No. 1.
Ricks College has given its endorsement of the 2nd West extension
and is willing to share in the costs.
Mr. Grant Bowen and Mr. Levi Thomason have also agreed to the proposals
outlined by signing this statement.
Mr. Sylvan Seely and Mr. Robert R. Lee as trustees of the Gem State
Irrigation Pension Trust which owns frontage and also as private land
owners also agree to the proposals outlined and have signed this statement.
We urge the Rexburg City Council to approve this proposal so that the
2nd West extension can be built under the current contract with H&K
Construction.

of 2nd West south to 7th South with an intersection of the two streets,
thus allowing an exit from 7th South onto 2nd West rather than 1st West r
as previously proposed. This letter is to indicate our approval of that
proposal.
We have been told that the property owners involved would be willing to
assist financially in this development. We also would be willing to pay
for the cost of paving the approximate 99 feet owned by Ricks College.
Because our Board of Trustees rather strongly object to extending 7th
South to 1st West, this proposal would help solve a problem for both
the college and the city. Where 2nd West is already a main artery into
the city, it seems much more logical to use this route, rather than
routing traffic onto to 1st West where student safety becomes a concern.

This letter is to summarize our commitment for the construction cost
of South 2nd West in Rexburg. Below are summarized the sources of
funding as we understand them:

If the City agrees to the above summary of available funds for the

to finish this project. $5,000 of this will go towards an engineering
contract with Forsgren-Perkins Engineering and the remaining $10,600
will be put towards the construction of 2nd West with the remaining funds
coming from the available TDRO funds. If there are contract savings we
understand that the $15,600 figure will be reduced. Each of the following
parties will pay a percentage of the costs based on 2nd West frontage.

SUBJECT: Shoshone Avenue of LID No. 23, Rexburg
Mayor Porter from Rexburg called me this morning asking if
Jack Randall had negotiated an agreement with H -K Contractors
to do his half of Shoshone Avenue for a dollar less than the
LID. I contacted Ned Sauer of H -K Contractors and he indicated
he had offered to do that half of the street for Jack for
$5.90 per yard, which is approximately the same cost as the
unit quantity cost of the LID. Jack Randall said no that he
would not do it for that price, but that he would do it for
$4.90 per yard. H -K said they would not do it fbr that
price. H -K then requested direction as to what to do -with
Shoshone Road.
I contacted Mayor Porter and he indicated that when Jack
Randall was removed from the LID, it was with the agreement
that he would put in curb and gutter himself, and that he
would pay the LID prices plus engineering to be done with the
LID for the road. Because of this the Mayor directed me to
tell H -K to go ahead and do all of Shoshone; it was not
Jack Randall's road, that it was a city road, and that they
were to put it in as if it were part of the LID.
The Mayor then directed me to get a cost for putting in half
of the road and the cost for engineering on that half of the
road which he would submit to Jack Randall in the form of a
bill. He indicated to me that if Jack Randall did not pay
this, as the City Council minutes indicated he had promised,
then the City would sue him.
I then met with Jack Randall and his attorney, Roger Hoopes, and
Ned Sauer. It was agreed in this meeting, after reading the
City Council minutes, that Jack would pay the LID unit
quantity prices plus engineering for the west half of Shoshone.
H -K was instructed to proceed as directed. Roger Hoopes
requested than an itemized bill be sent directly to him.
