would cost the City $2000 to $4000. Kemp didn't feel that we should commit money
now. The council suggested that we sell the state our existing line. Discussion
on putting a holding pond at the old gravel pit. A fence would need to be put
around it and also the lagoon.
Morgan Garner, Warren Porter and Barton Jensen are to meet Monday at 5:0o P.M. to
dissolve the Kent Jolley Project.
RE: CITY'S NEW ELEVATED WATER TANK
Earl Kemp reported that the board of health has been given plans for the city's new
elevated water tank on the Rexburg hill, pending approval. The tank would be South
West of the existing reservoir. At the location where they want to put the new Water
Tower, half the land is owned by the City and half the land is owned by AMR. The
piece that is owned by AMR is where the road runs. The new tank will be 140' high.
The new tank will be a 250,000 gal tank in addition to the city's water reservoir
further down the hill. The new water tower will be fenced all aroung. Nile Boyle
made a motion authorizing Forsgren Perkins to begin advertising for bids, if the
board of Health okays the plans.
RE: BILLS
Morgan Garner made a motion to approve the bills. Warren Porter seconded. All Aye.
RE: NEW DOWNTOWN PARKING FACILITIES
Nile Boyle gave a report on the new downtown parking facilities. He said that Gail
Lloynd, a licensed appraiser, is nearly finished with the appraisal of properties
being considered as part of the project. He said that several property owners have
expressed concern that the appraisals are too low.
The property owners will have the opportunity to get their own appraisals before
an offer is made on the project. When the appraisals are finished City Attorney
Mary Smith will be authorized to proceed to buy land. Mary Smith suggested getting
options on the property before the final purchase is made. The City has an obliga-
tion to come up with $150,000 to match the amount given to them by TEDRO.

Mayor Porter told the council that the Planning and Zoning committee had met once with
Gene Dunn and the property owners of Salem Avenue concerning the proposal to connect two
homes together owned by Gene Dunn at 367 Salem Ave. Mr. Dunn had since drawn up a plan
to connect the houses. The Planning & Zoning Committee was suppose to meet again and check
these plans but have been unable to get a quorum together. They would porbably have a
meeting in a week and check the plans at that time. Mr. Dunn was given a permit
on May 9, 1979, i,o move the house to the property, and had 6 months to start construction
or move the house. The residents asked the council to take some action to force Dunn to
move the house or have it boarded up so that the children in the neighborhood can not
get in or under it. They also asked the council to declare the buildings a public
nuisance. Mary Smith pointed out that it is a difficult situation to deprive a man of
property. She also pointed out that if the house is declared a nuisance, a public
hearing must be held and Dunn must be given sufficient time to remove the str~xcture before
the city can take steps to have it torn down. Mayor Porter pointed out that across the
street there is a house on the same dimensions of property that Dunn has for his homes.
The citizens felt that they did not press the issue that Dunn would not do anything
with the houses. A motion was made by Barton Jensen to instruct Mary Smith to write a
letter to Gene Dunn instructing him to board up the two homes for safety reasons within
72 hours so that people and children cannot get in or under the houses. Seconded by
Darlene Blackburn. All Aye
Mary Smith told the council that they all should go down and look at the houses before
the next council meeting. The council also said that they would have Nile Brown check
to see that he had it boarded up so that it was safe.
RE: BARNEY DAIRY ROAD
A Public Hearing on the proposed routes of the Barney Dairy Road, in the northeast
section of the city was held. Madison County Commissioner John Smith and County ~idmin-
istrator Doyle Walker were on hand to discuss possible alternatives. One proposed
route would connect the Barney Dairy corner of the cemetery road to third east street along
the south bank of the Rexburg irrigation canal. Sections of the canal would be moved so
the road could be built without crossing the canal. The county has encountered problems
acquiring the right-of-way along the proposed route. The council felt that this might
not be a safe route. This route would cross the end of the new park, which would prese
a problem. Citizens from North 3rd East were present to protest the proposed route if
it connects to North 3rd East. The Citizens of that street went on record as being
opposed to the proposed Barney Road route ending on 3rd East. (attached) They ques-
tioned why the road would not be built straight through to the highway. It was explained
that the county could not obtain right-bf-ways necessary. The orginal proposed route
went north of the canal, but the property belongs to the Willis Walker family. Mayor
Porter suggested abanding the idea of the new road and fixing and widening the old road.

Meeting called to order 24 October 1979 by Jim Keller at 7;30 p.m.
Minutes of 26 September 1979 were read and approved as amended.
BUSINESS:

1 , jim Flamm volunteered to contact the County Commissioners about adoption
of the Madison County-Rexburg Comprehensive Plan .
2. Discussed whether to urge adoption of proposed zoning ordinances and sub-
division ordinances . Dan and Leonard to complete instruction booklet for
educating people on new building plans .
3. Jim Keller to submit forms for approval of preliminary building plot plan to
the. City Council .
4. Gene Dunn appeared before the Planning and Zoning to discuss a proposal to
connect two homes together at 367 Salem Avenue with a common carport. The
area is currently zoned R2 and Mr. Dunn felt that a tri-plex or four-plex could
be constructed on the property. A group of concerned neighbors from Salem
Avenue also met with the Commission to voice their concerns about the pro-
posed construction. The existing home at 367 Salem Avenue was damaged
during the June 1976 flood . Repairs to this home have never been completed
and the neighborhood contends that it is a public nuisance and a safety hazard.
The property is approximately 114' frontage by 136' deep. The second home
on the property has been stored there since the middle of May 1979. This house
is still on blocks where the house movers left it. Both homes can be easily
entered either through open basement windows in the existing home or unlocked
entrances in the moved in home . The property has not been maintained and is
strewn with weeds, old pieces of pipe, scrap lumber and other debris.
Mr. Dunn's proposal was vigorously opposed by the group of neighbors because
of the following reasons;
1 . There has been an apparent lack of commitment from Mr. Dunn to complete
repairs to the existing home at 367 Salem Avenue. Little, if any work, has
been done to the home in the last three years .
2. The neighbors feel that joining the two homes together would detract from
the essential residential area of the neighborhood . They also feel the two
homes cannot be joined together in such a way as to create an attractive
tri-plex or four-plex.

The Planning and Zoning Commission reviewed the Rexburg City Zoning
Ordinance and feel that the proposed project is in violation in several
points :
1 . The home was moved onto the property without issuing a city
building permit as required on Page 30 of the Ordinance . There
has never-been a plan presented for approval to the City.
2. The existing home is also in violation of the Ordinance on Page 30
wherein the landscaping around the existing home and weed control
has not been done
The recommendation of the Planning and Zoning Commission is that the City
Council advise Mary Smith to take the steps necessary to inform Mr. Dunn
that he is in violation of the City Zoning Ordinances and that he fake immediate
steps to complete the building project or remove the flood damaged homes . The
property is a public nuisance as it now stands . If Mr. Dunn is issued a building
permit for construction of a tri-plex or four-plex (a tri-plex or four-plex is per-
missible in an R2 zone) the Planning and Zoning Commission further recommends
that Mr. Dunn be required to post a completion bond with the City. This bond
would insure that the project be carried to completion and not left in an un-
resolved state as it has been during the past three years .
This problem urgently requires resolution before the issue ends up in litigation.
There are several other homes in Rexburg in the same condition and a definite
stand needs to be taken now in order to encourage the clean-up of the remaining
flood damaged homes .

Meeting called to order 27 June 1979 at 7:35 p.m. by Chairman Jim Keller.
Thee minutes of the last meeting were available to read .
New Business:
1 . Bruce Lind , President of AMR Corporation and David Benton , Engineer
of Benton Engineering met and asked that Rexburg City annex their
development known as Heritage Estates, located S/E of Kent jolley's
subdivision known as Crest Haven. A discussion followed and
suggestions were made on the addition.
A discussion was had on Heritage Addition.- A motion was made by
Gale Weber that we recommend to have an annexation agreement from
AMR Corporation to install pavement on the street known as Sk.yview
Thrive and to have a bond to guarantee completion. Motion seconded by
Whitey Brock . Voting' was unanimous .
motion was made by Leonard Longhurst that we eliminate from the AMR
addition the following streets, Fairview Avenue,1400 South (known as
Erickson Dugway) , Sunrise Drive and the north extension to , _ orningside

All property owners within 300 feet of the proposed annexation are to
receive by mail a notice of the annexation meeting. The annexation hearing
will be scheduled for 26 July, 1979:
2 . Garth Harker from Idaho Falls , met and asked that the property located at
2362 South 1st West (Bertha Fullmer property) be zoned to Commercial or
continue the present variance .
The Board recommended we hold a hearing for a variance. The hearing was
scheduled for 25 July 1979.

RE: DISCUSSION OF THE NEW GOLF COURSE
John Smith told council that he would like to discuss the new Golf Course. Mayor
Porter. told him that they should have aboard similar to the Air Port Board with
representatives. They could appoint two from the county and two from the city and
one from each league to serve on the board, Smith also ask what was going to be
done with the old Golf Course. Mayor Porter told him that during the period of time
that the new Golf Course was being built, they would decide what to do with it. It
could ~ possibly ire made into a park.
RE: BIDS LET FOR STORM DRAIN ON BIRCH STREET
John Millar told council that the bids had been let for the Storm Drain on Birch
Street
H & K - $64,980.50
Dee Ard - $48,607.80 being low bid but irregular because it was not in an envelopE
Charles Zo'linger - $65,984.75
The engineer's estimate was $61,698
Mary Smith advised that there was a possibility of the City being sued if they decide
on the low bid because of the irregularity of the bid. Mary said that the bids
must comply with the terms of the specifications. They are suppose to follow the
instructions of the bidding. Mayor Porter said that Dee Ard was informed he was
in violation before the bids were opened. Ard presented the bid personally just
minutes before the bids were opened, so there could be no question that the bids were
tampered with. Mayor Porter also pointed out that if the city did take the higher
bid because of this, he felt that the people would be upset because of there being
nearly $17,000 difference. After discussing it at length, Darlene Blackburn made a
motion to give the bid to Dee Ard, Jim Morris seconded. All Aye.
RED MAYOR PORTER TO EXECUTE CONTRACTS ON WATER LINES
Jim Morris made a motion to authorize Mayor Porter to execute contracts on water
lines down the hill and the additional reservoir, seconded by Morgan Garner. All Aye.
RE: MORGAN GARNER TO SIGN EASEMENTS ON THE STORM DRAIN
John Millar said that everything was ready to go on the storm drain except that they
did need some easements signed. They needed a member of the council to go around with
Forsgren Perkins to get the easements signed. Morgan Garner said that he would go
around with them.
RE: NEW ROAD ON 5th WEST
Mayor Porter told the council that the new road on 5th West had been completed.
RE: REVIEWED PLANS FOR ELEVATED WATER TANK ON REXBURG HILL
Earl Kemp showed a map of the South East section of the City, and reviewed plans for
installation of an elevated water tank on the Rexburg Hill. He also stated that AMR
Corporation had given the site far the tank to the city as previously arranged. The
two million gallon tank will improve water pressure for better fire safety and would
not tax the electrical pumps as much. The construction of the water tank is the first
phase of the water project, The second state will be addition of lines and a second
tank further down the hill. Earl Kemp proposed a contract to the City for the second
phase, which included $75,000 for engineering fees, which is 10%. Jim Morris made
the motion that the city enter into the agreement with Forsgren Perkins, seconded by
Morgan Garner. All Aye.
RE: VETERANS DAY OFF FOR EMPLOYEES
Mayor Porter ask the council if it would be ok if the City employees took Veterans
Day off to observe the holiday. The council agreed.
RE: NEXT COUNCIL MEETING TO BE CANCELLED
The council decided that since the next council meeting was scheduled for the night
before Thanksgiving, they would cancel it. If anything has to be done a special meet-
ing would be called.
RE: LETTER FROM PRESIDENT HAFEN
Mayor Porter said that he had received a letter from President Hafen telling how they
appreciated the City's assistance and cooperation at homecoming.
RE: MEETING AT THE LIBRARY BY FARM HOME
The Mayor told the council of a meeting at the Library that the Farm Home was going
to hold.

RE: WORK DONE ON WEST FIFTH SOUTH BEFORE WORK WAS BEGUN ON LID 23
Mayor Porter told the council that the engineers had given him a letter telling the
Council and Mayor that last summer before the work was begun on LID 23, Forest
Investments needed work done on the street in front of their apartment on West Fifth
South so that their apartment could be rented, They were given permission to do the
work themselves, with the supervision of Forsgren Perkins. Mayor Porter had gone
over the charges with the engineers. The Mayor explained that the company had
installed 400 feet of six-inch water line and a canal crossing along West Fifth South
They had done preliminary work on the street and graveled it from the canel to 5th
West. A fair share would be $4195.64 plus $1900.00 for work done by ~ollin~er
Construction on the water line. Forest Investments were asking for that amount plus
supervision and administrative and the cost of a dust coat, the total being $6500.00.
Barton Jensen made a motion that they be given a credit on their LID for the work
done with exception of supervision, administrative and dust coat. Credit to be given
being a total of $6095.54, seconded by Jim Morris. All Aye.
RE: GENE DUNN DUPLEX ON SALEM STREET.
Mayor Porter told the council that the Planning and Zoning Commission had met and
gone over the plans of the duplex that Gene Dunn had given them for his proposal to
join two houses with a carport on Salem Street, It had been denied because it did
not comply. Since Mr. Dunn had boarded up the houses and made them safe, he would
be given time to revise his plans and re-submit them to the Planning & Zoning Board.
If he wants any other action he can come to the council and ask for a variance.
Mayor Porter had told him to come back after the first of the year with the revised
plans.
RE: FEDERAL GOVERNMENT TO TAKE A CENSUS.
Mayor Porter told the council that the Federal Government is going to take a census,
which sould be completed by April 1, 1980. They have suggested that each City organise
