HomeMy WebLinkAbout1979.10.24 CITY COUNCIL MINUTESOrdinance 606 AN ORDINANCE VACATING AND CLOSING ALL THAT PORTION OF THIRD NORTH STREET BETWEEN SECOND EAST AND THE REXBURG CANAL AS IT NOW EXISTS TO THE WEST, IN THE CITY OF REXBURG, IDAHO, SUBJECT TO EXISTING RIGHTS OF WAY AND EASEMENTS AND RESERVATION BY THE CITY OF RIGHTS OF WAY AND EASEMENTS OVER, ACROSS AND UNDER SAID PROPERTY FOR CITY UTILITIES AND PURPOSES; PROVIDING SAID STREET REVERT TO THE OWNERS OF ADJACENT REAL ESTATE, ONE-HALF ON EACH SIDE THEREOF; PROVIDING WHEN SAID ORDINANCE SHALL TAKE EFFECT. Motion was made by Morgan Garner that the rules be suspended, seconded by Warren Porter. All Aye. Warren Porter made a motion to pass the ordinance, Darlene Blackburn seconded. All Aye. RE: PROPOSED STORM SEWER SYSTEM Earl Kemp told the council he had talked with Ricks College officials about the proposed storm sewer system to be constructed in the City. He said the proposal of the college to be included in the system will be presented to the college president and the board of education soon. We could possible get some financing from the College so they would hook on it. He also had talked to the Idaho State Highway Department about storm drain extension, and them participating with us. Present were the following: Presiding President of the Council: Barton Jensen Councilman: Jim Morris Warren Porter Nile Boyle Morgan Garner Councilwoman: Darlene Blackburn Also Present: Rose Bagley, City Clerk Mary Smith, City Attorney ~~ ~~: RE: MINUTES APPROVED Warren Porter made a motion to approve the minutes of October 3, 1979, seconded by Jim Morris. All Aye. RE: SALEM STREET A group of citizens from Salem Street were at the meeting to discuss the problems of the houses owned by Gene Dunn. Floyd Roundy of 350 Salem Street acted as their spokesman, He stated that they had met with Mr. & Mrs. Gene Dunn once but since that time they had not Y-ad any effective contact with them. They still maintain that there isn't enough room on the property for the two houses. Mr. Dunn had boarded the doors at one time but since they had blown open, Some of the windows are broken out. The houses have not been closed at the bottom allowing children to play under them. The people are still concerened about the safety of the child- ren, The appearance of the houses distracts from the neighborhood. Mr. Dunn stated that he had had some people that have been trying to buy the prop- erty. The building inspector had given him six months after he had been issued a permit to move the second house on the lot for him to either improve the house or move it. He said that he was also condisering making a multiple houseing unit out of the two houses. The council referred Mr. & Mrs. Dunn to the Planning & Zoning Board, after the council received the report from them they will take definite action at the next council meeting on November 7. RE: BARNEY DAIRY ROAD Nile Boyle reported on the Barney Dairy Road which had been discussed the the County Commissioners meeting. The commissioners want to put the road south of the canal emptying the traffic onto 3rd East. If enough money is available they would build a bridge across the canal extending 3rd East North routing traffic back onto the highway by Forsgren Perkins. Two disadvantages of this route would be (1) it would go through the North end of the new community park, (2) it would empty the traffic onto 3rd East which is a 50' wide street. This road would get some of the traffic away from the highschool. It would be a straighter road. It was decided by the council to hold an Informational Hearing at 8:30 P.M. on November 7 to receive input of the location of the road from the public. RE: BIDS OPENED FOR WATER DEPARTMENT PICK-UP Bids were opened for a pickup for the Water Department Erickson Pontiac - $5277 Also a bid for $5236 Taylor Chevrolet - $5292 The bids were turned over to Morgan Garner for him and Dan Moulton to study specs. RE: PLANS FOR A PORTION OF THE STORM DRAIN SYSTEM John Millar explained plans for a portion of the storm drain system. Mayor Porter had signed the advertisement for approximately 1,000 feet of the storm drain system. The bids will be opened on Nov. 2. The drains would provide better drainage for 135 acres of land along Mill Hollow. It would help the drainage problem at Lincoln school, along Birch, and the High School area. The proposed to put in catchbasins and drain pipe to handle that area of town. The water will be discharged into Smith Park this winter and in the spring pipes would carry the water to the river. Nile Boyle moved that authorization be given to Forsgren Perkins to call for bids for the rest of the project this winter, seconded by Jim Morris. All Aye. RE: REXBURG-SUGAR CITY SEWER PROJECT Earl Kemp reported on the Rexburg-Sugar City sewer project. The grant from the EPA had been approved for the step tw® phase of the sewer project. The grant will cover the design phase of the project. They would need to get an aerial photo. A letter would be sent out to the land owners. and a public hearing held to decide which side of the road to put the sewer line on. Easements would need to be gotten from property owners. If the line is run along the eastside of the highway it will be constructed along the state highway right of way. Any connections to the line would have to be installed across the highway at a considerable cost to the property owners. Earl Kemp pointed out that if the line is constructed along the west side there would be easier access for hookups. There are two proposed routed (1) along the canal straight to the lagoons crossing the north end of Walters property and a portion of Louisianna-Pacific, requiring easements from property owners. Mr. David Walters was present at the meeting and said he would trade the land for the easement for a portion of the old junk yard for a stockpile area, (2) down 2nd North and follow the road to the lagoon requiring an easement only from Louisianna- Pacific. Earl Kemp reported that the Highway Department is putting in a storm sewer down Highway 33 and on down the Hibbard road and dumping at the old meat packing plant. Minutes of 24 October 1979 were read and approved. Old Business -Hold-over Items 1. jim Flamm volunteered to contact the County Commissioners about adoption of the Madison County-Rexburg Comprehensive Plan. 2. Discussed whether to urge adoption of proposed zoning ordinances and sub-division ordinances. Dan and Leonard to complete instruction book- let for educating people on new building plans . 3. jim Keller to submit forms for approval of preliminary building plot plan to the City Council. New Business 1. Dean Ricks presented asub-division of 124 building Iots on 34 acres on property north of Mill Hollow Meadows Mabile Home Court. This will be joint venture between Gene Palmer and Dean Ricks . The County Commissioners are committed to construct the Barney Dairy Road to U . S . Highway 2 6 via 3rd North , 3rd East , and 4th North . Mr . Ricks would like to annex the property to Rexburg City with an R-2 zone . Sidewalks , curb and gutter, sewer lines , water lines will be part of proposed sub-division . A preliminary Platt will be presented for the Ricks-Palmer Sub-division. Moved by Whitey Brock, seconded by Alice Tout that the property be annexed to Rexburg. Unanimous. 2 . Planning & Zoning recommends that all new construction be charged a realistic connection fee for sewer and water. With the large number of sub-division lots planned, capital construction money must be accumulated by user connection fees in order to pay for required new facilities . The current connection fees do not accumulate sufficient capital money. 3. A petition from concerned neighbors near Sherwood Hills Sub-division was presented (copy attached) . They are concerned about less than 60' frontage and a lack of recorded restrictive covenants. Moved by Dan Hess, seconded by Leonard Longhurst, passed unanimous: a . That Cul-de-sac lots be changed to have 60' frontage . b. That restrictive covenants be approved and filed prior to approval of final Platt . c. A discussion of Gene Dunn's proposal to join two homes into a duplex by adding a common carport . Moved by Jim Flamm , seconded by Chuck Frost that Mr. Dunn's four-plex proposal be denied because in our opinion-joining two houses with a carport does not create afour-plex. 5 in favor, I abstain. S . Moved by Alice Tout and seconded by Jim Flamm that the City Council Committee have two annexation meetings each year-in the February and July meetings unless by special request. Kemp didn`t feel that we should commit money now. The council suggested that we sell the state our existing Line. Discussion on putting a holding pond at the old gravel pit, A fence would need to be put around it and also the lagoon. Morgan Garner, Warren Porter and Barton Jensen are to meet Monday at 5:0o P.M. to dissolve the Kent Jolley Project. RE: CITY'S NEW ELEVATED WATER TANK Earl Kemp reported that the board of health has been given plans for the city's new elevated water tank on the Rexburg hill, pending approval. The tank would be South West of the existing reservoir. At the location where they want to put the new Water Tower, half the land is owned by the City and half the land is owned by AMR. The piece that is owned by AMR is where the road runs. The new tank will be 140' high. The new tank will be a 250,000 gal tank in addition to the city's water reservoir further down the hill. The new water tower will be fenced all aroung. Nile Boyle made a motion authorizing Forsgren Perkins to begin advertising for bids, if the board of Health okays the plans. RE: BILLS Morgan Garner made a motion to approve the bills. Warren Porter seconded. All Aye. RE: NEW DOWNTOWN PARKING FACILITIES Nile Boyle gave a report on the new downtown parking facilities. He said that Gail Lloynd, a licensed appraiser, is nearly finished with the appraisal of properties being considered as part of the project. He said that several property owners have expressed concern that the appraisals are too low. The property owners will have the opportunity to get their own appraisals before an offer is made on the project. When the appraisals are finished City Attorney Mary Smith will be authorized to proceed to buy land. Mary Smith suggested getting options on the property before the final purchase is made. The City has an obliga- tion to come up with $150,000 to match the amount given to them by TEDRO. RE: ADJOURNMENT Nile Boyle made the motion to adjourn. Seconded by Warren Porter. All Aye.
