MINUTES OF THE CITY COUNCIL MEETING
May 16, 1979
A meeting of the City Council for the City of Rexburg, Madison County, was held on
May 16, 1979, at the time of 7:30 A.M. at City Hall. Present were the following:
Mayor: John C. Porter
Councilwomen: Darlene Blackburn
Councilman: Jim Morris
Barton Jensen
Warren Porter
Nile Boyle
Also Present: City Attorney, Mary Smith
City Clerk, Rose Bagley
RE: MINUTES
Nile Boyle moved that the minutes be approved, Barton Jensen seconded. All Aye.
RE: DAVID WALTERS, WALTERS CONCRETE REQUESTED LEASING PART OF OLD DUMP
David Walters, representing Walters Concrete was persent to request leasing part
of the old dump. He would like to lease about 2/3 of it to pile gravel on.
The Mayor said that the Fair Board could take another area to put the barns on.
Mayor Porter stated that if they leased the land, they should pile the gravel
so it did not interfer with the proposed bridal path or too near the road. He
suggested that they use it for parking. Mayor Porter told Mr. Walters that
he dad been getting a lot of complaints of the concrete trucks going down 3rd West,
and ask if they could go down 2nd West. Mr. Walters said that there were no stop
signs on 3rd West and on 2nd West there were three. The Council told him that they
would check on the stop signs and see if they could be changed. The Council told
Mr. Walters that after the meeting they would go down and look at the old dump,
so they could decide about leasing it.
RE: BRENT PETERSON, FROM HOUSE OF CARPETS REQUESTS BUILDING PERMIT
Mayor Porter read a letter from Brent Peterson, from House of Carpets requesting
to put a game room in that building and agreeing to tear the house in back of
it down sometime this summer for the required parking area. They would like to
open business before the house is torn down Jim Morris moved that they be
turned down until they are in compliance. Darlene Blackburn seconded. All Aye.
RE: FUNDS AVAILABLE TO WIDEN BRIDGE ON 5th WEST
Mayor Porter stated that he had a letter from the Highway Department saying that
the funds are available to widen the bridge on 5th West. The total cost including
the engineering fees would be $30,000. They would pay $24,000 and our cost would
be $6,000. Barton Jensen moved that we go ahead. with the bridge, Jim Morris seconed.
All Aye.
RE: BIDS FOR NEW GOLF COURSE
Mayor Porter told the council that the bids had been opened for the new Golf Course,
by Madison County. The lowest bid was $800,000, with the total money available
from the Grant being $658,000. They have been negotiating to reduce the cost.
They are going to narrow the bridges, & eliminate the playgrounds and camping area.
The County is going to haul fill. They want us to participate in hauling the
fill, when crew and trucks are available. Mayor Porter discussed this with
Forsgren Perkins and would like to get the okay from the Council. Nile Boyle moved
that Mayor Porter be allowed to get in touch with the County Commissioners and
work out something to help them, Darlene Blackburn Seconded. All Aye.
RE: MAYOR PORTER REPORTED REXBURG IRRIGATION COMPANY SIGNED AGREEMENT
Mayor Porter told council that the Rexburg Irrigation Company had signed the
agreement with the City allowing Them to dump into the Canal for 6 months of the
year when the water is in=ttie Canal. He told them that the City had also got
a letter from the Teton Pipe Line Association relative to leasing water from the
City.
RE: KEN HART OBJECTED TO HOUSES ON SALEM STREET
Ken Hart representing the people on Salem Street was present to object to two
houses that Gene Dunn had put on that<~treet. They complained that there was
not enough footage for the two houses, and that they were a hazard to the
children on the block, because of the way they had been left without being
properly finished. The children were able to climb under the houses and play, .°~'~
and could get hurt. Mayor Porter stated that he had talked to the building
inspector. He had allowed them to park the second house there only temporily,
until he either met with the requirements to be in compliance or moved the house.
He is going to meet with the planning board. The house is on stilts at the present
time. He will not be allowed to put it on a permanent foundation until it is in
compliance. He has a 52~ foot lot, if he puts the house 10 feet from the other
house and uses some of the other lot footage, he sill have a 58 foot lot. Before
the building permit is issued, everything will have to be done in compliance within
6 months time or it will be canceled. Mary Smith was instructed to write Gene Dunn
a letter declaring it a hazard. Both houses need to be boarded up. Unless he has
the houses boarded up in a week after he recieves the letter, Mary Smith will start
proceedings declaring it a nuisance.
Barton Jensen moved that the bills be approved, Jim Morris seconded. All Aye.
City Attorney Mary Smith read Ordinance 604
ORDINANCE 604
AN ORDINANCE AMENDING PARAGRAPH l OF FACILITY DESCRIPTION, SUBDIVIDER PERCENT OF
COST, CITY OF REXBURG PERCENT OF COST OF SECTION VL OF ORDIANANCE NO. 444`OF CITY
OF REXBURG, IDAHO, ELIMINATING FROM SAID SECTION THE PERCENTAGE OF-COST OF FIRE
HYDRANTS TO BEPAID BY THE CITY AND PROVIDING THE EFFECTIVE DATE OF THIS ORDINANCE.
A motion was made by Councilman Nile Boyle seconded by Councilman Warren Porter
that the rules requiring an ordinance of a general and permanent nature to be
read on three occasions be dispensed with and that said Ordinance 604 be placed
beforethe council for final passage.

Ordinance 604 was then placed before the council. The Mayor then called for the
voting final passage of the Ordinance, the motion was made by Barton Jensen and
seconded by Darlene Blackburn. The roll call of the council by the City Clerk for
the final passage of the Ordinance was as follows:

The roll showed all council men present voting "Aye" carried, the Mayor declared
that the majority of all the members of the City Council had voted for the passage
of said Ordinance, and that said Ordinance was duly and regularly. passed. Mayor
Porter declared the motion carried.
RE: ZONES FOR TRAILERS
Mayor Porter told council that in some areas in
of Hud trailers and are renting them. Some of
notzoned for trailers. He felt that something
the City, people have moved out
the trailers are in areas that are
sould be done about it.
RE: ADJOURNMENT
Darlene Blackburn made the motion that the Council adjourn from the Council chambers
to go in cars to 3rd West to look at the Curb and to the old dump to look at the
area that Walters wants to lease, Jim Morris seconded. All Aye.
