A meeting of the City Council far the City of Rexburg, Madison County, was held on
Niay 2, ]_979, at the time of 7:36 P. M. at the City ):Fall. Present were the fallowing:

RE: MINUTES
Barton Jensen maVE'd that the minutes of April 4, 1979, be approved, Darlene Blackburn
seconded. All Aye,
Jim Morris moved that the minutes of April 18, 1.979, be approved, Darlene P,lackburn
seconded. All Aye.
RE: TRANSFER BEER LICENSE
Application to transfer the beer license at VI Oil_ to Roy Gri_ndrod was presented to the
Council. Eartcn Jensen moved that the transfer be approved, Jim. Seconded. All Aye.
RE : B IDS FOR FF.NCF AND PARKING L•OT AT THE NEW PARK
Mayor Porter told the council that the City was ready to call far bids for a fence and
parking lot at the r?ew park. Advertising for bids would be ir! the paper tomorrow and
the bid opening would be in 15 days. The state pays half, and the City pays half.
Ricks College and the .Lions C]_ub wi.Il plant the grasp. The Lions Club will furnish -~
the seed and the College will use their ec~ui.pment. The parks should be ready to use by
August.

Mayor Porter told council that he and Mary had been ever to the Bureau and went.
through the ClalIIt. The Bureau will pay the iritere.st UI1 all the money that We have had
to borrorr~ from the bark since the floac~. The City r•.hould get about $800,600 or $9GO,GC(!.
It will be about 3G days after everything is signed before we get the money. Mayor
Porter told the Council also tr:at on tkzE_ federal disaster ]_oan, that the City got right
after the flood, they told us to make a list of the homes that have not been replaced
after the flocd a.nd the addresses arzd then go up to the assessors of_fic:e and get the
amount that these homes were assessed for taxes before the flood. If it was a certain
amount they would either cancel. the loan or a percent of the lean. The Bureau gave
us a deadline of November of 1976, for clean up of debris, The FDAA gaveus. a longer
period of time. S~~e are to figure the additional amount it cost us for the clean up
and the FDAA will pay it eventually.
RE: DAVID WALTERS MF'T WITri COUNCIL ABOUT MAP:ING 3RD WEST A 50FOOT W1DE STFtEE'I'
David Walters, of WTa]_ters Concrete was presera. He told the Council that he thought
the City should make 3rd West a 5G foet wide street instead of 4G feet wide. Mayor ~
Porter showed a map explaining the problem anal different. routes that his trucks could
take.Mr. Walters told the council th«t the street was to narrow for two trucks to pass
on it if cars were parked along the street. Mayor Porter told him that this street
was in the orginal townsite a.nd so the City would have to pay far the paving and narrowing
the street would save .the City money. The savings would be about $36,000. Earl Kemp
of Forsgren Perkins told the council that the curb and gutter was already ir, and ready
t.o pave that street anal that it would ccst the city $12,286 to take the curb and gutter
out to change it. The council ask Mr. Walters what street the trucks turned on when
they came back in town after being out of toF~n. He told them they always turned ~n
2nd West. Mr. Walters then ask if they could not widen the road, if they could open
North 5th West. Mayor Porter to]_d him that the City and. Fairboard had spent too much
money to change the North 5th West road to open it now. Clair Boyle of the Fairboard
told the council that the race track was used nearly everyday. The City does not have
the money to tare up the curb and gutter, so Earl Kemp was instructed to have them ga
ahead anal pave 3rd West without changing it. Discussion on the route the trucks should

take. It was felt that if the trucks went down 2nd west and then turned down 2nd North,
it would help the problem. If no parking signs for one side of the street between
2nd West and 3rd. West en 2nd North were put up it would help the traffic flow. It was
moved by Nile Boyle and seconded by Jim Morris that no parking on th2 north side of
the street on. 2nd North between 2nd West and 3rd West be put up. All Aye.
RE: Warren Porter asked about the change on 5TH West
Warren Porter ask mayor Porter how they were coming along with the change of the road
on North 5th West. Mayor Porter told him that it would take 45 days for some special
pipe to come that was ordered for the road. In the mean time they were filling in the!
curve to move it out to make it wider. It should be finished by fall.
E. STOP SIGN FOR RICKS WADE ADDITION
Mayor Porter told the council that the people in the Ricks Wade Addition wanted to
put up a stop sign on 5th West where the H & K come around the corner by the race track.
Mayor Porter also told tham that some trees were going to be donated by a farmer ~to
be put in between ricks Wade Addition and H & K property.
RE: CLAIK BOYLE ASK ABOUT LEASE BE;TWE;EN FAIRBOARD & CITY
Clair Boyle ask the Council about the lease between the Fairboard and the City for the
property they were leasing. Mary Smith told him that it had been made up and he
was given a copy.
RE: LORIN KAUER & GUY ERICKSON FROM REXBURG IRRIGATION
Mr. Lorin Kauer a.nd Ntr. Guy Erickson from the Rexburg Irrigation Company was present
to further discuss the matter of leasing water from the city. City Attorney Mary
Smith stated that the l.aw reads that the City can lease property when. it isn't being
Gsed by a resolution of the Council. It would be up to the council to decide on terms
and conditions of the lease. The Mayor told them that at the time that the lease was
made up with Parkinsons, they wanted it for three years. The amourxt tio~~c:harge there
was decided upon by taking the amount charged to the farmiers ar,d the same rate was
charged to them. 'Phe money received from leasing water is used to maintain the ditch..
Mayor Porter told the Irrigation Company that with the 1~ initiative, the water we have
will be an asset to the City. He also told them that the City pumps about two million
gallora of water a week and will empty that much into the canal through the sewer system,
and they would get the water at noccst. Tim Farkinson told the council thfit he was
trying to get other sorces of water and would relingL:ish their lease when they got the
other sorce of. water. Discussion an water rights. Barton Jensen toJ_d tk,e irrigation
Company that Municipalities car: keep waterright.s even if they don't use the water,
and they car. lease or rent water wile they are not using it. The other water
lease that. the City has with Teton Pipeline is up at the end of 1979 with an option to
extend it for two years. The Irrigation Company complained about the residents that: live'
in the City and use canal water anti have t.o back it up to water their gardens. The
Council told them that the City would stop them from hacking up the water. If they used
the water they would have to pump it out of the canal. The Irrigation Company ask for
a de~init:e decision. The the Council ask them to give the City until July to give them
a definate answer, in the mean time the City would check what the cost of water is in
other areas, sc they could give them a price on the water. In the mean time the
City ask the Irrigation Comipany to sign the papers allowing the City t.o dump into the
Canal.
RE: KED' BIRD VARIANCE
Jim Morris made the motion to give Ken Bird a variance on his property at 255 South 1st
East for his apartment house as recomr,emded by the Planning and Zoning Committee.

Barton Jensen moved that we pay the bills, Darlene Blackburn. seconded. All Aye.
