A meeting of the City Council for the City of Rexburg, Madison County, was held on
March 7, 1979, at the time of 7:30 P.M. at the City Hall.
Present were the following:
Mayor: John C. Porter
Councilmen: Nile Boyle
Jim Morris
Warren Porter
Morgan Garner
Councilwoman: Darlene Blackburn
Also Present: J.D. Hancock, Acting City Attorney
Rose Bagley, City Clerk
RE: AUDITORS MAKING SUGGESTIONS IN ACCOUNTING OF THE CITY
Joe Call and Merrill Rudd for Rudd, Dabell, and Hill Accounting Firm were persent to
make recommendations in accounting procedures.
RE: MINUTES
Nile Boyle moved that minutes of February 21, 1979, be approved. Jim Morris seconded.
All Aye.
RE: SAW MILL
Sylvester Cooper representing 40 families of Rexburg was present with a letter
protesting the amount of ashes and debris that continue to be produced by the local
saw mill. (attached) Discussion by the Council. Mayor Porter will contact Bruce
Arnell of the Public Health Department.
:LIONS CLUB
Dell Carlson representing the Lions Club was present, to get permission from the
City Council for the Club to put up shelters at two locations for the handicap
Children to wait for the bus. One would be on First North and one by the
Bishop's Storehouse behind the tabernacle. They would be 8' long, 7' in front, 6'
in back with a slop and a red wood floor, movable with a bench in them. Council
said they would have to get conscent from the property owners involved. After they
had the permission there should be no problem and they could go ahead. Jim Morris
felt that the City could paint the curb by the bus loading zone.
RE: PLANNING BOARD MEETING
Mayor Porter stated that the Planning Board had met and decided that the City should
go ahead with the annexation of Cresthaven. It would be zoned R1.
RE: CARL SMITH PROPERTY
Mayor Porter ask the Council if any of them remembered if the property owned by
-'" Carl Smith on the corner of Main and Ash had been rezoned. None of the Council
could remember.
LETTER FROM FRANK CHURCH
Mayor Porter read a letter that Senator Frank Church had received requesting inform-
ation on Rexburg.
RE: TEDRO FUNDS
Mayor Porter read a letter from Senator Frank Church reguarding TEDRO Funds.
RE: ORSON SMITHS LID 22
Discussion on the LID of Orson Smiths, LID 22 Item 78, which was originally billed
to john Smith. Mayor Porter ask permission the the Council to waive the interest
due because it had been sent to the wrong person. He stated that they had o~me in and
paid the principal in full, but did not want to pay the interest. The Council agreed

RE: BILLS
Morgan Garner moved that bills be paid. Warren Porter seconded. All Aye.
RE: ADJOURNMENT
Nile Boyle moved that the meeting be adjourned. Morgan Garner seconded. All Aye.

Dear Senator Church:
This is in response to your letter of February 7, 1979, regarding
payments for certain projects in the Teton disaster area pursuant
to Public Law 95-629 which amended Public Law 94-400,
As of February 2, 1979, approximately $117,6 million of the
$400 million available under the Teton claims program had not been
obligated, At that time, claims in the amount of $104,1 million
were pending, the Office of Hearings and Appeals was considering
appeals of administrative determinations for claims totaling
$73,7 million, and lawsuits involving claims totaling $1,8 million
had been initiated, Thus, a total of $179,6 million or more could,
theoretically, be required to cover the claims that have not been
settled, In addition, administration costs will be incurred,
Until we are certain that the total amount to be obligated under
Public Law 94-400 is less than $400 million, we do not believe it
would be appropriate to obligate funds pursuant to Public Law 95-629,
We will keep you advised as the program progresses,

Mayor Porter and the Rexburg City Council:
We have been asked to represent about ~0 families of Rexburg who are
concerned about the amount of ashes and debris that continue to be pro-
duced by the local sawmill.
It is our understanding that both the current owners and the previous
owners were given a "temporary" permit by the State of Idaho Depart-
ment of Health to continue operating while a solution to the pollution
problem could be worked out. Apparently, the:°previous owner did not-
hing and we are .able to detect no progress by the current owners.
We realize the financial contribution this industry makes in the empl-
oyment and tax revenues to the people of our community. It is not our
intent to try to drive them out of business, but we feel that sufficie-
nt time has elapsed to develop a workable solution to this problem.
We feel that the time~~as come to require that something be done.
We would like to know how long the temporary permit allows the mill to
continue operating. We also request appropriate action by the Mayor
and City Council to get the owners of the mill moving toward a prompt
solution to this long standing problem.
It is our intent to stay on top of this situation until something is
done to stop this dirty and unhealthy condition in our community.
