A Meeting of the City Council for the City of Rexburg, Madison County, was held on
December 20, 1978, at the time of 7:30 P.M. at the City Hall. Present were;

RE: SEWER TREATMENT PLANT

Rose Bagley, City 1Clerk
Earl Kemp of Forsgren Perkins was at the meeting and stated that they had heard from the
Environmental Service Administration and they had okayed the Sewage Treatment
plant. The next step would be to have a public hearing. Copy attached. It was
agreed that the Public Hearing would be January 31, 1979, at 7:30 P.M:

Jim Morris moved that the minutes of December 6 be approved, Nile Boyle seconded

RE: BEER LICENCES
Beer Licenses for the following were read:
Rexburg Food Center
Johnsons Grocery
College Market
Circle K
Nile Boyle Moved that they be approved, Warren Porter seconded. All Aye.
RE: T~dO HOUR PARKING TO BE EXTENDED IN FRONT OF PENNEY'S
Mayor Porter read a request to extend 2 hour parking North on 1st East in
front of J.C. Penney's Store, on that one side of the street. Nile Boyle
moved that the 2 hour parking should be extended in front of penney's, Warren Porter
seconded. All Aye.
RE: PLANNING BOARD.
Mayor Porter stated that there was one opening on the planning board. Wood Miller
had resigned. Mayor Porter said he would like to appoint Dan Hess to fill
the vacancy. Morgan Garner moved that Dan Hess be appointed. Jim Morris
seconded. All Aye.
RE: Mayor Porter stated that Anita Reynolds of St. Anthony had filed a claim
against the City of Rexburg, statiAg in the. claim that the ~'ity was neglegent
in enforcing parking regulations, allowing vehicles to park on the city
street:, in an area clearly marked "no parking " causing restricted visibility,
which resulted in an accident on August 7, 1978. Mrs. Reynolds was driving
out of a parking lot on 1st east and could not see traffic and hit a motor
cycle. She paid the fine. Mayor sorter has instructed the police to check
all driveways and alleyways to see if they are posted correctly.
RE: LID
Jim Morris asked why LID assessments were not filed at the Courthouse to show
the debt owed against property. Mary Smith City Attorney stated that after
the LID ordinance was passed with the assessment roll, it then was recorded.
RE: BI~3S FOR SALE OF PROPERTY
Mayor Porter asked for bids for the sale of the property owned by the City
behind the Telephone Company, now used for the impound lot. `l~he property had
been appraised at $34,500. The only one present to bid on the property was
a representative form Mountain Bell. Their bid was for $34,500. The impound

lot will be moved to property by the City Street Shop. No one was present
to protest the sale of the property and these was only one bid. Morgan Garner
moved that the property be sold to Mountain Bell for $34,500., Nile Boyle
seconded. All Aye.
RE: BILLS
Jim Morris moved that the bills be paid, Warren Porter s<~conded. All Aye.
RE: ADVANCE FORM THE BUREAU
Mayor Porter stated that the City was going to get an advance from the Bureau
for $59,600.
RE: ADJOURNMENT
Nile Boy3;~ moved that the meeting be adjourned, Morgan Garner seconded.
