Hoopes stated that I~ir. R~>.nd.-11 wanted to be excluded from the District and proposed to put in his own curb and gutter under City supervision and according to City specifications and th~:t when the City put in the street, this being Shoshone Avenue, he would pay one-half of the expense for paving ~.nd improving Shoshone Avenue It was moved by Barton ~'ensen, seconded by Nile Boyle and unanimously carried that h1r. R~ndall's property adjacent to Shoshone be deleted and excluded from the Improvement District, it being agreed that Mr. Randall would put in the curb and gutter at his own expenses according to City specifications and supervision and. that he would pay for one-half of the cost of improving and paving Shoshone Avenue. P~Sr. Hoox~es was also informed th.~~..t Mr. Randall should return to the City the gravel ~.~hich he had taken from Shoshone Avenue and hauled away. The Mayor then st~::ted that the Counsel would hear any other written or oral protests. There were three other people attending the meeting, however, they stated they had. just come for information pertaining to the proposed Improvement District and. were not protes- ting. ri general discussion was had but no other written or oral protests were made again the improvements or the creation of the district. RE: BILLS APB''=:OVL`D On motion duly made, seconded. and carried, the bills were approved and ordered paid. Rorter presiding. `1'he following Council members were present: Darlene Blackburn, Barton Jensen, Plile Boyle, Jim PJiorris, P~:organ Garner and Warren Porter. Also present were Afton Anderson, City Clerk, NSary Smith, City Attorney and Leland. Thomr;son, City ir.'orks Director. RE: AR.ACC - L~r:ASING C~~'•.. AND C'IL -=,I:~HTS The ~"ayor stated that Amaco wanted to lease gas and oil rights on approximately 240 acres of City property on which the golf course and airport wa located. He read the proposal contained in a letter from them and directed that the letter be attached to the minutes. He stated. that he had suggested they also contact the airport board to see if such a lease would be agreeable with them. The matter was discussed. It was moved by Barton Jensen seconded by Darlene Blackburn and unanimously carried that the City enter into the lease and the Mayor and City Clerk sign the same, providing the terms of the lease ire acceptable. RE: CITY EP~RLOYEES - JUhY 24 HOLIDAY The matter of the City employees taking a holiday on July 24 was discussed. It was moved by Jim Morris, seconded by Nile Boyle and unanimously carried that July 24, 1978, be designated as a holiday for the City employees. RE: STATE HIGH~idAY DEF''rRTI~:°~NT - BRIDGE OVER CANAL CF1 rjth blEaT The N:ayor read a copy of a cooperation agreement with the State Highway Department and the City of Rexburg pertaining to the construction of a bridge over the canal ooh 5th irdest. The only cost to the City would be x'700.00. It was moved by Nile Boyle, seconded by Morgan Garner and unanimously carried that the City enter into such an agreement and the Mayor and City Clerk be authorized to sign the same. RE: BOYD b4EB~~TER - ENE:~GY CGNTROL NODULE Boyd 'Webster appeared before the Council to inform them about an energy control module which would save on power bills and control the surges of electricity anr' remove the sparks which would be a savings insofar as hump motors were concerned. The matter was discussed. Jon Ray also talked pertaining to-this matter. It was moved by i~arren t'orter ,~ i _~ and seconded by Piorgan Garner and unanimously carried that Jim Morris investigate this matter and report to the Council. The Mayor explained th<t it would be necessary to secure the sig- natures of the neighbors within a radius of 300 ft. approving the location of the trailer on this lot and that if such variance was gr~~.nted he would hve to renew his request each year. It was moved by Barton Jensen, seconded by Nile Boyle and unanimously carried that the City circulate the necessary petition and if the neighbors approved, that the customary procedure far the granting of a variance be followed. RE: KL'N SPICKS & Er~RL KF;P•IP Fi~OA^, FORSGk'F_?~ & ~%~RK_INS DICCLT~~"~.FD ~OPfL ~"~T'R:FT FRC:BLF2~1S Ken Spiers and Earl Kemp from Forsgren & Perkins, City Lngineers, stated they would like to discuss some street problems. The Mayor told them that the people in the Ricks-Made addition were paying one-half of the street chNrges. It was further determined that 3rd ti+Iest had been narrowed to a 40 foot street, that the Planning and coning Board feels that 2nd ~r~est should be 50 feet, that it was a North- South arterial and should be that wide, that the cost difference is about X4,000.00 The engineers stated a bridge would be constructed over the canal on 7th South; that a 34 foot asphalt strip would be laid on 7th South; that a 58 ft. bridge would be built over the canal; that when 7th South Street was finished it would likely be a 48 ft. street and wculd work in nicely with the bridge; that there would be no curbs and gutters across the bridge; that the bridge would be designed t~ be extended 80 feet in width, if necessary. The engineers also stated that the owners of the island on Shoshone Avenue would not give it to h1r. Randall and ~`Ir. Randall stated he was putting in his curbs and gutters the way the street is now. The Mayor stated the City was not interested in buying the Island. RE: _ EARL B?G`~N - F.ri'C'TrauT TO TH:. ItiI'`iOVF't;;;NT DI`';TRICT The itayor read a letter from Carl Brown registering a pratest to the Improvement District and the Mayor stated tY;at it had not been timely filed. The Mayor suggested that when ?the assessment roll was considered th;3.t P-~r. Brown's protest could be taken into consideration as he did not receive the benefits that others did receive. RE: OIL IN BACI'; GF FIRF E:~TATION ~iN OId 350 NCIKT?? STRr;ET The Mayor stated that the oil in back of the fire station had been torn up. That it had started to go to pieces and that the same thing 1,~as happening to the oil on 350 North Street. That he had a letter from r~orsgren & Perkins designating the soft spots and that H & K contractors h~~ve stated. that they would repair the same. r ^ : P ZC`BI~i: TH TF? C. 1 PUT~iP A~' CI'''Y ti~ ^.I.L The City Engineers also discussed the matter of a problem with the No. 1 pump at the city well explaining their concern if there was a failure and suggested that there should be a backup unit. The matter ~rn~as discussed as well as the other pumps and the pumps at Porter and ~;r:ith Parks. RE:~ ~ GARBAGE - BiILK PICKUP The matter o.f. bulk pickup for some types of garbage and debris was discussed by i"jr. Thompson. RE: t~1ADISCIV` CC. F.~~.IR B0.',RD Clair Boyle cif the 3~Tadison County Fair Board thanked the Council for its help on the 4th of July rodeo. ~,;;: GARBAG: PICKU?' The council continued to discu=,s the problem of garbage pickup. I`ar. Thompson stated he thought that the City was receiving quite a benefit by use of the Garner land fill even though the City was rroviding the cover for it. i~'r. Thompson suggested that the city Council meet with the county and determine responsibility of the city and the county pertaining to the land fill. The matter was further discussed. r !~S The Mayor su~,gested that i°ir. Thomp4~on give the schedule of increased garbage rates to the City Attorney in order that she mip;ht draft an amendment to the garbage ordinance. RE: EMPLOYEE VACATIONS The matter of employee vacations was discussed. RE: CITY PAF~KS DICCUSSED - UNE CF S`w`IPrt~"ING POOI. AFTER 11 F.h1. The matter of the city parks Maas also discussed and. the fact that there had been use of the swimming pool after 11 P.P~1. and that they had received sa;:~e complaints regarding music and noise at the swimming pool disturbing the neighbors. The matter of improving the maintenance of Porter Park was discussed and that Lou Gillespi was doing an excellent job at Smith Park. RE: SIDEU'ALKS Barton Jensen stated he was concerned about the sidewalks. That in new construction areas, cuts in the curbs were being made that were nct lasting and suggested that if the cuts did not last for a year, those making them would be required to do it over again. The matter was discussed. RE: GAS COMPrNY - LEAVING HOLES Barton Jensen stated th~.t the gas company was not taking care of the holes they had dug in the streets and that they should be required to repair them immediately. RE: SPRINKLING SY"TEP^ - PACK AT ST ^.F;I.IGHT A:~DITION Leland Thompson suggested that a sprinkling system be installed at the little park at the at the Starlight Addition. A sprinkling system for Porter Park was also discussed. RE: BILLS APP~'CVED It was moved by Morgan Garner, seconded by Jim Morris and unanimously carried, that the bills be apprtwed and paid.
