A meeting of the City Council for the City of Rexburg, Madison County, was on April 18,
1978, at the time of 7:30 P. M, at the City Hall. Present were the following:

RE: MINUTES APPROVED
Minutes of the previous meeting were read and discussed. Councilman Nile Boyle moved
the minutes be approved as corrected. Councilman Barton Jensen seconded.

RE: PLANNING BOARD MINUTES
Mayor Porter read the planning board minutes
RE: PLAN PRESENTED FOR ROLLING HILLS ESTATES DIVISION #2
Thompson Engineering presented a plan of the Rolling Hills Estates, Division #2.
Vilda Orgill developer presented the plans 2 years ago but went with Division 1
only; they are now ready for Division 2. If the EDA funds are available to build a
a water tower, the water pressure problem will be alleviated. Councilman Barton
Jensen moved the city accept the additional lots however the city will not guarantee
water pressure. Councilman Morgan Garner seconded.

RE: GALE REESER PRESENTS PETITION
Mayor Porter presented a petition signed by all the neighbors giving them permission
to build their garage closer to the property line. Councilman Barton Jensen moved
the variance for 3 feet be granted. Councilman Morgan Garner seconded.

PETITION FROM OWEN SLAUGH ASKING TO BE ANNEXED
Mayor Porter presented a petition from Owen Slaugh asking to be annexed to the city when
Cresthaven Property is annexed. Councilman Barton Jensen moved the city annex all
the property owners on the petition when it can be contiguous and be included with
Cresthaven. Councilman Jim Morris seconded.

RE: CITIZENS WANT 4-WAY STOP AT CORNER OF 2nd NO AND lst EAST
Numerous citizens were present to ask that a 4-way stop be placed at the corner of
2nd No. and lst East. Councilman Jim Morris moved that a 4-way stop be installed as
soon as the signs can be obtained. Councilman Barton Jensen seconded.

RE: REQUEST FO LIGHT AT CORNER OF lst NORTH AND CENTER STREET
Mrs. Kidd also asked to have a light on the corner of 1st North and Center Street.
Mayor Porter advised that when checking with the council, traffic safety commission and
the Chief of Police, all felt there should be one through street with no stops for the
truck traffic. The U. S. Safety Council has proved that more accidents happen where
there are lights. Councilman Warren Porter moved that a study be made and a decision
be made at the next meeting. Councilman Morgan Garner seconded. All Aye. Councilman
Barton Jensen stated that it should be a light rather than a 4-way stop.,

IRE: CITY IN VIOLATION OF THEIR DISCHARGE PERMIT, WARNING LIGHTS AT LAGOON INOPERABLE
Jim Perry of the Dept of Health and Welfare from Pocatello stated that the city is
in violation of their discharge .permit. It expired June 30, 1977. The EPA has just
issued a new permit. He wished to express concern that the effluent tntas in compliance
only during the summer months. He reported that the warning lights ,at the lagoons
have been inoperable for at least a year. He asks the city to get an auxiliary power
station as soon as possible.
IRE: PHIL BARE REAL ESTATE HAS CUL DE SAC STREET
Phil Bare Real Estate has a cul de sac street; they are putting in the curb and gutter.
They want the city to write a letter guaranteeing FHA the street will be paved. The
contract has already been let. The city engineer brought to the attention of the council
that Mr. Bare has made no provisions for a turn around for snow removal or garbage pickup.
Mayor Porter stated that they would have to correct that.
RE: COUNTY HAS ENTERED INTO AN AGREEMENT WITH GARNERS TO FILL THEIR GRAVEL PIT
The County has entered into an agreement with Garners to fill their gravel pit. After
the council expressed a great deal of opposition, Councilman Nile Boyle moved the
city haul to the Garner gravel pit instead of the landfill West of town. Councilman
Morgan Garner seconded. Vote: Nile- Aye, Darlene- Aye, Warren- Aye, Morgan- Aye,
Jim Morris opposed.
IRE: ZACKERSON PROPERTY APPROVED FOR ANNEXATION
The Zackerson property has been approved for annexation and the planning board recommended
they be zoned R-2.
~ RE: ORDINANCE 592
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE-CITY OF REXBURG, IDAHO; DESCRIBING SAID
LANDS AND DEGAARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND AMENDING AND CHANGING
THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, TO SHOW SUCH ANNEXATION AND THE CLASSIFI-
CATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO, AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
A motion was made by Councilman Nile Boyle and seconded by Councilman Darlene Blackburn
that the rules requiring ordinances of a general and permanent nature to be fully and
distinctly read on three different occasions be dispensed with and that said Ordinance
be numbered 59"a and be read in full and at length and placed upon its final passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call
upon said motion etas as follows:

The Mayor thereupon declared that the motion, having been passed by not less than
three-fourths of the Council, had been duly carried, Ordinance No. 592 was then read by
the clerk in full and at length.
RE: PLATT PRESENTED FOR ANNEXATION F3Y BOWEN, THOMASON, LEE, SEELEY, GEM STATE IRRIGATION
A platt of Grant Bowen, Levi Thomason, Gem State Irrigation Pension Trust, Robert Lee,
Sylvan Seeley property have requested annexation and approval. The council asked them
to come back in two weeks after we find out which streets we are putting through 5th,
6th or 7th.
RE: DISCUSSION OF THE WIDTH OF NO. 4th EAST
Discussion of the width of No. 4th East. There has been a lot of debate about the width;
and after study the council .agreed that a 40 feet street must have a 60 feet right of
way.. On the East side of the street the city property goes back 5'; on the West side
it goes back 15'. Councilman Morgan Garner so moved. Councilman Warren Porter seconded.

RE: DONALD DONOHUE WANTS TO BUILD 4-PLEX
Donald Donohue, property owner wants to build a 4-plex at 122 No 4th E. The property
is zoned R-2. The planning board voted the plans down as they are out of size both in
size of lot and unit size. In order to build a 4-plex the size of the building would
have to be reduced and the unit size corrected. Also, they would have to line their
building up with the houses along the street.
RE: DISCUSSION ON LID 23
Discussion on LID 23. The citys share would be approximately $115,000. After much
discussion the cost of it to the city would be approximately half.

Councilman Morgan Garner moved the bills be approved for payment. Councilman Warren
Porter seconded.

A meeting of the City Council for the City of Rexburg, Madison County, was on May 3,
1978 at the time of 7:30 P. M. at the city hall. Present were the following:

RE: RICKS WADE ADDITION TO GET NO 5th WEST PAVED FOR $150.00 EACH
The Ricks Wade Addition represented by Randy Landon presented a petition signed by
signed by the people in the addition. They agreed to pay for the paving of North
5th West if the cost was no more than $150.00 each. The engineer stated that the cost
would be $8,800 for just the paving. Councilman Nile Boyle moved the city would have
the street paved and the cost to the property owners would be no more than $150.00
each. Councilman Barton Jensen seconded.

RE: DEPARTMENT OF HEALTH AND WELFARE AGREE TO COOPERATE ON SEWER HOOK-UPS
