MINUTES OF THE CITY COUNCIL MEETING
March 1, 1978, 7:30 P. M.

A meeting of the City Council for the City of Rexburg, Madison County, was on March 1,
1978 at the time of 7:30 P. M. at the City Hall. Present were the following:
Mayor: John C. Porter
Councilman: Morgan Garner
Jim Morris
Nile Boyle
Barton Jensen
Warren Porter
Councilwoman: Darlene Blackburn
Also Present: Mary Smith, City Attorney
Afton Anderson, City Clerk
Leland Thompson, Public Works Director
RE: MINUTES APPROVED
The minutes of the February 15th meeting were read and discussed. Councilman Morgan
Garner moved the minutes be approved as corrected. Councilwoman Darlene Blackburn
seconded.

RE: DISCUSSION ON 6th SOUTH
The street has one family living along there but the armory construction trucks have been
traveling the road and it is really in bad shape. The Mayor reported that the city had
graded that street today. The national guard may help with the road.
RE: DISCUSSION 7th SOUTH
They will bring three routes over the hill. Jim Keller showed a map of the proposed routes.,
A public hearing will be scheduled.
RE; ROBERT PETERSEN RESIGNS FROM PLANNING BOARD
Mayor Porter read a letter from Robert Petersen offering his resignation from the
planning board. He has too many other obligations to give the job the time it requires.
Mayor Porter asked the council to accept the resignation and to appoint Jim Flamm to
take his place. Councilman Barton Jensen moved the appointment be made. Councilman
Nile Boyle seconded.

RE: LAW SUITE BY ALDEN PACKER
The city has been notified of a suite by Alden Packer. Dee Ard was doing work there
and knocked a rock and dirt in the manhole. The sewer then backed up into Mr. Packer's
basement. Councilman Morgan Garner moved the claim be denied as the fault was not the
cities. Nile Boyle, Councilman, seconded. All Agreed. The City Attorney was instructed
to notify them that the city had denied the claim.
RE: KENT JOLLEY WANTS TO GET HIS PROPERTY ANNEXED AS SOON AS POSSIBLE
Kent Jolley asked the council to meet with Ricks College to complete the annexation of
their property. He wants to get his property annexed as soon as possible. Mayor Porter
reported that there will be some updating of the sewer lagoons so the Dept. of Health
will lift the restrictions on new hook-ups.
PUBLIC HEARING 8:00 P. M. Medical Center on Jack Randall Property
Public Hearing 8:00 P. M. Medical center on Jack Randall Property. The police had taken
a petition around and there were no signatures for the zoning change. Roger Hoopes,
Attorney for Jack Randall, requested a continuance of hearing until April 1. The
council agreed that because of the number present; they would be allowed to express their
view. Robert Swartz-opposed, Darwin Wolford-opposed, Bill Moss-opposed, Phil Choate-
opposed, and Robert Woodmansee-opposed. Councilman Barton Jensen asked those present
if the medical center were redesigned would the people still be opposed. The unanimous
opinion was yes. Councilman Jim Morris moved that the zoning change be denied as 80~
of the people have expressed their opposition. Councilwoman Darlene Blackburn seconded

RE: GERWIN BOWEN ZONING CHANGE
The Gerwin Bowen zoning change, South 5th West for the Alpine Apts. Councilman Nile Boyle
moved that as there are no opposed the change from R-2 to R-3 be granted. Councilwoman
Darlene Blackburn seconded. The City Attorney was instructed to draft the ordinance
making the change. All agreed. The plans must be approved before the building permit
is issued.
RE: 7TH SOUTH ROUTES SHOWN
The 7th South routes were shown so the alternatives could be studied,
Garner seconded.

RE: LOAN OWED TO FIRST SECURITY BANK DISCUSSED
Councilman Morgan
The matter of paying the First Security Bank the $225,000.00 and interest which was
due February 1, 1978, was discussed. The Mayor stated that the BOR settlement had not
been made and there was not sufficient money to pay it. The Mayor stated he had dis-
cussed the issuance of the city's registered warrant with Mr. Widdison which was accept-
able by the bank at 6~ interest.
RE: LID 23 PLANS SHOWED
John Millar of Forsgren, Perkins showed the plans for LID 23. Councilman Nile Boyle
moved the City Attorney proceed with LID 23. Councilman Morgan Garner seconded.

RE: MAP SHOWED OF ROTATION OF THE CUTTER TRACK ON NORTH 5th WEST SHOWED
Clair Boyle, Lee Boyle, and Engineer Lyle Thompson presented a map showing proposed
rotation of the cutter track on north 5th West. Councilman Barton Jensen moved we
accept the alternate plan. Councilman Warren Porter seconded. All Aye. Mayor Porter
asked Mary Smith to contact Rexburg Irrigation about approval for canal piping. A
petition was presented fo the residents on 3rd West protesting the closure of
5th West.

RESOLUTION INTRODUCED TO PAY THE BANK
Nile Boyle said he would introduce a resolution to pay the bank 6~ interest on the
warrant. Roll call showed members of the Council voted "aye". The Mayor stated the
First Security Bank had agreed with the City to purchase a $75,000 tax anticipation
note to be issued by the City, payable August 1, 1978, and drawing interest at the
rate of 5~ per annum. Councilman Morgan Garner said he would introduce such resolution,
and the members of the council, on roll call voted "Aye". The Mayor asked the City
Attorney when she could have the resolutions prepared and she stated by March 8, 1978.
It was moved, seconded and carried that a special meeting be held March 8, 1978 at the
city hall to complete the necessary proceedings for the loans.
RE: BILLS APPROVED
Councilman Nile Boyle moved the bills be approved for payment. Councilwoman
Darlene Blackburn seconded.

RE: MAYOR PORTER REPORTED ON THE NEW ROAD
Mayor Porter reported on the new road. A right of way 80 X 80 is needed from Louisiana
Pacific, in order to put a street and bridge. Councilman Nile Boyle moved start pro-
ceedings to condemn the street. Notify them to cut down on their burning. There have
been lots of complaints.
Councilwoman Darlene Blackburn moved the meeting be adjourned. Councilman Barton
Jensen seconded.
