Councilman Warren Porter moved the bills be approved for payment. Councilman Barton

RE: CONFERENCE CALL TO PLANNER FOR MADISON COUNTY AND CITY OF REXBURG
Conference call. Mayor Porter put in a conference call to Arlo„Nelson, Planner for
Madison County and the City of Rexburg. He explained the proposed plans with the
sketches and designs which had been given to the council.. Various business men were there
to ask questions and view the proposals. After the discussion with Mr. Nelson, another
call was placed to the engineers so any questions could be answered. The public was in
general agreement with the plans; however, they were concerned with the money. It was
agreed that we would go with the 1st part of the plan until we used the $500,000 available
by grant. The project could be done in stages over a number of years. Everyone was
in agreement with this plan as some stages could be decided upon later.

Councilman Warren Porter moved the meeting be adjourned. Councilman Morgan Garner
seconded.

A meeting of the City Council for the City of Rexburg, Madison County, was on
February 15, 1978 at the time of 7:30 P. M. at the City Hall. Present were the following:
Mayor: John C. Porter
Councilman: Jim Morris

Also Present: Mary Smith, City Attorney

Absent: Councilwoman, Darlene Blackburn
RE: The Minutes Approved
The minutes of the February 1st council meeting were read and discussed, Councilman Barton
Jensen moved the minutes be approved, Councilman Jim Morris deconded.

RE: CHAMBER OF COMMERCE AND FAIRBOARD ASKS FOR PERMANENT CLOSURE OF NORTH 5th WEST
Members of the Chamber of Commerce and the Madison County Fairboard were present to
ask for the permanent closure of North 5th West. Lee Boyle asked the council to close
the street so they can make the fairgrounds and cutter track something to be proud of.
They have plans for additional facilities and horse barnes at the fairgrounds. The
Cutter Association wants to build a permanent track so they can hold state meets in
Rexburg. They are presently racing in St. Anthony. Clair Boyle, spokesman for the
group asked that the council close this street. They have been waiting three years
and can't wait another three years. They have spent or will spend $350,000 on the
facilities by the time they are through. The college wishes to build some barnes there
for their use. They want to expand the fairgrounds and bring many groups to Rexburg
for a number of different functions. This would bring money to the Rexburg Merchants.
Phil Hackbarth of the Rexburg Chamber of Commerce expressed the wishes of the Chamber
to bring people to Rexburg as we do not have the industry to bring them here. The
national guard has agreed to build the street past Walters Concrete this summer.
The fairboard would supply the culvert for the bridge. If they expand to accomodate
the college, it will be necessary to have more city property. Councilman Barton
Jensen asked if they couldn't rotate the whole track so that an access road could be
kept for 5th West. Tt is not good to close city streets. There should be two access
roads if there is an increase of people to that area. The streets that would be
traveled to and from the fai=rgrounds, if 5th West is closed, are narrow dirt roads
that have not been made for heavy traffic. These small streets would not handle the
heavy trucks. If the track could be moved enough so an access street could be put
between the Ricks Wade Addition and the cutter track, it wouldn't increase the
present load of traffic so much on the other route. Dave Walters expressed his opposition
to North 5th West being closed anytime. Breck Barton, Attorney for Dave Walters stated
that there would have to be public hearings and legal procedures. The Mayor agreed.
Councilman Nile Boyle moved that the engineers be asked to find the best way of placing
the track so that a street could still be there; then have a special meeting at 7:00
A. M. Friday morning to make a final decision. Councilman Barton Jensen seconded.

RE: CITY SERVED WITH A SUIT BY MARION S. CHENEY
Mary Smith, City Attorney reported that the city has been served with a suit by
Marion S. Cheney. He was hit by a car at the crossing of Main Street and College
Avenue. Councilman Barton Jensen moved the council turn down the claim and notify
their attorney that it is a state highway, Councilman Warren Porter seconded,

RE: B 0 R ASKS INFORMATION ABOUT INTERMOUNTAIN BLOCK
Larry Martin of the Bureau of Reclamation requested information of the city council.
After the flood, Mayor Porter wrote a letter to Intermountain Block to the effect that
the council would not let them build back at their present location if it was necessary
for them to expand. Mr. Martin asked if the council would let them rebuild if it
was put to preflood state. Councilman Nile Boyle stated that the city could not stop
them from rebuilding as they were before; the objection was that if they intended to
expand, they would violate our zoning ordinance. We will not stop them from improving
if they can do this on the same size lot. The council all agreed.
RE: LIBRARY SHOULD BE MOVING OUT OF THE CITY BUILDING BY APRIL 1st
Mayor Porter reported that the library should be moving out of the city building by
April 1st. The Senior Citizens have asked for the use of these quarters for their
luncheons and meetings. Councilman Jim Morris so moved. Councilman Warren Porter
seconded.

RE: DELOY WAR@ & MELVIN COOK PLATT PRESENTED
Brian Burte presented two platts of DeLoy Ward South of City and Melvin Cook property
South of Park Street as revised by recommendations of the planning and zoning board.
They wanted a through street for 2nd West. The revised platt shows this street.
Councilman Morgan Garner wants the street to go straight. They agreed. Councilman
Nile Boyle moved the preliminary approval be granted, and the proceedings be started
for annexation on Cook property. Councilman Warren Porterseconded. All Aye.
They have requested R-2 zoning.
CITY TO GET GRANT FROM EDA
The Mayor reported that EDA will give the city a grant for $14,000 to build the 7th
South highway.
RE: ENGINEER PRESENTED THE FINISHED LAND USE PLAN
Jim Keller, Engineer presented the finished Land Use Plan. The council studied and
discussed the plan. It was agreed to set a hearing for March 15. Councilman Morgan
Garner so moved and Councilman Jim Morris seconded.

RE: MINUTES APPROVED
The minutes of the February 15th meeting were read and discussed. Councilman Morgan
Garner moved the minutes be approved as corrected. Councilwoman Darlene Blackburn
seconded.

RE: DISCUSSION ON 6th SOUTH
The street has one family living along there but the armory construction trucks have been
traveling the road and it is really in bad shape. The Mayor reported that the city had
graded that street today. The national guard may help with the road.
RE: DISCUSSION 7th SOUTH
They will bring three routes over the hill. Jim Keller showed a map of the proposed routes.,
A public hearing will be scheduled.
RE: ROBERT PETERSEN RESIGNS FROM PLANNING BOARD
Mayor Porter read a letter from Robert Petersen offering his resignation from the
planning board. He has too many other obligations to give the job the time it requires.
Mayor Porter asked the council to accept the resignation and to appoint Jim Flamm to
take his place. Councilman Barton Jensen moved the appointment be made. Councilman
Nile Boyle seconded.
