RE: ROBERT BOICE FROM RICKS WADE ADDITION COMPLAINS ABOUT CONDITION OF NORTH 5th WEST
Robert Boice expressed his concern about the North 5th West street past the Ricks-
Wade Addition. He complained that the City crews are not plowing or grading that
street. There is a great deal of traffic, most of which is city trucks, on that
street. Mayor Porter explained that the county was going to put soil cement on that
street for us with their equipment. The flood took their equipment and the city
hasn't had the funds to pave it. He said the city would pay for their share of the
paving if the people in the Ricks Wade Addition would agree to pay for the curb
and gutter; which is what is done in the original townsite. Mr. Boice stated that
the people may agree to tYiat, however, the city should be able to grade that once
in awhile and put some gravel on it so that you could drive down there without
tearing up their cars. Councilman Barton Jensen assured Mr. Boice that something
would be done with it first thing in the spring. Then they will put a good base
under and gravel on the top. Mary Smith said if they petitioned in a hurry they
would be able to get on the LID now being put together.
~ RE: ZONE CHANGE HEARING
Zone change hearing. 8:00 P. M. Zone change on the West half of block 25 from
Commercial to R-2. There were numerous people attending to express their support.
Councilman Morgan Garner moved the rule be suspended requireing the ordinance to
be read on three occasions. Councilman Barton Jensen seconded.

~ RE: ORDINANCE 591
Ordinance 591 rezoning the West half of block 25 from Commercial to R-2.
AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY .OF REXBURG, IDAHO, TO
PROVIDE THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED LOCATED WITHIN THE CITY LIMITS
OF REXBURG, MADISON COUNTY, IDAHO, BE ZONED R2.
A motion was made by Councilman Nile Boyle and seconded by Councilman Nile Boyle
that the rules requiring ordinance of a general and permanent nature to be fully and
distinctly read on three different occasions be dispensed with and that said
Ordinance be numbered 591 and be read in full and at length and placed upon its final
passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call
upon said motion was as follows:

Those Voting Nay: None
The Mayor thereupon declared that the motion, having been passed by not less than
three-fourths of the Council, had been duly carried, Ordinance No. 591 was then
read by the Clerk in full and at length.
RE: REPORT ON HEARING ON ZONE CHANGE FOR JACK RANDALL PROPERTY
Mayor Porter reported that the hearing on the zone change for the Jack Randall
property near the hospital will be set for March 1, 1978. The police are taking
the petition to get the consent of the property owners within 300 feet of the
property in question. A great deal of oppositon is expected.
VOLUNTEER FROM COUNCIL TO MEET WITH THE PLANNING BOARD

Mayor Porter asked for a volunteer from the council to meet with the planning board.
They will attend all the meetings for the next 6 months; then they will change to
another council member. Jim Morris will attend for the next 6 months.

Mayor Porter appointed Mary Smith and her firm Smith, Hancock, and Moss Attorneys
at Law, as the City attorneys.
RE: BILLS APPROVED
Councilman Warren Porter moved the bills be approved for payment. Councilman Barton
Jensen seconded.

RE: CONFERENCE CALL TO PLANNER FOR MADISON COUNTY AND CITY OF REXBURG
Conference call. Mayor Porter put in a conference call to Arlo„Nelson, Planner for
Madison County and the City of Rexburg. He explained the proposed plans with the
sketches and designs which had been given to the council. Various business men were there
to ask questions and view the proposals. After the discussion with Mr. Nelson, another
call was placed to the engineers so any questions could be answered. The public was in
general agreement with the plans; however, they were concerned with the money. It was
agreed that we would go with the 1st part of the plan until we used the $500,000 available
by grant. The project could be done in stages over a number of years. Everyone was
in agreement with this plan as some stages could be decided upon later.

Councilman Warren Porter moved the meeting be adjourned. Councilman Morgan Garner
seconded.

A meeting of the City Council for the City of Rexburg, Madison County, was on
February 15, 1978 at the time of 7:30 P. M, at the City Hall. Present were the following:

Councilman: Jim Morris
Nile Boyle
Barton Jensen
Morgan Garner
Warren Porter
Also Present: Mary Smith, City Attorney
Afton Anderson, City Clerk
Absent: Councilwoman, Darlene Blackburn
RE: The Minutes Approved
The minutes of the February 1st council meeting were read and discussed. Councilman Barton
Jensen moved the minutes be approved. Councilman Jim Morris deconded.

RE: CHAMBER OF COMMERCE AND FAIRBOARD ASKS FOR PERMANENT CLOSURE OF NORTH 5th WEST
Members of the Chamber of Commerce and the Madison County Fairboard were present to
ask for the permanent closure of North 5th West. Lee Boyle asked the council to close
the street so they can make the fairgrounds and cutter track something to be proud of.
They have plans for additional facilities and horse Barnes at the fairgrounds. The
Cutter Association wants to build a permanent track so they can hold state meets in
Rexburg. They are presently racing in St. Anthony. Clair Boyle, spokesman for the
group asked that the council close this street. They have been waiting three years
and can't wait another three years. They have spent or will spend $350,000 on the
facilities by the time they are through. The college wishes to build some Barnes there
for their use. They want to expand the fairgrounds and bring many groups to Rexburg
for a number of different functions. This would bring money to the Rexburg Merchants.
