RE: MAYOR INSTRUCTED TO SIGN CONTRACT WITH STATE HIGHWAY DEPARTMENT
Councilman Morgan Garner moved the Mayor be instructed to sign the contract with the
State Highway Dept. Councilman Nile Boyle seconded. All Aye. The Mayor suggested
widening the bridge on 4th South. Have pipe to put in can on north side.
RE: J. R. CLARKE COMPLAINT ON COLLEGE STUDENTS IN APARTMENT NEXT TO HIM
Complaint by J. R. Clarke. College students in apartment house by them throw their
garbage out their windows and into their back yard. Mayor told Mr. Thompson to
check into the complaint.
RE: DISCUSSION OF TRAFFIC AT MAIN AND COLLEGE AVE
Discussion of traffic at Main and College Ave. Mr. Cheney was hit there. Should
have an officer there giving tickets several days to see if that will slow the cars
down.
RE: MARIAN NELSON BUILDING
Mayor Porter read a letter from Gordon Thatcher, Attorney for Marian Nelson. Mr.
Thatcher stated that he had advised Mr. Nelson to finish his building as he had
the necessary building permit. Mayor Porter advised that the building :permit was
for a residential garage. The City Attorney was instructed to inform them by letter
that they do not have permission to build.
RE: DISCUSSION ON MR. MORFORD BUILDING
Discussion Mr. Morford still hasn't done anything about his house on 2nd South.
Mayor Porter heard he was going to sell the property.
RE: BILLS APPROVED
Councilman Morgan Garner moved the bills be approved for payment. Councilwoman
Darlene Blackburn seconded.

A meeting of the City Council for the City of Rexburg, Idaho, Madison County, was
on December 7, 1977, at the time of 7:30 P. M, at the City Hall present were as

Sylvan Seeley met with council about the new third Ward Chaple at the end of
Park Street. There should be another access onto highway 33 from the new
church.

RE: DISCUSSION ON RAY WALKER CLAIM
Discussion on Ray Walker Claim, our Insurance Company claims the fault is caused by a
faulty sump which H & K Construction Company .built. Amount of claim is to be held
out of there payment, that City owes H & K.
RE: BEER LICENSES APPROVED
Retail beer licenses approved for Food Center and Johnson Grocery. Barton Jensen
moved that we approve them seconded by Darlene Blackburn.
DISCUSSION ON WATER RATES
Don Ellis of Rex TV MET WITH COUNCIL

Don Ellis of Rex TV met with council. They want to raise monthly charge for Cable
TV up $1.00. Nile Boyle moved that they go ahead Barton Jensen seconded.

RE: STREETS BEING DUG UP ALL OVER TOWN BECOMES A PROBLEM
The telphone company has been digging up the streets all over town to put lines in.
They have promised to fix streets. They are to withold portion of their contractors
pay until pathing is done. They will have to fix manholes that they damage as well
as streets.
RE: EMPLOYEE MANUAL
Employee manual discussed, it will be discussed more new.week.
RE: KENT JOLLEY'S CRESTHAVEN DISCUSSED
Kent Jolley's Cresthayen discussed. He should have water line to the back of all lots.

RE: ORDINANCE N0. 590
AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO: AND AMENDING
AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, TO SHOW SUCH ANNEXATION AND
THE CLASSIFICATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG,
IDAHO, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. -
Kent Jolley and Sylvan Seeley present platt for church at the end of Park Street.
They request it to be coned R-2. The bid opening for the church will be Tuesday.
They are to get an agreement to put through access to highway. They would like to
file the platt. They want it to be annexed.
a motion was made by Councilman Barton Jensen and seconded by Councilman Nile Boyle
that the rules requiring ordinance of a general and permanent nature to be fully
and distinctly read on three different occasions be dispensed with and that said
Ordinance be numbered 590 and be read in full and at length and placed upon its
final passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call upon
said motion was as follows:

The Mayor thereupon declared that the motion, having been passed by not less than
three-fourths of the Council, had been duly carried, Ordinance No. 590 was then

RE: AUDIT PRESENTED
Merrill Rudd presented audit, for 1976. Barton Jensen moved that we accept .audit,
Darlene Blackburn seconded.

MINUTES OF THE CITY COUNCIL MEETING
December 21, 1977 at 7:30 PM
Minutes of regular Rexburg City Council meeting held December 21, 1977, at 7:30 P. M. at
the Rexburg City Hall. Present and presiding, Mayor John C. Porter, Councilmen:
Darlene Blackburn, Nile Boyle, Barton Jensen, Morgan Garner and Councilman elect,
Jim Morris. Absent: Warren Porter and Norman/dolman.
The City Clerk Afton Anderson was excused. The Mayor asked City Attorney, Mary
Smith, to take the minutes.
RE: MASTER PLAN FOR CITY DISCUSSED
The Master Plan for the City pertaining to streets, sewer, water, and other problems
was discussed at length.
RE: CRESTHAVEN ADDITION AND RICKS COLLEGE PROPERTY DISCUSSED
The matter of annexation of Cresthaven Additon and the Ricks College property
adjacent to it on the North was discussed. The Mayor reported the college had agreed
to annexation subject to many restrictions which were impossible for' the City to
accept. The Mayor suggested that the City annex the College property without the proposed
restrictions.
RE: REPORT ON SEWER, WATER, AND GARBAGE RATES AND GARBAGE PICKUP
The Mayor asked Leland Thompson, Public Works Director to report on sewer, water and
garbage rates and garbage pickup. The cost of pumping water and cost of garbage removal
was discussed at length. Mr. Thompson had prepared a cost study. The Mayor asked that
it be attached to t~~ Minutes. The cost and use of various size bins in the
commercial area was discussed and the desirability of a 3 yard bin over a 2 yard bin.
Nile Boyle suggested that the businesses be required to use 3 yard bins. Morgan Garner
suggested that the residential area suggestions were discussed. Also that people
be encouraged to arse metal garbage containers rather than plastic as the plastic
containers shattered in cold weather.
It was moved by Morgan Garner, seconded by Darlene Blackburn, and unanimously carried,
that the City pick up garbage in the residential area once a week on a three month
trial basis, commencing in January, 1978.
Nile Boyle moved, seconded by Barton Jensen and unanimously carried that garbage
pickup in the business areas be given more study.

RE: LELAND THOMPSON SUGGESTS THAT COST OF WATER BE INCREASED
Leland Thompson reported on the hourly cost of pumping water, and suggested in order to
break even the cost per thousand gallons should be increased. The mater was discussed.
It was moved by Barton Jensen, seconded by Nile Boyle and unanimously carried that
consideration of this matter be deferred until the audit is completed and more
information available.
