A motion was made by Councilman Nile Boyle and seconded by Councilman Norman Holman
that the rules requiring ordinance of a general and permanent nature to be fully and
distinctly read on three different occasions be dispensed with and that said Ordinance
be numbered 586 and be read in full and at length and placed upon its final passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call upon said
motion was as follows:

Norman Holman
Barton Jensen
Those Voting Nay: None
The Mayor thereupon declared that the motion, having been passed by not less than
three-fourths of the Council, had been duly carried, Ordinance No. 586 was then read by the
Clerk in full and at length.

seconded.

MINUTES OF THE CITY COUNCIL MEETING
November 17, 1977, 7:30 P. M.

A meeting of the City Council for the City of Rexburg, Idaho, Madison County, was
held on Thursday, the 17th of November, at the time of 7:30 P. M. at the City Hall.
Present were the following:
Mayor: John C Porter
Councilwoman: Darlene Blackburn
Councilman: Nile Boyle
Warren Porter
Norman Holman
Morgan Garner
Barton Jensen
Also Present: City Clerk, Afton Anderson
City Attorney, Mary Smith
Public Works Director, Leland Thompson
DON WYLIE REQUESTS A VARIANCE
Don Wylie requested a variance to put 3 trailers on his property immediately West of the
Utah Power & Light service area. Councilman Nile Boyle moved the variance be granted
for a period of one year. Councilman Morgan Garner seconded. All Aye. Mayor
Porter advised that they would have to get water and sewer permits according to
specifications.
~ RE: GRACE BAPTIST CHURCH GRANTED TRAILER VARIANCE
The Grace Baptist Church has requested a variance to leave their trailer at the
present. location at 262 No. 2nd West for another year. They hope to have their church
build within three years however, they have been warned that they must renew their
variance each year. Councilman Barton Jensen moved they be granted their variance for
one year. Councilman Nile Boyle seconded.

RE: VOTES CANVASSED
The votes were canvassed by the council members. The election results were read.
Nile Boyle, Morgan Garner and Jim Morris were elected to the Council. Mayor Porter
war re-elected for another term. All accepted the election results.
RE: PRESIDENT RYDALCH PRESENTED ANNEXATION REQUEST.
President Rydalch presented annexation request. Mayor Porter advised that the planning
board would need a platt. They will then approve at their next regular meeting.
RE: MINUTES ON BEER LICENSE HEARING TO BE ADDED
RE: ORDINANCES 587, 588, 589
Councilman Morgan Garner moved a resolution to be passed to adopt ordinances
587, 588, 589. Councilman Norman Holman seconded (separate votes).
RE: ORDINANCE 587

AN ORDINANCE PROVIDING FOR THE AUTHORIZING THE ISSUANCE OF NEGOTIABLE COUPON, GENERAL
OBLIGATION WATER REFUNDING BONDS OF THE CITY OF REXBURG, IDAHO, IN THE AGGREGATE
PRINCIPAL AMOUNT OF $490,000 FOR THE PURPOSE OF PROVIDING FUNDS WITH WHICH TO
REFUND CERTAIN OUTSTANDING GENERAL OBLIGATION WATER BONDS OF SAID CITY NOW OUTSTANDING;
PROVIDING FOR THE PAYMENT OF SUCH BONDS; PROVIDING FOR THE LEVY OF AN ANNUAL TAX
SUFFICIENT TO PAY THE PRINCIPAL OF AND INTEREST ON SAID BONDS; PRESCRIBING OTHER DETAILS
IN CONNECTION WITH SAID BONDS AND SAID TAXES; RATIFYING ACTION TAKEN TOWARD ACCOMPLISHING
SAID PURPOSES AND ISSUING SAID BONDS THEREFOR; AND PROVIDING THE EFFECTIVE DATE HEREOF."

ORDINANCE 589
Mary, Smith, City Attorney read Ordinance 589
AN ORDINANCE AUTHORIZING THE ISSUANCE OF WATER AND SEWER REVENUE REFUNDING BONDS, OF THE
CITY OF REXBURG, IDAHO, IN THE PRINCIPAL AMOUNT OF $613,000, FOR THE PURPOSE OF
REFUNDING OUTSTANDING WATER AND SEWER REVENUE BONDS OF THE CITY,: PRESCRIBING THE FORM OF
SAID BONDS AND PROVIDING FOR THE APPLICATION OF THE NET REVENUE OF THE JOINT WATER AND
SEWER SYSTEM TO PAY THE BONDS AND THE INTEREST. THEREON, AND OTHER DETAILS IN CONNECTION
THEREWITH; PROVIDING FOR THE APPLICATION OF THE PROCEEDS OF SAID REFUNDING BONDS IN A
SPECIFIC MANNER; REPEALING ALL ORDINANCES OR RESOLUTIONS, OR PARTS THEREOF, IN CONFLICT
WITH THE PROVISIONS OF THIS ORDINANCE: DECLARING AN EMERGENCY; AND PROVIDING AN
EFFECTIVE DATE OF THE ORDINANCE.

~ RE: ROBERT CURETON PRESENTED PLATT FOR APARTMENTS
Robert Cureton presented Platt for apartments. He wants to reduce the minimum feet re-
quirement from 800 to 500 sq. ft. The council turned down taking any action until
he has adequate parking.
RE: PETERSONS CARPET PROBLEM WITH PARKING FOR APARTMENT
Petersons Carpet claims they have enough parking for the apartments behind and for
their business. Mayor Porter stated that they do not have adequate parking and should
be made to take down the old house as agreed. Discussion.
BOYD CLARKE REQUESTS A ZONE CHANGE TO BUILD A 7-PLEX
Boyd Clarke has requested a zone change from R2 to R3 to build a 7-plex to the rear of
his property directly south of the Post Office on Center Street. The planning board has
turned down the proposal as they have not left the required 20 feet back yard nor do they
have adequate parking. The council agreed to go with the planning boards decision.

RE: MAYOR INSTRUCTED TO SIGN CONTRACT WITH STATE HIGHWAY DEPARTMENT
Councilman Morgan Garner moved the Mayor be instructed to sign the contract with the
State Highway Dept. Councilman Nile Boyle seconded. All Aye. The Mayor suggested
widening the bridge on 4th South. Have pipe to put in can on north side.
RE: J. R. CLARKE COMPLAINT ON COLLEGE STUDENTS IN APARTMENT NEXT TO HIM
Complaint by J. R. Clarke. College students in apartment house by them throw their
garbage out their windows and into their back yard. Mayor told Mr. Thompson to
check into the complaint.
RE: DISCUSSION OF TRAFFIC AT MAIN AND COLLEGE AVE
Discussion of traffic at Main and College Ave. Mr. Cheney was hit there. Should
have an officer there giving tickets several days to see if that will slow the cars
down.
RE: MARIAN NELSON BUILDING
Mayor Porter read a letter from Gordon Thatcher, Attorney for Marian Nelson. Mr.
Thatcher stated that he had advised Mr. Nelson to finish his building as he had
the necessary building permit. Mayor Porter advised that the building -rpermit was
for a residential garage. The City Attorney was instructed to inform them by letter
that they do not have permission to build.
RE: DISCUSSION ON MR. MORFORD BUILDING
Discussion Mr. Morford still hasn't done anything about his house on 2nd South.
Mayor Porter heard he was going to sell the property.
RE: BILLS APPROVED
Councilman Morgan Garner moved the bills be approved for payment. Councilwoman
Darlene Blackburn seconded.

2E: NEW THIRD WARD CHAPLE DISCUSSED
Sylvan Seeley met with council about the new third Ward Chaple at the end of
Park Street. There should be another access onto highway 33 from the new
church.

Nile moved that the minutes be approved. Darlene Blackburn seconded.
