DOG OWNER RATHER THAN IMPOUNDMENT OF DOG; PROVIDING FOR NON-COMMERCIAL KENNELL LICENSES:
providing for disposition of dogs with rabies; PROVIDING FOR DESTRUCTION OF DOGS;
MAKING IT UNLAWFUL TO INTERFERE WITH SEIZURE OF DESTRUCTION OF DOGS; MAKING IT UNLAW-
FUL TO INTERFERE WITH SEIZURE OR DESTRUCTION OF DOGS. PROHIBITING CRUEL TRATMENT OF DOGS;
DEFINING OWNER OF DOG; PROVIDING PENALITIES FOR THE VARIOUS VIOLATIONS OF THIS ORDINANCE;
REPEALING ORDINANCE N0. 411, CHAPTER 35 OF THE REVISED ORDINANCES AND ALL OTHER ORDINANCES
OR PORTIONS THEREOF IN CONFLICT HEREWITH; PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
A motion was made by Councilman Warren Porter and seconded by Councilman Morgan Garner
that the rules requiring ordinances of a general and permanent nature to be fully
and distinctly read on three different occasions be dispensed with and that said
Ordinance be numbered 581 and be read in full and at length and placed upon its final
passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call upon said
motion was as follows:

MINUTES OF THE CITY COUNCIL MEETING
A meeting of the City Council for the City of Rexburg, Idaho, Madison County, was held
on Wednesday, the 3rd of August of the hour of 7:30 P. M. at the City Hall. Present were
the following:
Mayor: John C. Porter
Councilman: Norman Holman
Nile Boyle
Morgan Garner
Barton Jensen
Warren Porter
Absent: Darlene Blackburn, Councilwoman
Also Present: Mary Smith, City Attorney
Afton Anderson, City Clerk
Leland Thompson, Public Works Administrator
MINUTES APPROVED
The minutes of the July 20th meeting were read and discussed. Councilman Nile Boyle moved
i the minutes be approved as corrected. Councilman Morgan Garner Seconded.

ARE: LID REQUESTS TURNED OVER TO CITY ENGINEER AND CITY ATTORNEY
Mayor Porter reports that the LID requests have been turned over to the City Engineer and
City Attorney. There are still some areas around that should be on the LID. The county
has made a contract with Burgraff for s<-~i1 cement at $5,000 per mile which is a very good
price. He asked the councils feelings concerning some of the streets that should be paved
at City cost. Should the city try a few streets to see how it holds up with the soil
cement in comparison with seal coat used before. Mayor Porter advised the council that
Burgraff would give us a bid and that there are funds available for this.
IRE: TENNIS COURTS COMPLETED

The tennis courts have been completed with the exception of the lights. They should
be completed in another week when the power company should have the poles set.
RE: TWO HOUR PARKING TO BE POSTED ON NORTH 2ND EAST
Mayor Porter advised that there have been many complaints by business men with their
business' located on North 2nd East, that there is no parking for their oestomers.
Employees from the court house and Porters printing park on the street all day as it is
not patrolled parking. This leaves no parking places for customers to use. They want
2 hour parking posted and patrolled for at least one half block no~.th of the court house.
Councilman Barton Jensen moved that the 182 block North of the Courthouse on North 2nd East
be posted and patrolled as 2 hour parking. Councilman Norman Holman seconded.

RE: LID 22 BONDS TO BE SOLD
Mayor Porter suggested that the other LID 22 bonds be sold as soon as possible
before other LID bonds come up for sale.
RE: CLOSING OF GARNER GRAVEL PIT FOR DUMPING AND CITY DUMP CLOSING DISCUSSED
The county wants to close the Garner gravel pit for dumping and re-open the City dump.
The FDA wants to turn all claims with them over to the BOR. Doyle Walker, representing the
County said there was $300,000 was allotted to reclaim the City dump. After it was closed,
the City was given a DSR; the work would have to be completed by August 30th which was
impossible. The BOR could take over the project. They assured us that we should cancel
out until next spring. Then submit claim and they will grant funds.
RE: PUBLIC HEARING GENE PALMER PROPERTY PRESENTLY HUD COMMUNITY TRAILER PARK
8:00 P. M. Hearing on the annexation of the Gene Palmer property presently the
Hud Community Trailer Park.
Mr. Gene Palmer gave his presentation and presented his Platt for the trailer court he
plans to put in at this location. The Platt shows larger spaces than the present court.
There would be spaces for approximately"112 trailer homes. He presented a restrictive
covenent which he has adopted and assured the people that he would enforce these
covenents. (Copies of these are on file in City Hall).
Darwin Wolford read a letter written by Charles Frost protesting the location of a trailer
court at the HUD court site. He feels that this should be prime $-1 property and
should be developed only as such. (letter on file).
Mr. Wolford then read a letter presented by himself also protesting a trailer court in
that location. He doesn't want his view ruined by having to look down on a trailer court.
He feels it should be strictly an R-1 zone.
Mr. Robert Lee read his letter protesting the trailer court at this location. This site
being close to schools, hospitals, parks, and churches should be R-1 zone. (letter on
file.)
The question was asked if the City could refuse to supply water and sewer service to the
trailer park if it was not annexed to the City. Gene Palmer stated that he had checked
with attorneys on this subject and was assured that the City having given service for a
period of time, could not stop those services. Mayor Porter also stated that the sewer
lift station which was put in by HUD would have to be purchased by the City, should
the city wish to withhold services; this would be very costly. Councilman Barton
Jensen stated that we now furnish water and sewer service to people living outside the
city limits at a slightly higher cost. We could not refuse services to some while
providing them for others.
Barton Jensen stated that the purpose of this joint meeting of City Council and the plann-
ing board was to get the recommendation of the planning board. The City will then make
their decision. Ed Strobel expressed his opposition to a trailer court in this
area. Chuck Yates stated that he had lived in Los Vegas where there were beautiful
Mobile Home Parks and they in no way ruined the view of the residences near by. In fact
the residential subdivisions and mobile home parks were side by side in perfect
harmony. Mr. Mc Ginnis stated that homes will develop around the court with no problems.
Bill Wagner would like to see the sourt developed and taken care of in the way that Mr.
Palmer plans to. There is a need for a good trailer home park. We people living in
trailer houses or mobile homes have as much pride in our homes as you do. Dell Barney_
advised that all these people keep saying this is R-1 property when it is not for the
simple reason it is surrounded by cow pasture and will continue to as that property

is not for sale. Express's his approval of the mobile home park. Bill Moss believes
trailers bring in a transient type which they don't want. He doesn't want to live by
them. Juanita Bruce lives in a trailer house because she lost everything in the flood.
She was very upset to think people looked down on her becuase of it. Terry Brunson
expressed his anger that people aren't allowed to live in the kind of home they can
afford. Everyone can't affr>rd big homes on the hill. Jim Morris is not opposed to the
court. Gwen Lee advises that there is such a hazardous road conditon there that the
court shouldn't be left there. It was pointed out that the hazardous rdad condition
would be there regardless of whether their were trailer homes or homes ire there.
Donna Sanford stated that there is already an overcrowded problem with the Adams
school now and that court would increase that problem. Councilman Warren Porter
stated that it was not the job of the city council to prohibit children; there will
be an increase in children there whether they build homes in that area or have a mobile
home park. Mayor Porter reported that a road from Barney Corner directly to North 2nd
East is being planned. This would help alleviate the traffic hazard. Robert Swartz
opposed. Gordon Thatcher advised that homes in Rexburg are too high for young people
just starting out or old people. We can't refuse to let people live in Rexburg because
they can't afford $65,000 homes. Robert DaBell apposed.
Mayor Porter reported that the purpose for the hearing was to find out the feelings of
the neighbors. The planning board must now make their decision and report to the
City Council. The council will then make their decision.
The hearing adjourned 10:30 P. M.
~ RE: LORIN CLEMENTS ASKS FOR VARIANCE
Lorin Clements asked for a variance on his lot. His lot is only 55 feet wide;
however, his home will still leave 5 feet on each side. Councilman Morgan
moved the variance be granted. Councilman Nile Boyle seconded.

~ RE: DAN MOULTON RESIGNED HIS POSITION AS SUPERINTENDENT OF STREETS
Dan Moulton has resigned his position as Superintendent of the street department.
Louis Sommers is taking over until a new man is hired as Supt. Leland Thompson is
also supervising. They are now in the process of rerouting the garbages routes and getting
the time schedule closer. There have been so many complaints on that department. A
lot of the problem has been with the regular men on vacation.

Councilman Barton Jensen moved the bills be approved for payment. Councilman Nile
Boyle seconded.
