A meeting of the City Council for the City of Rexburg, Idaho, Madison County, was

Minutes of the July 6, 1977, meeting were read and discussed. Councilman Nile Boyle
moved the minutes be approved. Councilman Norman Holman seconded.

RE: LeLAND THOMPSON WILL START WORK AUGUST 1
Mayor Porter reported that Leland Thompson will be starting work for the City
August 1st.
RE: LID REQUESTS HAVE BEEN COMING IN
LID requests have been coming in. (1) Surface & curb & gutter on So 4th West.
(2) on 5th South from 4th to 5th West wants paving. (3) 3rd East and 2nd North need
water and sewer.
RE: JACK RANDALL FEELS THERE HAS BEEN DISCRIMINATION ON OLSEN & MICKELSON PROPERTY
Jack Randall has property in Indian Hills Addition feels there has been discrimination
on the Olsen & Mickelson property when annexed. They put in their own sewer on Shoshone.
It was put in in such a way that he could not hook on for his division. He had to go
clear across Dr. Youngs property to hook on which was very costly. He feels he should
be reimbursed. The Mayor talked to Bud Armstrong of the water department. He disagrees.
The correct place for him to hook on to the sewer line would be on 4th East. The
council felt a meeting should be set up with Olsen & Mickelson, Randall and Mr. Armstrong.
RE: JACK RANDALL STREET ONTO 5th WEST FROM HIS SUBDIVISION TO CITY
Mr. Randall bought 50 feet of property from Ross Covington for a street onto 5th
West from his subdivision. He wants to deed the street to the City. He would have to
develop the street at his expense and then deed it to the City for maintenance. The
attorney will draw up the deed.
RE: MARIAN NELSON PROPERTY
Marian Nelson property. The council agreed to take no action until they are able
to reach all the property owners.
RE: ROBERT CURETON ASKED FOR ACCEPTANCE OF HIS PLATT
Robert Cureton asked for acceptance of his platt. He was referred to the planning
board as he has never given them a scale plan.

RE: CRAIG PARKINSON FOR THE RICKS WADE ADDITION MAKES REQUESTS
Craig Parkinson from the Ricks Wade addition makes requests. The street needs paved.
They need street lights. Mayor Porter stated that the street would be paved and that
Utah Power & Lights has the request for street lights and wo~xld put them in as soon as
they can. He also wants speed bumps put in the street to slow down the traffic.
The people in the addition are also concerned about the closing of the 5th West Street
for the cutter association. Mayor Porter reported that they were building a new street
around the track so this will be no problem.
RE: CITY ENGINEERS CHECKED ALL SIDEWALKS AND CURB & GUTTERS THAT WERE IN NEED OF REPAIR
A team from the city engineers crew went around to check all sidewalks and curb & gutters
that were in need of repair. We discovered that more areas are sinking down. They are
letting a contract on this concrete work. The bid opening was July 15 at 4:0o P, M.
The engineers estimate was $106,754.00. Zollinger Construction was high with a bid
of $152,221.90. Rhinehart bid $95,144.15, and took the contract.
IRE: DON ELLIS REQUESTS REX TV FRANCHISE TAX TO BE REDUCED
Don Ellis, represented Rex TV in a request to the city council to reduce the franchise
tax owed to the city. The attorney, Mary Smith, advised that she would have to check
the ordinance. If possible the council agreed to grant the request, to reduce from 3 to
2%. All agreed. The attorney was instructed to do whatever is necessary to make the
reduction.
RE: FEDERAL FUNDING HAVE REQUESTED MONEY TO EXTEND CITY WATER & SEWER ON NORTH HIGHWAY
Federal funding have requested money to extend the city water and sewer on the north
highway, which would include the lift station; money to build a bridge on no lst East and to
build highway out to North 2nd East. Senetors Church and Mc Clure say they have been
granted. The BOR may fund the storm sewer.
RE: RAY WALKER SUBMITS BILL FOR DAMAGES TO HIS BASEMENT BY WATER LINE BREAKING
Roger Hoopes, Attorney representing Coleen Walker and Ray Walker at 4th West and Main.
water main was broke and flooded their basement. The drain was supposed to take water
rom the street but was not functioning. They submitted a bill for damages to be
turned over to the insurance agent.
RE: BOSWORTH AND SULLIVAN ARE INTERESTED IN REFUNDING BONDS AND SAVING CITY MONEY
Ed Felsink of Bosworth & Sullivan are interested in refunding bonds and saving the
city money. He presented his proposal. No action was taken.
RE: PLANNING BOARD WANTS TO SEE PLOT PLANS OF STUDENT HOUSING
The Planning board has asked that they see plot plans for student housing so they can see
if there is enough parking.
RE: KENT JOLLEY PRESENTED PLANS FOR CRESTHAVEN SUBDIVISION
Kent Jolley presented plans for Cresthaven Subdivision. He has petitioned for annexation.
He has petitioned for annexation. The Ricks College property would have to be annexed
first.
RE: SUGGESTION TO HAVE BUMP IN THE ALLEYS
Warren Porter, Councilman, suggesting getting a bump in the alley to slow down traffic.
A LOT OF BUILDING BEING DONE WITHOUT BUILDING PERMITS HAVING BEEN OBTAINED
ayor Porter reported that there is still a lot of building being done without building
permits having been obtained. In some instances the house is completed before they ever
get a building permit. Our ordinance #527 says that the buildin permit fee is double
if construction has already begun. Councilman Nile Boyle moved that we go to the
extent of the ordinance and charge double if not invoking penalties. Councilman
Morgan Garner seconded.

~~COMPLAINTS ON RESTROOMS BY SWIMMING POOL
Complaints on restrooms by the swimming pool.
RE: NORMAN HOLMAN REQUESTED VARIANCE TO PUT TRAILER ON LOT
Norman Holman requested variance to put trailer on his lot on a 1 year basis. Councilman
Morgan Garner moved the variance be granted. Councilwoman Darlene Blackburn seconded.,

RE: REPORT ON TABERNACLE
Mayor Porter reported on the tabernacle. They are in the process of getting the deed.
They have to make a correction on the discription.
RE: BILLS APPROVED
Councilman Nile Boyle moved the bills be approved for payment. Councilman Morgan Garner
seconded. All Aye.
RE: GRANT AGREEMENT FOR THE AIRPORT READ
The grant agreement for the airport grant for $79,000 was read. Councilwoman Darlene
Blackburn intruduced the resolution that the agreement be signed. Councilman Nile
Boyle seconded.

Re; ORDINANCE 580
City Attorney, Mary Smith read ordinance 580 prohibiting trespassing on the runway or
taxi strip at the airport.

AN ORDINANCE TO REGULATE AND CONTROL UNAUTHORIZED PEDESTRAN AND VEHICLE TRAFFIC UPON
THE AIRPORT RUNWAYS AND TAXI AREAS OF THE REXBURG-MADISON COUNTY AIRPORT; AND
PROHIBITING ANIMALS FROM RUNNING AT LARGE UPON THE PREMISES OCCUPIED BY THE
ReXBURG_MADISON COUNTY AIRPORT AND REXBURG MUNICIPAL GOLF COURSE; MAKING IT A MISDEMEANOR
TO VIOLATE THE PORVISIONS HEREOF; AND PROVIDING PUNISHMENT FOR THE VIOLlSTION THEREOF.
A motion was made by Councilman Nile Boyle and seconded by Councilman Darlene
Blackburn that the rules requiring ordinances of a general and permanent nature to
be fully and distinctly read on three different occasions be dispensed with and that
said Ordinance be numberd 580 and be read in full and at length and placed upon its final
passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call
upon said motion and as follows.

The Mayor thereupon declared that the motion, having been passed by not less than
three-fourths of the Council, had been duly carried, Ordinance No. 580 was then read
by the Clerk in full and at length.
RE: ORDINANCE 581
City Attorney, Mary Smith read ordinance 581 a dog ordinance.
AN ORDIANCE PROVIDING FOR THE LICENSING OF DOGS; PROHIBITING DOGS FROM RUNNING AT
AT LARGE AND DISTE3RBING THE PEACE; PROVIDING FOR THE IMPOUNDMENT OF UNLICENSED DOGS
AND DOGS RUNNING AT LARGE; PROVIDING FOR IMPOUNDMENT DUTIES OF POLICEMEN AND
AND POUNDMASTER; NOTICE OF IMPOUNDMENT AND REDEMPTION; PROVIDING FOR CITATION OF
DOG OWNER RATHER THAN IMPOUNDMENT OF DOG; PROVIDING FOR NON-COMMERCIAL KENNELL LICENSES:
providing for disposition of dogs with rabies; PROVIDING FOR DESTRUCTION OF DOGS;
MAKING IT UNLAWFUL TO INTERFERE WITH SEIZURE OF DESTRUCTION OF DOGS; MAKING IT UNLAW-
FUL TO INTERFERE WITH SEIZURE OR DESTRUCTION OF DOGS. PROHIBITING CRUEL TRATMENT OF DOGS;
DEFINING OWNER OF DOG; PROVIDING PENALITIES FOR THE VARIOUS VIOLATIONS OF THIS ORDINANCE;
REPEALING ORDINANCE N0. 411, CHAPTER 35 OF THE REVISED ORDINANCES AND ALL OTHER ORDINANCES
OR PORTIONS THEREOF IN CONFLICT HEREWITH; PROVIDING FOR THE EFFECTIVE DATE OF THIS
ORDINANCE.
A motion was made by Councilman Warren Porter and seconded by Councilman Morgan Garner
that the rules requiring ordinances of a general and permanent nature to be fully
and distinctly read on three different occasions be dispensed with and that said
Ordinance be numbered 581 and be read in full and at length and placed upon its final
passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call upon said
motion was as follows:

MINUTES OF THE CITY COUNCIL MEETING
A meeting of the City Council for the City of Rexburg, Idaho, Madison County, was held
on Wednesday, the 3rd of August of the hour of 7:30 P. M. at the City Hall. Present were

The minutes of the July 20th meeting were read and discussed. Councilman Nile Boyle moved
the minutes be approved as corrected. Councilman Morgan Garner Seconded.

RE: LID REQUESTS TURNED OVER TO CITY ENGINEER AND CITY ATTORNEY
Mayor Porter reports that the LID requests have been turned over to the City Engineer and
City Attorney. There are still some areas around that should be on the LID. The county
has made a contract with Burgraff for s<-~il cement at $5,000 per mile which is a very good
price. He asked the councils feelings concerning some of the streets that should be paved
at City cost. Should the city try a few streets to see how it holds up with the soil
cement in comparison with seal coat used before. Mayor Porter advised the council that
Burgraff would give us a bid and that there are funds available for this.

RE: TENNIS COURTS COMPLETED
