State of Idaho) County of Madison(SS City of Rexburg) A meeting of the City Council for the City of Rexburg, Idaho, Madison County, was held on Wednesday, the 6th of July at the hour of 7:30 P. M. at the City Hall. Present were the following: Mayor: John C. Porter Councilman: Barton Jensen Morgan Garner Norman Holman Nile Boyle Warren Porter Councilwoman: Darlene Blackburn Also Presnet: Afton Anderson, City Clerk Brent Moss, Asst. City Attorney RE: PROTESTS ON ISSUANCE OF BEER LICENSE FOR BAR Numerous. protestors were present to protest the issuance of a beer license for a bar at 200 West Main. They want the City Council to deny a beer license for the location. The area is commercial, but adjacent to a residential area. Petitions were presented to the council. Councilman Barton Jensen moved that we accept the petitions from interested parties apposing a bar on West Main to be held on file until appli- cation is made. Councilman Morgan Garner seconded. All Aye. Mayor Porter pointed out that there has been no application made for either a building permit or a beer license. RE: MRS GARRETT CASE GIVEN PERMISSION FOR KINDERGARTEN IN HOME Mrs. Garrett Case asked to be allowed to continue her kindergarten in her home. Mayor Porter told her to get a business license at the City Hall. RE: PROTEST HEARING ON MARIAN NELSON BUILDING 1 Protest hearing on the building erected by Marian Nelson on his property at 249 So 3rd West. Mr. Nelson advised that he needs a large building for storage and for his vocation of putting together farm equipment. The building he has begun is 50 x 72 x 16. He stated that he was told zoning and building requirements had been set aside because of the flood. Mayor Porter says that is just not so; some colored steel or aluminum buildings have been allowed but not of that size. Mayor Porter read from the zoning Ordinance for a residential area allowing a 3 car garage. Owen Walker said he would like a smaller building there and he does not want it for commercial purposes. Merle Fisher feels that the site for a building of that size is intolerable. It must be stopped to preserve the residential zone. Once the building is constructed there will be no control. Gene Ber er objects to a commercial building in the residential zone. Nina Carter objects. Marian Nelson stated that a smaller building would be worthless to him. Councilman Nile Boyle moved that limited commercial cannot be granted without 80~ of the neighbors and that a petition would have to be carried by a disinterest party. Councilman Barton Jensen seconded. All Aye. Council- man Barton Jensen moved the hearing be continued until July 20th. Councilman Warren Porter seconded. All Aye. RE: REQUEST FOR ELECTRIC SERVICE AGREEMENT FOR FIRE STATION Mayor Porter read a request from Utah Power & Light for a electric service agreement for the fire station. Councilwoman Darlene Blackburn moved that the Mayor and Clerk be instructed to sign the agreement. Councilman Warren Porter seconded. All Aye RE: PETITION PROTESTING PURCHASE OF BARN ON NO 5th WEST FOR COMMERCIAL USE A petition was presented by the property owners in the Ricks Wade Addition on North 5th West. A business has purchased the barn on No. 5th West for commercial purposes. They are opposed as it is currently zoned R2. s~ IRE: FRANK BELL ASKS TO BUILD STORAGE SHED Frank Bell on Second North wants to build a large storage shed. His property is zcned R-3 and located across from the fair gounds. The request was referred to the Planning Board. IRE: ORDINANCE TO BE MADE MAKING IT A MISDEMEANOR TO TRESPASS ON THE RUNWAY AT THE AIRPORT A request has been made to pass an ordiance making it a misdemeanor to trespass on the runway at the airport. The City Attorney was instructed to prepare the ordinance. IRE: IDAHO HOUSING AUTHORITY HAS APPROVED SENIOR CITIZENS APARTMENTS Mayor Porter reported that the Idaho Housing Authority has approved 50 senior citizens apartments in Rexburg, They will be built by Riley & Palmer on North Center. R REPORT ON CURRENT STREET PROJECTS. John Millar, Engineer, reported progress on the current street projects. IRE: ROBERT CURETON WANTS A ZONE CHANGE ON HIS PROPERTY Robert Cureton wants a zone change on his property on South lst West. He wants the zone changed from R2 to R3. Mayor Porter stated that he would have a petition taken around. IRE: CRAIG NELSON NEEDS A VARIANCE BECAUSE PROPERTY IS 2 FEET SHORT FOR THE HOUSE HE IS BUILDING Craig nelson has a lot that is 2 feet short for the house they are building. There is a larger distance from house to house but he would still need a variance. The attorney will draw up an agreement for the adjoining neighbor on the north to sign stating they give their permission. Councilman Morgan Garner moved the variance be granted upon the signning fo an agreement by the north neighbor, Marion Nelson, Councilman Warren Porter seconded. All Aye ARE:' DISCUSSION ON PROPOSED TRAILER COURT ON GENE PALMER PROPERTY I RE Discussion on proposed trailer court on Gene Palmer property. Petition must be taken around to neighbors by a disinterested party before the hearing. APPROVAL OF BILLS Councilman Barton Jensen moved the bills be approved for payment.
