A meeting of the City Council for the City of Rexburg, Idaho, Madison, County, was held on Wednesday, the 20th of April, at the hour of 7:30 P. M. at the City Hall. Present were the following: Mayor Porter absent. Acting Mayor: Councilwoman: Councilman: Also Present: Barton Jensen Darlene Blackburn Nile Boyle Morgan Garner Warren .Porter Norman Holman Mary Smith, City Attorney Afton Anderson, City Clerk RE: ANNUAL VARIANCE FOR TRAILER GIVEN TO DENNIS HEBDON OF R&B DRIVE INN Barton Jensen read a letter from Dennis Hebdon requesting a variance to put a 14' wide trailer behind the R & B Drive Inn on 2nd West.. It is zoned Commercial there and has had a trailer there before. Councilman, Nile Boyle moved they be granted an annual variance which would have to be renewed each year. Councilwoman Darlene Blackburn seconded. All Aye RE: RESOLUTION TO IMPROVE COMPREHENSIVE PLAN AND APPLY FOR GRANT READ Barton Jensen read a joint City and County resolution to further improve the comprehensive plan and apply for the grant. Councilman Nile Boyle moved the Mayor be instructed to sign the agreement. Councilman Norman Holman seconded. All Aye RE: MINUTES APPROVED The minutes of the March 30th meeting were read and discussed. Councilman Morgan Garner moved the minutes be approved as corrected. Councilman Warren Porter seconded. All Aye RE: MINUTES APPROVED Minutes of the April 6th meeting were read and.dsscussed. Councilwoman Darlene Blackburn moved the minutes be approved as corrected. Councilman Norman Holman Seconded. All Aye RE: MRS HAROLD HILL REQUESTS PERMISSION TO OPERATE A BEAUTY SHOP IN HER HOME Mrs. Harold Hill has requested permission to operate a beauty shop in her home located at 122 No. 1st East. Acting Mayor Jensen suggested that if the neighbors were not opposed, the zoning could be changed to Limited Commercial. This would give her sanction to operate this particular business and no other. A petition will be circulated to the neighbors within 300' and a decision will be made at the next council meeting May 4.th. RE: BIDS OPENED ON NEW WATER DEPARTMENT PICKUP The bids were opened for a new water department pickup. The bids were as follows: Rexburg Ford for a 77 Ford $4,451 no trade, $3,951 with trade Erickson Pontiac for GMC 5,337 no trade, 3,737 with trade Taylor Chevrolet for Chev. 5,289 no trade, 3,745 with trade Stones for Dodge 4,515 no trade, 4,215 with trade Agricultural Equipt for Int. 5,171 no trade, 4,871 with trade The low bid being Erickson Pontiac $3,736.85 with trade. ~' RE: MANWARING CONSTRUCTION PRESENTED A PETITION REQUESTING A ZONING CHANGE Manwaring Construction presented a petition requesting a zoning change. Mary Smith, City Attorney read the planning board minutes pertaining to this zoning change, in which they re- commend the zone change be made to Industrial #l. Manwaring have talked to the Mayor concerning a bridge accross the canal to route trucks from the area out to the highway without going through the residential area. Barton Jensen instructed City Attorney, Mary Smith to give notice of hearing. The Manwarings and their attorney agreed to hold their suit in abeyance until after the hearing. RE: Discussion On Ted Garner Building Discussion on Ted Garner building. They have constructed a building on the City street. It must be in compliance with City Ordinance. DISCUSSION ON CONCRETE TRUCKS SPILLING CEMENT Discussion concrete truck spilling cement all over the streets. It was suggested that they be fined heavily if not cleaned up within 15 minutes. RE: PLANNING BOARD WANTS TO KNOW WHAT CITY IS GOING TO DO ABOUT CINDER BLOCK BUILDINGS The planning board wants to know what the city wishes to do about cinder block buildings. Jim Keller says they do not pass the state building code. Discussion. RE: DISCUSSION ON BUILDING INSPECTOR Discussion. The building inspector. People figure the building inspector should stop any contractors that are doing a bad job on homes. They want the building inspector to notify the owner of the property if it is not being done properly. RE: PLANNING BOARD WANTS TO KNOW IF ELECTRICAL CODE HAS BEEN REVISED 'S'ET The planning board wants to know if the Electrical inspector has finished revising the electrical code. If so, they want a copy. RE: MORFORD HOME DISCUSSED Discussion. What has been done on the Morford home? RE: PETERSONS HOUSE OF CARPETS HAS NOT REPAIRED THEIR DRAINAGE PROBLEM Petersons House of Carpets has not repaired their drainage problem. Mary Smith, City Attorney, will write them a letter to say they must have a correction made by May 15th. RE: DISCUSSION CULVERT ON CITY DITCH BEHIND THE SOBER SOCIETY Discussion culvert on City ditch behind the Sober Society. They want to comer the ditch along the street and want the City to pay half. Acting Mayor Jensen stated that there were no funds available; there is a problem of cleanout if the ditch is covered. Grass clippings from the hill come down and stop right in that location. This impedes the progress of the water. There would have to be cleanouts left along there. Talk to Mayor as to funds available. RE: BILLS APPROVED Councilman Morgan Garner moved the bills be approved for payment. Councilwoman Darlene Blackburn seconded. A meeting of the City Council for the City of Rexburg, Idaho, Madison County, was held on Wednesday, the 4th of May at the hour of 7:30 P. M. at the City Hall. Councilman Barton Jensen moved the minutes be approved as corrected. The motion was seconded by Morgan Garner. All Aye RE: ZONING CHANGED FOR MRS. HAROLD HILL's BEAUTY SHOP Mayor Porter read a petition concerning the operation of a beauty shop in Mrs. Harold Hill's home at 122 North 1st East. None of the neighbors contacted were opposed. Councilman Nile Boyle moved that the zoning be changed to limited commercial. Council- woman Darlene Blackburn seconded. All Aye tE: STEVE REED ASKS PERMISSION TO OPERATE A DANCE HALL Steve Reed was present to ask for a business license to operate a dance hall and lunch counter in the basement of the Idamont Hotel. Mayor Porter advised them to check the state laws on dance halls in basements. He also was warned about the parking problem. They could keep open until 1:00 A.
